This is a terrible law. You have no rental license, therefore you must let the deadbeat stay for free. How about, the tenant must leave since it isn't a legal rental!

Problem is she has already established residency there with the "landlord's" consent. Little did he know at the time she was going to turn into a deadbeat that wants to not pay rent. Now that her residency has been established but it has been discovered he has no rental license then that is hiss fault unfortunately. He has no authority to have her forced to vacate the premises over his mistake of not doing things the proper legal way. He just needs to obtain the license then re-file for eviction if she still hasn't vacated. As for her, she needs to stop whining and begging for sympathy because she has 3 kids and can't afford a new place. Why didn't you consider the expenses of having 3 kids before you opened your damn legs? Instead of whining like a 5 year old and wanting handouts that you feel entitled to, grow up and take responsibility for your kids and raise them right!

I love mikes point, "he is guilty of jay walking and she's is guilty of a felony" ok, he eff'd up on getting his license taken care of.. he's never lied to court about it and she continues to misrepresent herself in this as being a victim and not just wanting something for free.

    • @slupot
      @slupot 2 года назад

Oh it will be trashed. In my state the liberal laws are so bad that the illegal squatters cooking meth in your apartment have more rights than you do. Not only the fact that don't pay rent, it takes months to YEARS in the courts to evict them legally. It costs THOUSANDS, if not TENS OF THOUSANDS of dollars in court/attorney fees, all the while you are not getting paid rent from a replacement tenant. On top of ALL of that the damage costs tens of thousands of dollars to repair. Some times the meth lab can contaminate other units and cause countless damages. The squatters who commit crime all the while, cause harm to your other paying tenets near by, even to the point of your building getting a bad reputation causing EVEN FURTHER financial damages well into the future.

      Oh for sure.
It probably already is trashed .
My neighbors got evicted cus they just didn't pay rent, and thought being unemployed and broke made them immune to having to. "How am I supposed to pay?" and "where am I supposed to live then" was their entire argument lol.
So they eventually landed on "The Judge and Park Management was racist" of course. They were out to get them because of prejudice, and so they deserved to never be able to rent it out ever again and just trashed the place. They broke every set of blinds, put holes in the walls, wrote this big litany to their own entitlement on the door with a sharpie, dumped the cat box and garbage cans and spoiled milk all over and plugged up the toilet on purpose.
The place was already trashed and smelled like cat pee and armpits all the time when they lived there.
And then they had this grand plan to sue the city and county over the prejudice and win all this money lol. They were talking like it already happened and were just waiting for the check lol.
It was so hard for me to listen to them rant about it and not call them selfish entitled lazy idiots to their face.
I wish I could have been there to see them argue in court, cus they were the most ignorant arrogant entitled people I ever met. I was friendly with them cus I had to live next door, but man I was glad when they were gone. Its a very nice monile home park on a lake, mostly retirees and bachelors like myself. And its not cheap compared to the average park... idk how they ever got accepted in the first place. You need like $3000 down just to get the key. Every other home is really nice, and I assume theirs was when they first moved in.
They ended up tearing down their trailer cus it was beyond irreparable.

Another subscriber explain to me that that's in Flint Michigan and the fees involved he'd have been better off to spend that 💰 first and then work toward the repairs. The landlord has 60 days to get his license and make repairs meanwhile the tenant said all these months of not paying rent playing these games. I'd guess this isn't her first rodeo. Renting is tricky, been there done that.

I get that this particular filing has to be dismissed, but I feel like the judge should have at least suggested to the defendant that the plaintiff's offer fixes her issues, she gets to move to a new apartment that presumably doesn't have the issues she alleges this one has and effectively gets a few thousand dollars for her trouble. Maybe at least get it clearly on the record that the plaintiff made this very generous offer and the defendant turned it down.

There was no help at all: no WIC, no child tax credit, no government help with daycare cost, and no medicaid. NOTHING But for some reason I never expected that anyone should help me. Stop putting the responsibility for your problems on others.

They weren't even talking about smoke detectors when she said it, and she interjected it almost as to say 'can you believe this? The house doesn't have smoke detectors'. And when Marable ran with that because it's an obvious safety hazard, she just let him go without ever bothering to correct him and say "well they're hanging up, but they don't work". She was doing everything in her power to make the landlord look terrible, and she only made herself look bad in the process.

Should have called CPS the moment she tried arguing that she kept three children in a house with a gas leak.
Of course, a) the pipe was unused, meaning it was probably shut by a valve somewhere upstream, b) natural gas companies add a chemical specifically to give the gas an odor so you can easily smell a leak, and c) if you actually suspect a leak, call the fire department instead of b***hing about it in court. But she should be held accountable for the full extent of the arguments she's trying to hit her landlord with.

But in Indiana if you own a house and you do not have a legal renter, for example a boyfriend who is crashing at your pad, you can in fact trespass them from your property. If he does not have the authority to rent out the building, then he should trespasser as not a renter but instead just someone who is crashing at his pad. The judge has found that the rental agreement is illegal therefore she’s no longer a renter and she should be dealt with as a squatter not a renter

I got assistance for two other tenants but when it came to the one that owed me $18,500, we were eventually told that she earned substantially more than the income threshold for any program and I'm stuck accepting payments over almost 4 years because my state says in the absence of a reasonable plan no more than 25% of monthly rent in catchup payments I would be unable to collect at all. She bought herself a new SUV but can't pay rent and wrecked it and gets a BMW while not paying rent. I was a landlord that had tenants do over $4,000 worth of damage to my house when they were evicted. This man provided adequate housing, in fact - compared to some horror stories that I have heard about in the US, it sounds like it was more than livable. He should not have to pay her anything to get her to leave, or let her stay if she got help with a program (which she would be able to do if she was actually in the financial situation she claims to be). The reason he has agreed to though is because he knows that if he forces the eviction and she is as vindictive as I think we can all see she is, that she will cause damage to the house. I hope that he did a video walk through or took photos of as many things as possible when he had access so that he would be able to bring it to civil claims if he has to. The Judge in this situation is ridiculous, his behaviour is embarrassing. The fact that he reads through the report and says "uncapped gas line - thats really not good" and then explaining it to the lady later that its actually not a big deal made me want to throw my phone across the room.

I’m in Victoria, Australia and my insurance covered everything from lost rent, to the chandelier they stole and the cost of cleaning and repairs. I was very lucky in that regards. Didn’t rent it again though. I just let it sit for sale until someone bought it.

It COULD be a big deal if one of her kids opens the gas cock and it isn't capped. Then she will sue you, guarenteed!

Mike.. you were definitely right about this one!! I had a feeling he was telling the truth with all the accusations and excuses she kept throwing at the judge. Not to mention her attitude. She seems like she would be a nightmare to deal with. I feel bad for Mr. Smith. He seems like a genuine kind of guy. I hope for his sake, he gets a license and can get this woman off of his property.. hopefully he can look back on this one day and think of it as a “lesson learned” kind of thing. I’m disappointed in Judge Marabal. I always liked him but he definitely is being too lenient with the tenant and way too hard on the owner. I don’t understand how this can even go on..

This judge is far too in infatuated with the sound of his own voice. He likes lecturing so much that he lectures the ones who don’t deserve it just so he can lecture. And in the mean time she gets to continue living there rent free which is the real problem!

I watched this again. This Landlord seems like a decent guy trying to do right and she is a lying sack of poop (lol I said poop). I like Judge Marable but he was driving me a little crazy. I’m with you she needs to have her booty placed in jail for lying under oath. She is a manipulative person and sadly she will keep doing this act and I feel for her kids because they will grow up thinking acting this way is okay and it isn’t. Sorry for the rant. Thank again for posting this it really did make my Friday!!

I’m so happy that I’ve finally seen the context behind Judge Bryant’s famous comment at 1:36 . I’ve always found it hilarious and known what sight provoked her spontaneous utterance, but for some reason, seeing the few seconds beforehand where she’s frustrated already and watching her open the Zoom window to see the defendant elevates it to a whole new level.

I'm with you Mike, the judge needs to let up. Judge is pretty much saying that he will not make her pay back rent she has not paid. He was handed this tenant and it appears she had not complained about no rental license from prior owner then this is all a scam.

If the gas line was leaking the inspector, or any halfway intelligent person would leave the house immediately and call the fire department, not sit and write a report.

  • @-HeyLyd-
    @-HeyLyd- 2 года назад +1

Mike, you TOTALLY called it in the last video on this case. I believed what she was saying because she had the inspection report that she kept holding up to the camera. But she LIED, not just about "no smoke detectors" but also saying all the windows were painted shut. She conveniently forgets to mention when they were discussing ventilation about all these ceiling fans. I just didn't believe she would outright lie when there had just been an inspector out there and she had proof right in her hand that could contradict her! Boy, I was fooled.
ABSOLUTELY, she's in bad faith. Get that license and get her out, ASAP. Marable, as usual, with his disorganized thinking keeps wanting to hammer this guy unnecessarily. This whole thing was so frustrating.

I respect you for speaking up against this judge. This poor guy is getting scammed and this woman takes advantage, plays victim, and cries about having kids. Like no one else has kids. Don’t have sex and make kids, then! This is a mess and I’m simply giving you props for speaking up against the injustice he’s perpetuating and the preconceptions this judge is holding onto.

She said w/out a doubt there were no smoke detectors in the house, and she said it more than once. I remember that clearly, because the judge made such a big deal about there being no detectors in the house. She said it, and now she is trying to excuse what she said. Now she lied about the windows being able to be opened, and wow, they are. She has lied at every chance, and I agree, she wants to live there for free. She just said, I have nowhere to go, I don't want my kids to be homeless, and so on. Her endgame is to live there rent free, for as long as she can, and get away with it. Now that all this has come out, I don't think the judge is buying anything she is saying. I know I don't. Cause once you lie in court and get caught in it, you're done.

This girl needs to be locked up for a few days!! To just boldly lie like she has .People will just keep committing perjury because nobody ever gets charged for it!! I only hope people see what she's about so that if new landlords will know what her track record
    really is. This is RIDICULOUS!!
