I definitely hear the similarities with Shakatak despite how many times bunnies will tell you “they don’t even sound similar” but New Jeans don’t deserve to make not money from it, I hope Ador can settle a deal where they pay for the sample and still get to perform it!     What poetic justice this is. To be fair, MHJ didn't write that song. But this is just perfect because of how thoughtlessly she threw around plagiarism accusations against illit, using content made by spectators and consumers as her "evidence" instead of actually having all the data analysed by professionals with real knowledge. People like to cry plagiarism without knowing the meaning or the legal parameters behind it, and MHJ is certainly one of them. Honestly, how is someone so ignorant and careless the CEO of a company? And people are calling her a hero?? Maybe through this lawsuit, she'll finally learn what it actually means to plagiarise.

      Yes and being a fan of Shakatak I also said the same thing, I was furious. I knew Kpop companies in the past have done this many time's before but because they are such a nice market they got away with it. That's why when I found out about BTS I was so happy that when they sample they pay for those samples and pay homage to their influences. Somehow that didn't rub off on Ms Min & NJ but then Ms Min came from SM who have very often sampled and out right copied Western Artist work without permission and/or paying for it.

      It doesn't matter, the label is responsible for plagiarism. The CEO is an administrator, in fact, she is like the principal of a school. The label could retaliate against the musician if it could demonstrate that the management was totally unaware of the plagiarism, but on the contrary, the previous Ador staff has already said that MHJ had given precise indications to copy the music and concept of the Mexican Jeans, so I am pretty sure the same thing happened with Bubble Gum.

    This is huge. Because if the Korean judges side with Ador. Shack Attack is an English band. They will refile in England. This isn't going away. Also, for the other songs that are suspect. Those bands won't bother the Korean court system. They'll just file in their home countries. Artists are extremely protective of their work.
    All of that is going to kick a ton of dirt on Korea. So it isn't just MN the issue it's that a whole genre and country could lose face.
    I wouldn't fire her. Then she would get to hide and whine. Poor me....

      Considering how hard Korea is using Kpop to attract international attention, favor, and hopeful travel and buisness. It really should be known that if they allow these same musical groups to engage in plagiarism of other countries music, it makes them not only look bad. It makes them look extremely disrespeful to people in other countries ans those countries themselves.
      Korean cares a out it's world reputation. So they should care when people from another country or union as famous as the UK, files claims of plagiarism and being ripped off.

    i dont know how this will work in korea but in america it happens. marvin gaye's estate sued robin thicke for his song blurred lines sounding too similar to got to give it up and they won. he had to pay $5 million to gayes estate. it'll be interesting to see what happens

      There is World Intellectual Property Organization and Komca (korea) which is for SK. mean the copyright infringement is the same. *Since 2007 Jasrac (japanese copyright) signed with Komca so there in no banning anymore.

    People make a mistake because this not using a sample. This is using the totall basic music with different lyrics, multi samples. Normal you credit the owner of the sample. Hybe credit always, paid, has always done. Ador - not? The IP of this song has an owner, is not credit or used with their concensus. Read about Niles, Sting etc. artist used a riff, their riff etc. These artist has to pay for everytime that song went out. (They ask Ador first to shut down the song, if not they have more rights to sue). Her blatant response saying they have to prove, they actually already did. Korean or not they can not get around this. They can and will ask to pay per sales and play wherever or live. That is the damage pay. Only songs written or done befor 1927 are (copy) free. In other words If you sample an audio recording without the express permission of the owner, you are infringing the owner's copyright. This means when you sample music or rip audio from TV, film or social media and use them in your songs, if you haven't got permission from the rights holder, you are infringing their copyright.

      Correct also you can't use an artist work to support your political campaign like or like Trump tried to do with Queen's song Brain May of Queen send Trump a Cease and Desist notice threatening to sue if he refused. My friend a painter did the same to one of our British Politicians who used her work on his political manifest online page. Cease and Desist went out also demanding a written apology on his official page and one in the newspapers, she gave him 7 days to comply failure to do as requested would result in suing him for damages. You can image how quickly he did as demanded as he knew he was in the wrong and the law was on my friends side.

    I think MHJ thought this would blow over since the Mexican group didn't make complaints when the concept comparisons to them came to light. Since they didn't fight back she figured everyone would just let her do her thing unckecked. Besides that, she comes from SM who have a history of groups using other peoples published music so she's doing what she has watched over the past 20years or so

      It's a lot harder to prove visual & design concepts being plagiarized I'm sure even MHJ knows that and why she likes to make a lot of noise about it knowing it literally wouldn't go anywhere just give other hybe labels grief and harass the other girls from those groups so the Mexcian group would have a much harder time proving it but when it comes to music there are copyright laws in place to protect musical artists. If they had copied the Mexican groups song they would've had more of a leg to stand on going after them legally.

    I wonder if MHJ did it as part of her master plan to "destroy" Ador/Hybe so in the end she can buy Ador at a cheap price once all of what she had planned was completed? She already instigated the attacks on all the groups that HYBE/BIGHIT created which was part of her plan so maybe this is her next step? She also skipped out on The Grammy Museum. She seems to be doing everything to separate from HYBE. She's definitely nervous because the public is aware and her intense Joker smile is just a way to mask her explosive and vulgar thoughts.

    Le Sserafim didn't get hate about their vocals on their Fearless & Antifragile era. It's just these last March & April. The hate was full force. Also, other Hybe artists were being attack as well that months. Bang pd hired detective & found out it was MHJ is the culprit & she has back up outside. That's y they took her laptop. Cause it's very suspicious why the hate train on hybe was full force that past months. Now, MHJ is getting her karma 1 by 1👏👏

      The media tried to get her to talk about it when she was found guilty the second time. She said that this was all a circus and still said it wasn't true the she said I'm done talking about it and went to the car and left. A total of 5 minutes of her talking. She did say that HYBE copied her with BTS I can't remember the group name of the group she said BTS copied but, the video showed toddlers referring to her KPop groups age when BTS was becoming popular. .

    Sure, Hybe owns 80% of Ador but NWJS albums were decided by Ador solely (aka MHJ). If Hybe can prove MHJ screwed up, and this cause a damage on Ador, can't this mean that Hybe can kick MHJ out from the company? I mean if it is proven that Ador choose the song directly without Hybe's awareness than, the burden is gonna be on Ador solely. Right?

    Sampling is actually very much illegal. 😆 The only way it is legal is to negotiate a sample license from whoever owns the copyright for the sound recording itself and the composition, and it's obvious she did not do that. She's insistent that she be responsible for everything; use her in-house PDs and choreographers, hire everyone herself, have a hand in every little thing, so it's on her. She should know all of this, but I get the feeling more and more she's just playing and causing drama like it's high school. And making bank as she does.
    From what I understand, because Adore is part of the Hybe conglomerate, Hybe doesn't have to step in and take responsibility. MHJ is the one legally responsible for everything that happens with Adore and the people she employs. They could sue Hybe on the side, but it's been stated like 500 times already due to all the bs before this that she has full responsibility and control over Adore, but Hybe can step in.
    From what I've been told by my lawyer friend, is basically Hybe gave her a loan, and they own the lease, but she owns the business kind of situation. So you wouldn't sue the bank to go after the loan holder, which is how it was described to me. LOL Does that even make sense? 😅
    And yes, I think it's karma!

They didn't have a clue it was a lot of smoke and mirrors on her part, I've known a lot of people that remind me of her in the business world where they are master manipulators & major b.s.-ers that are really good at sucking up and schmoozing people. They end up getting ahead easy and fast getting promotions or management type positions while their poor subordinates work twice as hard to just to keep the boat afloat or to fix all the mistakes their narcissist manager makes cuz they don't know how to actually do their job cuz they lied.

    Good lord she thought it was really over! I don't know how on earth Min thought she was going to "borrow" sounds and songs from foreign artists without paying, or at least giving props to them and not expect the same foreigners to say anything! That's one of their superpowers! This is basically stealing and that's not a good face for S. Korea who has been known to "borrow" a lot of elements from foreign influences without giving the originators their props. If even your people can tell a song sounds too similar to a foreign artist they know and like, what made Min think no one was going to catch on? Poor NJs...they do make great vibes, but now I can't help but wonder just how many sounds and elements they've taken without either asking permission, or giving the originators their flowers so to speak. Trust me Min, you DO NOT want to get lawyers involved when it comes to the music scene. Them sharks are cutthroat and will not care if you show up to court looking like you're poor and crying about how the people are against you.

    They've sent a Cease and Desist notification and are now suing on top. Some time's we Brit's will be happy just with sending a 'Cease and Desist' and demand a public or write apology, if we get that we might not sue. I've done it a few time's but I've also sued when the other person has refused to comply. We are reasonable most of the time but we will not be walked over when it come's to IP rights.

      Public opinion and reputation is fickle. If anymore starts coming out that's she really has been copying and ripping others off of their ideas, then even their Korean reputation can fall as well.
      She in on the edge right now and one more screw up that becomes exposed about her and straight up end her whole career. She is trending on dangerous grounds.

    I read this quote many years ago, and it impressed me very much:
    Be aware of the bad, that you are doing today, cos tomorrow, it will brake your legs.
    From what I understood from a friend, who is making music, when you want to sample, you have to ask the permission, and then you can use the sample. If I understood correct, practically you are announcing the author that you are using the sample and you have to credit him for that part of your song, and pay royalties. Many song writers and producers are doing that as a normal thing to do, because they will honour and respect the song and author that inspired them. Also the letters between the parties, it seems that it is the usual way, because going to court will imply a lot of money and time to lose. And, yes, they have to provide audio and technical proves and if the conclusion it is plagiarism, they will settle down and pay the credits and compensations. Something like that, and even it isn't so accurate what I understood, it may not be a trial, to know where to file the suit. Anyway MHJ as a full CEO that she was, approved and made herself the producer of NJ, even if she isn't the musical producer, someone should have been very fond of Easier Said Than Done, because they thought that it will be also, easily to do. But they didn't do it right. Instead they MHJ and musical producer damaged ADORE.

    the Producer of the track called 250 is the one responsible for the production. This person needs to testify if Ador did the due diligence and checked with the music library worldwide any similarities. I work in media, and we always hire assistants to check this before the go ahead, and pay for any sampling, or get clearance for copyrights. MHJ is not mentioned as Producer, but she is responsible for Ador overall production output, so we will have to see if Hybe will put this on her, bc it was under her management & hopefully a good excuse to fire her mwahaha I've witnessed in realtime your msg to Shakatak on twt (clap clap clap) . Thank you for the update on the case. Shame this is an Ador case, bc I would be so happy to see another case MHJ would have to pay the lawyers from her own pocket. Since Attention, there was a lot of similarities with older songs. MHJ even copied Virg*n Su*cides scene by scene.. Sofia Coppola should sue MHJ as well. she is no genius😆😆

    I just listened to both songs. Bubble Gum's chorus is the same melody as Shakatak's song; the only difference, like you mentioned, is the key. It is clearly plagiarism. Keep in mind the Blurred Lines lawsuit a few years ago. In that case the songs in dispute share the same beats but the melodies are not that similar, yet the Blurred Lines writers lost the case and were held liable for damages. Shakatak has a much more substantial case against Ador this time. However, I don't think MHJ will be held liable for this since she's not the writer but I am so hoping that this time, the courts can let Hybe kick her out of Ador.

    It's not sampling, that's where you use a recorded audio clip from a copyrighted recording. This is copyright infringement (alleged) of a composition. It can be a high bar (Spirit v. Led Zeppelin), but either way it's gonna cost Ador a lot of legal fees, thus lowering profit and MHJ's potential stock profit. Listening to the songs myself, it sounds the same in terms of melody, harmony and rhythm. Hybe will fight the good fight, but find the silver lining if they lose.

    Sean, it's good to see your continuing informative and insightful reports on what's happening at HYBE with MHJ. I think you're right that HYBE may be adding this situation as an additional item to MHJ''s long list of offenses against her parent company.
    My thoughts are that this case will be settled between Ador and Shakatak without going to court which you mentioned in your report. Ador is now led by four executives (I.e., MHJ + 3 HYBE execs). The 3 execs have probably taken a look at this and agreed with Shakatak that plagiarism took place. But as with all things involving MHJ, there needs to be solid evidence or else MHJ slithers away unscathed. The 3 execs needed Shakatak to formally give them the complete list of New Jeans plagiarism offenses so that MHJ can be dealt with effectively. The exclusive news report confirms that the official notice happened.
    I doubt that HYBE, Ador, and Shakatak's legal counsel haven't already reached an "agreement" on the outcome of this unsavory situation. But HYBE is once again going through the meticulous steps of documentation as they work methodically through this latest MHJ problem. Shakatak is probably only interested in compensation and making sure it doesn't happen ever again.
    The people who may really have to worry are Sony Music and the Korean/Hong Kong Music Association. This is a precedent -setting case. South Korea was already discussing an Asian Grammy startup. The Grammys may be watching this case to determine if there is a systemic problem ahead with Kpop "sampling" music from other countries. The Shakatak case could determine what happens next with the Grammys which now impacts the music industry's financial streams between continents. I'm not a music industry expert, but I agree with you. This case could open a can of worms beyond HYBE and Ador.

    i saw this on reddit so take it with a grain of salt but apparently its been a long time theory in the fandom that gigi is actually min heejin. since gigi has not written for anyone else but nj. and it seems to be a pen name more than anything, and no one really knows anything else about them. it would make sense that she doesn't really know how to write but she can rearrange certain aspects of the lyrics and change a few words or change the structure of a sentence. so she would automatically be put as a lyricist. idk, kind of interesting to think about because this was a theory since last year. and if true, that would mean mhj has another problem to think about since she is in the credits.

      I did a quick google search on this when i saw the rabbits a few months back claiming mhj is responsible for Tae’s songs in Layover.

    Artist do this all the time. They choose to risk having to share royalties over paying them up front
    Olivia Rodrigo was having to pay left and right on her first album and look at Ariana with 7 Rings - super popular song and she ended up making $0 on ot

    It’s really hard for me to listen to their music or even watch their MVs because of the wholesale copying of “concepts” and musical influences straight out of the late 80s and 90s. I don’t know if the girls don’t know any better. I really drew the line with NJ after the Lisa Lopes car accident reenactment in their “How Sweet” MV, not to mention all the other dangerous things they did in that music video. I’ve had enough. Those girls need to be responsible for their own careers, as individuals and as a group. They can’t allow this MHJ to destroy them like this.

      Those girls support their "mother" and think exactly the same as her. Recently in a kpop concert they even ignored Illit. Stop thinking they are victims when they are just as bad as her for watching how their "mother" almost ruined the career of other groups and not doing anything to stop it. We should all stop supporting all these ugly people and start supporting the groups that are the real victims here: Illit, Le Sserafim and BTS in a way.

    I think HYBE should always monitor every song that NJ ADOR releases because whatever they do is the result of plagiarism if they don't want to always spend money on plagiarism that ADOR does, and MHJ is so clever in pointing out the problem when JIMIN's album is published

      After this situation if I were Hybe I would be doing my own separate checks from now on thoroughly on each labels music from now on. It's sad that others will have to suffer being under such a rigorous checking process to protect the parent company because one awful person that oversaw one of the labels.
