  • Israel is often accused of war crimes against Palestinians, and accusations of targeting civilians, using disproportionate force, and blocking civilian access to humanitarian aid have intensified during this latest war in Gaza. But are Israel’s current actions towards Palestinians in Gaza actually war crimes according to the legal definition? And if they’re not war crimes, does that mean they are justified?

Hamas officials openly admit that they are not responsible for the Gaza population and that the civilians’ well being does not concern them. When asked why Hamas built 500 km of tunnels but did not build any bomb shelters for the Gaza civilians in an interview with the Russia Today TV(RT) channel, Senior Hamas official Mousa Mohammed Abu Marzook said: “The tunnels in Gaza are meant to protect our (Hamas) operatives and not the civilians. 75% of the residents in Gaza are refugees, therefore it is the responsibility of the UN to protect them”.
The interview aired on October 27, 2023 on Russia Today TV.

But you are completely misinformed, Netanyahu has turned the entire Gaza Strip into a huge prison. Years ago, Netanyahu was visiting Germany and in a speech he falsely blamed the Palestinians for the Holocaust. Historians immediately denied this. He implemented his Human Rights Wiedrich settler program, his right-wing extremist government discriminated against Palestinians and drove them from their land, sometimes with extreme violence. Netanyahu's finance and administration minister responsible for the occupied West Bank had called for the "extermination" of the Palestinian village of Huwara. Settlers brutally expelled the Palestinians and the army and police just watched. The UN pointed out to Netanyahu that he was violating human rights, Germany was very concerned, and no one did anything. In 2021, the International Court of Justice felt responsible and condemned the human rights violations of Netanyahu's government. The settlers shot several Palestinians on their olive plantations. Even many observant Jews around the world opposed this policy. Now Hamaz has murdered horribly and that cannot be forgiven or condemned. But what worries me now is that someone like Netanyahu, who has never cared about human rights, is coming to power with the support of the USA. It was always right for Netanyahu that Hamaz exists so that if something happens, he can wash his hands later and say that the terrorists are to blame. Now he is trying to drive the Palestinians towards Egypt and clear out the Gaza Strip. By the way, if he cared about the hostages, he wouldn't bomb the Gaza Strip extremely like he does now.

Israel withdrew from the Gaza Strip in 2005 and it became a self-governing state. The only reason it became as you term an "open air prison" was because Israel AND Egypt (so weird how Egypt never gets mentioned; is it because they're not Jews?) imposed a blockade after Gazans elected Hamas and Hamas immediately declared war on Israel and started attacking it with rockets. And even with the blockade, Egypt and Israel still allowed essential supplies like food and medicine to get into Gaza, AND Israel supplied it with much of its electricity and water, when they had no obligation to. Re. Netanyahu "blaming" the Palestinians for the Holocaust, what he referred to was the incontestable fact that the Palestinian Arabs were on the side of the Nazis during the war, and were important allies of Hitler in the region.

    “They told us their intentions”
This video hinges upon listening to Israeli officials in good faith. The problem is that plenty of Israeli officials have said on record they target civilians intentionally.
The IDF, Netanyahu and this channel can’t hide behind the statements of their more disciplined spokespeople.
Israeli officials (including the Israeli president, IDF officers and diplomats) have been recorded saying this war is against “the Palestinian people” and “it’s about damage, not accuracy”. The Prime Minister himself has used dehumanizing, genocidal language calling Palestinians “the children of darkness”.
More importantly intent cannot simply be limited to the statements of spokespeople. Israel has been using the “human shields” defense for decades. They KNOW civilians will be killed in large numbers when they bomb Hamas. Israel has superior military force and intelligence. They have the capability of attacking their enemies without using large scale bombing, yet they decide to bomb anyway. In doing so they have bombed every single major civilian structure in Gaza, and all the while they have been formulating plans to move Gazan civilians out of the Strip permanently.
Communications from Israel to Egypt have exposed an Israeli plan to pay off Egyptian debt in exchange for Egypt taking the remainder of Palestinian refugees from Gaza.

What causes a belligerent population to want to surrender and accept peace? Have a look at history and look for examples where popular support for a war was very high in the population of a losing side and peace was welcome in the aftermath.
Nazi Germany comes to mind for many. A much more devastating war. But ultimately it was the experience of weeks if bombing raids and loss and destruction that made the final surrebder complete.
Gaza is under siege. This is the strategy. Coexisting behind lines on the map didn't work. The Palestinians still chose terrorism.

Israel has intentionally targeted and destroyed a Christian hospital and the third oldest Christian church on the planet. Israeli leaders are all about having a nationalist ethnostate, that doesn't include Christians, only select groups of Jews. The difference is the meaning of the attack. If Israel had been meaning to target civilians, attacking without first dropping leaflets to alert the citizens and giving time to evacuate then yeah it'd have been a war crime. But we do drop leaflets, we do secure a safe passage for citizens to pass, we do make phone calls to warn. It's not our fault that Hamas puts roadblocks to stop cars, that they send back the people who left and shoot anyone who tries to escape. This is their tactic. If people stay and we don't shoot, Hamas's location is safe. If people stay and we do shoot, Hamas can play victim while hiding in the tunnels or even other countries like cowards.

Preface - this is one faction of Islam, and one fairly extreme interpretation of it, I'm not claiming this is the world view of all Muslims!
Hamas is an Islamic Jihadist extremist movement, this is on their covenant from 1988 and it's on their official website, declarations, speeches etc.
"Islam is its ideology and Jihad is it's way".
What that means, essentially, is that everyone is a combatant (including women, children and the elderly, both on the Palestinian side and the Israeli, regardless of their wills and personal beliefs) - and that they will fight until either all Jews or all Muslims in the area are exterminated.
This is actually mandated in the Quran several times, both for Jewish people and also (though less times) for Christians - both are mortal enemies of Islam.
More so this is the Ibn Taymiyya interpretation, who was an Islamic scholar during the Mongolian occupation of Asia and Arabia.
Under the vicious and cruel Mongolians, Ibn Taymiyya clinged to Islamic law (Shariya) by force over the land and resistance by any and all means.
The Geneva convention wouldn't take place for centuries so that's obviously not a thing..
Just to be clear, I'm not claiming every Muslim is an extremist who would follow these passages and Hadiths to the letter, but obviously - there are enough who do.
Also, there's a "Greater Jihad" in the Quran which is an internal struggle with one's own desires - much like other monotheistic religions. But that's beside the point.

The sources you use in this source are highly partial, i.e. Dr Goldfeder. There is a high degree of narrative construction present in this video, rather than actual balanced presentation of impartial opinions on the issue of whether Israel is committing war crimes. On the other hand, you have the secretary general of the UN as well as many within the Human Rights Council highlighting Israel's emerging war crimes. These are much more credible sources than those used in this video. The tone and the framing suggest it is designed to refute the allegations, rather than provide a sound analysis on whether they are true or not.

@Unpacked, But Amnesty International is compiling a report showing Israel attacked civilian homes where there were no signs of militants present. When all is said and done we will need to see how many Hamas soldiers they killed in each of these civilian residential buildings. Also the attacks are disproportionate and indiscriminate. You can't attack a residential building that you know is full of civilians and then claim you did not intend to attack them. My understanding is if the place you want to attack has too many civilians, the law says you should not attack at all and retreat to look for other methods of fighting your enemy.

Hamas wants to play human shield, that's not their problem, also furthermore no one is talking about how 75% percent of the population wanted the Hamas government to start with. As well you have to establish that the IDF knew there were no weapons caches or numbers of insurgents there. This is all foolishness if there were actually intentional genocidal war crimes going on the casualties wouldn't be measured in the thousands (assuming these number are accurate you can trust neither the Israelis or Hamas.) but tens of thousands to hundreds of thousands, do you even know what modern munitions are capable of. I am fairly certain the entire Gazan strip could be immediately flattened if the IDF so chose its only 140 sq. miles. Correct me where I'm wrong but there are 2 million people packed into that small place it isn't possible to prosecute a war there without large civy casualties. if you don't use airstrikes and munitions then you are fighting the insurgents gun to gun which is what they want which will increase substantially the casualties of the IDF forces, I think you idiots forget the soldiers of the IDF are people too with families. 1. Why Israel was established? To be the one place in a world where Jews will be safe and not persecuted.
      2. Why is there no Palestinian state? Actually, there is, de jure. State of Palestine was officially declared into existance on November 16, 1988, and claims as its territory all of West Bank (from the Jordan river to the "Green Line", a 1949 armistice line between Israel and Jordan), and the Gaza Strip. It does not officially claim any other territory, even though most Palestinians consider the entirety of Israel their rightful land. As to why did it not exist before 1988 - Palestinians were actually offered to have their own state several times, but they rejected each offer on grounds that the proposed state did not include all of land they consider theirs. It was, and apparently, still is more important to them to make sure a Jewish State does not exist, then to have their own. They prefer to be stateless over having a Palestinian State alongside a Jewish one.

Israel definitely has a right to defend itself and Hamas should definitely pay for the atrocities they committed, but while Israel may not technically be committing war crimes according to the letter of the law, it appears their response has been excessive. Even if Israel was committing war crimes, I am not confident they would report that accurately. Civilians in schools, hospitals, ambulances and residential buildings all have been bombed. Maybe the IDF isn’t specifically targeting civilians but it appears they are targeting Hamas with little to no regard for how many civilians are there. You say the purpose of the IDF’s attacks are to prevent future attacks, but when people see their families and friends get murdered and maimed they are much more likely to become radicalized. Additionally, as the IDF continues to attack disproportionately, it angers a lot of the surrounding countries. This could perpetuate the violence, thus putting Israel in more danger. Unlike Britain in WW2 who had their people hide in the tunnels of the underground during the luftwaffe bombings, Hamas would rather sacrifice their people and they are proud of it - again they said so themselves.

as someone who emphatically opposes Netanyahu I can tell you that this is more of a certain framing of the situation or a narrow point of view, and doesn't really reflect reality.
First of all, even before Hamas there were ALWAYS Palestinians/Arabs committed to war against Israel. Before Hamas it was the PLO/Fatah and other terrorist organizations, before them it was the neighboring Arab countries that engaged in 3 wars attempting to destroy Israel. Hamas is just another name in the list, its ideology is what matters, and Netanyahu didn't create this ideology, it has existed among Arabs/Palestinians since before Israel's establishment.
Second, Netanyahu (and Sharon and other governments) reached a stalemate in the negotiations with Palestinians where their leaders weren't willing to move on, because the palestinian people aren't willing to compromise on any form of 2 state solution. From this terrible starting point, the Israeli governments now have to choose the least bad option. The general line of thought was to stop keeping Fatah alive and in power (they were helping them against Hamas) because they don't advance this conflict towards a solution. The consequences of this decision creates a power vacuum which was filled by Hamas in Gaza when Israel withdrew from the strip.
The more I try to think about it in a deep way, the more I realize that this might have been the "better" choice in the long-run although Israel should've handled it with less casualties clearly. If Israel kept the PLO in power, and hadn't gotten out of Gaza, then Hamas is weaker in the short term, but that doesn't mean it's better for Palestinians, Israelis and the advancement of peace.

I need an honest answer from Israelis: what makes you believe that the military advantage of destroying a Jabalia to kill a few Hamas fighters will be enough, considering there is zero guarantee that a new Hamas will not prop up after it is destroyed? Especially consider Israel is handing Hamas their propaganda on a silver platter by giving in to their human shields, as you put it. This is why a lot of people have a hard time believing that it is proportional. You all know for a fact that Hamas as an idea will not die from airstrikes, you know Hamas wants you to strike them because it will make Israel look bad, and you know that for every civillian (who are 90-95% killed by each airstrike) dead, you've literally made an enemy out of their surviving families, so what exactly is gained from a defense point of view? This is why people say that civilians are intentionally targeted because from a defense point of view the actions do not make any sense.
Also I find the "we told them to flee" point of view to be very misguided. But I understand why it's hard to understand so i'll try to explain: Imagine if, Hamas is removed and a new group takes power, and decided before invading Israel that they will warn Israel. They send leaflets and emails to Israeli civillians to leave Ashkelon, leave the Kibbutz, leave Negev, to the north off to Tel Aviv and Haifa, and they will attack IDF targets as revenge for the current strikes, but in reality will not be very careful. Will the Israelis take kindly to this and see this as a "moral" army? Of course not! Because it's basically the Palestinian group saying "Leave so we can take this territory or we will kill you". THIS, by the way, is how you sound when you try to act moral for asking civilians to leave the area. Many Gazans descended from refugees from villages that used to Ashkelon, Sderot etc, and to be asked to move feels like it's happening again. Hamas may have done a second holocaust, but Israel is doing a second Nakba. Also, then to make it worse, after being told to move north, Hezbollah attacks from there into Haifa and Tel Aviv. THIS, by the way, is how you sound when after telling Gazans to move south, you bomb the south as well.
Look, I do not want to paint all Israelis as evil. I am pro-Palestinian but I acknowledge many Israelis have suffered. The fact that this video shows acknowledgement by an Israeli of the conditions of Gaza is a good step. But please, understand that Hamas committed war crimes on Oct 7th, but Israel is now committing war crimes in Gaza. What is needed is a ceasefire and forcing Arab nations like Egypt and Jordan to take part in negotiations instead of ignoring their fellow Palestinians except in lip service, but instead the U.S and Israel is continuing an aimless assault with no plan of what to do after it.

I do not know if i will ever come back to respond if you decide to chat with me, but as an Israeli who felt war for the first time, i can 100% say that if Hamas isn't completely destroyed, then a cease fire would be held. As a result of that, Hamas would steal the civilian's supplies, and just take it for themselves, i understand that killing innocents isn't ok whatsoever, but most of those palestinians had two choices, to by the air strike in one swift blow, or get executed by Hamas in the street. The actions of Israel aren't humane, and I completely understand the criticism, but without the death of radical groups like Hamas, the Palestinians will suffer forever, either by Hamas, or by Israel trying to remove Hamas.
I want you to know that i don't like the war, and i have to side with my own country here, because if you lived here you would arguably say the same; "My people were slaughtered in the past by this radical group and now this one? can't it stop?" and so, even with all this violence, it's the only language Hamas is going to speak, after all, the Nazis didn't stop killing jews
after they were asked to stop (I know it's cheap to bring up the Holocaust but stick with me here),it's the same thing, the Americans and the British bombed civilian german cities, even though there were civilians. because there were terrorists there (or war criminal i guess), but my point from earlier still stand, the German populous could either help the german cause, or get hanged in the middle of the road, the Palestinian aren't much different, they are stick between a rock and a hard place, Hamas and the IDF, the IDF want's Hamas to be destroyed for Israel's safety and for the palestinians, as even if the civilians didn't do anything, they are forced into subjugation or to die, Israel is helping both sides by killing Hamas, even if thousands of people will die, Israel has the right to keep itself safe.
Even if you disagree i want you to imagine this, the people in japan were bombed with a whole sun, so that Americans would stop dying, killing like 200,000 (i think), while we kill way less without wanting to, as even the japanese empire killed people for their cause, they were in the army and the people of Gaza are not, Hamas is using innocents for their own reputation to smite Israel, if Israel wants to destroy Hamas and help Gaza, then of course they would put civilians in important buildings with tunnels and such.
Until Hamas is shunned back to hell, no help to the people of Gaza will reach them, only Hamas and fueling blood curdling unnecessary deaths, i too don't want innocent palestinians to die, even if i hate them, i understand that it isn't everyone, only Hamas and organizations like Hezbollah, i hope you can learn from what i wrote, i have no problem with a palestinian state, i have a problem with an evil organizations sacrificing it's own people to gain a reputation online only for it to be used as easy fuel for anti-semitism, it's a hard topic but i had to express my opinion as an Israeli, have a nice day, and hopefully this provides a new outlook on the situation.

@@ericgur1 Granted you may not reply, I hope you see this. I want to address your comment as I've heard the rhetoric many times before. It is easy to boast of patriotism but do not think condemning war crimes makes you anti patriotic. It makes you human.
Palestinians are not lambs for slaughter and the war crimes by other countries do not justify the war crimes of yours. Innocents are not permitted to go into tunnels for safety and Israel has bombed every inch of Gaza. This isnt a just war, it is an excuse for ethnic cleansing so Israel can claim more territory. Make no mistake. Netanyahu doesnt represent Israel. Israel is more than the inhumane orders given by one man. Just because Hamas uses human shields gives Israel no right to dehumanize and destroy those so call human shields. These human shields are women and children. They could have been your wife, they could have been your children. Consider yourself lucky not to have been born in such conditions.
Do not underestimate the potential of humans to justify the most inhumane acts. If your country cares about the hostages, why take actions that could further enrage them? and even that wasn't safe on 7/10/23. Do people forget so easily the massacre, slaughter, depraved, brutal and barbaric acts of savagery on innocent civilians in Israel on 7th October. This was the worst carnage in Israel's history, but this is nothing new to the Israeli, after being subjected to too numerous to mention suicide bombers within Israel for decades. Im from Scotland and a dearly beloved member of our community was the victim of a terrorist attack in Jerusalem in 2002 at the age of 19. If you google him Yoni Jesner you will see details of his death and the aftermath. In fact, some of his organs were donated by the family and his kidney was donated to a little Palestinian girl, which saved her life. She will be about 30 today. I hope none of her family were involved in 7/10/23. the Palestinian cause has completely distorted the narrative, it is Hamas who committed genocide on the Israeli people. Their mission that day, was to murder as many Jews as possible, you can listen to the transcript of a phone message which journalists were privy to, of a Hamas terrorist calling his parents to announce and rejoice in the fact he had just killed 9 Jews with his bare hands. He was calling on the phone of the Jewish woman he had murdered. He was absolutely ecstatic and looking for his parents to praise and extol him. They did seem quite pleased but were urging him to return home, but no, he said he wanted to stay and kill more Jews. Does Israel want to kill as many Palestinians as possible. no, they want to destroy a terrorist organisation to make the whole world a safer place. so no Israel is not committing genocide and in fact thousands of Palestinians were able to leave Gaza and go into Israel every day for work. Is that the behaviour of a country that wants to commit genocide. Not as far as Im concerned.

By the way, there are many peace-loving Jews around the world who have never agreed with Netanyahu's right-wing extremist government, even in Israel there is a peace movement who want to live in peace with the Palestinians, but are sometimes discriminated against by their own people. Many Jews are now walking on the streets and want to stop the killing because it is not compatible with their beliefs.
That shows greatness and deserves the highest respect, that you don't lose your humanity despite what terrible things happened. Or does the God of the Jews say that when a terrible crime is committed, should it be made 100 times greater by revenge? Do they have the intention to kill civilians? Shows a clip of the israel ambassador to Canada instead maybe someone with more authority like, I dont know, the president of israel who said:
“it is an entire nation who are responsible. This rhetoric about civilians supposedly not being involved is absolutely untrue and we will fight until we break their backs."
What about the refugee camp that supposedly had one hamas member, without providing any evidence.
And the point about hamas needing a body count to justify attacking israel, if anyone has half a brain about this conflict they’d know it’s because of apartheid and the occupation happening to palestinians. Thats the reason. Amnesty international has it all on their website.
And shutting off water, electricity and preventing aid is a war crime because it’s a form of collective punishment.
The only thing you got right is that most palestinian dont want hamas but that’s their only form of resistance.
And there’s currently torture videos by the idf on palestinian workers in the west bank which is a clear war crime. Look it up people.

Guess that constitutes a war crime according to your definition as they were clearly aware of the civilian cost and still proceeded with the bombing of this densely populated area. • @UNPACKED
      @UNPACKED  3 месяца назад

Hey @AntonioLopez-zf3eh seems like you have a lot of question, happy to unpack them and educate you further.
First off, not sure if you’re ever been in one or know much about war, but war is complicated and tragic
White phosphorus- its use is not a war crime.
Hospitals, universities, mosques, civilian homes used for military purposes, or military tunnels built underneath them - that makes them legitimate and legal military targets. But yes, Hamas using civilians and civilian infrastructure for military purposes is a war crime, thank you for pointing that out.
3 surrendering hostages, and other civilians shot - killed accidentally, not a war crime. It’s a shame that Hamas’ strategy of pretending to be civilians and literal false flags helps lead to that.

    • @AntonioLopez-zf3eh
      @AntonioLopez-zf3eh 2 месяца назад +2

i swear you just can't make this up lol, also:
You just implied that the CIVILIAN carrying a white flag shot down by a gunmen on an IDF tank was an undercover hamas member? I mean even then it violates de Geneva Conventions but to say that it was a "false" flag and that he was hamas it's defamation and it is easily debunkable. (people can Google it)
The three Israeli hostages were not killed accidentally, they were shot.
Your videos about water and electricity and the torture of civilians don't mention international law even once, and don't deny that those aren't war crimes.
Not a shread of real evidence has been shown to determine a single hospital, university, school, mosque or church has been used with military purposes in Gaza, (that was said by the CNN btw, not me).
Saying tha Hamas is using civilians with military purposes just because they live in the same area, is an excuse to kill innocent people, and everyone can see through that.
Saying that shot down civilians are an accident indicates two things, the IDF is either lying, or very bad at identifing the targets. We also can see through that.
      Also:
*You selectively forgot to comment about some topics I mentioned:*
The torture on KIDS (with visual evidence and witnesses),
The non-consensual organ transplants (with visual evidence and witnesses),
The demolition of civilian homes and agricultural infraesrtucture (with visual evidence and witnesses)
Opening fire on protesters (with visual evidence and witnesses)
Clandestine executions (with visual evidence and witnesses)
The people killed while sleeping in that hospital (with visual evidence and witnesses)
The cementery the IDF desecrated (with visual evidence and witnesses)
All the above are war crimes.
For your information, in order to debunk these events, you would need to provide visual evidence AND witnesses, not a propagandistic video from an Apartheid country.
War IS complicated, no doubt about that, but this isn't a war, hence there aren't two armies, two countries or even two airforces fighting against each other. This is an invasion, period.
Israel has NOT yet declared war on anyone, and _I'll leave it there because this comment is too long anyways, but you can look up the definition of war aswell.
You say again that it's a complicated subject, and it has akways been, but you are not the first ones to think this, just like Israel is not the first country to commit atrocities to its neighbors.
Thats why the Geneva Convention and The Nuremberg Principles are on Google, and you can download them as PDF files, so ythat even if it's complicated, you can check if someone on mainstream media or a RUclips channel is lying.

    • @AntonioLopez-zf3eh

@@UNPACKED It is in the way Israel is using it, (there is this thing called International Law, and it's written and avalible for the public so countries can't lie about their actions being illegal).
-(The Weapons Law Enyclopedia of the Geneva Academy of International Humanitarian Law and Human Rights is a pioneering online compilation of information on the regulation of weapons under public international law).
      From the Weapons Law Encyclopedia:
White phosphorus (WP) is an incendiary and toxic chemical substance used as a filler in a number of different munitions that can be employed for a variety of military purposes.
      *1980 Protocol on Incendiary Weapons*
The 1980 Protocol III on Incendiary Weapons of the Convention on Certain Conventional Weapons restricts use of incendiary weapons as a means or method of warfare during armed conflict.
      *1992 Chemical Weapons Convention*
The 1992 Chemical Weapons Convention prohibits the development, production, stockpiling, transfer and use of chemical weapons and requires States Parties to destroy chemical weapon stockpiles.
Owing to the incendiary effects of WP, munitions containing WP can fall within the ambit of the 1980 Protocol on Incendiary Weapons (Protocol III to the 1980 Convention on Certain Conventional Weapons). The Protocol defines incendiary weapons as:
*Any weapon or munition which is primarily designed to set fire to objects or to cause burn injury to persons through the action of flame, heat, or combination thereof, produced by a chemical reaction of a substance delivered on the target.*
In keeping with this definition, any munition, including improvised devices, containing WP and that is ‘primarily designed’ to set fire to objects or to cause burn injury to persons is covered by the Protocol’s provisions. Consequently, aerial delivery, in the conduct of hostilities, of incendiary weapons containing WP within a concentration of civilians is prohibited.
Basically, the videos are during the middle of the day on an empty street, where the use wouldn't be justified as illuminating or obscuring for strategic purposes. Hence making it a war crime.
PLEASE cite verifiable and official sources when refuting comments people might think you are dishonest. It also makes you look more profesional, citing other YT videos by the same channel is not providing real evidence for your arguments. 😋
