      If I recall correctly, he was impeached for firing a member of his cabinet (who was appointed by Lincoln) without Congress’s approval.
      Hardly the basis of a criminal indictment.

    To me the Georgia call was the most damning evidence. My jaw dropped when I heard that.

      When I first heard that, I thought it was just Trump being kinda immature like he tends to be. So I kinda took that with a grain of salt and trusted the Governor did the right thing.
      Then… the rest of the evidence came out. And I’m still reading through them. I don’t really trust these official news sources because they aren’t the most reliable… and tend to push one narrative or another.
      The evidence I’ve been reading is quite telling though. I haven’t gotten to the ones that support he invited the riot (from what I’ve read, the FBI concluded it wasn’t an “insurrection”). Most of the evidence I’ve seen is mostly just Trump bitching and crying… which isn’t new.

      The amount of people who support illegal actions and criminal people and treat scum like Trump as their God is mind boggling. They are completely fine if he does illegal things to become King, they want that and support it. It breaks my heart to see America hate itself so much

    This is also what makes upcoming SCOTUS rulings so dangerous: the ability to give states a legal way to override the will of the voters and certify as they wish.
    Question: If a SCOTUS justice got disbarred, would they have to step down?

      don't have an immediate answer to that question, but my inclination is that any action against a judge would have to go through the judicial boards first, before they go to the bar associations/lawyer regulation. I.E. they wouldn't get disbarred before they faced the judicial authorities.

      Agreed. A TV show specifies alternate facts, and people believe it, when they should only believe what happens at trial. The fact, despite all this evidence against Trump, he was never taken to trial, makes me believe it was all a TV show, and none of it was real. Much in the same way, all the evidence against Hillary, and Biden, no arrests, it's all a show.

    When put into objective (and legal) terms, it's terrifying to hear/think of how close this country actually came to becoming a dictatorship. If he had been able to plant just a couple more of "his people" in positions of power, things very well could have gone down a very different, and darker, route.
    Anyways, love the channel! Politics sometimes makes my head spin, so it's nice to be able to come here and have things explained without any fluff or padding (the occasional joke notwithstanding; those are appreciated). I do often have to slow the video speed down to 0.75 or so because I have some auditory processing difficulties, but I still enjoy learning the legalities of situations both political and not political (like when things weren't so crazy in the world and a lot of the content was lawyer-ing movies).

    I remember when the campaigns were running for the 2016 election, Trump suggested that Clinton would take Americans guns, I literally saw him say that the second amendment people will know what to do. He showed the world exactly who he is that day. Nothing that came after shocked me.

      The 'red meat' has been fed by right-wing media increasingly since the late 80s in particular when Rush Limbaugh exploded on the scene. Then you had people like dinesh d'souza, and laura Ingraham stirring up hostilities by getting very controversial and nasty towards liberals, and because their comments were so shocking the media picked up on them, and they gained a large following from disgruntled whites. The red meat filtered through congress with Gingritch, and just got worse and worse over the years. The last few decades of constant priming by right wing media makes Trump's combative and vile rhetoric appealing to millions of Americans. It's scary how bad things have gotten.

    I think - though admittedly I'm not 100% clear - but it seems to me that the J6 committee handed off evidence which they could legally gather, but which the DOJ would have had a much harder time acquiring: Congress can essentially go on fishing expeditions, saying "Hey, this seems fishy, you need to come in and tell us about that. Under oath." Whereas the DOJ needs to operate under Judicial oversight and provide a specific allegation.
    Which isn't to say what congress found was unlawfully gathered, just that they can cast a wider net than the DOJ, and then hand it off to the DOJ.

      Been a long time since his last Real Law Review. Bis treatment of the classic lawschool case of Palsgraf was great. There are a ton of great cases I'd love to see. Here's a short list (some well known, some obscure):
      Symphony Space (great charity buys their building for a dollar because the owner screws up his attempt to dodge his taxes).
      Vanna White v. Samsung (Samsung makes a Vanna White robot and she sues for use of her likeness)
      Don't have time to list more now, but maybe I'll add more later. Feel free to reply.

    Have you heard about the David Eastman Jr court case in alaska? Both Stewart Rhodes and John Eastman (the key Jan 6 guy) testified. At issue is a loyalty clause in the Alaska constitution. Eastman Jr is a lifetime member of the oathkeepers and has refused to renounce them. The lawsuit argue Eastman Jr is ineligible to serve as a state Legislator because he is a member of an organization that seeks to violently overthrow the government. Would love your take on the case!

    The amusing thing about LegalEagle videos (and other Nebula creators) is that while Devin is one of the main creators on Nebula and asks people there to give him feedback, there is no comment or chat function on Nebula. You have to come to RUclips to make comments on the same video posted here. So here goes... Personally, I think the J6 committee was a success in that it documented what happened and who was to blame, but it's somewhat limited power means that for it's work to reach fulfillment, it requires the Justice Department and courts to act on its information.

    Could the fact that he didn't act on the insurrection for 3 hours be something that they consider for the "aiding and comforting" charges? His inaction certainly contributed to just how far they got, and likely emboldened some of them with how little resistance they were met with.       I think that's part of what they're relying on, yes. The question is whether practical inaction is an actionable offence. It generally isn't an offence to stand by and let an offence happen, so did he have a legal duty to act that he didn't fulfill? Moral duty, certainly, and that might be enough for civil responsibility, but may not be enough for criminal responsibility.

    I watch this channel mainly to get an opposing viewpoint. I do agree with a lot of this assessment. In the interest of bringing an opposing viewpoint in these comments. The other half of the country has been focused on the Twitter files which definitively prove that during the 2020 election conservative voices were being silenced and news harmful to the Biden campaign was being suppressed or removed. The FBI did play a massive role in that suppression and did in fact pay Twitter. All of which does in fact prove that there absolutely was cheating on a scale that would have changed the result of the election. It just wasn't the direct voter fraud that Donald Trump was and is focused on. People willing to undermine the democratic process and violate the 1rst amendment as well as the principle that the people are intelligent enough to analyze the information and vote appropriately would also be willing to do more nefarious forms of direct vote manipulation is not unreasonable. I sincerely hope that all those people who chose to place their thumb on the scale in the 2020 election see justice, including Donald Trump. I suspect that it will happen.

    This comes up often, but it makes me curious of the question - as a lawyer, what is the definition of "or"? Because treason is defined as "...levying war against [the United States], *_OR_* in adhering to their Enemies, giving them aid and comfort." Colloquially, the word "or" generally means that at least one of two surrounding statements, but not necessarily both, must be true for the condition to hold. But in this case, and basically any other time I read some law people are arguing about that contains the word, people tend to read "A or B" as "A or, but really, A, please ignore B". It is really annoying.
    Applies also to the punishment for treason - people like to trot out "the punishment for treason... IS DEATH!" when it's actually "death... or a pretty mild fine (not adjusted for inflation) and like 5 years in prison" iirc.
