Just because the cuffs come off, doesn't mean they were lawfully put on. I agree, this happens all too often and we don't hear much about it.

The only way to really tackle this is to make it hurt the shareholders and board directors bonuses financially, and no govt so far - or labour will enforce this.

      Companies are already liable for those things and if they are in the business of manufacturing have to work to standards set and audited by the International Standards Organisation, ISO .One of those standards is all the aspects of the environment . If they do not keep those standards they can be fined and lose business from other companies in the supply chain that do adhere to those standards . A company that I worked for as part of internal audits , that also had to be carried out , had to make appointments with recycling companies to be able to follow those company vehicles back to their depots to ensure items were being processed correctly . This company here might be quite small and as yet has not had any pressure put on it to meet environmental standards . In this case it is just a basic case of bad housekeeping and loss of control of materials , which are also audited by ISO . Your comment is not naive as the majority of reputable companies have been working that way for years already and absorbing the costs .

    It's like living in North Korea. Authorities, citizens and jobsworth don't like cameras and drones, and that's because they capture reality, bad behaviour and law-breaking. We might have a freedom-based society with a legal framework, but against current standards of policing and recruiting we don't stand a chance. The law is quite clear on public photography as Daniel says. Unfortunately, police, security staff and interfering busybodies with no jurisdiction whatsoever, don't know the law or they flout the law and make things up.

      @tonyb1223 2 месяца назад +2

      Except its not as easy as you think.
      If you think those jobsworths don't like cameras, just think of how it affects us photographers when people like auditors go around quoting laws that have nothing to do with photography, forcefully remove others rights by filming through windows, trespassing on peoples property, causing a nuisance, flying drones low and looking through windows with them?
      Just to give you an idea, that is more like North Korea as your rights are being abused but you don't even see it. Please read below, its the part of article 10 that no one reads but is the most important when expressing a freedom (note the duties and responsibilities part, that means the person expressing that freedom is responsible for what they do, so why do auditors always refuse to take responsibility for their actions?)
      The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.

      Airspace, you have a right to privacy and you can trespass with the drone if its too low, this can lead to the operator/pilot being stopped or even arrested.

      That's not completely true. AFAIK, airspace is divided into the higher and lower stratum. Depending on the location, the lower stratum is usually 500-1000ft above ground level and can legally be controlled by the land owner beneath it; it's the upper stratum that is under CAA control. Drone operators are limited by law to a maximum altitude of 400 feet, so a land / property / building owner can legally insist that you do not shoot aerial footage of their land / property / building.

Specifically, if a building or part thereof appeared in a photograph then that would violate the copyright of the architect of the building.

    • @cstrip976
      @cstrip976 2 месяца назад +1

      It was naughtly of them to tell you that. Buildings are protected by copyright under English law but there is a specific exception under section 62 of the Copyright, Designs and Patents Act 1988 which permits you to take a photograph or film of a building without infringing its copyright.

    • @StephenBoothUK
      @StephenBoothUK 2 месяца назад

      @@cstrip976 I normally went with right of panorama (article 93) as I wasn’t taking a photograph of the building, it just happened to be in the background of the image behind who or what I was photographing. Part of the issue was that this was the early 2000s and if the police were called the conversation stopped being about copyright and turned into one about preparation and planning for a terrorist attack, when really it was probably mostly about them wanting to exert control.

    There should be a law which allows a person to choose whether they go on the internet or not. It’s not about whether they’re filmed, or upset by an auditors comment, it’s about how and where it is distributed afterwards. Yes, abuse, shock, be rude to them, ridicule them reduce them to tears, make them frightened, but don’t then put it on your you tube channel so that all your flying monkeys can add more abusive comments towards the person. Surely this is unacceptable human behaviour? Isn’t that inciting hatred? Reality TV contestants chose to perform in front of tens of thousands of people, they don’t have it forced upon them, when they’re a quiet person who just wants a quiet peaceful life. A security guard has an obligation to speak to a stranger on the premises. It doesn’t say on their job description that they should expect to appear on a you tube channel of an auditor which can be viewed by the world, just for carrying out their job description. Perhaps that’s something that will happen in the future. I suppose when it becomes hard to get security job vacancies filled, ( because becoming an infamous you tube star is on the job description) and people don’t join the police because they don’t want to be ridiculed on the internet, maybe something will happen. Life is such, that a fair percentage of employees encountered by an auditor will have at least one serious problem in their life, they may have cancer or dealing with bereavement, or a child might be ill, or their dog might living out its last days. . This is another reason why you don’t then plaster them all over the internet for ridicule, it just isn’t fair play or decent. As an auditor you can’t assume that the person you’re victimising doesn’t have a serious problem in life. If it was only rude behaviour which was ridiculed and abused in the comments then you might have an argument, but it isn’t. Some people now, behave wonderfully, but they still get abuse in the comments section. ( i.e. the two Karen’s in the DJE recent video) Meantime we have to rely on a persons moral focus, human empathy, and hope they care about their fellow human being sufficiently, to know what is morally right and wrong, especially when you have the ability to”expose” the average person to the world on your you tube channel. It is a great power, and with it, comes great moral responsibility.

There's one by a Scottish auditor where he asks a security guard in Morrisons where the blind spots are, whilst looking at the security screens. A confused exchange with the security guard ensues, who understandably assumes the guy is up to no good. The auditor then leaves the store and comes back in holding a cane and pretends that he was asking about changes to the store that affect blind people. He demands the manages come over to teach the security guard a lesson and potentially sack him. I can't see why current laws should protect those actions.

      I tend to agree, I am sure the vast majority of drone uses do it legally and for either personal videos or other reasonable reasons, however as with most things there is a rogue element that will go out to deliberately annoy people or violate there privacy. We had several instances in the village I lived in last year where a drone was being flown between houses (mostly bungalows) at a height that easily looked into windows and several pictures were taken of it hovering outside rear windows, it also did low passes over peoples heads, eventually it hit a rotary washing line (which shows what height it was at) and crashed. Pictures of it were posted in a mangled state, apparently the households dog used it as a toy, no one ever came forward to try and claim it back. To the best of my knowledge this sort of use is already illegal in the UK, (feel free to correct me or give details of existing laws) but I believe you are right that complaints will lead to tighter laws even through the laws are only like to be followed by and impact the responsible users and ignored by those who are currently breaking the laws anyway. The UK has a history of passing reactive "knee jerk" laws to implement controls after "incidents" that were already covered by existing laws so as to be seen to do something for political ends, they are rarely well thought out.
      Some industries it could reasonable argued that the workers should have a reasonable right to privacy, police is an obvious one for all sorts of reasons, but also meat processing or other sometimes controversial industries where workers could face abuse or be at risk of targeted attack from extremists for working legally, even places of worship could be considered to have a reasonable expect for privacy, during funerals comes to mind.

I've seen many times the same truck leaving and then returning shortly later and reverse into the processing building to drop off a full load. I can't be certain because you can't really see in there when the truck is backed up, but I'm sure it's the same load they left with! Sometimes they are just blatant and empty two different bins into this building where it's piled up like a mountain, all mixed. Maybe that's how it all gets processed? I don't know, but why mix the bin contents after everyone has been made to put their rubbish in the correct bins? Am I on to something?

    Many times auditors will record people coming and going from a site. One guy was deliberately standing at an entrance to a site and was putting the camera right up against car windows to see in. This can be considered alarming. So when they are approached they DELBERATELY act in a dismissive or whatever manner KNOWING that what they are doing will cause a negative response.
    Their sole point is to act in a way that will cause the negativity, the response they want.
    In this case mentioned it just happened that there WAS a genuine journalistic worthy issue... But more often than not these channels don't actually want that. They want the negativity.
    So... My question is this... Do I have the right to stop someone making money from their recording my reasonable confrontation with the auditor?
    The auditor who is acting in a manner that could well cause alarm.

      Yes, many auditors do seek confrontations, but each case has to be judged on its own merits. The one breaking the law would be whichever one used threatening and abusive language etc, whether the auditor or the person being filmed. Some auditors are just annoying but not breaking any laws. How you respond is your own responsibility.

      @@jonfrance7201 That's the thing though. So many of them skirt just on the edge... They are annoying and POTENTIALLY dangerous...
      Especially when they are live streaming and start looking in peoples cars.
      You could think that they are casing for someone else to steal later.
      Like marking jackets of people at cash machines.
      One person marks it and another robs them later.

      The point is, none of that stuff can be proven, you are talking about people's intentions and thoughts and people 'knowing that what they are doing is going to cause concern'.. the fact is what they are doing is legal, standing in a building entrance site is legal, pointing a camera through a car window is legal - these are the facts. If people take offence to that that's their problem.

      @@cstrip976 Of course you can know what their intentions are.
      Just watch their streams and videos.
      Listen to what they talk about.
      They know, we know and you know what is going on.
      Don't piss on my leg and tell me it's raining.
      They are taking things RIGHT TO THE EDGE to get a response.
      They KNOW they will get a response.
      THEY WANT THAT RESPONSE.
      They monetise because of that response.
      PEOPLE GO TO THEIR CHANNEL TO SEE THAT RESPONSE KNOWING IT WILL HAPPEN.

      @Kalamain I agree, but so what? For the same reason the police are toothless in this matter and any barrister will tell you, filming is a perfectly LEGAL activity. It's no different to people being offended and wound up by someone eating an ice cream outside their premises. That too is a legal activity

    Face covered individuals...some shameful and cruel work in the name of citizen journalism.....they like easy targets in which to inflict their brand of pain and suffering with people being harassed and intimidated in their workplace.. then the auditor's create their own privacy with a face covering... ..thanks for your expertise...
