    • @karlrovey

      I think the problem is that only one witness showed up. That made it impossible to establish a pattern of willful violation of a court order. If even 10% of his victims (who were victimized after the court order was issued) were to show up, it would have been far more difficult for the judge to not hold him in contempt.

      They reported that the prosecutors were only able to produce a single victim in support of their claim of criminal contempt out of several hundred vehicles that were towed by the company (their open records request lists 706 tows). Rather obvious why the motion failed - insufficient evidence. The burden of proof was on the prosecutors but they were seeming either too lazy to find victims or unable to convince them to testify in court. They had the list of potential witnesses available so why weren't they able to get more victims/witnesses to come to court?

    • @JameyMcQueen
      @JameyMcQueen 3 месяца назад +9

      @@jormugand5578
      He was told not to tow cars. He continued to tow cars. Even if there were zero witnesses that testified, there's still sufficient evidence that he kept doing it. The evidence in question? The vehicles.

    • @jormugand5578
      @jormugand5578 3 месяца назад +2

      @@JameyMcQueen Incorrect. The injunction PRACTICALLY prevented him from towing vehicles, it didn't completely prohibit him from towing vehicles. It required he get the property owner's permission (or a representative thereof) to get written permission/authorization BEFORE he towed each vehicle. Whether he actually did follow that restriction is questionable.
