2:04 A kid I knew growing up went to prison for 13 years after he and his little brother tried to rob a convenience store at gunpoint. The clerk shot and killed his little brother and he went to prison under a manslaughter charge for his brother’s death…sad story all around. 😕

@@TheGamingShogun the real point is you shouldn’t go around robbing people _period,_ but still a sad story for everyone involved….especially for the boy’s mother, who had _already_ lost another child to illness a few years before that…. 😢 *AND* they lived in pretty extreme poverty, like, I grew up poor, but they were _far_ below that

Lakeith Smith did participate in the burglary. However, the fact that they were partners and the nature of the crime was non-violent. Lakieth Smith could not have known or suspected that a death might occur.
If the graphic is accurate, it appears his partner was shot in the back. They were running away unarmed. Running away unarmed and not presenting as a threat to the officer or others. There was no reasonable expectation or knowledge a death would occur. He certainly could not have anticipated that a police officer would shoot his partner, killing him.
How is this different from the other case where it could not be proven the person had prior knowledge or believed death was a possibility? How are they not the same thing?

I would intentionally get death over 50 years in prison.
Sometimes it takes 25 years on death row before they execute you.

@@davidmacko983 maybe in the third world but you physically cannot be executed in the US in a period of just 2 years, the minimum currently on death row is the serial killer row like Shawn Grate who got 7-8 while most others are usually an average of 12 before they get to leave. What did Tim Mcvei get for the Oklahoma Ciy bombing I think it was 5 and he didn't appeal/asked to be executed from day 1? I actually do think that long of a time on death row is the worst form of cruel and unusual punishment I can think of.
@@davidmacko983 not necessarily. Every state has its own situation and then there is the federal system. There are people on death row for decades that have sued trying to speed up the process. Some states have governors who spend their term not allowing any executions. Some states still send people to death row but don't actually have a legal process to carry it out.

Cattle rustling/horse thieving can still be enforced by shooting or hanging on sight in some western states... It happens.
In Montana, Horse Thievery is still punishable by hanging. And that I know of, that law hasn't been revised since cars came about, so that's still technically the only punishment applicable to the crime.

I was doing some genealogy and found a great great uncle who was charged with horse theft and sentenced to death!! That's so crazy that was mentioned 😂 Luckily he got pardoned later. That was way back when they hung people 😬

There are lots of problems with the American judicial system. Prohibiting counterfeiting and allowing hunting or industrial livestock production are very low on the list of problems, in fact some would say they are not problems.

Honestly I think r*pe, especially of a child should be punishable by death. The trauma that that child or person has to live with the rest of their life is a fate that is arguably worse than death.

Many countries who have done away with the death penalty in civil use kept it in exemption circumstances like war. I know the UK & France are two that fit that criteria.
These videos help me feel like, I'm actually doing something with my spare time.

probably awaiting a "fair trial" meaning no one on the judge pannel, or jury could have been effected or have outside of the courtroom knowledge and since all u.s citizens were effected and many around the world that will be hard to do and could give him a mistrial with prejudice and let him walk
@@MystPlazma I had to say it, but they should just be let go at this point. They've been held for 20 years without conviction. I'm sure that's also a civil rights violation, possibly even more so than a tainted jury
Great and amazing content. Yet some deaths are not purely physical. Any individual that murders innocence should know their own deserved death in our reality.

Meanwhile in Finland: no death penalty and the life sentence is not even what it really means, max 50 years… Aaand the prisons are even better to live than nursing homes… Thats why some people just use prisons for their own advance by doing crimes just to get in prison to have a better life…
