Fair use is a defense in court, not a free pass to legality. Also, the burden of proof of fair use lies on the party accused of copyright infringement. When in doubt, the rightsholder wins by default.
Settling says nothing of the legality of an action or which party would win. They would settle because actually fighting and going through the legal process costs much more even if they win. In most cases, it's simply about winning more and losing less. You also can't deduce that a monetary exchange took place because credit is given on a news channel. If anything, it's more likely that no money was involved if credit is given. Do not breed.

Just a heads up about the sponsor, the title you purchase from them doesn't even make you a lord if you look into the Scottish Legal System, and the company isn't even in Scotland, it's in China. There are videos on RUclips that can go more in depth then I can. Make sure to do your prior research (I.E googling if it's a scam) before purchasing from them!

It's also just polite to ask, and if not ask, at least inform people that their work was chosen to be given exposure. There are good ways and bad ways to use other people's work. And fair use has become very unfair to smaller creators where they get hit even when they just hum a tune of a song, or have 1 minute to much of screen time even though it's not like they uploaded a whole movie or series and are talking trough it with reactions.. The new media used my video once without my permission. I was out on a 150mph wind storm leaning forward against the wind. A whole wall of concrete fell right before me. They took it, edited it with Michael Jackson music and aired it lol. I then contacted them and presented all the laws about them using my content. They tried to settle it for $200 and I was like, nope, I'll do $500 and we can go on our way. So then they PayPal'd me $500. This was back in 2010. Lol.

Just a FYI; Established Titles isn’t a real thing. They’re a scam. Scotland has a law that separates owning land and obtaining a title as lord or lady. Along with that they don’t actually plant a tree, they just “donate” to a company, but there is no official public record of any transaction between the two companies.
The owner of Established Titles runs two other companies Deal Dash, and another company that literally strives to make scam companies. They have some 40+ failed companies and 2 successful ones… Deal Dash and Established Titles.
I know they may be what pays the bills, but they’re not a legitimate company, they falsely advertise what they do, and the owner thrives off people who don’t do the full research.
People really shouldn't be promoting companies like this whether or not they pay the bills. At the end of the day it's basically Allen pan scamming his audience.

I had one idea what the outcome of this video would be. that's a rare one, usually you can kinda guess mid point where a video will end up, but him with the rights to mythbusters merch in a blue shirt to hide the stains of the sonic popsticle showcasing his snake idea... 10/10 documentary

They stole your IP. They did this by publishing your material in totality for purposes other than news reporting. This is apparent because they didn't create anything novel with their publications of your material to the point that all they apparently did was replace your audio with music they undoubtedly paid for license to use after captioning a paraphrase of the content of that audio (whether from the audible portion or the captioning of such being immaterial)... not that there would have been a difference had the text been vocalized because the outcome is the same - they created nothing, they merely republished your material for their commercial gain to the point of using it to direct traffick to their home page and that infringes on your commercial interest especially given the fact that CNN is reknown around the world for being a proverbial dumpster fire.
Any media source they published that material to should have received a copyright claim from you.
Now they are threatening to sue him.
I'd recommend having a talk with some lawyers.
Fair use encompasses a bunch of things, such as transformative use, reviewing (like a movie critic making a review of a movie), but also news reporting. So unfortunately they can put the video of the snakes on their social media for the purpose of reporting on the news.
But you may have noticed that they didn't really report on the news. They posted the video with a small caption of what you'd see in the video, not reported on the fact that someone made the robot contraption for the snakes. It's the equivalent of a news station showing the full music video of Lindsey Stirling's Roundabout Rival without so much as mentioning her name. So claiming that CNN reported on the news in this case is on shaky grounds. The way their posts are made give off the impression that CNN MADE the video, which is not the case.
Another thing is that they likely earned money off of the video. With these sorts of things, monetization is an important factor. The judge would look at whether or not it substitutes the original market. The original market is in this case this RUclips channel. And CNN posting the video on all their social media without any form of credit is definitely substituting the original market in my opinion.
So i think you would be in the right to issue DMCA takedown notices here and if it were to go to court, i think it might be in your favor.
Do keep in mind that I'm not a legal expert, so it is possible I missed something. But I would definitely have a conversation with some lawyers about this.

CNN would definitely just take the video down rather than go to court, so in pure financial terms, it's probably best to just take the license fee (and maybe haggle it a bit, don't just take the first offer).
A video of a robot snake is just a drop in the bucket for CNN, they're not gonna fight in court. It would cost them way more than the video ever would get them.
Also, be prepared to make a follow up lawsuit for defimation if they decide to use their "news" to badmouth you.

They stole a video from me too - they told me they would credit me and pay me for it and they never did.
The irony is if you use something like a CNN clip or a movie clip on YT and its in a fair use manner they can still copy claim it and either take it down or take the revenue. But they can do the same thing to you and use it however they want, keep the revenue, and you can't do anything about it, unless you want to take them to court...

I love/hate how many of my favorite youtubers have videos straight up stolen by big companies with nothing shared in return.
It is why I am enjoying the downfall of these people. Fox, CNN, NBC, MSNBC, etc. They are all trash and deserve their inevitable bankruptcy.
Also I thought I should note: The Fair Use doctrine isn’t like a big umbrella for news networks to steal other peoples’ work and not credit or get permission - that’s still plagiarism. The dude who said it is wrong (won’t mention how stupid the “you should be grateful for the exposure” bullshit is.) It’s just that currently nobody really has the funds to take it to court and create strong case law prohibiting news networks from directly violating Fair Use. Same reason why RUclips can have such a stupid amount of leeway on what their impression of “Fair Use” is. Just because people do it and get away with it doesn’t mean that it’s okay (or really legal.)
Reporting is just as viable under Fair Use as Parody and Critique is, and people can’t rip movies and place it on their site and monetize it just because they write an article about how stupid it is.
