The Codex specifices that a Chapter doesn't have a recruitment limit while in the middle of a crusade, and since the Black Templars are ALWAYS in a crusade, they are technically not violating any Codex Astartes rule !
To be fair, he did *try* to kill Sonic and his friends for years.
But due to his incompetence, he allowed these Xenos to taint mankind’s birth right for far too long. That, along with his overzealous love for technology leading him to tech heresy, is why the Astarte executed him.
