How did all the news stories fail to mention this? What do you mean they "cited" it in closing arguments? You mean that one or a few brought it up verbally while someone was making closing arguments, as opposed to officially stating this in a decision by SCOTUS. I will be looking for something from Watching The Watchers to get some clarification.
