Q) the IBC no doubt has improved the recovery of creditors, however it faces certain issues which need resolution - elaborate (15 marks, 250 words )
Ans:- the insolvency & bankruptcy code came into effect from 2016,to resolve insolvency & bankruptcy disputes & also to address the issues of non performing assets.
Insolvency is the condition in which the debtor is unable to pay his / her debts & bankruptcy is a legal proceeding involving a person/ business that unable to repay their debts
Aims & objectives of IBC are:-
a) amendment of all existing insolvency laws in india
b)simply insolvency & bankruptcy proceedings in India.
c) to protect the interest of creditors & stakeholders in company.
Positive outcomes of IBC are:-
a)stability in indian financial systems
b) increase in rate of recovery of lenders or creditors ( from 23% to 43%)
c)improvement in India's global rankings in resolving insolvency.
d) rather than liquidation focus is shifted to resolution
Challenges associated with IBC:-
a)no specific provision of mediation, settlement & arbitration.
b)greater liquidation than resolution
c)delays in resolution process(in some instance,more than mandated time of 330 days)
d) out of 25 national company law tribunal benches established across the country ;most remain non operational or partly operational bcoz of lack of proper infrastructure & inadequate staff.
Way forward :-
Proper use of national asset reconstruction companies, it will increase resolutions and reduce liquidations. Promote alternate disputed redressal mechanism like mediation,arbitration and settlement. To address the resources and infrastructure deficit in National Company law Tribunal by hiring more financial professional. Allowing the defaulters who are not wilful once to bid at nclt. {example mainly business is failed due to covid.}
