Meanwhile, almost everywhere else in the world the rule that is followed is called "costs follow the event" which means that the losing party will also pay the winners legal fees. That drastically reduces the amount of frivolous lawsuits like these because it's a huge risk.
Fabricating charges like this should be a felony

These days, cops smell an odor of alcohol 15 feet away immediately after a split second of encountering the person. They’re like X-Men. 😂

Even if you _have_ been drinking, play it cool, repeat the phrase, and don't submit to field tests. Eventually, they may try to detain you. They might bring you to the station and make you wait, but that's a _good thing_ bc it gives you time to get more sober. 3hrs later when they're testing you at the station, you're clean and they have to let you go.
But usually, if you're this kid's situation, cops are just being bullies & trying to trick you bc they think you don't know your rights!!

Innocent until proven guilty is a fantasy. It only exists when you are on your private property and heavily armed so nobody will take a chance arresting you until after a court has issued a judgement against you.

Until their precious Qualified Immunity gets revoked that would force them to get malpractice insurance (like doctors and other professions), there will be no change or accountability. This happened to me when I came home late one night after visiting my family out of town on a holiday. I even joked that "I understand on a holiday night there a plenty of people driving around drunk". The officer still insisted on giving me sobriety test and kept telling me I had failed it. When I don't drink. EVER. He even asked my I was shivering when it was obviously very cold and I wasn't wearing a jacket.
Eventually he called two or three other patrol cars to stop by and they all questioned me. I was eventually let go, but I was less then a block from home and had committed no traffic violation. The cop just felt like pulling me over and did.
This is what cops do when they are bored.
Happened to me driving home late from work and they said I went over a "line" when I turned and I must have been drinking. I said I wasn't, that I had been at work. They said my car was registered to my dad who was an alcoholic, so they had to check. I said, do I look like Mike? Was I swerving? Or was it just the line ? They fumbled around and said well ide like to do a sobriety test and I asked on what grounds and they said the line and I said ide be happy to call such and such judge in the area ( I knew from my dad's trial) to confirm I was being treated fairly or if I was just being pushed around to drive up to tickets by a cop who was low on a ticket quota. He glared , said to stay in the lines and go. Proceeded to get pulled over in my college town ever week because of my car, because it was in my dad's name " just to check until I called the police department to say I was concerned the police were harassing me and pulling me over with no real justification.

Cause I’ve seen tons of police body cam videos and resisting arrest (let alone assaulting an officer) is the charge that never gets dropped. Ever.
It's very spykful and polite and patient. And you could definitely tell the kid wasn't high on anything or drunk. He was just too clean and they wanted him for something. I didn't want him to outsmart them.

The courts have agreed to hear a defamation claim by the officers against their victim. The judge dismissed many portions of the suit but is hearing the claim that the boy defamed the officer by insinuating he was convicted for beating his girlfriend when in fact he had merely been given a restraining order. I don’t know what they expect a jury to do with that other than spit at the officer.
False imprisonment is still a major issue that doesn't get enough attention. This is one of many cases.
The kid was super respectful and obedient. He passed EVERY SINGLE TEST. The officer still arrested him and accused him. Just watch the video, you'll be blown away

He had decided he was drunk the second he pulled him over. Even went so far to say he slurred his words when that never happen and the kid consistently spoke clearer than the officer. Cops deciding people are guilty and working backwards to find evidence to support their assumptionis a massive problem with police. When this cop couldn't find evidence, he just made shit up, and this is not a unique situation.

They claimed he failed because he misheard how many steps to take. If I remember correctly, the officer also initially claimed to have smelled the overwhelming smell of Alcohol coming from the vehicle (PC for the Sobriety Test in the first place), but there was no alcohol. Cop either straight up lied or his brain is fried smelling stuff that isn't there.

If you get a cop claiming to smell alcholol or weed and you know you don't have it, he's a liar and you should not do any of these tests except the chemical ones the state may require. No state requires the physical FSTs, that's a myth. The worst some states allow is for refusal to be used as evidence in court, but CA decent lawyer can argue that away.

Always refuse the field test , its not to prove your not intoxicated its to gather more evidence against you, whether you take the test or not your going to a jail cell that night , the field test will only be used against you in court. The only breath test that counts for you in court is the one at the station.

I hope this kid gets a hefty settlement and a public apology. I saw this video and cops were out of line. I heard they were suing him. It's pretty telling that other civilized countries don't do the roadside humiliation circus at all. Breathalyzer and if drugs are suspected a quick-test mouth swab.
I mean ive been put through a field sobriety test and passed it. They made me cuz they smelled my vape in the car when they pulled me and thought it might be alcohol on my breath. Let me go no issues when i did the check and passed it. Its just a matter of if the cop wants to mess with you and if they do refusing to do a field sobriety test is NOT gonna help you. It gives them MORE reasonable suspicion to pull search warrants for your car or escalate it however they choose.

In some states refusing to take sobriety tests is actually viewed as an admission of guilt, so it’s so stupid bcz there no way out. They should just take what the breathalyzer says bcz that’s not subjective

Defamation is Damaging the reputation of someone by liable or slander. He is only showing what they actually did. So they just gave him a case that is won by showing the evidence that he already has online. He can of course counter sue that defamation claim for costs and emotional damages. Which should net him another good payout... Do these 2 cops just want to dig themselves another bigger hole to jump in ?

I hate to see shit like this and yes there are some cops who do shit like this. At the same time there are cops that go above and beyond who do good work that don’t deserve to have their personal lives threatened every time they do their jobs.
Look at the soros sponsored DA who don’t do their jobs and allow crazy acts to go unpunished. We don’t need groups suing cops for no reason in an effort to influence them.

Qualified immunity is only applied to cases where there is probable cause for the arrest and the officer correctly places the suspect under arrest.

This same thing happened to a friend of mine. He wasn't inebriated, he has MS, but even though he disclosed that to the cops they still took him in for the night
i saw that video- he did really well. He didn't challenge the officers or give them any reason to add charges, he just complied with instructions, said why he wasn't impaired., and asked for a breathalyzer. Now he has a great case for a lawsuit and the support of millions.

That's the precise issue here. They're looking for issues over a trivial thing I see many drivers do. And all the taxes that go to their equipment and vehicles and services that support their endeavours... What a waste of resources to spend on harassing a guy when there are reckless drivers, traffickers, abusers, murderers, thieves, and coordinated crime rings to stamp out? If he were more suspect, then I'd understand, but he was as cooperative as you can be and the pigs still treated him like they expected him to be guilty.

This happened in Aug of 22. In Feb 23 he sued.
The cops countersued for defamation. most of their case (whining about the bodycam footage being uploaded to the internet being an invasion of their privacy) was dismissed.
The parts that weren't, were accusations that officer Winters was guilty of DV. (if he has proof, it's not defamation and he'll win that one.)
If only the mayor, city administrator, and chief of police didn't cover for power tripping cops arresting a guy because he wasn't using drugs . . . .This wouldn't have gone this far.
When I got my DUI 14 years ago, my lawyer was an ex state trooper and he told me that those field sobriety tests are designed to make you fail. Even if you're sober, there is a high chance you will mess up. When they make you do the line walk, the trick is to listen to every detail he is saying on how to walk the line. Most people think as long as they walk straight they will be fine, but in reality most people fail by not putting your heel right against your toe. Most people leave a inch or two gap between the feet and fail. The lawyer said to always decline the field tests, agree only to breathalyzer

My school did D.A.R.E when I was in 5th grade. The officer actually accused one of my classmates of being drunk at school. My classmate volunteered to try the test in front of the class. The kid had a break down and that was the second to last straw for the program at our school. Cherry on top I went to a private Christian school.

Edit: They don’t need a warrant for breathalyzers! But they do for blood tests for drugs. Yes, you consent automatically to a breathalyzer when you get your license, but they can’t use force to do the tests without a warrant (which they can get pretty quickly over the computer in the car) If you know you’re not drunk, take it but you can refuse to take the breathalyzer and they can’t force you, so they’ll get a warrant and take you to the station for a blood test.

Saw the bodycam for this. Cops were rude af and this dude was just so chill. They immediately assumed he was drunk driving, and even when he blew a ZERO, they still arrested him for a DUI
To be fair I'm glad to see that anyone has ever been pulled over for driving with brights on as someone who is visually impaired already it is just as dangerous as driving drunk. I didn't see the video so they may have gone too far but dashes have indicators to show when bright lights are on and intoxication or lack of driving experience/license is the only excuse to not notice that.

He doesn't belong on the road with such little driving knowledge or such impairment even if it isn't evident it can still kill innocents(which he is not, guilty of high beams should be more points off a license than speeding)

Also people who have a harder time seeing at night may need high beams to see. I understand it can be dangerous for other drivers, but we also don't know if he turned them off when passing other drivers, it should not be points on a license and there was no reason he should have been arrested

A buddy of mine is a cop who used to be on a DUI unit and explained all of the indicators of “intoxication”. Literally half of the people in this country would fail some of those tests dead sober and most of them are pretty subjective.

Keep in mind that the officer’s supervisor was at the scene and allowed the false arrest to happen. The kid passed all the tests at night in the rain. The cop was mad the kid was playing college ball and he never made it.

A relative of mine switched from being criminal lawyer to divorce after 2 decades. He always said American justice system was corrupt and inept, there was a case where his client was a victim of brutal police beating 2 decades ago. But word of that cop and his buddies put the victim away in jail. That cop had to retire because of another incident(instead of going to prison) and karma came for him as he ate his gun soon after retirement.

@@autumnwillows7942I think it depends on the state, I’ve seen some where if you refuse to do field sobriety tests, they take you to the station to do a blood test (maybe they don’t have breathalyzers?) if you refuse to take a breathalyzer, I can see why they’d want to take you to the station (again, probably to do a blood test). So I think even the smaller details about the laws differ from state to state. And absolutely it is fucking stupid to take somebody back to the station after a breathalyzer showed 0 alcohol, even if it was pot, they had nothing showing that he smoked pot or had any in his possession.
