Granted, this video is boring as shit, but only because the type of mediation I'm interested in is workplace conflict resolution, at the moment. I happen to be a tax disputes mediator but these kind of mediation is hard as it about business . Everyone is looking at how to stay in business. You have to understand the emotions here.

The video was okay. At the end of each party stating their positions, the mediator did not summarise. It seemed she played no part in facilitating communication between the parties. This gives an impression that the dispute did not need a mediator in the first instance. Consequently, trainee mediators will hardly learn from this clip.
I've been mediating disputes at work for many years now (very controlled and professional environment in our office) and have recently gone out on my own- My greatest fear, honestly, is that I would not be able to control my own "temper" if I have someone like that rude guy in my session (yes, I know these are actors and may be exaggerating the experience for demonstration purposes)...
Iam a student of ADR.. and in mediation, this is exactly what happens, our mediator in this case should try one more thing.. control one person to talk at a time to avoid argument. More also pointing at each other rises more temperatures, the mediator should creat a condusive environment for both parties.
This is not true. The judge can order a mediation to happen. If there is no resolution at mediation, the case will be taken back to court where the judge will have the final say.
