Glad you resolved it but with a title like this, it would have been nice to give at least a 30sec overview of the reason and resolution of the lawsuit, without just dumping it off to a court document. Other game devs would find it valuable.

Reading the last two motions to dismiss... it appears the publisher was in trouble for claiming Conradical was trying to sabotage the game and sully the publisher's name... and because of this, the publisher likely not wanting to deal with the counterclaim, decided to agree to toss out the complaint. Basically she was defaming him, the court was siding with him, and it wasn't looking good for her case, so since she was the one who filed the complaint she just agreed to dismiss it. (ie, she really goofed by posting that video where she attacked Conradical's character and intentions with no real evidence of it)

Conradical was disappointed with this and did not want to release his game in that state, so he took the game down/edited the steam page so people wouldn't buy the game. The publisher didn't like this, and felt he was disrupting their launch and sales of the game, so they took him to court over it. The publisher put a video on social media basically claiming Conradical was trying to sabotage them and "sully their name". Which didn't go over well with the courts, who found it to be defamation. So I think basically the publisher backed off for fear of being counter-sued for defamation.
Heck yeah! I remember when this whole drama started which made me sub to hear what happened. As someone who wants to turn my own stories into games at some point, it's great to see someone doing it in real time and also overcome the tribulations that can limit exposure and negatively affect the games production, publishing path as well as release. And also love to see how you are handling post launch and additional content. Props, brother!

Hey man, I'm really happy for you on winning this lawsuit. I was really looking forward to this game, I'm actually one of the people who got the physical SWITCH version of the game. I was kinda disappointed how the game ran and also how the publisher screwed you over, I almost thought I was stuck with an unplayable game. But you fought back, to repay the fans on the game we all wanted and won. As of right now I'm trying to update the game but I'm still on ver 1.0.1 Hopefully I can still update the game.

The lawsuit against you was how I discovered you and the game (when other video game RUclipsrs were talking about it and their videos popped up in my home feed), and even though I'm more of a comics person than a games person, it did give me more encouragement to pursue self-publishing if I ever were able to turn any of my fiction book ideas (and one game idea I came up with as well) into reality. I seemed to recall that the Switch port was initially unauthorised and done by the greedy publisher, which reminded me of my game idea as I would've designed that to primarily be played on PC because of its primary control scheme (that being with an active pen), but then I imagined that going with a publisher would result in unauthorised console ports and them adding game controller support with an awful control scheme (e.g. the Switch port of Freaky Trip, which should've had touch screen support, but instead only had mouse simulation using the left control stick and A button), then reviewers who bought the PlayStation or Xbox releases would've complained about how bad the controls were. With self-publishing, some of the increased control I would get is in what you describe as self-porting, as I would've had Linux-based desktop OSes (e.g. Linux Mint) as the primary target, then self-ports to Windows, macOS, iPadOS and Android, then when porting to consoles, I'd only port to whichever would be the current Nintendo system at the time if it support touch input, as well as a PlayStation handheld if it were to exist at the time and had touch input. Trying to bend Unreal Engine to support pen pressure and allow the pressure curve to be adjusted in the game's settings would be a different story, though. With the new self-port and performance fixes, I was reminded of when I saw a Merge Games published copy at an EB Games store some months ago but didn't get it, however I assume that the updates will apply to that release as well as i assume it has the same title ID. (Edit: I was right) I was also reminded of an author who's long-running book series was optioned by a major TV channel for an animated TV adaptation, but it was scrapped after a pilot that I think was since lost, and he lost almost all rights to that series except to publish existing books, then he learnt his lesson to never sell rights and instead just licence out his IPs. I won't name any names here, but on my side of RUclips, I could tell that channel has bigger problems.

I was so happy when Outbound Ghost was announced and I finally got to play it because I'm a HUGE Paper Mario fan, it's my favorite game series of all time. Additionally, RPGs are my favorite game genre. When I finally got to play the game, I was in love with it. I think in my first run I feel like I played like 15 hours or something. I explored everything, and fought many battles. It definitely was one of those paper Mario s games that succeeded, succeeded in being very fun and challenging, but also being unique from paper Mario itself in the battle system and mechanics. Actually somehow beat Soul stalker like a couple days ago, I finished level 10 of ascension. Got all the characters, and I think all the achievements. That game is super fun. I think I beat Wanted Shadows too. I'm going to set some time aside, and curate a review for all three games. I actually review stuff professionally, as well as beta test. So excited for Outbound Ghost Reborn and Synth Beasts when they release in the near future.

Congrats again on the resolution. Since you said it would be hard to print physical copies of the "fixed" game due to small interest and minimum quantity, the alternative is 2 game 1 cartridge: both base game and reborn in 1 physical game

You should definitely be patient with Reborn and Soulstalker, the announcement for the newest Nintendo Switch successor console is just around the corner, it'll definitely be a game people (and me haha) would want to play on the newest console.
I only started reading the documents and have very limited understanding of legal-ease but, its seems the publisher was sueing because of a "breach" of contract. They claim (in the first docket) to have had exclusive publishing rights and had provided resources for the development of the game. I'm assuming conradical terminated the contract, and claimed their involvement was unsubstantial . Which made them big mad. Again I might be misunderstanding what's in the docket but, that seems to be the jist of it. There's a lot more to read through so, it's possible they revised their claim. Which tends to happen a lot. Still he won his case. Which is a good thing. Big corps shouldn't be able to run rough shot over someone. Just because they have the deeper pockets.
Oh YES! Finally! I've been waiting to open my physical copy for soooooo long! Now I'll have this and the new Mario & Luigi as great RPGs to look forward to! And throwing in Reborn for backers is awesome!!! I'm really happy for you!

I’m SO happy this game had a happy ending! I bought the physical version of The Outbound Ghost and I still have my pin that I believe came with the first 500 copies or so. The game is still sealed in the plastic wrap because I wasn’t going to play it if the version of the game was bad. This whole situation was so messed up, but it’s all fixed now! What about making a physical version with both games on the cartridge if they will fit? Games like Enter/Exit the Gungeon, Cat Quest, Overcooked did that
I've definitely considered this, and it would be super cool! The main thing is that by the time Reborn comes out, the Switch 2 will probably be the main console so I'm not sure if people will want a Switch 1 physical. Wanted to get something for Switch 1 going, since that was the original versions' physical platform :)
@@Conradical Don't see why not. When the 3DS and Switch first came out, there were still some DS and Wii U games being released right? I can see people still messing with the Switch even after the Successor comes out. Plus it's not like there aren't games that have multiplatform releases on multiple consoles from 1 company. Breath of the Wild did it, so did most Xbox One games with Series S or X or PS4 and PS5. It gives people more options depending on what consoles they actually have. So a collection physical copy would be cool. Maybe a all in one collection eventually with all your Games, DLC, ect all on cart after everything is released? Like we see with updated collections for some games like the Disney one, Cat Quest or Nicktoons Racers.

Congrats again on the resolution. Since you said it would be hard to print physical copies of the "fixed" game due to small interest and minimum quantity, the alternative is 2 game 1 cartridge: both base game and reborn in 1 physical game
Definitely will pick up the new complete edition if you made a kickstarter. Waited to buy the physical release, it's a good thing I did.

You should definitely be patient with Reborn and Soulstalker, the announcement for the newest Nintendo Switch successor console is just around the corner, it'll definitely be a game people (and me haha) would want to play on the newest console.
why did they sue you?
I only started reading the documents and have very limited understanding of legal-ease but, its seems the publisher was sueing because of a "breach" of contract. They claim (in the first docket) to have had exclusive publishing rights and had provided resources for the development of the game. I'm assuming conradical terminated the contract, and claimed their involvement was unsubstantial . Which made them big mad. Again I might be misunderstanding what's in the docket but, that seems to be the jist of it. There's a lot more to read through so, it's possible they revised their claim. Which tends to happen a lot. Still he won his case. Which is a good thing. Big corps shouldn't be able to run rough shot over someone. Just because they have the deeper pockets.

I’m SO happy this game had a happy ending! I bought the physical version of The Outbound Ghost and I still have my pin that I believe came with the first 500 copies or so. The game is still sealed in the plastic wrap because I wasn’t going to play it if the version of the game was bad. This whole situation was so messed up, but it’s all fixed now! Congratulations on a new successful release!

What about making a physical version with both games on the cartridge if they will fit? Games like Enter/Exit the Gungeon, Cat Quest, Overcooked did that
I've definitely considered this, and it would be super cool! The main thing is that by the time Reborn comes out, the Switch 2 will probably be the main console so I'm not sure if people will want a Switch 1 physical. Wanted to get something for Switch 1 going, since that was the original versions' physical platform :)
@@Conradical Don't see why not. When the 3DS and Switch first came out, there were still some DS and Wii U games being released right? I can see people still messing with the Switch even after the Successor comes out. Plus it's not like there aren't games that have multiplatform releases on multiple consoles from 1 company. Breath of the Wild did it, so did most Xbox One games with Series S or X or PS4 and PS5. It gives people more options depending on what consoles they actually have. So a collection physical copy would be cool. Maybe a all in one collection eventually with all your Games, DLC, ect all on cart after everything is released? Like we see with updated collections for some games like the Disney one, Cat Quest or Nicktoons Racers.
Maybe VGP would be interested in helping with the reprint!

I wouldnt rebuy a reprint of the orginal. I would buy a one cartridge double game print or a physical of the new game.
I really want a physical of the new game to go with the original. I think Kickstarter would be the best route.

I've managed to get the physical game when first pre-order released. Unfortunately it has the frame problems. Are people who already have the game gonna have an updated to resolved this issue. Glad everything went fine. 🙏

You might want to avoid the name "reborn" in the new game as that immediately sounds like it's a remaster to me. Just my opinion.
