Democracy in Chile: Is the rewrite of the Constitution failing? | Marcel Oppliger

  • Is Chile’s Rewrite of the Constitution failing? Is Chilean democracy on the brink and the “Chilean Miracle” just falling apart? In this week’s #Forum2000online Chat, Marcel Oppliger, a Chilean journalist and editor at Diario Financiero, joined Jessica Ludwig, Director for Freedom and Democracy at the George W. Bush Institute in the U.S., to talk about the current situation and to try to answer these questions.
    According to Marcel Oppliger, you will learn that:
    👉 In October 2019, in the midst of social unrest and violence, some groups, mostly related to the left, started pushing the idea that the way out was a change in the constitution, even though the protests had nothing to do with it.
    👉 After a political negotiation in November of that year, it was agreed to have a referendum on changing the constitution under the message that the current text is “Pinochet's constitution”. That is not true because it has been amended several times in the last 30-40 years.
    👉 In 2005, President Ricardo Lagos, who is a socialist, enacted important reforms and declared that finally Chile had a democratic constitution for a democratic country.
    👉 The referendum agreed in November 2019 was held in October 2020 and an overwhelming majority (78%) voted to write a new constitution. As a result, there was a subsequent process to elect a constitutional convention of 155 members, most of them ordinary citizens with no expertise at all in the legal field or in the democratic process.
    👉 The members of the convention has understood that their work was not to improve the institutional framework but to completely “refound” the country. Constitutional experts warn that the proposal is radical and one of them said that it sends Chile “back to the 17th century”. Other experts say that the draft of the constitution, which declares Chile a “plurinational state”, is “a copy of the Bolivian constitution”.
    👉 Now, on September 4, a new referendum will be held to approve or reject the new constitution, but things have changed. According to the polls, a majority of Chileans would reject the draft.

    Well the text is full of privileges , to small perceived oppressed minorities…. A Republic is about equality not about privileges . In the other hand upper class had always a leverage Such a text does not resolve the issue will open a series of inequalities , under the legal system.
    In the other hand , putting tho government to be the only manager of education, health , and services, will lead to a gross monopoly of government companies that will become the depositaries of political favors with the known lack of effectiveness of a true dedicated companyfor water electricity and energy management.
    The Senate is key for the separation of powers in the State … getting rid of this will be a carte blanche for an elected King or elected despot in disguise….
    BTW I am not a momio and I consider myself a typical mestizo Chilean , that has studied his ass off, and studied more than our obligatory Cultural build from Russeau to Marx , which is the guided steps to learning a skewed Historical view…. I also went for Hume, Tocqueville , Hobbes , because they are vilified in every Humanistic liberal education system and is a gross manipulation, read Montesquieu , learn about Separation of state powers!

    There is a very strong psychological bias among the upper class in Chile that are afraid and sometimes even terrified that they will lose everything with this new constitution. This journalist represents this way of thinking very well, although he is moderate. The new draft of constitution produces an infinitely more democratic country that the current constitution which strongly favors some clans in Chilean societies and continuously fuels tensions and divisions, strongly harming economic development. This new constitution will bring much more stability and acceptance of the law by citizens, it is akin to the best European constitutions in Europe, chiefly Switzerland : strong federalization, national and federal houses, elements of direct democracy at every levels of governance. This would clearly benefit everyone, the same way anyone in France or Germany, rich or poor, would love to have the decentralized and very democratic system of Switzerland that only produces beneficial effects : social peace and economic development.
    The only dangerous thing with this draft of constitution is that it keeps an elected president with a strong power although thankfully less than with the current constitution), like everywhere else in the Americas but Canada, and everyone knows that is never a good idea for that divides society in camps and only give the power to the winner camp, that does not need to make any compromise to represent all of society during his tenure. But I believe his power should be limited by the direct democracy rights that are in the draft of the constitution.

      @@EzraMerr Why? Can you point to what in this constitution would produce such effects? I personally do not see in any way why this new constitution would produce this.

      You see socialism starts out like HIV, remember the 2008 crash? Yes USA is also mostly a socialist shithole now, Clinton introduced a house bill that forced banks to give out risky mortgages and house related loans eventually leading to the 2008 crash 10+ years later... the sec is great at first but then the HIV (socialism) starts attacking your immune system (economy) and hiding in your nervous system (blaming all the problems it causes on capitalism) until your body (society) collapsess. But meh truth is the Socialists and feminist politicians infiltrated Chile long ago cresting these problems then blaming it on "free market" capitalism right?
