In my market, giving someone access to the MLS who is not an authorized user is an MLS violation and can result in a fine up to $5,000.00 and being banned from the MLS for the user who shared their credentials. The point of the MLS is fair cooperation between licensed brokers and their agents. Licensed participants who have a fudiciuary duty to their client are the best way to go for people seeking to buy and sell a home. In my opinion, go to a local brokerage who is part of an association of realtors and has MLS access and ask them if they can help you join the association and MLS the right way. Other actual local participants of the MLS will struggle relationally with you if they find out you got into the system without a license and without paying.

Connecting with local brokerages who are members of the realtors association is a great way to access MLS data. In many markets, there are ways of obtaining direct access to the MLS if you don’t have your license. This includes getting unlicensed MLS Assistant access, unlicensed clerical access, and other names for a role within the MLS system that doesn’t require a license. That said, these roles always require approval from a licensed real estate broker and compliance with all respective rules and regulations. Hello again Randy! Glad to see you’re liking the content! Each deal will vary but typically you will be asked for the EMD (Earnest Money Deposit) within 72 hours of getting the executed contract. Usually within this timeframe your cash buyer will have the contract assigned to them and they will take care of the EMD. If you need a bit more time to assign the contract you would put down the EMD which if you read your contract (You should always read your contract before signing) - we want it to say that the deposit is refundable. You also want to make sure you have an inspection contingency in the contract (Typically 7-14 days) in order to stay protected. I cannot emphasize this enough but it is very important to line up and qualify your cash buyers before you set up your deals and not scramble around trying to find one after you have the contract executed. Actually there is one national MLS access that connects all 50 state local realtor/MLS boards . Just saying because the bureaucracy of the local realtor boards are not going to tell or they are ignorant about it.. 👍🏼
When you have to use a buyers agent because the sellers agent will only work with another agent, are you transparent with your chosen buyers agent that you’ll be assigning the contract to a cash buyer?
Hey there Noloc! As Real Estate Investors we always first go into a deal as the principal (meaning, as the original buyer). If we choose to assign the contract rather than purchase the property and fix and flip it, then yes we'll absolutely be transparent in telling we'll be assigning the contract. 👍 BOTH the Seller's Agent & the Buyer's Agent will both receive their commissions when the deal is closed regardless if you buy the property or if your Cash Buyer buys the property! :) Cheers!
i am kind of confused with watch you said, you sold property when you wasn’t licensed… I know Florida is you can not get commission or get paid for any real estate transaction if you don’t have license… So this video still apply for florida as well?

Hello, Herm! It is common that many properties will not be free and clear at the time of contract formation. This can be for multiple reasons but most commonly people will have a mortgage against the property. Typically in the contract, there will be a clause that states that the title will be delivered free of liens and marketable by the time of closing. If for whatever reason it isn’t, the assignee or yourself as the buyer will be able to terminate the contract if you choose to. Cheers!🏠😊
I have a broker that is willing to work with me on Bright MLS. But it says “A person who assists specific individual(s) within the office” for the Personal Assistant Application and he is worried about that since I don’t work at his brokerage. Is there a way to work around that?

Great question, @holidayhearth4756! Typically we recommend you start in your local market unless your market is particularly. The benefit of this strategy is you know a ton already about your local market such as where are the good areas and the areas to avoid. Having local market knowledge is extremely valuable when starting out. This also allows you to go see the property if needed to look for criteria that matches what your cash buyers actually want. If you do choose the Miami market it would be helpful to have someone that can meet with agents that want to show the properties on the fly. This can be a family member or preferably your cash buyers that you've already built a relationship with. Cheers! 🏠

If the selling/listing agent is not open to writing up the offer THEN we go ahead and have the agent that helped you get access write up the offer! :) It is definitely normal for us & our clients that have doing this for 10+ years in order to get wholesale, flip, and buy & hold type deals from the MLS and from working with real estate agents! You can wholesale houses still without starting a legit business and split the profits with each other. Just know that people can change over time so make sure you're both in this for the long haul! I also recommend that if one of you doesn't want to keep going after you have already started the business together, then the other partner should be able to buy the shares of the partner who wants to leave. This is only fair (in my eyes) and so the person who wants to stay can always keep the business moving regardless if one partner doesn't want to do it anymore. Hope this bit of insight helps! Title Companies & Real Estate Agents are as incentivized as you to get a deal closed because they only get paid when the deal closes. They'll absolutely work with you if you know what you're doing! This is the difference between being an amateur vs. being a pro. Amateurs have no idea what they're doing; Pros know exactly what they're doing. I'm licensed as a real estate agent in CA & NV. Can I go direct to the association in the state I want to get MLS access to and pay for this MLS access? I can also call to find out. Just wanted to know if you know.
Hello, Jennifer! Calling the specific association and getting instructions direct from the source would be the best thing to do since every MLS has different rules. Generally, you need to be licensed in that state and a member of the local associations to access the MLS. Certain states have license reciprocity and, therefore, may have exemptions. Happy to answer your question about how to get real estate deals under market value, Randy! For starters, we’re looking at fix and flip homes. These houses need a wide range of repairs before they can be lived in. One strategy we highly recommend is our day 0 strategy! This requires you to gain access to the MLS as you just learned and be one of the first people to put in an offer. It’s also very important that you know your numbers so you can identify what is a good deal that fits into your cash buyer's criteria. As far as them getting multiple offers above list price, you will be giving a real & no B.S. offer to them that you won’t be changing at the last minute! This is valuable to the listing agent because you save them time & won’t be a tire kicker like a lot of other wannabe wholesalers & investors out there. Hope this helps! As a former RE Broker for 20+ years I question this, MLS Assistant Access by any name, since the MLS is owned and operated solely for the benefit of the realtors who pay for MLS access. It is controlled by the state and local boards with no entry for anyone not licensed to list, sell or do anything else with RE. What State are you in that allows that practice? Was I paying high fees year after year and having the boards lie to me and thousands of others while allowing "civilians" access? It wouldn't be the first time the boards lied to their members, but this time, I would really like to know. Thanks

For instance you cannot list properties for sale on the MLS or represent buyers. There is a lot of misinformation and unfortunately bad wholesalers out there, @D0P35! It is usually best to refer to yourself as a real estate investor. This isn't a lie because that is exactly what you're doing! Wholesaling is just one exit strategy. As you evolve as a real estate investor and start doing fix and flips or even buying and holding properties you will still have wholesaling as a possible exit strategy in our tool belt. Cheers! 🏠
If it’s on the market, why would a buyer buy it from me instead of just going directly to agent? Is the assumption I get it under contract first so they can’t? I work with a probate real estate agent and anytime I put an offer on. He always tells me he needs to let it sit on the market at least five days.

Here’s why a buyer would buy from you instead of going directly to the agent: You Control the Deal: Once you secure the contract, you hold the right to assign it to another buyer, giving you control of the deal. Convenience for Buyers: Many cash buyers prefer wholesalers to handle negotiations and contracts, saving them time and hassle. Profit for Everyone: Buyers still get a good deal, and you earn your wholesale fee by securing a contract below market value. Regarding the five-day wait with probate agents, it’s common to allow fair exposure to other buyers before accepting offers. Once you have it under contract, it’s yours to assign. Hope this helps!💙

Each MLS is specific to its local area, meaning access to one MLS only covers properties in that particular region. For example, having MLS access in Atlanta, Georgia, won't let you view properties in Houston, Texas. However, there are software platforms like PropStream and others that aggregate MLS data from across different regions, giving you more widespread access. The listing agent can’t go with your offer because they like you more because it isn’t their decision. The owner of the home decides which offer to take.
If your offer and another offer are at the same exact price - and the Listing agent LIKES & TRUSTS you more because you bring more CREDIBILITY to the table - which offer do you think the Listing Agent would ADVISE their seller to accept? The Listing agent would absolutely encourage the seller to accept your offer. At the end of the day, it is the sellers decision to choose. However, Listing Agents definitely can influence this decision.

Hello, Miftakho! You can use Zillow, Redfin, etc., and then look at the source section for the houses you're looking at and see what MLS they are coming from. In my market, giving someone access to the MLS who is not an authorized user is an MLS violation and can result in a fine up to $5,000.00 and being banned from the MLS for the user who shared their credentials. The point of the MLS is fair cooperation between licensed brokers and their agents. Licensed participants who have a fudiciuary duty to their client are the best way to go for people seeking to buy and sell a home. In my opinion, go to a local brokerage who is part of an association of realtors and has MLS access and ask them if they can help you join the association and MLS the right way. Other actual local participants of the MLS will struggle relationally with you if they find out you got into the system without a license and without paying.
We appreciate your comment, Caleb! We do think it is important to understand your local MLS Rules and regulations. Connecting with local brokerages who are members of the realtors association is a great way to access MLS data.
In many markets, there are ways of obtaining direct access to the MLS if you don’t have your license. This includes getting unlicensed MLS Assistant access, unlicensed clerical access, and other names for a role within the MLS system that doesn’t require a license.
That said, these roles always require approval from a licensed real estate broker and compliance with all respective rules and regulations. Since there are over 600 MLSs it is important to understand the appropriate that applies to your specific market!

Each deal will vary but typically you will be asked for the EMD (Earnest Money Deposit) within 72 hours of getting the executed contract. Usually within this timeframe your cash buyer will have the contract assigned to them and they will take care of the EMD.
If you need a bit more time to assign the contract you would put down the EMD which if you read your contract (You should always read your contract before signing) - we want it to say that the deposit is refundable. You also want to make sure you have an inspection contingency in the contract (Typically 7-14 days) in order to stay protected.
I cannot emphasize this enough but it is very important to line up and qualify your cash buyers before you set up your deals and not scramble around trying to find one after you have the contract executed.

@rinadalbarjas8883 It might take you a little bit of time to get MLS assistant access and that's okay. Just use Redfin or Zillow for the time being until you build up that relationship with agents in your area.

Actually there is one national MLS access that connects all 50 state local realtor/MLS boards . Just saying because the bureaucracy of the local realtor boards are not going to tell or they are ignorant about it.. 👍🏼

When you have to use a buyers agent because the sellers agent will only work with another agent, are you transparent with your chosen buyers agent that you’ll be assigning the contract to a cash buyer?
Hey there Noloc! As Real Estate Investors we always first go into a deal as the principal (meaning, as the original buyer). If we choose to assign the contract rather than purchase the property and fix and flip it, then yes we'll absolutely be transparent in telling we'll be assigning the contract. 👍
BOTH the Seller's Agent & the Buyer's Agent will both receive their commissions when the deal is closed regardless if you buy the property or if your Cash Buyer buys the property! :)

Do all houses have to be "free" and clear in order to sell the contract?
Hello, Herm! It is common that many properties will not be free and clear at the time of contract formation. This can be for multiple reasons but most commonly people will have a mortgage against the property.
Typically in the contract, there will be a clause that states that the title will be delivered free of liens and marketable by the time of closing. If for whatever reason it isn’t, the assignee or yourself as the buyer will be able to terminate the contract if you choose to.

I have a broker that is willing to work with me on Bright MLS. But it says “A person who assists specific individual(s) within the office” for the Personal Assistant Application and he is worried about that since I don’t work at his brokerage. Is there a way to work around that?
The Broker is worried about committing fraud / participating in a conspiracy to commit fraud... I am not surprised they are concerned.
Hello, Xander! It's understandable that your broker may be concerned about the language on the Personal Assistant Application that states "A person who assists specific individual(s) within the office" if you don't work at their brokerage. However, there may be some ways to work around this issue.
First, you could consider working out an agreement with your broker where you are officially affiliated with their brokerage as a virtual assistant or independent contractor. This could allow you to be included on their application as a personal assistant and have access to the Bright MLS system.
Alternatively, you could explore other options for accessing the MLS, such as through a third-party MLS service or a co-listing agreement with an agent who already has access to the MLS. Great question, @holidayhearth4756! Typically we recommend you start in your local market unless your market is particularly. The benefit of this strategy is you know a ton already about your local market such as where are the good areas and the areas to avoid.
Having local market knowledge is extremely valuable when starting out. This also allows you to go see the property if needed to look for criteria that matches what your cash buyers actually want.
If you do choose the Miami market it would be helpful to have someone that can meet with agents that want to show the properties on the fly.
This can be a family member or preferably your cash buyers that you've already built a relationship with.

Yes, we always call the selling agent to talk about the deal and to get as much information about the deal as possible (talk numbers, repairs, seller's motivation, etc.,). If the selling/listing agent is not open to writing up the offer THEN we go ahead and have the agent that helped you get access write up the offer! :)
It is definitely normal for us & our clients that have doing this for 10+ years in order to get wholesale, flip, and buy & hold type deals from the MLS and from working with real estate agents!

Hey Colton! Appreciate the comment! Working with a partner always has it's pros & cons! Working together in the beginning can be great & fun. You can wholesale houses still without starting a legit business and split the profits with each other. Just know that people can change over time so make sure you're both in this for the long haul! I also recommend that if one of you doesn't want to keep going after you have already started the business together, then the other partner should be able to buy the shares of the partner who wants to leave. This is only fair (in my eyes) and so the person who wants to stay can always keep the business moving regardless if one partner doesn't want to do it anymore.

We haven't seen that to be the case. The reality is that title companies & real estate agents do not like working with people who have no idea what they're doing. But this is literally the case for any normal human being...nobody wants to work with someone who causes headaches and doesn't know what they're doing.
Title Companies & Real Estate Agents are as incentivized as you to get a deal closed because they only get paid when the deal closes. They'll absolutely work with you if you know what you're doing! This is the difference between being an amateur vs. being a pro. Amateurs have no idea what they're doing; Pros know exactly what they're doing.

I'm licensed as a real estate agent in CA & NV. Can I go direct to the association in the state I want to get MLS access to and pay for this MLS access? I can also call to find out. Just wanted to know if you know.
Hello, Jennifer! Calling the specific association and getting instructions direct from the source would be the best thing to do since every MLS has different rules. Generally, you need to be licensed in that state and a member of the local associations to access the MLS. Certain states have license reciprocity and, therefore, may have exemptions.

Happy to answer your question about how to get real estate deals under market value, Randy! For starters, we’re looking at fix and flip homes. These houses need a wide range of repairs before they can be lived in.
One strategy we highly recommend is our day 0 strategy! This requires you to gain access to the MLS as you just learned and be one of the first people to put in an offer. It’s also very important that you know your numbers so you can identify what is a good deal that fits into your cash buyer's criteria.
As far as them getting multiple offers above list price, you will be giving a real & no B.S. offer to them that you won’t be changing at the last minute! This is valuable to the listing agent because you save them time & won’t be a tire kicker like a lot of other wannabe wholesalers & investors out there.

MLS Assistant Access typically refers to a type of limited access provided by some Multiple Listing Services (MLS) for individuals who are not licensed real estate agents but want to access property listing data for specific purposes, such as research or personal use. It is not the same as applying for a job as a real estate assistant.
You might provide some service to the brokerage in order to get that access but that is entirely dependent on what you negotiate.

Tell them you’re a real estate investor
As a former RE Broker for 20+ years I question this, MLS Assistant Access by any name, since the MLS is owned and operated solely for the benefit of the realtors who pay for MLS access. It is controlled by the state and local boards with no entry for anyone not licensed to list, sell or do anything else with RE. What State are you in that allows that practice? Was I paying high fees year after year and having the boards lie to me and thousands of others while allowing "civilians" access? It wouldn't be the first time the boards lied to their members, but this time, I would really like to know. Thanks
@andysear There are a number of states that have unlicensed assistant access.
Here is an article from the National Association of Realtors that has each state you can learn about each state:

Here is also an example of Florida's application to gain access:

Keep in mind, this level of access does not give you the same level of access as a paying licensed member. For instance you cannot list properties for sale on the MLS or represent buyers.
There is access, but functions and responsibilities differ and you have many more permissions as a broker than you would as an unlicensed assistant. 🙂

There is a lot of misinformation and unfortunately bad wholesalers out there, @D0P35! It is usually best to refer to yourself as a real estate investor. This isn't a lie because that is exactly what you're doing!
Wholesaling is just one exit strategy. As you evolve as a real estate investor and start doing fix and flips or even buying and holding properties you will still have wholesaling as a possible exit strategy in our tool belt.

If it’s on the market, why would a buyer buy it from me instead of just going directly to agent? Is the assumption I get it under contract first so they can’t?
I work with a probate real estate agent and anytime I put an offer on. He always tells me he needs to let it sit on the market at least five days.

Great question! Here’s why a buyer would buy from you instead of going directly to the agent:
You Control the Deal: Once you secure the contract, you hold the right to assign it to another buyer, giving you control of the deal.
Convenience for Buyers: Many cash buyers prefer wholesalers to handle negotiations and contracts, saving them time and hassle.
Profit for Everyone: Buyers still get a good deal, and you earn your wholesale fee by securing a contract below market value.
Regarding the five-day wait with probate agents, it’s common to allow fair exposure to other buyers before accepting offers. Once you have it under contract, it’s yours to assign.

Can mls access be gotten nationwide?

Great question! MLS (Multiple Listing Service) access is regional, not nationwide. Each MLS is specific to its local area, meaning access to one MLS only covers properties in that particular region. For example, having MLS access in Atlanta, Georgia, won't let you view properties in Houston, Texas.
However, there are software platforms like PropStream and others that aggregate MLS data from across different regions, giving you more widespread access. While these are useful, direct MLS access in specific regions remains the most accurate and up-to-date option for real estate professionals.

The listing agent can’t go with your offer because they like you more because it isn’t their decision. The owner of the home decides which offer to take.
If your offer and another offer are at the same exact price - and the Listing agent LIKES & TRUSTS you more because you bring more CREDIBILITY to the table - which offer do you think the Listing Agent would ADVISE their seller to accept?
The Listing agent would absolutely encourage the seller to accept your offer.
At the end of the day, it is the sellers decision to choose. However, Listing Agents definitely can influence this decision.

Hello, Miftakho! You can use Zillow, Redfin, etc., and then look at the source section for the houses you're looking at and see what MLS they are coming from. There is usually more than one MLS in any given area, and you may find that properties are listed on multiple MLSs.
