  • In what is believed to be a first-of-its kind San Francisco eviction case, a kindergarten teacher was served with an eviction notice because the use of appliances in what her new landlords called an illegal in-law apartment. Michelle Griego reports. (6-24-16)

      Didn’t they say it was $1,700 a month? I live in the Bay Area- NOTHING is even close to that cheap in SF unless it’s rent controlled. An average SF studio is something like $2,600 a month

    Sooooo just so we're all on the same page here : this teacher was paying $1700 a month. That's $20,400 a year for the past 9 years. Grand total : $183,600....for an illegal unit that was not up-to-code. BUT, those landlords had no problem taking that money----year after year---for an apartment that I'm pretty sure they knew wasn't up to code....
    The greed of these landlords truly knows no boundaries....

      I think you misunderstood the story. The old landlord sold the house. The couple that purchased the house either wants to get her out of there so they can renovate and raise the rent for the next tenant or just live there themselves. Either way, they went about it the wrong way and SF is a shithole.

      @Sergio Aguirre Isn't that sad. Thier are some apartments in Dallas Texas that you are not allowed to use the water excepr for flushing your toilet between the hour's of 12 am and 5 am. Get this .It was challenged in court an the apartments won. Strange..

      out to dry, right after she awarded all previous rent paid returned to tenant.The owner is
      a penny anti con who is disrupting the tenants life bc they're trying to slither out of their legal responsibility.Sounds like a criminal to me hiding behind a 'damnable frivelous' lawsuit that a shyster lawyer drew up.Hang 'em high Judge for causing duress to an innocent tenant.

      It sounds more like a city problem to me. The landlords are acting under pressure from new city ordinances which were written without regard for the tenants or owners they would be affecting. How can you pass a law condemning electrical units as unsafe without a plan for bringing buildings up to code?

      @@lotusjaggarage2989 - a 30k trailer? Bad idea. First: where are you going to put it? Water and sewer? Throw in a couple of thousands more for construction. Insurance? Gotta have a foundation. Easily 10k. Going to rent a spot? Yeah, bad idea for more reasons than I can type, first being additional cost. Then there is resale value. Mobile homes have jack-shit in resale value. I can go on, but it's pointless. Moral of the story: mobile homes are a bad investment, for one of the largest purchases in a person's life.

      Technically the tenant isn’t even suppose to be their in the first place since it was a known illegal apartment. Also many tenants refused to be bought out since they can’t afford to find a cheaper place to live in SF. Even if they gave the teacher the typical buy out amount of 10k it wouldn’t even last her half years of rent in SF.
      The teacher isn’t stupid. She knows her rent is cheap in SF standards. She also knew it was an illegal apartment to begin with.
      Most the landlord could to do wait her out and refuse to take rent for half a year. Sure they lose money but they also won’t be accepting rent so it’s a legal eviction afterward.

      HeatJourney it’s not a low income housing. The teacher isn’t living in an apartment she is living in an illegal in-law unit at a single family home. She isn’t suppose to be there in the first place. It was a known illegal unit to begin with and was created by the previous home owner.
      Technically the new landlord just inherited the mess. The tenant technically is the one breaking the law. In some cities knowingly renting an illegal unit can be charged by association especially since rent is cheap.

      Francisco Lopez Nah; I disagree. The landlord just wants the renter booted so they can be the sole occupants of the house. This is the most common reason that game is played to harass the renters in those in-law shacks. The “landlords” are regular families that are trying to own their own property. Too bad the mayor’s office and city council will not support the construction of affordable housing within city limits. They continue to deny building permits on a regular basis.

      Riun Larose Maybe in California that's normal... That's not exactly the norm for other places. Some people buy houses that are being lived-in, but its usually the "tenants/homeowners" that are selling. Some people also buy new construction, which is less likely in a large city like this with tons of building codes and laws restricting new developments, but it's not very often that you go to buy a house from the homeowner & there's a separate tenant in an illegal apartment. lol

      Reb: an "in-law-apartment" is not a commercial apartment (by any stretch of the imagination.) It is created for elderly, the in-law that can support themselves. There must be a shared door or opening between the main house and in-law apartment for it to even BE an in-law apartment. We are not talking a separate residence here. A separate residence means that the property one which both the house and the in-law sit must be zoned for commercial building, not just residential.They bought the house expecting to kick her out or (failing that) she would leave on her own. Since she can not rent a 2-bedroom apartment anywhere in the Bay Area for $1700 (or anything close to that) of course she is forcing them to evict them. This is just about money. She doesn't make enough money in the Bay Area to live in the Bay Area. That is really all this is about.

      You're welcome to charge whatever you want for the apartment homes you own. This situation is not new. It's free market economics. Owners wouldn't be charging "a lot" if there wasn't anyone to pay it. I'm sorry I'm not sacrificing my resources and putting up all this risk to build an apartment building only to charge 1/4 of the going rate because some dumbass adults moved into an area that they couldn't afford and have some shit job as a secretary.

      Jorge Horna I agree with you. If SF just got rid of rent control and didn’t listen to nimbyism, then Sf would be more affordable. Of course, it is not this specific property owner’s responsibility to make sure a teacher is housed. I hope he gets his property back, as he is the victim here.

      The house is not illegal. All over San Francisco there are additional units to the house called mother-in-law. They were add ons or apt in the backyard that people built back in the 60s. Supposedly so Mom could move in with you and have her own separate little place. People never got permits they just built them. Times have changed. Now people have more electronics. Multiple TVs, computers, etc. Many of these additional units do not meet building or electrical code. The new owners can actually be in trouble renting a illegal unit that is not up to building or electrical code.

    It’s a ploy on the part of the new owners; they can bring it up to code for a minimal amount of money based on the return they will get by renting out to new tenants for double or triple the rent being paid now by this teacher. Disgusting example of heartless greed.

    Do not live in an inlaw unit. They are very overpriced for the meager conditions they provide and you can get a real apartment for about the same. They often are not up to code and are fire traps. People just build them to pad their mortgages in this overinflated housing market.

    I've been living rent free in an RV in San Francisco for going on 8 years now.
    Sure I've had the cops ask me to move, but I've never gotten a ticket, not even once.
    A good job in SF + zero rent = a comfortable debt free life w/ adequate savings in the bank.

I considered living in an RV on the California coast myself, but I wised up and left for the southern nevada desert of Las Vegas, bought a brand new house for 100k ( back then ) now it's paid off, no debt WHATSOEVER ! ..... now the cash is piling up from the menial job that i love going to 4 days a week and that I've had for the past twenty years....the point is, live within your means and live where you can afford to

      I've been dreaming for years to have my own RV to call home. I've been stuck living in my dad's kitchen in Long Beach for way too long. I have zero personal space or privacy. I can't even eat a meal without being in the way and needing to move for people while I'm still chewing. It's killing my soul and driving me insane and into deep depression. I can't ever seem to save any money though. I can't function like a normal person and get things done. I can't even answer phone calls. No privacy for anything. All I do is Uber, and I can barely even stand to do that anymore since I'm always in a bad mood and don't feel like dealing with people. I used to work at a warehouse (just making min wage) but had to quit since I couldn't even stay awake while doing my job. My bed is between the sink and the living room TV, and my dad and his spouse would blast the TV all night directly behind my damn pillow. I can't live or work like this. I'm just falling deeper into debt and depression by the day. I hate my life and I hate the world. I can't even have a life. Nobody understands or wants to help me.

    People in the Bay area have been converting their garages into apartments for as long as I can remember.
    When I lived in Daly City I knew about three houses on my block that had those as far back as the 70s-80s. And this was before stuff started getting mega expensive out there.

    Both previous and current owners were at fault here. Previous owner rented it out as illegal unit and the new owner bought it (presumably) knowing there were already tenants living in the illegal unit. But I agree more with the current landlord since the place is not supposed to support that much extra appliances/plumbing/kitchen/etc. The previous owner should be responsible to relocate the tenants.

      Here in Canada you can give eviction notice to anyone for anything as long as you give them 90 days notice.

    All the landlord has to do is hire like day labor ( Labor Ready) to get the Mother In Law apartment up to code. This case doesn't need to be brought to court! Its a waste of legal time & money. Make a list, get it done, then document it to present to the people serving the eviction ( I forgot the name ). And I agree with Noel on here one million for that house? I've been around for a long time & that place was for working class people. It's the greedy real estate people. It's one reason I refuse to take real estate courses for a possible career. They're evil + greedy.

    Instead of eviction, the new owners could simply have refused to renew the lease once it expired, and she'd have no defense. By telling her at the time of purchase the lease would not be renewed, she would have had plenty of time to find a new place.

The harder the government tries to force the issue by interfering in the market (and California and San Francisco especially seems to think screwing the free marker is a sport), the fewer affordable houses are available - and just like the insane person who keeps doing the same thing expecting a different result, San Francisco will continue to repeat the same bad policies and be surprised at the poor results.

    I once did some work for a recent arrival from SF. She asked me when someone was going to check her smoke detector. Apparently she meant a firefighter or some bureaucrats. Is that really a thing there? I explained to her that was her responsibility and to change the battery when she changed to daylight savings time. I was really astounded that she expected someone to hand hold her through such a thing.
    As for the home in this story-the city planning department should require the new owners to completely gut the apartment and do it over again. I have seen that happen where I live over unpermitted additions in homes. I feel bad for the lady living in the apartment.

    If someone buys a house that you live in and they don’t want you to live there, you should leave. But, the law says you can stay. Well, in this case, the law also says that apartment isn’t permitted to be rented, so you have to go.

    Surely she has a lease? They could have just waited til the lease was up and not offered renewal. I wonder if their real estate agent was honest with them pertaining to taking full custody of the house. If they were told that they could quickly boot out the present tenant, the agent lied and that's an issue...but they carry responsibility for doing due diligence.

    Landlord wants more rent. Hell, when I was paying for the home I had built I wan't paying even a fifth of that amount. We should secede from California, declare it a country, build a wall around it, and not let anyone visit without a passport.

      I have a mortgage on a 1500sq.ft. home with 3 bedrooms and 2 full baths, 1 half bath. Car port on 1/4 acre. We payed $120,000 in 2007 w/ $700 payments. It's in a older subdivision, but it's quite. I don't ever want to have to sell. We'll never get that lucky again. My friends are paying $1500 - $2000 a month for mini-McMansions. Heck no! I'd rather travel.

      Sounds like an excellent plan to me and should go onto the 2020 ballot😁~I say this as someone who was born, raised, and reared my own 2 kiddos in S. Cali...
      Now, my Daughter and Hubby are paying $3,500 monthly in Orange County since he grew-up near the ocean and wants to stay there to raise their own 4 Girlies💕💕:)
      That's fine except for the fact that the entire state system is totally broken, with tragically millions of Homeless, horrible taxes, zero affordable housing, and schools so Liberal Parents are then having to pay for private education🤪🤯~

    It's crazy that when the housing crisis of 2008 hit, people in the middle to upper middle classes told people with lower middle class incomes to just " get a better job". Here it is 15 years later and the housing market is now kicking THEM in the a*. This woman paid her rent for 9 years and clearly was a good tenant. The fact that someone like her facing homelessness exposes how unfair and greedy landlords can be.

    I'm not sure how to solve the rental issue, but it IS an issue.
    Three working professionals in Vancouver (similar housing crisis to SF) should not have to choose between paying 70% of their income for a safe place of their own, or share a knock-down house with no heat, a broken window, and at times water only coming from the tub. We were paying $2000 canadian for this and the landlords didnt care about the safety of the tenants. We were just occupiers until they bulldozed it.
    Edit: It was just HALF the house. Another few tenants lived downstairs, paying a similar amount.

    They were probably ok with the tenant until they started getting the electric bill and water bill. A lot of people think they that they can be landlords but they don’t actually know the real cost of being a landlord.

      You mean improvements. Permits are issued by the city to allow improvements and tax them. Code violations don’t normally equate with illegal. Moreover it’s not her property the owners might have any number of plans and tenants have no inherited right to stay beyond the lease

    If the property is not legal as a rental unit, then the "landlord" broke the law by renting. He/she should return all the illegally acquired rent payments and be responsible for the tenant's housing until she finds a new place.

      I know it’s bad, I tried to evict her, she won’t go so I have no choice but to let her live there and collect rent, so you can’t fine me cause I tried.

    I think it was the previous owner's responsibility to make sure the tenant would be taken care of before selling the property. And, since the previous owner charged her rent to live in an "illegal unit" for nine years, it's their obligation to give the tenant her rent payments back so she can either find a new place or stay somewhere else while the new owners bring the existing unit up to code.
    Honestly, the new owners were fucking idiots for buying this property when a tenant was still living there in a guest house that wasn't up to code. Why the hell would anyone purchase a new property without making sure arrangements were made to take care of the tenant so a lawsuit like this wouldn't happen later on?
    Also, I'm surprised there aren't laws regulating this kind of stuff (ie buying a property that has a tenant living there who intends to stick around after the old owner is gone). When my grandparents died, my father couldn't sell their house until their industrial grade appliances were removed because "you cannot sell a residential house with industrial grade appliances in California". But the old owners were allowed to sell their home despite the fact that their guest house had a tenant living there? WTF?

    As the homebuyers the permits should have been taken care of prior to closing on the house or they should given adequate notice as well as not accepted money on the uniit. They probably saw it as a good income potential and then it bit them in the ass. How did they even get a mortgage if the property was not up to code?

    Change the codes. Get rid of rent controls. Allow rent increases to keep up with market values. 1.3 million with a return of $1700 per month is a horrible return on investment. Only buy property when all tenants are out.

    I guess she expected her rent to increase like everybody else's. Didn't expect when the unit was sold the law would step in for it's cut of the sale and more revenue? She should be happy it wasn't raised in the years proceeding or that she wasn't charged after it was found out she was illegally leaving taxed free. What? Didn't hear about the Ghost Ship warehouse fire where 35 died that was caused by essentially exactly what she was doing -- living in a non-reviewed, non-approved hidden apartment?
