    Carol Ponton Esq. also spoke to this on Thursday’s live. Said if you’re in process when this takes effect, VA is supposed to apply whichever Rating Table is higher that benefits the Veteran. They won’t rate you at 0% if new rating would warrant a 10, as an example.

    What can you tell us about Inflammatory Bowel Disease (IBD) such as Ulcerative Colitis, as opposed to Irritable Bowel Syndrome (IBS). How is it rated?

    Have a C&P next week for GERD - Have it for sure, take meds, but don't (at this point) require dilation. You said as of May 19th, new rules apply. Typically, it's 6-8 weeks after the C&P for a decision. Will the VA delay a decision in order to use new guidelines? Thanks

    I've had a surgery where they had to go in and close a hole because I was bleeding internally because of GERD while in service. just to be clear, that counts right?

      It definitely should, as long as the military doctors documented things properly, which if it escalated all the way to surgery, they likely did 👍

    The new gerd rating is horrendous. My gerd causes pain for 5 hours after any food. Nothing like being tired all day because your heartburn kept you up all night. I aspirate at least once every other week, even though I’m on 2x max dose of ppi. But now, because there is no strictures, 0% rating.

    That’s shame how bad the VA treats our veterans. Is there no voting process or checks and balances within the VA or can they pretty much just do whatever they want. If so then I see them slowly taking everything away after each year. A shame that there’s no way for the people to fight this.

      It was open to comments and out of MILLIONS OF VETS, there were a whopping 60 comments.

      @@johnandstephanie377 my gosh. I didn’t know that and I’m sure the millions of vets didn’t know that. People will have to start getting the word out when these types of things are about to happen. I’m sure veterans would’ve fought it in mass as it’s them who are affected. Then again does the VA even want to get the word out to veterans when they’re about to make a unfavorable change. I feel they want to quietly make these changes to slowly save money.
      In the flip side you have veterans who try to take advantage of this system so I understand that but when it comes down to it, the veteran should always be favored more due to the ones who are actually having problems. Stuff like this scares people from even joining the military knowing their country isn’t going to take care of them after they give their lives and health to the country.

    I wondered about an IBS claim so for the last year I logged when I have diarrhea. About 3 times per week averaged across the year. I didn't know to log painful BMs. What I did log is times I had a BM without pain. Only four times in a one year span. I didn't even know it was possible for me to have a BM without pain for the last several decade.
    Now I'll look at the new rules and see if I have those other symptoms. IBS appears many times in my civilian and VA medical records.

    So my claim just closed today. I went from 80 to 90%. I originally got 10 percent for gerd and tried to get a increase when i filed in November 23. They brought me down to 0 percent with a effective date of June 2024. Is it normal for the va to rate someone at 0 with an effective date in a month in advance? Or did they get try to screw me over

    Well, at least the changes went IN FAVOR of us. That's a nice surprise. That said....
    1. Tinnitus change is coming (goodbye auto 10%)
    2. Obstructive sleep apnea (OSA) with prescribed CPAP (goodbye auto 50%) ...that said, I'm curious to see the new ratings and the "shades of grey" or nuances depending on the OSA severity.

      Yeah the sleep apnea one preturbs me a bit i dont have it but those who qualify for it... thats 50% amd gerd i have at 30% the new rating is nothing to do with actual gerd.

      No way is the new GERD rule in favor of us. GERD causes many other debilitating conditions outside of the esophagus problem. No more rating for GERDs typical symptoms.

      Tinnitus and OSA are NOT being removed. The change is they must be associated with another condition. IE: tinnitus must be associated with noise exposure and hearing loss.

      @@dieselscienceit IS being removed as a stand-alone condition. It is a symptom of hearing loss now, NOT a stand-alone.

    Can I service connect a condition if I suffered an illness or injury while on Title 32 502 F Orders ?..... I was diagnosed, sleep studied, and received a CPAP Machine while on Title 32 502 F Orders. However, the VA denied my Obstructive Sleep Apnea for not being Service Connected......Can you please answer this for me ?🤔🤔🤔🤔🤔🤔🤔THANK YOU FOR YOUR SERVICE. YOUR CONTENT IS SO HELPFUL.

      If you have the dd214 from that period you can fight it I am doing so as they denied me hernia service connected even though they did the surgery in Afghanistan theater. You need an incident document that proves it was during that active time though and don't assume they have any information or will look for anything that is not in your submission.

    The GERD change in this new rating rule is awful. No more GERD symptoms covered outside of the one esophagus conditions. GERD causes many different debilitating symptoms that are not covered in this new rule. I asked my gastro doc about it and he was dumbfounded that all the other GERD symptoms wouldn’t be considered anymore by the VA.

    Remember, if you are service connected for both GERS and IBS, it will be combined into a single evaluation with you being rated based on the predominant disability. No guidance has been put out that I am aware of that would allow for separate evaluations when service connected for both.

      @@johnandstephanie377 IBS had its own diagnostic code under 7319 under irritable colon syndrome. GERD was under 7346 analogous to Hiatal hernia so they never shared the same same diagnostic code. That’s not why they were combined. They were combined as both conditions fell under the Digestive body system and per regulations certain diagnostic codes with the digestive system need to be combined into a single evaluation.

      Articulating your symptoms on respective personal statements for both. You need to illustrate how the symptoms differ from one another

    Don't forget Hemorrhoids. I was rated 0% service connected for it. According to the new changes, I qualify for 20% for it. Unfortunately, I personally think they should back pay mine to August 2011 (date stamped). I did apply for rating increase. I will have to undergo another C&P exam. However, I wrote a lay statement after the fact, the last time I was seen they said I have anal fissures and it has gotten worse. I do know that GERD, IBS, and Hemorrhoids goes into the new law on May 19th 2024.

    I was rated for GERD at 0% and then for GERD with hiatal hernia at 10%. Under the new rules, If i try to increase my 0% rating would that affect the hiatal hernia? I do take daily medication to control my GERD

    I get esophageal spasms making it very difficult to swallow, but they are self correcting so far. I wonder how this will be taken by the VA.
