  • The boys are joined by the one and only Eddie Gallagher, the US Navy SEAL that was wrongfully charged and imprisoned for war crimes he did not commit. His story of strength and perseverance is truly amazing.

It kills me how outraged the government acted over Gallagher’s photo when DEA Agent Steven Murphy posing next to Pablo Escobar’s corpse is this quasi-iconic picture.

People are not taking into consideration the fact that, people are pretending to be cops everyday at someone's door to get them to open the door to rob them. The cop stood off to the side of the door, as is procedure, to avoid getting shot through the door. However, it makes it hard to determine if it's a real cop through the peephole. The airman answered the door with the gun down by his side and his support hand up, as in a "Stop, I'm not a threat motion." The cop didn't give him time to put the gun down. He drew his gun, yelling "put the gun down", and started shooting as soon as he got his gun to a high ready position. That cop was a fairly quick draw and drew his gun, yelled "drop the gun" and shot the guy in a little over second or so. If the airman had another half of a second to process, he most likely would have set the gun down. If the airman started to raise the gun, there would be no question in it being a "good shoot". All 3 of you know how long it takes a trained person to process and react. That airman was in the air force and not a PJ or Combat Controller. I can't say for sure, but I'd imagine, his OODA loop wasn't as fast as the cops. But, thats a "hine sight" issue. Theres no way for the cop to know his level of training. If the airman was intending to shoot that cop, he would have most likely raised his gun faster than the cop could complete his OODA loop and get shots off. Due to the fact the cop would be reacting to the airmans action and the airman would have made the determination to shoot prior to opening the door or as he was opening it. And at that distance the airman probably would have gotten shots off before the cop, even if he was untrained. The difference between an attacker and a victim, is the mental state in which they enter the fight. The attacker knows he's going to attack. The victim has to recognize and react, or Observe, Orient, Decide and Act. The highest trained people in the world still take almost a second. And average trained people take around 1.5 seconds. All that being said. As long as the cop followed department procedure and actually felt in fear for his safety, he should NOT be charged. You also have to take his previous experience into consideration, for him being in fear for his life. And no agencies should settle prior to criminal proceedings, it gives the criminal jury the message that the cop did something wrong. And if there's no charges because the cop acted in policy, they should NEVER settle. It sends the wrong message to people. It tells criminals families, even if the cop was in the right, we can still sew and "get paid". If the cop is within policy, the agency should fight it, even it is more expensive than settling it. It sends the message, "you won't get paid if you are in the wrong."

I am a retired 20 year Cop they are all wrong. It is this simple, you can't just shoot somebody who has a gun in their hand or on their person. If Cops could just shoot people who had a gun, then every second amendment auditor could be shot on sight as soon as the Cops arrive on scene. Same thing goes with states where there is a deer hunting season. This podcast group would say "well that is a legal activity with a firearm" but using their view a Cop could say "well how was I supposed to know the hunter was not aiming at a someone somewhere in the woods I could not see" and shoot the hunter. It is simply illegal to just shoot somebody who has a firearm. The person with a firearm has to pose a threat of great bodily harm or death. So what is a Cop supposed to do when they see someone with a gun? Take cover (which the Cop did not, was poorly positioned which indicates bad training IMO) and call the person out of their home with their hands up (this is basic policing procedures, Cop should already have their firearm drawn at low ready) until more officers arrive on scene (again basic policing procedures call for more than one officer for a domestic incident). Cops should never assume someone heard the Cop due to hearing impairment, load equipment running ETC. Then deal with the incident from a tactical advantage as the incident unfolds. This is a bad shoot and the Cop should be charged IMO but I do believe there is a strong chance a jury will find the Cop NOT guilty IMO. The group also seems to forget criminals will often get into people's homes by saying they are the Police.

No Dave doesn’t back up every accusation. I read his book. He tells one side of the story. The side of the accusers. Dave was not there. @@Getbaddudes But Eddie doesn't address anything in the book. He doesn't deny the existence of those text messages. He doesn't deny the story about getting his EOD guy shot. A whole book was written about Eddie with his face on the cover, and he can't refute anything in that book. No one corroborates Eddie's story. What Dave Philipps wrote is corroborated by a lot of people and it's backed up by the NY Times who Eddie is suing using Tim Parlatore, a "stop the steal" attorney who also represented Bernie Kerek, another "stop the steal" guy, and Shawn Ryan, another conspiracy theorist and "stop the steal" proponent. There's just no credibility on Eddie's side of the argument but there's a lot of credibility in Dave Philipps reporting. Philipps has zero issue bashing bad leadership in the military and standing up for veterans who are maligned and railroaded. Eddie wants you to think that this big machine is picking on the little guy but that's not true.

As a Veteran this crap that Eddie had to go through is more than frustrating. I do think WE need to begin to distinguish between Leader and boss. Leaders are loyal, care about their people “all of them”, and are truthful WITH EVERYTHING. Bosses are in it for what is best for them. I think ensuring we make this distinction in our speech is vital and will help the average human to better understand situations like this where the bosses had a job to do and it had nothing to do with the truth or caring for their people. Great podcast. Thanks for sharing.

WHat theyre trying to argue is that 'well it would probably scare the cops so you shouldnt do it"... well guess what, the cops needs to grow a fucking pair of balls then. Because you cant just shoot someone because youre scared of guns. Also, that "cop" that came to his door at night couldve been a home invader and his wife wouldve been taken forcibly after he had a piece of lead put into his skull. And you're right about jurisdictions throwing guys under the bus for anything. Until recently I was the Chief for a small town pd. Worked there nearly 9 years with 4 other years with another department. Multiple awards and was recognized for excellence by two different mayor's. I resigned due to lack of resources and the stress that came with it. The acting Chief and Town Manager asked I stay on part time to assist with training, admin, and mental health transports. Because I made a Facebook post letting my friends know what was going on where the only negative thing I said was the mayor and town council usually had different goals and it was hard to appease everyone they denied the offer for me to stay part time at entry level patrolman pay because their feelings got hurt. Now the department and tax payers have an even more depleted department because of hurt feelings. The department I worked at before that had an ois where the officer shot a guy high on meth that tried to run him over with a car after shooting at his girlfriend. The officer got charged and the city manager and city attorney made a statement saying they wouldn't tolerate his actions. He was found not guilty by a jury in 45 minutes.

In 2017 the Seals were medal chasing hard core. Advise and assist done correctly shouldn't put you within small arms range. Guys were bored and hunting for their last chance to be heroes and it put a lot of people in danger. The Seals got kicked out of I think it was Tikrit by their partner forces and had to retrograde to Al Asad to be in time out. There's a fine line between taking initiative and going against the strategic plan. And far too often Special Ops can play the "I'm cooler than you so I must be right" card. The Iraqis were supposed to be doing the fighting at the time. If they took too long so be it, it was their war to fight. But that's not fast enough for guys on a 6 month count down timer who want their shot at glory.
They were constantly submitting dumb missions, faking the funk in the planning phases to get conops approved at lower levels that were impressed they had the privilege of working with Seals. You want a good podcast topic talk about how many good men are dead because ultimately they had crappy conops. Tongo Tongo anyone? These plans would be poorly made but everyone in theater nutted their pants cause they came from Special Ops. You'd read these things thinking you're going to learn how the best in the business plan a mission only to think you found the returned homework of an ROTC student. I don't say this to sound like a staff wienie scoffing at the wrong font. But when the contingencies are mitigated by "don't worry about it we're Seals" it's embarrassing. Like you said Special Ops are better because they are masters of the basics, not just from pushups and budget.
I'm glad he's not in prison and didn't have his money and trident taken. He's lucky the trial was a sham and he got out but his treatment was disgusting. But he'll be the example in the UCMJ classes for the next twenty years right next to the Abu Gheaib pictures. Not taking any pictures used to be the standard in Special Ops but not posing with dead combatants was the standard for everyone since basic training. Again masters of the basics. How a whole team thought this was a good idea says a lot about the team and the leadership environment. I don't know what the repercussions should be for a dumb picture but that happened. Sorry if I don't want to attend a parade for his "innocence."

I just watched the bodycam footage, the cop walks up and puts his ear to the door and hears nothing, no yelling no signs of a DV. He then knocks and doesn't announce himself while moving out of the way of the peephole. then when he hears someone at the door he knocks and announces twice while still hiding from the peephole. Then when the door opens within 3 seconds (I counted) he pops out from out of view and says step back and draws and fires.

Being in a leadership role on lower levels (I’ll equate Eddies position in the seal teams as being a lead in civilian terms) from my experience means your job is to find the perfect balance of keeping your guys happy and both your manager at the same time. It’s mostly impossible as the boss always wants more work done and the guys don’t want to feel slave driven. It’s a hard place to be because if the guys turn on you your boss will blame you and replace you and if you don’t drive the guys they look at you as weak and they can do your job better than you and that also gets you replaced. In eddies case the stakes are so high you can face life in prison if the boys turn on you instead of being fired . That’s so crazy ass pressure to have to deal with.

Did the airman do anything legally wrong? No. Did the cop kill him? Yes.
Cops have a hard job. One I don't desire, but when you sign up for that job you are assuming a certain amount of risk in order to be able to serve the community.
The cop doesn't get a pass just because he is "keyed up".
Anyone could knock at my door and yell "sheriff's department". That phrase does not take away my right to self protection.
I am sure the cop did not want to kill this man for no reason, but due to circumstances he did, and he is guilty of murder.
It is a sad circumstance, but police are not above the law.

The cop is not above the law. There is a standard of case law for him that is different than you. It is a very hard job that many including yourself state they do not want. We as a society don't want to go to our neighbors house who is potentially in a domestic. That dude has to go and therefore has a standard of reasonability that is different than others. It is well within his rights to answer the door with a weapon. Do most people answer a door with a handgun, no. He made a choice, a choice that unfortunately has consequences. I know we as a society don't like consequences, but there it sits. There a great many things you can do, but it is entirely different if you should. Totality of circumstances my friend. The good news I have for you is this all may become a moot issue in the future. Most police agencies are collapsing currently due to lack of people that are willing to do this type of thing. Everybody wants a group of people to, "assume a standard of risk" for them and go to the screaming match and play mother may I with the dude at the door with the gun because that reasonable to them. Society is executing their right as well and voting with their feet and not signing on to meet your reasonable standard. So people can go investigate their neighbors potential violent domestic and we can see how much better and more reasonably constitutional they handle the situation.

@@andyfrist1957 That might be the crux of my issue. I just fundamentally disagree with the idea that the rules change because of the profession you choose. I have signed my name on the dotted line knowing that I was incurring extra risk for the profession that I chose. I did not expect special treatment because of my job.

If this officer would have taken 30 seconds to run his name on the way over this whole thing probably could have been avoided. Our country is great with our Second Amendment if you're too scared as an officer that you're going to shoot anyone that has a weapon then it's time to turn in your badge and your gun. The biggest issue was not announcing during the first knock. In the video he knocks the first time and hides to the side so he has an escape route. But he didn’t announce himself. The second and third time he did but he gave no commands when the door was open other than back up, and then shot. Sure he has it in his hand when he answered the door but there was never any attempt to give commands to drop the weapon or anything. Just 10 seconds and that Airman is dead. Probably a bad shooting and I think it’s okay to say that. Even if he did some things correct, the mistakes cost a civilian (not even cuz the dude was military but essentially civilian in this moment when being contacted by deputies. This piggybacks on to that shooting in Texas when those two female officers shot that woman in her own home that was broken in to. She was defending her own home and was killed. Bad shootings happen and by glossing over it and invoking George Floyd doesn’t help prevent bad shootings or look into what went wrong to prevent them in the future. Accountability is needed in these cases.

You don’t believe that a human that is ASKED to swear an oath of allegiance to the constitution should be required to understand the content of the document? They should just get a pass? It’s the basic, God givens rights of all men. Not just Americans. Yet, if I understand your message, it’s not a lack of training? Please expound on your opinion.

@@edwinjohnson257 i think we agree, at least mostly, my point was just that firearms training and deescalation training etc isn’t going to fix what amounts to a design flaw- if the police don’t have a duty to protect the public and have a siege mentality then they won’t protect the public and will always end up doing things like gleefully bash an unarmed teenage girl’s teeth in (Boston 2020)
you can chip away at it by doing things like eliminating no-knock warrants but if they’re not actually tasked with serving the people then it’s not going to happen

@@smrtnik4313 We do agree and that is good in my opinion. I see that the population at large have the belief that police or any Leo’s are on the job to protect them as in when it matters during the incident. So many believe that law enforcement officers jobs are to take a bullet for them. I am in my mid 60’s and have seen law enforcement change so much. I now live in the country where la w enforcement is done by the population. Don’t get me wrong as there is the sheriff and highway patrol but it is generally understood here that Deputies or Troopers always arrive after any danger just due to distance or because they are attending another call. I wholeheartedly believe that abolishing Qualified Immunity and a change in training reflecting the personal responsibility incurred from a round fired.(financial, criminal, emotional, ptsd etc.) The job can be dangerous! That is why I believe in training that is designed to weed out non hackers. I see QA as a license to kill ,amongst other judicial evils, and the perception that officers are more important than the public hence the “mantra” (it seems so) of “blah blah blah blah OFFICER SAFETY!” I believe that the result will be officers that think critically and thoroughly especially when the unexpected becomes reality
Thank you for the conversation. Your views are enlightening, intelligent and thought provoking in my opinion and I thank you and wish your journey to be all you put into it!”

I was in Iraq 16 to 17 at Q West as an Army cook, the SEALs used to come get food from us and I'd line it all up for them. In the early days of them coming to pick up chow, a dude that looked an awful lot like Eddie chewed my ass for not making the call instantly on what food to give them hahaah

He answered the door with a gun but it was not in a threatening manner which he can. It's only law enforcement once you see a badge and the officer identifies themselves and states their purpose there. You have home invaders knocking on door and yelling police all the time.

@1:16:30 mark, the Chief confirms that Corey Scott confessed to murdering the ISIS kid…& did so because he was granted total immunity by the JAG. Okay, BUT aren’t those immunity deals predicated on being 100% truthful with JAG? So, since Scott had apparently lied about his involvement, and was actually the SEAL who ended the life of the wounded ISIS kid - why hasn’t his deal been quashed and he been prosecuted for the war crime? Has the admitted murderer Scott been shunned by NSW and deemed Persona Non Grata at the Command?

Yes, the cop announced himself, but anyone can say they are a cop. The cop was not visible through the peephole, so that likely spooked the occupant. I think that deserves a discussion.

I'm a Marine that also saw behind the curtain. The Corps sent me to Afghanistan in 2010 with a rare 15 pound cancer tumor. I did the entire deployment with it barely able to walk. Came home, they found it sent me to NYC for treatment for a year. had chemo and half my pelvis amputated. Then i got melanoma then I got kidney disease. Corps tried to kick me out without retirement. A colonel told me to kill myself and do him and the world a favor. I'm one of the toughest MFer's you'll meet. Glad it worked out for Eddie. That was some malarky. I donated to his foundation. They (the govt) did Stu Scheller dirty too.

Were they incompetent calling EOD ? To me it seems like they were creating scenarios that look bad on paper to use against Eddie Gallagher.

I went through something very similar with a P.D. I fought back on some trumped up ADMIN charges....I was found not guilty by PD board members....who were replaced by the chief for finding in my favor, when I showed up back to work in uniform, having been cleared, I was told to report to the quartermaster's office to refill vending machines at the PD.....THEY WILL GET THEIR POUND OF FLESH. However, I ended up loving the gig on dayshift with weekends and holidays off, which pissed them off even more...LOL.
