  • Baldwin just got a major break in the involuntary manslaughter case against him as prosecutors announced they have dropped the firearm enhancement charges. Baldwin is charged in the shooting death of Halyna Hutchins on set in New Mexico. Harvard Lawyer Lee explains what this news means for Baldwin and why the prosecution may have dropped the charges.

    The armorer admitted she loaded the rounds in the gun. She obviously did not check for a live round. The buck stops with her.

      I totally agree. Alec isn't well liked, but that doesn't mean he's a murderer. The armorer has a very bad reputation professionally, which is totally different.

    He has to check the gun, too. Safety session is mandatory. Especially when using an INHERENTLY dangerous product.

    I still think the one they need to go after is the armorer. Why the heck are they paying that person if not to take charge of these guns and make sure they are safe? I would be livid if I were Baldwin. I feel like they are only going after him bc of his fame.

    This whole case has been so bizarre, I appreciate your clarifications. I could not BELIEVE they were going to try to put him in jail. A terrible, terrible accident, but NOT Baldwin's fault. And no, I do not care for Baldwin at all.
    Sadly, the prosecution was relying on the man who says he "cleared" the gun (made sure it was not loaded) and told Baldwin (in front of multiple witnesses) that it was clear for their main witness.
    Huge mistake.

      Why were they using a real gun at all? They weren't actually shooting (well, filming anyway), so they shouldn't have been using a real gun.

    I can’t stand Baldwin but he should be treated fairly.
    Why did the prosecution bring the firearm enhancement to begin with?
    The DA and Special Prosecutor are intelligent and capable. How did they make this mistake?
    Also…I don’t like “Alec Baldwin has expensive attorneys that want to slow the process and distract from justice” narrative coming from the prosecution.
    It seems immature and unprofessional.

      "Why did the prosecution bring the firearm enhancement to begin with?" - She answered this at 2:03 - 'The 5 year enhancement is mandatory.' In other words, they were required to bring it.

      The charge isn’t mandatory. The five year sentence is. In other words…a judge can’t shorten the sentence.

    Again , thanks for the fast and thorough update. Nobody wanted to see Alec going to jail. I bet Alec is beating himself up more about this than anything else. He was friends with her, and I’m sure this is killing him. They need to make sure this never happens again.

      I did! He was reckless with that gun. He was ultimately responsible for the whole set as producer and knew there had already been a safety issue on the set. This is just another example of the unequal justice in this country.

    For the sake of argument with regard to due diligence, Let's say that a patient dies after surgery from an infection caused by a contaminated scalpel. Is the surgeon liable for the death because he did not personally check the tools for contamination? No. He relies upon a third party for that. But in Baldwin's case, checking the gun prior to using it in a rehearsal would have been warranted and practical, not only for others, but for his own safety. And IMO, had this been established as a mandatory safety protocol prior to shooting the movie, the accidental shooting would not have occurred.

    What about Brandon Lee( Bruce Lee's son) shot & killed on set in Wilmington NC. (March 31,1993)I thought new laws were set in place after this tragedy. What happened in this case? This does not need to happen again. Please advise & I thank you in advance.

    This case is a waste of time and money. The death was clearly accidental. Fighting in court is closing the barn door after the horses got out. Isn’t there Insurance that will pay out to the woman’s family? Either that or they could bring a civil suit against Baldwin. The woman who’s job it was to be in charge of the guns, while important, only worked for his company. She is a cog in his machinery.
    Clearly changes need to be made to the system and there needs to be better safety around guns on set.
    Also, NEVER point a gun at a person unless you plan to kill them!!!

    I’m not a lawyer but I don’t believe the law provides the ability to hire out your personal responsibility. Regardless of how the film set is set up for safety measures, the person holding the gun is legally responsible for that weapon. Basically he is being shown favoritism because he’s rich and powerful. The fact that he has good lawyers and money to put behind it to take through appeals should not be a factor in charging. So basically, if this was your average Joe, he would be charged to the fullest because it would be easier for prosecutors. How is that fair justice?

    I think this is crazy that Baldwin has even been charged with anything! It was an unfortunate accident probably negligence involved but Baldwin did nothing wrong! "The law is an ass"

    I feel that he needs to be charged if not now... Maybe the case could go forward with more evidence.
    Also it had been reported early on that they did target shooting in spare time on the sight. What happened to that report?
    The real bullet in the gun proves that live ammunition was on the set. With Movie magic this could have been prevented.

    if someone on set gave him a real gun and said it wasnt loaded then why is this even a case, its not his fault, whoever gave him the gun loaded is to blame here, if my boss gave me a nail gun and told me it wasnt loaded and it went off injuring me or another employee it would be my employer that is to blame for my workplace accident, whoever is in charge of props and what comes onto set could also be to blame, society and the media just like to go after people like this for the headlines it seems, someone always has to be blamed, really its just a tragic accident in an unsafe workplace

      This was a preventable incident. No one (well almost no one) is disputing the armorer's role in this. But there were multiple failures on Baldwin's part as well that could have prevented this from occurring. In addition to failure to follow procedures as an actor, he was also a producer on the movie, and as such, failed to follow additional procedures in that role as well.

    Good! I think they should drop all charges and put the blame on the person who’s responsibility it is to monitor weapons aka the armorer. I watched the interrogations and there’s no way in hell Baldwin should be held responsible. That girl had no business handling & being in charge of any weapons. Whoever hired her should be at fault also. It was clear she had zero knowledge or experience just by watching the interviews. She was hired because of her daddy. This whole thing is awful and ridiculous.
    Also, prosecutors need to stop worrying about how things “look” politically when considering charges on anyone. You can’t ruin someone’s life because you don’t want to look bias. If they can’t do that then they need to be removed.

    Can you quote a precedent for your extraordinary claim that it may be constitutional for a lawmaker to increase a criminal's sentence by increasing the minimum legal penalty, *after* the crime was committed?

    Glad to hear this. I was shocked when criminal charges were brought against Baldwin and don't understand why these charges were dropped against the Armorer. I hope all real guns are banned from movie/tv sets. There is no justification for them. Classic rush to judgement: Immediately in the aftermath, Amazon dropped 30 Rock; so I bought the series. I hope Alec is able to reclaim his life soon and maybe get some PTSD counseling - I'd need that. No different than when a person runs into traffic and is killed by a car. The person driving, who would be devastated and might never drive again, is not at fault. Thanks for posting this.

    This whole thing reeeeeks of black opps. Some patriots believe its not acceptable to mock the president of the USA on national television and they have taken their revenge. I believe both Alec and his armorer are not guilty.

    Technically, he is the last person and should have checked it. And his arrogance in the training shows disregard for others' safety, the law, and those trying to keep all safe. He is guilty to some degree, no doubt, however, his armor was paid to be sure it was safe, and did not. I think it was not her first screwźup, either. And whoever used that gun and put live ammo in it should share that guilt. There should have been no live ammo anywhere around there. None of it brings back the person killed. She and her family need justice, not excuses.

    I like Alec. Go light? Yes, I can see that. He has to, for the sake if future settings, accept some level of responsibility.
