The recent judgement of a 7 judge bench of a supreme court reverted its judgement in EV Chennaiah vs state of Andhra Pradesh. This provides for sub classification of scheduled castes and the treatment of unequals through substantive equality rather than formal equality. Need for Treating unequals in an unequal manner: 1. Ensure constitution morality. Eg- article 14 and 21. 2. Ensure equality of opportunity through affirmative action. Eg- preventing any discrimination(article 15), Employment equity(article 16). 3. Promote adequate structural means for achieving the cultural goals. 4. Alleviate the economic deprivations for the marginalised based on historical wrong doings. Eg- Caste based occupational tagging(Manual scavenging). 5. Ensure that each section within the marginalised is equally empowered(Sub-classification of castes). 6. promote democratic accountability and People's governance. Challenges: 1. Infrastructural and institutional gaps to carry out sub-classification in a time bound manner. 2. Political favouritism to certain communities over the other in sub-classification. 3. May cause sub- caste polarisation and divide. 4. Promote political turmoil and disharmony in society. 5. Implementation gaps w.r.t. the time taken and its implementation. Way forward: 1. Ensure fairness in sub classification through participation of all stakeholders. 2. Promote non-partisanship and impartiality towards certain communities. 3. Technological upgradations to bridge the implementation gaps. 4. Infrastructural adequacy to develop a wholistic approach in sub-classification. Thus, the horrors of past should shape the policies of present to promote dignified living for priviledged and the marginalised so that they sustain on a levelled platform.

This could have been conveyed by them much before also but they chose now (i.e when the SC is giving its verdict on sub classification of SCs) thereby undermining this entire subclassification (lowered its significance) in comparison with the 3rd pointer. If they really advocate for this, the focus should never be on whether subclassification occurs or not, it should just be independent of the above issue. Takeaway: they want status quo to be maintained in case of SC subclassification (i.e they don't want it to happen) and will be the first one to propagate reforms in other cases (typical left philosophy which is not wrong btw). The truth is it is impossible to decide reservation or benefits based on each individual (which could be the most efficient method) but at least we can exclude individuals from the benefits of affirmative action through "creamy layer" concept (to maintain equitable access to all).
