Loved your presentation on Subject To purchases. I am reentering the investment arena at 65 years young. I thought I might add something to your comments about disclosures and bankruptcy specifically that can keep everyone out of trouble. If you buy a property from someone that is either going into bankruptcy or has recently failed at a chapter 13 (which is payments/ 30 to 60 months) and may be headed to a conversion to a chapter 7, YOU CAN NOT BUY THE PROPERTY AT ALL. Having worked for a national foreclosure and bankruptcy firm for the last 10 years I can tell you with certainty that a Trustee will take the house back and strip you of the deal with a click of a pen. There is however an opportunity to buy if the person sells it a minimum of 6 months before they files a chapter 13 or a chapter 7. Also, if they sell to you and file before the 6 month curfew after a chapter 7 the asset is jeopardy of being taken back by the court to pay down other debt. I plan of focusing in on properties involved in BK's and have an attorney that has given me guidance on this and is setting up new P & S agreements to reflect the specifics hat I have noted. In the event the seller is not as motivated, or is not sure wether or not to sell, do you have any tips on helping them over the hump. I know this is old school, and is falling borderline on “sales/persuasion”, but would you make a video on common obstacles or hurdles investors have to overcome and the “how to” on getting past these objections in order to lock in a desirable deal.

Just seems rare to find these deals..u have to find the property then convince people who are slow to do anything and basically ask them to sign their lives away.. doable but tough odds

The reason the banks don't call loans due is that they might end up having to foreclose on the property and then it becomes the bank's liability. they become liable for the taxes and attorney fees etc.
Well, it should in theory bring prices down a little since higher rates, mean a higher payment on the same house and that new rate would exceed that person's budget. Now if people don't care, then monthly payments just inflate further, increasing profits for the bank, and the irrational exuberance continues. In regards to the due on sale clause, if you got the deed from someone who was paying say, 4%, but the going interest rate at the time that person was approved for the loan was 3%, banks won't care about the deed transfer as continuing to collect that rate on the older money that was lent out is better for their balance sheet than lending it at the current market rates. In a rising rate environment however, that same money which was previously lent out at 4%, could be lent out at a higher rate today (lets use 5% as an example). In that case, it's much more likely the bank could come after you for the due on sale clause since that's money they could be lending out at the higher 5% rate, but aren't.

At 2:50, unfortunately , I don't think an agreement to leave a debt out of bankruptcy is enforceable because that os just another agreement and agreement may be canceled in bankruptcy. It might however discourage the former homeowner who doesn't speak to am attorney.

So it's gonna stay on the seller's credit bureau? The buyer can default losing all equity in the property. So, wouldn't the foreclosure also go on the seller's credit bureau as well? They're making a mutually beneficial agreement. Yet the seller takes on all the risk, no? Is this something people are willing to do? Like you said there's no personal liability beyond defaulting and losing equity, or the loan being called due.
Yes correct. But there are ways to set rhs up to where the original owner can take the house back if we as the buyer defaults. We set up wra notes for situations like that. That's an advance strategy. Good points

Just seems rare to find these deals..u have to find the property then convince people who are slow to do anything and basically ask them to sign their lives away.. doable but tough odds

Good question, I'm not sure how ur debt is set up but where there's savvy investors we can figure it out.
The reason the banks don't call loans due is that they might end up having to foreclose on the property and then it becomes the bank's liability. they become liable for the taxes and attorney fees etc.
Rates are staring to rise again, so that due on sale bit is a real risk now. Just something to be aware of. Glad you mentioned it.
hey, tell us a little more about what rates rising may mean for us investors?
Well, it should in theory bring prices down a little since higher rates, mean a higher payment on the same house and that new rate would exceed that person's budget. Now if people don't care, then monthly payments just inflate further, increasing profits for the bank, and the irrational exuberance continues.
In regards to the due on sale clause, if you got the deed from someone who was paying say, 4%, but the going interest rate at the time that person was approved for the loan was 3%, banks won't care about the deed transfer as continuing to collect that rate on the older money that was lent out is better for their balance sheet than lending it at the current market rates.
In a rising rate environment however, that same money which was previously lent out at 4%, could be lent out at a higher rate today (lets use 5% as an example). In that case, it's much more likely the bank could come after you for the due on sale clause since that's money they could be lending out at the higher 5% rate, but aren't.

At 2:50, unfortunately , I don't think an agreement to leave a debt out of bankruptcy is enforceable because that os just another agreement and agreement may be canceled in bankruptcy. It might however discourage the former homeowner who doesn't speak to am attorney.

So it's gonna stay on the seller's credit bureau? The buyer can default losing all equity in the property. So, wouldn't the foreclosure also go on the seller's credit bureau as well? They're making a mutually beneficial agreement. Yet the seller takes on all the risk, no? Is this something people are willing to do? Like you said there's no personal liability beyond defaulting and losing equity, or the loan being called due.
Yes correct. But there are ways to set rhs up to where the original owner can take the house back if we as the buyer defaults. We set up wra notes for situations like that. That's an advance strategy. Good points

In part 1 you said never to take a property in your own name and said you would get unto it a little later on, I don;t think you ever revealed how to take title. So my question is.......how are you supposed to take title to the property if not in your own name? LLC? Trust? Something else?
