Not really fair to say. Madoff investors paid full cap gain taxes on their "gains". They weren't trying in any way to evade those taxes. I know folks like to drop cliche's because it makes them sound smart which is why you wrote what you wrote. You should really rethink.

most people even libertarians believe the government has a responsibility to enforce contracts and ensure people are not defrauding others. You're just a small, bitter person, I can't imagine how much of a low life you have to be to look at Bernie's victims who have lost their life savings through no fault of their own and kick them while they're down.

Perhaps you don't understand tax law but when trades are made and there are capital gains the government doesn't care if you take money out of the stock market to spend on a car or you leave it in there to grow. Unless this is an Ira retirement account it was all text at long or short term gains no matter whether they left the money in the account or not.

They designed software that automatically allocated fictitious traders to individual accounts and created a phantom computer trading platform in case an investor, regulators or auditors requested too see how the operation worked. I think most people don't realise that the investors were as greedy as Madoff himself. For instance, one of the investors initially wanted to invest only 100K with A&B, but upon learning that SEC cleared Madoff of any wrongdoing, the same investor now invested 900K with Madoff.

Yes and it will push for regulations that will do little to no impact until the next "Madoff"/ "SBF"/ Fraudster comes along. They will throw the book at SBF because he was either very smart or very stupid. Recently, information came out that he had a secret chat called "Wire Fraud". Funny at first, but this gives the DOJ plenty of support for the many, many charges that will be charged against him and his former "associates".

To explain this in simple terms, let's compare a Ponzi scheme to a broken vending machine that's supposed to give you a candy bar every time you put in a dollar. Instead of a machine, though, imagine there's a person behind it (like Bernie Madoff) who takes your dollar and promises to give you a little more candy than you should get, every year, no matter what.
    1. The Promise of More Candy: This person promises that for every dollar you put in, you'll get more candy back every year, say 10% to 12% more. So, if you put in $100, you expect to get $110 to $112 worth of candy each year.
    2. Early Birds Get More Candy: If you were one of the first people to start putting dollars into this machine, you probably got a lot of extra candy over the years. That's because the person behind the machine was using new people's dollars to give you your extra candy. As long as new people kept coming and putting in dollars, you kept getting your promised candy.
    4. Stopping at Just Right Time: If you put in your money early and didn't keep adding more dollars, relying only on the extra candy you were promised, you likely ended up with a lot of candy over time. Especially if you stopped before the machine broke down (or before the Ponzi scheme was discovered).
    5. When New Dollars Stop Coming: The problem happens when new people stop putting dollars into the machine. Suddenly, there's not enough new candy to give out to everyone. That's when the scheme collapses, and everyone realizes there was no actual magic machine making extra candy; it was all just a trick with money moving around.
Summary: So, even though the whole setup was dishonest and bound to fail eventually, some of the early participants might have gotten all their original dollars back and more, in the form of candy, over the years. But this doesn't make it a good or safe way to get candy, because it's unfair and illegal, and not everyone gets their candy in the end, especially those who joined late or kept putting in more dollars hoping for more candy.
