1099/W2 info is incorrect. Your worker classification is determined by the service you perform and the direction and control of the worker!

Most of employers will now allow transfer to 1099. Irs limits amount on time a company can hire someone on 1099 to 3 years. Good luck claiming those 20%percent on your returns. No cpa will do it.

not only that, the legal definition of a w-2 employee vs a 1099 are clear and different. what my guy is saying is very true tax wise, but just take a look at Calis AB5
I wanted to post that but didn't want people to think I was down playing the information because much of it is great info. You are correct you can't just go to your employer and ask them to switch you to become a 1099 contractor there are a lot of intricacies when switching that will not benefit the employer.

Being paid as 1099 could be rate limiting. This could limit the time of employment due to Dept of Labor audits. Some companies are fined for keeping contractors to long because the government could say these individuals are technically being treated as employees due to the duration of employment.

Can any position be a 1099 because my tax person told me some positions are a red flag and I could get in trouble if they investigate that this person is full time on hours and my employee can sue me if they get hurt on the job?

Facts and circumstances are always key in determining employee vs contractor.
Your food delivery person can sue you if they slip and fall on your property and get hurt.
