    I have always wondered why Tommy was not questioned during the first trial? I do believe Michael is guilty, guilty of something!? I'm not 100 % convinced that he acted alone. It is my opinion that others in that house helped cover up the murder if not more. Tommy knows more, in my opinion and probably others.

      Did Tommy ever get on the stand? I believe Tommy and Michael both had a hand in it. Martha wrote in her diary that she only liked Michael as a friend. Michael felt rejected and his temper plus drugs and alcohol took over and he went into a violent rage. Rip for Martha. Justice for Martha. Michael did it not a doubt in my mind.

      I think he drank all night. Michael did the night of the murder. Tommy as well. I think someone else knows who killed Martha. Not talking. Does anyone know who owns the skakel house now?

      @@shannamoxley1040 I'm so sorry for your loss and for the suffering your family has had to endure as a result of what is literally a miscarriage of justice. I was 15 at the time your cousin was murdered and was living just outside of Washington, DC. I went to a private school too, Catholic, that was attended by a lot of kids who came from uber wealthy, politically influential families aligned with the democratic party (I, on the other hand, came from a middle-income family with a father who was a career naval aviator, so you can imagine how well received I was by that supercilious lot of smug elitists). Most of those kids, though by no means all, were cut from the same cloth as the Skakels: rich and entitled, they thought they owned the world and could do whatever they wanted, whenever they wanted, with immunity from all repercussions, responsibility and accountability. All of them came from homes with absentee fathers (and even when their fathers WERE physically home from their high-powered positions on K-Street or on the Hill or with some lucrative government contracting company or law firm, they still weren't really there). All of them lived in neighborhoods like Villa May, Marlin Forest, Belle Haven (yes, there's a Belle Haven down here too, complete with eponymously-named country club) and Mount Vernon where the police were forbidden entry unless they were specifically summoned; consequently, all of them ran wild on Friday and Saturday nights during the school year and all week long during the summers. All of them drank to excess. All of them were good at one sport or another. All of them were severely lacking in intellectual capacity or curiosity and as a consequence were marginal students (and that's being generous). They were, in essence, spoiled, self-absorbed, narcissistic trust-fund shits with no redeeming human qualities or value whatsoever. In the weeks and months following your cousin's murder, I remember overhearing several muted conversations amongst that crowd. These people, all of whom had some kind of connection, whether real or imagined, to the democratic party and to the Kennedy's, were worried that one of their own would be implicated in the homicide (by way of an aside, that seems to suggest that even from a distance of some 300 miles, the local whisperings of possible Skakel involvement in your cousin's murder had traveled quickly). From what I was able to gather from their mutterings, this crowd of indolent, overly-indulged wastrels was more concerned with the fate of one of their own than with seeing justice done. The callous indifference of those consummate hypocrites to Martha's suffering nauseates me to this day and is one of the principal reasons why I haven't been back to that school since graduation in 1978.

    Funny Dershowitz says that failing to raise reasonable doubt is not enough, since he advised O.J. Simpson's lawyers to constantly waver reasonable doubt. And that was in a case with tons of evidence towards O.J.'s guilt.

    Tommy and Michael are covering for each other.
    Tommy claims he got out of the car with Martha and her friends.
    Martha's friends leave because Tommy knocks Martha to the ground, jumps on top of her to makes out.
    It's 9:30 pm Tommy says they mutually masterbate to Climax, fix their clothes and Martha heads up the driveway home.
    At 11:30 pm, Michael says he returns home, goes across the street to Martha's, climbs a big tree, peeks in at Martha, masterbates, done in 30 seconds, goes home.
    In the weeks fallowing up to this, Martha's diary says Tommy is an ass because he keeps hitting on her, putting his arms around her, hands on her knee etc and all she wants is to be friends.
    Are these guys twisted or piecing this together for protection?
    Lets see, At 9:30 Martha fights Tommy off, heads up the driveway toward home.
    Explosive tempered Tommy grabs a golf club from his yard across the road, runs up the driveway and attacks Martha.
    Tommy sneaks into the house to clean up and sits down at 10:00 to watch TV with the tutor.
    Michael returns at 11:30 and Tommy tells him what happen.
    They decide her body is too close to where they were last seen together so they drag her body up near her house under the tree.
    Tommy was the last to see her but if Michael says he was in the tree at 11:30 masterbating to her in the window, then she is alive in her house long after Tommy last saw her.
    But wait, this now shines a light on Michael as being the last to see her.
    This change in Michael story is why he went to prison, what a backfire!
    I think they both are guilty of murder/accomplice cover up.

    I DO NOT THINK THAT THE STUPID JUDGE WOULD LIKE BEING HIT OVER THE HEAD WITH A GOLF CLUB BY SOME MANIAC HE FREED
    A GUILTY PERSON TILL HE GETS PUT BACK IN PRISON AND YOU DO NOT NEED TO BE CHARLIE CHAN TO SOLVE THIS CASE--REST IN PEACE MARTHA!

      Right....that's literally the "get of jail" card. This guy had one of the best criminal lawyers money could by and he claims incompetent representation because he was found guilty??? What gets me is that the lawyer is SILENT on the accusation. That silence speaks VOLUMES. I've NEVER known a lawyer to allow an accusation of incompetence to pass without rebuttal or challenge, and yet this one did. Makes me wonder how much he got paid to keep his mouth shut...more apparently than his reputation was worth and the economic value of any potential new cases that went to other attorneys because of the accusation.

    Dershowitz is such a great mind - I love listening to him. He is greatly underutilized in this country. He should be teaching logic and reasoning to kids.

    The truth is it doesn't matter what political name you utter, Bush, Clinton, Obama, Biden, Kennedy, each and every one have deeply buried pasts, and usually enough skeletons to fill a graveyard of their own. From where were you born, to who was your daddy, to poor Martha's caddy, these people are never as they appear, and "THEY DON'T GO TO JAIL."

    This whole case is so circumstantial - and now it's hard to sort out anything.

      From the start, there wasn't adequate evidence in the case, which is why the prosecution built their case around the Sutton Agency interviews. In the nearly 45 years since the murder, several of the key witnesses have died, and most of the Skakels refuse to be seen, so the truth will come out later but only after more of the main players in the case have died.

    Judge Bishop thinks Tommy was the better suspect, and he based his decision on questioning defense strategy, not on ineffective counsel.

      There was a lot more that pointed to Michael! Tommy had no reason to do it but it’s easy to believe M was mad because Martha she chose Tommy that night

    Rfk junior said he's innocent he also says sirhan sirhan didn't kill his father despite writing rfk must die several times , going to the range all day , admitting he did it to David Frost etc , etc , etc I'm afraid rfk junior talks a load of bollocks on such pertinent issues

      sunshineshine77 yeah,well im just a little sick of those damned kennedys hiding behind wealth to get away with shit.im tired of there arrogance and self importance.im convinced that fat arrogant bastard murdered that pretty girl and hid behind his familys' wealth and uncles' name to keep from getting endighted all those years,and im furtherly convinced hes doing that now to get out of prison.no matter how many lies his arrogant cousin tells that appellate jury,or whether they believe it or not can mean his conviction will be upheld and his fat arrogant ass will go back to prison wher he belongs,or hell go back to his spoiled rich lifestyle,but either way,when skakel finally does the world a favor and dies,the final judge who doesn't care about wealth or a famous uncle,and cannot be bought will send his fat ass to hell,where hell be rejoining that famous uncle and his brother for drinks!

      sunshineshine77 I guess I do overreact a little at times,im just fed up with the fact that it seems like every time you turn around justice bears a double standard,or no standard at all.im convinced hes guilty and should never get out of prison.and I do think it was sad that ted kennedy did not report that accident till the next day.they could have sent diving crews down there that night and saved her life,but because he waited to report it,she died.you or I would have spent a few years in prison,and been felons for life,yet ted kennedy got to plead guilty to a misdemeanor and remain a senator for 40 more years,and that chilled my spine.ill admit I do get a little reactionary,i just think justice sometimes goes awol! you to have a merry Christmas!

      mikemoair I hope hes only out very temporarily and justice wins out over money,fame,and camalot charm.if all goes well and justice prevails,by this time next year,but hopefully sooner,the bubbas will be using his fat ass for a butt darts competition! lady justice is supposed to be blind,i think the prosecutors and jurors in Connecticut need to make sure she stays that way!

      mikemoair im not bothered by the rich either,in fact I know a few rich people who are very decent people,my problem is when assholes like the kennedys and skakles use there big dollars to manipulate a system! hes guilty,plain and simple! a pretty girl wouldn't have sex with him,so he murdered her and hid behind his wealth,and now his wealthy cousin is trying to get him off! it is my ardent hope that the jury will have better sense!

    Robert Kennedy has suggested there is something to be made of a pair of guys known to the cousin of Kobe Bryant actually committed this murder.

      Why is that? Rushton Jr was never implicated in the murder at all.
