      If a landlord refuses or is incapable of renewing a lease (he passes away or is unreachable) and the tenant stays in the home after the lease is over they are considered a squatter, or in some states a "holdover tenant" and they do have rights. But it really depends on the individual state laws.
      In my state, the landlords were refusing to offer leases longer the 30days because an actual lease gives tenants rights and on a Month-to-Month the tenant had no rights. In the volatile housing market Landlord were kicking out long term renters, with no notice or cause (because they were are not required to provide either). Just so they could re-list the home at much higher rates contributing to the housing crisis and causing prices to skyrocket, seemingly over night. That changed when these laws were put into effect.

      im terrified since I live in a small state where it's known for having crimes... there's even a s*x offender I learned living not far from me and I'm scared my house is the next thing being taken since when me and my family go on trips we let the guy who rents one of our houses next door use the house.. but we saw our neighbor also come here uninvited on our porch looking around :/

      There's a Detroit property manage (channel's The Shay Show) & he found some squatters in a house he was about to sell. He asked them to leave, said he'd be back tomorrow to give them time... 2am he gets called to a charred wreck of the house; if the squatters couldn't have it, nobody can!

      At least a house fire is most likely accidental while squatters are breaking the law & KNOW they are! THAT'S what gets me! THEY break the law right from the beginning, but the OWNERS pay the penalty! I've always believed that once you break the law you give up your rights (pertaining to what you've done, not all rights)!     I first heard about this about 6 months ago. This is terrifying. I inherited my mother’s house when she passed and it sat vacant for a year while I fixed it up to sell. Luckily nothing happened the hose sold… happily ever after… BUT, that inheritance saved my life and the idea that it could have been snatched away so easily makes me sick. There is a special place in hell for people ho do this. There has to be a way to protect tenants AND property owners.

      There are SO many ways to protect both by creating a proper contract with proper conditions... on both sides...
      Imagine receiving an inheritance that you can't fix right now because you have your parents funerals and multiple costs... then after like 3-4 months you're ready to patch some small things up and you find some a-holes making it worse... you might end up needing double the money...

      @@TradBarbieThat happened to a friend. My friends hired someone part time in the daytime while they worked to be a caregiver to a family member with dementia that lived next door. The caregiver took her ward to a crooked lawyer to write a newer will. When the elderly woman died, the caregiver locked the family out, emptied the bank account & wouldn’t let the family bury their loved one. It took 5 years in California courts to regain the house & bury their loved one. The money was gone & nothing happened to the caregiver.

      It's due to technicality in the US laws that classify it as a civil matter rather than criminal, so the police will usually not even investigate it. That also means when the matter finally gets to court the squatter is simply evicted as the civil case won't be handing down any criminal judgement for property fraud and theft of rental value for duration of their stay, which would easily be classed as felony grand theft due to the amount. But once it's settled in civil court, same case won't be transferred to criminal court, leaving the squatters free with no criminal records to repeat again on next property. The problem does exists but much reduced in most other countries because different laws and systems allows for more flexibility than US systems.

    We owned some land and I just happened to check Zillow one day and it was up for sale. Someone posed as us and got a real estate agent to list it for sale. Luckily we were able to get the agent to pull it right down. It pisses me off that he listed it just from a phone call and an electronic signature claiming to be me and my husband. The fact that he pulled it down with no questions about whether we were who we claimed to be makes me wonder if he didn't have a bit of a stake in it.

    We need more specific laws so squatters can't just say "I've been living here for a month" and just get away with it. They should make the person claiming to have lived there for over 30 days show proof (including documents of the tenant agreement) so this stuff doesn't happen anymore.

      It works both ways too: It ensures the tenants have a paper trail for their protection.

      yeah basically if youre there for a certain amount of time without getting kicked out you can claim that since the owner wasnt taking care of the property and not using it, you deserve to keep it. it sucks bc they do it to normal people instead of big businesses because they know they can get away with it without being taken to court

    It's kinda surreal that in some countries this is legal. Even in my country (and we're talking here about Eastern Europe) if you enter someone's property without permission you get a solid fine or prison time from 3 months to a year. Like... If you're not on the house papers or don't have a renting contract and the owner wants you out, that means that you tresspassed. Break-ins are still Break-ins.

      I'm from South Africa and we still have trespassing laws (Private property). There was a situation where a large group of people tried to squat on a farmland and community members came together to chase them away. Police even rocked up with riot trucks and K9 units to aid community members

      it's the same thing in turkey too. you have to prove that you were a tenant for a long time (like more than a month) and you have to do that with legal documents. i've never heard these type of things happening nor i will be hearing it ever. there are a lot of issues with laws, owners and the tenants, but not like these ones in here. again, this would never happen cause even the "not working very well laws" in turkey are working with real documents, not with empty words.

      Big investment firms with a lot of political influence benefit from this chaos. Basically it's becoming safer to rent from them, and this is also forcing smaller landlords out of the market because they can't afford to fight scammers and squatters in court.

      In my country if someone doesn't have the address to that respective place in their ID card, they can be kicked out with police whenever.
      The address in the ID card is always proven with your ownership papers of that specific location or with the presence of the actual owner & his papers
      If your tenant has that address in their ID, indeed police will not get involved and barely then you need to go to court to prove he/she is not paying rent or contributing to any house bills.

      @@shirleyallen1418 not really, if it's a house then the arguement can absolutely be made that the person may require this to live in, their absence from that house being over the time limit yet still temporary, whereas nobody lives within a business/commercial building, and it's significantly less likely that someone will have absolutely nothing left if their business property is taken after being disused for that long as opposed to a house which doesn't generate any money in the same manner

    How is this even acceptable.. The governments really need to get a grip and get in touch with reality. It definitely starting to seem that they only care for one thing, money. Imagine just spending years of your life in your house, just managed to pay off the mortgage completely, and you decide to have a vacation to celebrate and you come back to see that your house has been taken and you’ve been arrested for practically no real reason other than then “trespassing” being used against you even though it’s your own home.

      Big investment firms benefit from this because it forces private home owners and small scale landlords out of the real estate market so they can hord it. They have the money and power to deal with squatters promptly in court while private citizens usually do not.

    How the hell is there no system for landlords? All you have to do is create a system where landlords and tenants register with the city, and have to register a building/house/unit as a rental. Any house tenant or landlord who isn’t registered can’t lease out the house to or from so that squatters can’t claim to be tenants.

I used to intern in the department where the leased houses were registered and we kept records of each lease, plus a simplified sheet would be emailed over to the police department. This way the PD would have documents on who the legal landlord is and also have a list of every legal tenant who would be considered a resident of that home (including children and nannies). Tbf tho this was a very small, very affluent town of about 6,000 people, so I’m sure keeping records like this in a city as massive as NYC would be a true nightmare. And basically impossible.

      Many states rule that squatters residing in a house for 30 days become legal tenants, but that’s not exactly the point I’m about to make.
      Imagine for a moment that your landlord wants to evict you without due-process. He claims you’re a squatter, maybe even adding on that your papers are fraudulent. If you have lived there for more than 30 days and can prove that; you are allowed to remain on the property and your landlord has to properly evict you.
      Yes- this is a rare situation, but I’ve been told stories where a legal tenant had to claim squatters rights to be allowed to stay on the property she lived on. I believe that the landlord wanted to sell the property or that it was transferred to a new, younger landlord and he wanted to move his friend in instead or something.

      Landlord claims it’s fraudulent, now what? Sometimes the only thing you can do is claim squatters rights to buy yourself some time to gather evidence (bank transactions, messages between you and the landlord if possible, (best case scenario, handwritten) letters given to you by landlord, etc) while still having a roof over your head.

    Well, I was arrested in jail for a night. Don’t ask why lol I met a woman who actually faced this same thing, but the reason why they arrested her was because of exactly this but the squatter that she let stay in her home, called the police on her and said that they were intruding into into her own home. She let that person stay there out of kindness. And they turned around and stole her home and she wasn’t even allowed to go back home afterwards. Completely messed up her whole entire feng shui and she had to go stay in a hotel and I don’t know what happened to her from then on, but we talked about a little bit of what she was going to do. Essentially, she had to move homes because of it.

    I know so many military families who deal with squatters in the homes they buy in various duty stations. People always ask me why we don’t own homes yet. I tell them about this stuff. With the stress of this lifestyle I couldn’t handle this stuff too.

      The squatters rights thing was written poorly. The person who can prove ownership of the house should be in the clear if the person who claims to be a renter can't provide proof they are renting from that person, and has never paid any money to them. You can't say you rent it from a third person who doesn't own the property. Just like somebody can't say that they were renting from a deceased person, so now the new owner of the property is your landlord and you refuse to leave. If your landlord dies, when the new property owner shows up informing you that the previous landlord is now deceased and the property is now theirs, with proof and that the property is no longer a rental property, you should have to get out within 1 to 2 weeks.

    Unless they have a proof of residency like a LEASE …legal documentation that needs to be shown to law enforcement …. And mail being delivered there or some kind of communication between “said renter” and the owner…. It shouldn’t have to go to court because w/o proof that’s trespassing

    They don't even have to live at the house. If they get mail at the address and sleep in the home with your permission, even one night, they can stay unless you evict them in SC.
    Had a very scary experience with an x-friend.

    If a tenant does not pay rent, you are allowed to get them evicted, but a squatter may stay? How about people who work abroad, study or are on dispatch???     But there is a clear definition difference between squatters and renters. Renters have legally binding rental contracts and have to pay rent. Simple way to fix this would be any squatters caught and evicted, upon court judgement they are to be charged with property fraud and must pay the amount rental value for the time they were living at the property plus interests and any damages done to the property. This amount would debt they cannot discharge by bankruptcy and will be garnished from any income including from social benefits they have in the future or money in banks and seizure of any property or vehicles they own. Refusal or unable to pay, if amount is high enough (which it certainly will be if it's 20 months worth of rent value) they can be jailed for grand theft.

    If a lot of these other landlords weren't so greedy, and the economy wasn't so dang bad, this wouldn't happen. My hubby & I run a small rental home business. 2-3 bedroom homes. The highest rent we charge currently is $650 per month. These 1 bedroom places I keep seeing for thousands every month is RIDICULOUS! We still keep our places very nice, make all repairs, and are still able to keep prices low. It's possible, but some landlords are greedy AF!

    If you watch the video until the end, they say that these cases are very rare and that the right wing media used these few cases to make it seem like there's an epidemic of squatters.
    This may be true but all the cases that we've heard of are real.
    If you or a family member of yours is personally affected by this, to you, it's not just a political issue or something you've just heard about in the news but it's something very real! Even if it "only" happened to a few people, even though these people did nothing wrong, for them, this was a nightmare and *they* should have been protected, not the squatters!

    My cousin had this happen to her, but with her now ex.. i dont think he was on the lease or paid any rent.. she left bc she didnt want to be with him anymore or to deal with his abuse. All her stuff was still there and she couldnt get him to leave and calling police didnt help bc they told her the same thing "squatters rights".. so now he has her apartment and she had to move out.. when she wanted her stuff moved out, he wouldnt allow anyone in to grab her stuff.. hed just set it out in the hallway.. so annoying 🙄😐

    You shouldn’t be considered a “tenant” unless you can prove that you’ve ever paid the landlord.
    Then if there is no proof, they should be obligated to pay for any utility costs for the full duration of their stay then be charged for trespassing. Trespassing should be punishable by being on record, making it difficult for the person to find a home, because that’s exactly what they deserve.

Most of these are rentals too, it’s not a needed resource to the landlords, but it is for the victims who have to sleep somewhere.

      That's a disgusting thought to have. Blame the government, not the individual home owners. It's not their fault the system is broken.

    My ex used squatters "rights" against me. Absolutely horrible. Made my life hell for months. N cost me a lot of money
