Meanwhile, almost everywhere else in the world the rule that is followed is called "costs follow the event" which means that the losing party will also pay the winners legal fees. That drastically reduces the amount of frivolous lawsuits like these because it's a huge risk.

The idea is that they can detain you if they suspect you of a crime so you can’t keep committing it while they obtain proof. This is frequently abused though

If you're not being detained for a legal reason, they have to let you go. They claimed he failed because he misheard how many steps to take. If I remember correctly, the officer also initially claimed to have smelled the overwhelming smell of Alcohol coming from the vehicle (PC for the Sobriety Test in the first place), but there was no alcohol. Cop either straight up lied or his brain is fried smelling stuff that isn't there.

If you get a cop claiming to smell alcholol or weed and you know you don't have it, he's a liar and you should not do any of these tests except the chemical ones the state may require. No state requires the physical FSTs, that's a myth. The worst some states allow is for refusal to be used as evidence in court, but CA decent lawyer can argue that away.
Capitalism and politicians got us into this mess and I bet capitalism could get us out if we set up a business that competes with police forces. The company will make most of its profits from having lawyers sue corrupt cops, holding their own employees accountable when they go too far, and bodycam livestreams with either in the COPS show style or VTuber reaction commentary. In some areas the company wasn’t successful or the police stop getting funded or they’re both still around either working together or SPY VS SPY.

That's why you NEVER consent to a test by an officer. They can't legally force you. All the police are looking for is something to confirm their suspicion, they don't really care about the evidence

The problem is that many of the cops get really mad for any reason whatsoever. The moment they put the badge on, their ego starts to inflate and they think that "they are the law" so they can do anything they want.
Same thing happened to my daughter. They pulled her over in alittle hick town she was driving through to get home. Accused her of DWI. She doesn't drink. They arrested her. She blew 0 on the breathalyzer & nothing found on blood test either. She was jailed all weekend and it cost $3000 for a bondsman to get her out. They STILL tried to charge her with DWI even with no evidence. Finally the judge dismissed it but she was still out the $3000 & 2 days jailed for doing nothing wrong.
I thought the whole idea of Posting Bond is that you only lose it if you don't turn up to the court date. Turn up to court, get the Bond back. That's the whole point of posting bond...

When I got my DUI 14 years ago, my lawyer was an ex state trooper and he told me that those field sobriety tests are designed to make you fail. Even if you're sober, there is a high chance you will mess up. When they make you do the line walk, the trick is to listen to every detail he is saying on how to walk the line. Most people think as long as they walk straight they will be fine, but in reality most people fail by not putting your heel right against your toe. Most people leave a inch or two gap between the feet and fail. The lawyer said to always decline the field tests, agree only to breathalyzer

My school did D.A.R.E when I was in 5th grade. The officer actually accused one of my classmates of being drunk at school. My classmate volunteered to try the test in front of the class. The kid had a break down and that was the second to last straw for the program at our school. Cherry on top I went to a private Christian school.

I mean ive been put through a field sobriety test and passed it. They made me cuz they smelled my vape in the car when they pulled me and thought it might be alcohol on my breath. Let me go no issues when i did the check and passed it. Its just a matter of if the cop wants to mess with you and if they do refusing to do a field sobriety test is NOT gonna help you. It gives them MORE reasonable suspicion to pull search warrants for your car or escalate it however they choose.

In some states refusing to take sobriety tests is actually viewed as an admission of guilt, so it’s so stupid bcz there no way out. They should just take what the breathalyzer says bcz that’s not subjective

Saw the bodycam for this. Cops were rude af and this dude was just so chill. They immediately assumed he was drunk driving, and even when he blew a ZERO, they still arrested him for a DUI
To be fair I'm glad to see that anyone has ever been pulled over for driving with brights on as someone who is visually impaired already it is just as dangerous as driving drunk. I didn't see the video so they may have gone too far but dashes have indicators to show when bright lights are on and intoxication or lack of driving experience/license is the only excuse to not notice that.

He doesn't belong on the road with such little driving knowledge or such impairment even if it isn't evident it can still kill innocents(which he is not, guilty of high beams should be more points off a license than speeding)

Also people who have a harder time seeing at night may need high beams to see. I understand it can be dangerous for other drivers, but we also don't know if he turned them off when passing other drivers, it should not be points on a license and there was no reason he should have been arrested

never do a field sobriety test. they are subjective. the results can be whatever the officer imagines. The only test that is required by law is the breath test.
i saw that video- he did really well. He didn't challenge the officers or give them any reason to add charges, he just complied with instructions, said why he wasn't impaired., and asked for a breathalyzer. Now he has a great case for a lawsuit and the support of millions.
the issue is the cops get no punishment besides some bad press while us the tax payers get stuck with the bill, i think he should take them to court to get an investigation done and of course a payday for damage's

The cops countersued for defamation. most of their case (whining about the bodycam footage being uploaded to the internet being an invasion of their privacy) was dismissed. The parts that weren't, were accusations that officer Winters was guilty of DV. (if he has proof, it's not defamation and he'll win that one.) If only the mayor, city administrator, and chief of police didn't cover for power tripping cops arresting a guy because he wasn't using drugs . . . .This wouldn't have gone this far.

They don't have blanket immunity, but the evidence bar for hitting them with something like wrongful arrest is not terribly low. This is still important to protect good cops whom thugs try to go after, which is statistically far more likely than a cop doing this nonsense

These cops need to be fired and prosecuted. They abused their authority with there profession. They also wrongly accused and arrested this young man for no unforeseen reason. All their cases need to be investigated because who knows how many times they have actually done this to others. They were just too comfortable doing this.
They probably find nothing wrong with their officers and it most likely won't get that far. If they do get investigated, they'll probably not find anything wrong with their actions and it was in line with department policy. Keep in mind that the officer’s supervisor was at the scene and allowed the false arrest to happen. The kid passed all the tests at night in the rain. The cop was mad the kid was playing college ball and he never made it.
I live in the same county. Cops out here don’t really like to follow the rules and I’ve been told by my friend that’s a cop that the older dudes on the force started quitting, as soon as they were required to wear a body cam, because “back in the old days, you could hit a guy a few times and send them on their way, instead of arresting them.” That’s verbatim what a lieutenant told him. They don’t want to be better, they just don’t want to be caught.
A buddy of mine is a cop who used to be on a DUI unit and explained all of the indicators of “intoxication”. Literally half of the people in this country would fail some of those tests dead sober and most of them are pretty subjective.

Until their precious Qualified Immunity gets revoked that would force them to get malpractice insurance (like doctors and other professions), there will be no change or accountability. This happened to me when I came home late one night after visiting my family out of town on a holiday. I even joked that "I understand on a holiday night there a plenty of people driving around drunk". The officer still insisted on giving me sobriety test and kept telling me I had failed it. When I don't drink. EVER. He even asked my I was shivering when it was obviously very cold and I wasn't wearing a jacket. Eventually he called two or three other patrol cars to stop by and they all questioned me. I was eventually let go, but I was less then a block from home and had committed no traffic violation. The cop just felt like pulling me over and did. This is what cops do when they are bored.
Happened to me driving home late from work and they said I went over a "line" when I turned and I must have been drinking. I said I wasn't, that I had been at work. They said my car was registered to my dad who was an alcoholic, so they had to check. I said, do I look like Mike? Was I swerving? Or was it just the line ? They fumbled around and said well ide like to do a sobriety test and I asked on what grounds and they said the line and I said ide be happy to call such and such judge in the area ( I knew from my dad's trial) to confirm I was being treated fairly or if I was just being pushed around to drive up to tickets by a cop who was low on a ticket quota. He glared , said to stay in the lines and go. Proceeded to get pulled over in my college town ever week because of my car, because it was in my dad's name " just to check until I called the police department to say I was concerned the police were harassing me and pulling me over with no real justification.

QI is not the issue, QI when not used properly is the issue. QI should not apply for what the cops did to this kid. (I'm not sure it did) Also when they get rid of QI (a few states and cities have) they create a new worse version of QI and call it something else. Defamation is Damaging the reputation of someone by liable or slander. He is only showing what they actually did. So they just gave him a case that is won by showing the evidence that he already has online. He can of course counter sue that defamation claim for costs and emotional damages. You can refuse a field sobriety test. Ask for breathalyzer or blood test. Even sober people can fail field sobriety tests. If you fail it's a DUI. Officer can interpret and administer test in such a way to make you fail just as a flex.
Happened to me earlier this year and the department “has no body cam footage on file” even though the cops written report says he turned it on right away

That lawsuit is actually a violation of his first amendment right. He's allowed to video ALL police encounters and post it. Them suing is them trying to silence him, which since it's a law enforcement agency, it's government censorship, which is unconstitutional.

@@autumnwillows7942I think it depends on the state, I’ve seen some where if you refuse to do field sobriety tests, they take you to the station to do a blood test (maybe they don’t have breathalyzers?) if you refuse to take a breathalyzer, I can see why they’d want to take you to the station (again, probably to do a blood test). So I think even the smaller details about the laws differ from state to state. And absolutely it is fucking stupid to take somebody back to the station after a breathalyzer showed 0 alcohol, even if it was pot, they had nothing showing that he smoked pot or had any in his possession.

I had something similar happen to me when I was 19. Pulled over. My eyes were red because I wasn't getting any sleep from previous days. So then the cop says " I smell marijuana" To which I said, "You need to get your nose checked, no one smokes in this car." They are always looking for ways to harass citizens.
This is so important to do when they claim the smell of alcohol or marijuana is to verbally object. If you do not verbally object and in court, they can try to claim that since you didn't object verbally that you are basically accepting that the officer is correct. Don't incriminate yourself but do dispute any assumptions that are being made that are flat out false.

Even if you _have_ been drinking, play it cool, repeat the phrase, and don't submit to field tests. Eventually, they may try to detain you. They might bring you to the station and make you wait, but that's a _good thing_ bc it gives you time to get more sober. 3hrs later when they're testing you at the station, you're clean and they have to let you go.

They claimed he failed because he misheard how many steps to take. If I remember correctly, the officer also initially claimed to have smelled the overwhelming smell of Alcohol coming from the vehicle (PC for the Sobriety Test in the first place), but there was no alcohol. Cop either straight up lied or his brain is fried smelling stuff that isn't there.

Same thing happened to my daughter. They pulled her over in alittle hick town she was driving through to get home. Accused her of DWI. She doesn't drink. They arrested her. She blew 0 on the breathalyzer & nothing found on blood test either. She was jailed all weekend and it cost $3000 for a bondsman to get her out. They STILL tried to charge her with DWI even with no evidence. Finally the judge dismissed it but she was still out the $3000 & 2 days jailed for doing nothing wrong.
You should sue them in civil court to recoup the costs. No lawyer needed.

When I got my DUI 14 years ago, my lawyer was an ex state trooper and he told me that those field sobriety tests are designed to make you fail. Even if you're sober, there is a high chance you will mess up. When they make you do the line walk, the trick is to listen to every detail he is saying on how to walk the line. Most people think as long as they walk straight they will be fine, but in reality most people fail by not putting your heel right against your toe. Most people leave a inch or two gap between the feet and fail. The lawyer said to always decline the field tests, agree only to breathalyzer

My school did D.A.R.E when I was in 5th grade. The officer actually accused one of my classmates of being drunk at school. My classmate volunteered to try the test in front of the class. The kid had a break down and that was the second to last straw for the program at our school. Cherry on top I went to a private Christian school.

Edit: They don’t need a warrant for breathalyzers! But they do for blood tests for drugs. Yes, you consent automatically to a breathalyzer when you get your license, but they can’t use force to do the tests without a warrant (which they can get pretty quickly over the computer in the car) If you know you’re not drunk, take it but you can refuse to take the breathalyzer and they can’t force you, so they’ll get a warrant and take you to the station for a blood test.

I mean ive been put through a field sobriety test and passed it. They made me cuz they smelled my vape in the car when they pulled me and thought it might be alcohol on my breath. Let me go no issues when i did the check and passed it. Its just a matter of if the cop wants to mess with you and if they do refusing to do a field sobriety test is NOT gonna help you. It gives them MORE reasonable suspicion to pull search warrants for your car or escalate it however they choose.

To be fair I'm glad to see that anyone has ever been pulled over for driving with brights on as someone who is visually impaired already it is just as dangerous as driving drunk. I didn't see the video so they may have gone too far but dashes have indicators to show when bright lights are on and intoxication or lack of driving experience/license is the only excuse to not notice that.

Also people who have a harder time seeing at night may need high beams to see. I understand it can be dangerous for other drivers, but we also don't know if he turned them off when passing other drivers, it should not be points on a license and there was no reason he should have been arrested

i saw that video- he did really well. He didn't challenge the officers or give them any reason to add charges, he just complied with instructions, said why he wasn't impaired., and asked for a breathalyzer. Now he has a great case for a lawsuit and the support of millions.

The cops countersued for defamation. most of their case (whining about the bodycam footage being uploaded to the internet being an invasion of their privacy) was dismissed.

All their cases need to be investigated because who knows how many times they have actually done this to others. They were just too comfortable doing this.
They probably find nothing wrong with their officers and it most likely won't get that far. If they do get investigated, they'll probably not find anything wrong with their actions and it was in line with department policy. If they do get fired, they'll switch to a different department or they will quietly resign and switch to a different department

Cops out here don’t really like to follow the rules and I’ve been told by my friend that’s a cop that the older dudes on the force started quitting, as soon as they were required to wear a body cam, because “back in the old days, you could hit a guy a few times and send them on their way, instead of arresting them.” That’s verbatim what a lieutenant told him. They don’t want to be better, they just don’t want to be caught.
A buddy of mine is a cop who used to be on a DUI unit and explained all of the indicators of “intoxication”. Literally half of the people in this country would fail some of those tests dead sober and most of them are pretty subjective.
There needs to be consequences for this abuse of authority!

This happened to me when I came home late one night after visiting my family out of town on a holiday. I even joked that "I understand on a holiday night there a plenty of people driving around drunk". The officer still insisted on giving me sobriety test and kept telling me I had failed it. When I don't drink. EVER. He even asked my I was shivering when it was obviously very cold and I wasn't wearing a jacket.
Eventually he called two or three other patrol cars to stop by and they all questioned me. I was eventually let go, but I was less then a block from home and had committed no traffic violation. The cop just felt like pulling me over and did.
This is what cops do when they are bored.
Happened to me driving home late from work and they said I went over a "line" when I turned and I must have been drinking. I said I wasn't, that I had been at work. They said my car was registered to my dad who was an alcoholic, so they had to check. I said, do I look like Mike? Was I swerving? Or was it just the line ? They fumbled around and said well ide like to do a sobriety test and I asked on what grounds and they said the line and I said ide be happy to call such and such judge in the area ( I knew from my dad's trial) to confirm I was being treated fairly or if I was just being pushed around to drive up to tickets by a cop who was low on a ticket quota. He glared , said to stay in the lines and go. Proceeded to get pulled over in my college town ever week because of my car, because it was in my dad's name " just to check until I called the police department to say I was concerned the police were harassing me and pulling me over with no real justification.

A lot of departments will send officers to become certified phlebotomists to be allowed to directly take blood at the department vs bringing into a hospital

Qualified immunity is only applied to cases where there is probable cause for the arrest and the officer correctly places the suspect under arrest.

You can refuse a field sobriety test. Ask for breathalyzer or blood test. Even sober people can fail field sobriety tests. If you fail it's a DUI. Officer can interpret and administer test in such a way to make you fail just as a flex.

That lawsuit is actually a violation of his first amendment right. He's allowed to video ALL police encounters and post it. Them suing is them trying to silence him, which since it's a law enforcement agency, it's government censorship, which is unconstitutional.

Seriously. I was concussed after an accident with terrible balance (as well as eye teaming), and still struggle with it. I’m cleared to drive but would not be able to pass a field sobriety test. I don’t drink or do drugs.

Being a cop should come with larger risk. You’re enforcing the law, if you are found breaking/abusing it you should be charged 10x more than a civilian as you are abusing the system vs protecting it. I’m talking solitary cells for them. Being a cop means you should be trusted to serve the community, not abuse it.

@@autumnwillows7942I think it depends on the state, I’ve seen some where if you refuse to do field sobriety tests, they take you to the station to do a blood test (maybe they don’t have breathalyzers?) if you refuse to take a breathalyzer, I can see why they’d want to take you to the station (again, probably to do a blood test). So I think even the smaller details about the laws differ from state to state. And absolutely it is fucking stupid to take somebody back to the station after a breathalyzer showed 0 alcohol, even if it was pot, they had nothing showing that he smoked pot or had any in his possession.
@@autumnwillows7942 you won’t get in trouble for refusing a field test. You can however for refusing the breathalyzer or chemical test. You have the right to refuse the field tests but not the chemical ones because when you get your license you sign a thing saying you’re willing to take them

I had something similar happen to me when I was 19. Pulled over. My eyes were red because I wasn't getting any sleep from previous days. So then the cop says " I smell marijuana" To which I said, "You need to get your nose checked, no one smokes in this car." They are always looking for ways to harass citizens.
This is so important to do when they claim the smell of alcohol or marijuana is to verbally object. If you do not verbally object and in court, they can try to claim that since you didn't object verbally that you are basically accepting that the officer is correct. Don't incriminate yourself but do dispute any assumptions that are being made that are flat out false.

Okay mom. Missed the point entirely. I was 19 then and seems like you are dismissing the officers actions. I wasn't swerving or driving recklessly. I got pulled over for not having working taillights THEN he saw my eyes were red and ASSUMED I was under the influence. So clearly, he was mistaken and I explained what my situation was and STILL HE accused me of smoking and was still was given a field sobriety test with a breathalyzer test. If you are the type that likes wasting your time with nonsense and getting harassed all the time by law enforcement then by all means, be my guest. That's how people get shot by "mistake". By making fake assumptions and accusations like: "HE'S got a WEAPON!" only to find out later that the child was really only carrying the remote control to his TV and now he's dead. You shouldn't lead with that mentality as a law enforcement.

They think they can handle it. But sleep deprivation messes with your brain the same way alcohol or drugs does.
