Don't book flat no. B-2005 in SUNTECK NAIGAON, warns angry NRI flat-buyer after getting Legal Notice

  • NRI flat-buyer Ganesh Manjrekar is an angry man. He is angry because Sunteck has forfeited his amount and unilaterally cancelled his registered agreement, allegedly because of fatal breach of agreement. Sunteck has sent him a legal notice because Ganesh launched an angry social media campaign against them. Ganesh maintains that the cause of his delay in payment is because Sunteck's lines of communication with its customers is extremely restrictive and one sided.
    I am publishing this video in the teeth of a legal notice, fully aware that I may get dragged into the same defamation suit that Sunteck proposes to launch against Ganesh Manjrekar. My reasoning is very simple: Sunteck may or may not be legally entitled to forfeit a common man's hard-earned money because of their cunningly drafted one-sided agreement proforma, but Sunteck is not lawfully entitled to the silence of the common man after forfeiting such an amount. To say that the common man must lose his money to a big company, and must suffer that injury and insult in silence, without a public outcry, goes against every tenet of law known to me.
    I believe Ganesh has a claim against the flat that he booked or bought, and until Sunteck refunds him in full, he has a right to publicly state and agitate his claim. If Sunteck considers it defamatory for him to say so, and for me to publish a video with him saying so, then I am willing to let the matter be tested on every lawful forum.

Forks, stop buying flats from these crook and wicked thieves (builders). Let their buildings rot. Buy resale flats or ready to move in flats from good builders. We have to thoroughly study them too before dealing with them too.

    Krishna Ji - please highlight that Suntech plot is now attached in ED and no further sale is restricted at the Registrar's office as Unicon Global is market defaulter and it's land has been attached and Suntech has bought this land.

    He is correct. But it's very unfortunate to go in legal things. Bad thing is that if he checks the RERA date it will be of 2022.
    Even they have mentioned the clause of interest in Agreement. I don't think it will be fruitful to legally fight with them.
    Instead I would suggest to eat a humble pie & try to close it because in out nation property legal matters take a very long time.

    It's a very small flat. Even in hall they have not provided the wall ceiling design to hide the fire fighting pipes which is very bad as it provides additional expenditure to the buyer to build the ceiling. Moving to kitchen they have not provided double platform which is a violation of the contact as they have shown double side platform in the sample flat. Last but not the least the bedrooms are like a match box size bedroom where you cannot fix a 6x6 bed and wardrobe together. It's a pathetic investment and I wonder why the 1bhk flats here are sold at 40-41 lakh ready to move in. Thanks.

    you create the list of projects along with flat number... blocked listed flats and publish on RUclips... so that it will be easier for buyer to refer that list.. it won't be possible to go through so many videos.

    I have unfortunately bought a 2bhk in this Sunteck Westworld. After spending enormous amount of money in so-called "interest & GST" on pending amount mentioned in demand letter, I had to hesitantly pay the amount in order to receive my flat (partially also as my parents weren't ready to get into this mess as we had already booked this flat in March 2020 and were hoping to get the possession as soon as possible). They don't even give you the possession without signing their key and flat handover form which I think is the lowest a builder can go. How can we sign a possession letter without even seeing the flat that we have bought in first place? I really felt cheated at that moment but I had to sign it as my parents were with me at that moment and didn't want to go through another delay because of it. If I would have been alone that day to take possession, I would have taught them some lessons on how to treat with a customer who has already spent his hard earned money on such so-called "township full of amenities". I hope that flat owners don't sign the possession letter without seeing their flat first. I observed that their ceiling provided in hall is very low (abt. 8 feet 9 inch only) and their fire sprinkler pipe is very low and it looks very bad in hall without covering it in first place which is additional cost for flat owners. I also observed that the jet pipe holder location is badly placed as it always stays half fallen onto ground which most of the time will be wet as water from shower and pipe falls to the floor. Also, one of the jet pipe holder wasn't installed correctly ad it looked like it was hastily fixed which I corrected by sending an email their helpdesk after possession. I assume due to such bad design they were hesitant to first show our flat on possession before signing the possession letter. Flat owners should be aware of this bad gimmick used by this builder.
    Also, I would suggest to keep a diary to note down all payments done (along with the dates)to the builder at start so that its easy to point out the delay (if any) made from builder's side.

    Feel bad for you brother…I stay in Virar since 8 years ..recently moved to my 2 bhk ..project by Agarwal builders …Good builder..And Good project too ..it was under construction ..never faced such issue ..🙏but better to buy ready to move flats

    I had a bitter experience with underconstruction, while buying in Mira Road, i was sure of having ready to move with OC property. Many agent tried convincing me that the possession will happen in 3 months, 6 months, enjoy the rates, I was still, nahi lena hai matlab nahi lena hai underconstruction. And i bargained tough even for ready to move. Lastly I bought resale one, trust me, i got the best

      Very true, it is very important to first check the property before we buy, in Sunteck case they will not allow you to see or enter the flat until you pay 100% full payment. And later you will surprise to see what they showed in sample and actual flat there are huge differences.

    I have 2 bhk in suntech which i booked in 2020 some people have also gone to stay there they got the key but in 2 years i didn't even get to see my flat.. Very bad environment around suntech like water issues, under construction building, pollution,very bad roads....etc.

    Young man you should go to court instead of talking with staff or sending mail to them and write letter to registration office about your disputes with builder and request to registration office that you have not cancelled the agreement

    Today if anyone goes & buys Flat in Sunteck Westworld they won't be able to do the registration.Since COURT HAS STOPPED THE REGISTRATION. You won't get possession. All your money will get stuck.

      Pehle unke terms and conditions jaan lo, unhe writing main dene bolo ke agar in future kisi karan ke wajah se agar aapko ye booking cancel karni pade to kya aapka paisa refund hoga ya Sunteck khaa jayega? Uske baad decision lena, this is our hard earned money can't allow builder like Sunteck to eat it so easily.

      Ha ye to sunteck ne pehle hi clear kar diya tha ek baar ghar book hone pe aap cancel karte ho to paise refund nhi milga. Ha baki aap kabhi in future sunteck ka koi bhi property leto ho to usme aapne jitana amount pay kiya tha pehle wo deduct ho jayega. Mene agreement paper mail karne bola h.

    There should be a law where if possession is delayed builder should pay penalty and interest to buyers.
    Buyer is so polite. Very unfortunate that such people get conned. You must try and find a woman buyer who is going through the same issue.. if she speaks.. dudh ka dudh and pani ka pani..
    Also if they have put false allegations of abuse, you must fight that back and claim damages to reputation .. it's a emotional and mental harrassment for the entire family.
    These large corporation must learn how manipulating buyers is not their right!

      Totally agreed Ansh, what about his 6lac inr hard earn money.
      Which he trusted and handed out to them. My friend just see around you now a days to earn 6lac it’s not easy. The abuse was his frustration toward the organization not to any human personally.

      @@Ansh-jq6yw agreed but the behavior of CRM employees is no less. They try to incite people and provoke them to get angry by using rude lan guage . I had same issue with Puraniks aldea in pune but i just posted a linkedin review online about crm on the owner's profile citing non responsiveness and no information on change of crm executive and use of rude language. The CRM who was gayab from 6 months called me the very next day with an apology email and a call . Yes this person could have handled it more professionally. abusing these guys damages our goodwill. but again it depends on what kind of conversation was done by the CRM and the person in question.though no matter what in India abusing a lady is indirect invitation to issues.

    Mane bhi book kiya tha 1lkh rs booking amout se bad ma lockdown lag gaya jis ki wajh se ma age ka payment nahi kar paya yeh log mujh se 4.5 lakh with all interst ka sath payment ka liya cal kar rahe the lockdown ma ma na kaha abhi ma koi payment nahi kar payoga lock down ka bad mujse 4.5 lakh mang rahhe the nahi to booking cancel kar dege bole ma ne payment nahi kiya un logo na 1 lakh ka non refund kar diya us ma se 1 rupya bhi nahi wapas kiya sunteck a big fraud co. Koi bata sakta hai 1 lakh booking amount kaise waps le sakte hai plz suggest
