  • Today I'll discuss something of a controversial subject, namely are knives weapons or tools? For most knife lovers they are definitely tools, but there are people who will say otherwise (the good people at Facebook come to Mind as well as the powers that be in England). Wo which are they? And how do we decide? It's not an easy question when you get right down to it, but come along and we'll try to answer it anyway.

“Weapon” or “tool” can be rather subjective when it comes to describing an object. Things designed to be tools can be used as weapons and things designed as weapons can also be used as tools. A gun is primarily a weapon but some people own guns simply for collecting or sporting and hunting purposes. I guess in those cases you could call it a “sportsman’s tool” or a “survival tool” in the case of hunting for food while living off the grid. The bow and arrow was originally designed as a weapon but today it’s primarily used for sports like archery. Another sporting tool. In my view, I feel like it comes down to what someone’s intent is.
Knife Rights actually got the “gravity knife” law repealed in New York last year so NYC doesn’t do the wrist flick test anymore. However, they still don’t want you walking around with the pocket clip of your knife exposed. The NYPD still hassles people over that. New York actually has an exception in their state law in which you can own and carry a switchblade if you have a valid fishing and hunting license with the state. However, you can only carry and use the knife when you’re actively engaged in one of those activities and there’s no protection for transporting it to and from fishing or hunting so if you got stopped by a cop it’s open to their discretion and they could still arrest you.
Knife Rights was in the process of fixing Ohio’s knife laws when COVID hit and all non emergency legislative activity was put on hold. In Ohio you can legally own and open carry any knife you want (including switchblades, gravity knives, assisted openers and butterfly knives) but if you walk out of your home with them concealed in your pocket and you run into a bad situation where you end up searched by a cop, you can easily get hit with a “concealed deadly weapon” charge. When I travel to Ohio (I’m in Southwestern Pennsylvania near Pittsburgh), I try to only carry a Leatherman multi-tool in a pouch on my belt. That’s much more defendable as a tool with all the gadgets like files, bottle opener, screwdriver, etc. I go to a lot of friends’ parties in Ohio so having something to open beer bottles with is always helpful. :)

Excellent points. I know when I was a paramedic, some police would give me a mild hassle over carrying a sheath knife (they didn't want to give me too much grief since I was a paramedic and they never knew when they might need my services) even though the law said I had every right to do so.

In Florida a weapon is defined by intent. So im guessing that a pen can be defined as a weapon based upon intent

They are tools. Weapon means a tool to harm so... they are tools
