Yeah, I was pissed because I listen to OT and this video was so NOT what it was "titled". OT's producer made a beat using a melody this guy made from a pack that was released for FREE. Meaning anyone could've done the same, with the FREE beat pack.

The first question I have with any producers samples/loops is, is this pack royalty free? It seems like a marketing tactic. He makes these packs, he knows his own terms. He's been in this game for a minute. Here's how me and my friend who made a royalty free pack are trying to get paid for it because it's plat. And then you get hit with the oh but new pack guys, and 1million plus people are seeing it. I'm not disregarding the fact they might deserve credit, but he's not stupid and he's giving himself exposure in multiple ways, he is a business.
I'm an engineer/mixer on the West Coast and I've run into all kinds of shady garbage. I've done sessions for artists, who are on known labels, and I'm sure there are thousands of hit songs that people never knew their beat was at the bottom of it. But their beat wasn't even in the final mix. Here's what I'm saying... artists, managers, etc get emailed every day by producers looking to get their music/beats out there. The artists, managers, etc will have writing sessions and go through all these beats that are coming in through email. They'll choose one they really like. They're write a whole song to it. Then they'll send it off to a well known producer/beatmaker to REPLACE the beat with something that sounds similar but not the same. These producers basically get the beat and the vocal splits. This kind of crap annoyed me to my core.
👏🏽I mentioned the same thing about T&C/TOS in the comments on Kyle's video. Many producers were concerned about copyrights and didn't understand if they should use samples anymore. Musical education is important. I'm glad you also said the same thing defining Royalty Free. Royalty Free = $0! A producer can sell the royalty-free sample pack to earn profit but outside of that? Nothing more unless it's in the T&Cs.
to answer you question about the plaque, OT’s team could send them one. same way you see DJs/radio personalities presented with plaques with their name on them.
@@DJPain1 it has to be a mixture of hilarity and frustration at so many misunderstandings for you pain. this one made me chuckle. love what you do, and also really love the albums you made with Sole.
Thank you sir. I watched that original video and was invested with the struggle until he said it was released ROYALTY FREE. WTF - thanks for calling him out. Oh well - he got me to watch it .
I subscribed YEARS ago because you were one of the ONLY major producers using Acid Pro and ‘till this DAY this has been one of the best decisions I’ve made! Thank you!
Hate to break it to you but most sync agencies explicitly do not accept works with samples from Splice. Too many people plagiarize samples and they don't really vet them. Plus dealing with them is a nightmare.
my biggest issue was how he downplayed the producer so much the whole video saying, he stole he stole he stole, to end up being that he didnt steal....and OT's manager said this was the first time that producer had a placement. its just shitting on someone who did nothing wrong.
It's free to use for yourself and play with it, there is not a problem. He gave that sample to an artist, whole thing blows up goes platinum and when they asked that guy "if this your beat that you made" he said YES (which is not true) and he gets the credits. That is the whole problem.
1. I stopped watching Kyle’s channel a long time ago because the video titles started to seem like click bait. 2. This is why I don’t mess with the sound kits. Especially the “free” ones.
I've never heard of Kyle Beats but I do watch a lot of DJ sets, DJ hardware related stuff so eventually his "stolen" video made it to my front page via the algorithm. When I watched it and then it became clear that the loop was royalty free, it f**king pissed me off. How does a guy like him with such a huge following not understand the meaning of royalty free? Of course he knew the meaning cause he can't be that st*p*d, but just to create fake drama and make a mountain out of a molehill, he actually went through with that video just to stroke his ego. That was the first Kyle Beats video I ever watched and it was the last. I hate clickbait content. I'm happy that you posted this video calling out his BS. I respect you for it.
10:41 I think that's WHY they went through the manager was to ONLY get him CREDITED because LEGALLY they couldn't FORCE anyone to do anything... its royalty free... talk about Kyle TWISTING the narrative for content though cause I was confused the whole time too
How does this come into play if you sell sample packs? What if you sell a sample pack and a producer goes platinum? Do you need your create a read me file that states, you get credit if it goes big or something?
if its in a sample pack its not stolen, if u dont want it to be used dont put it in ur sample pack lol. BUT the producer that "stole" the loop is lazy asf for using loops still. didnt even do any sound design on it, these industry beatmakers are straight ass and have the easiest job in the world jus putting drums and a 808 sub bass over royalty free loops. these ppl need to hop on serum or vital for once. all beats sounding the same bc these trap producers are doing all the same shit. My advice to ppl working to become a producer and wanna stand out is to get into other genres, especially edm subgenres since u learn to use all of the daw and learn how to do ur own sound design which helps u develop ur own unique style, which in turn helps u to stand out from the rest.
I didn't realize that entire video summed up into "oh wait it was completely royalty free, nevermind". That makes it wayyyyy more hilarious and semi embarassing. I don't get how they weren't aware of this on the front side, it seems unbelievable to me. How would they be ignorant to how they labeled their own pack and their own term agreement(s) for any downloadable free content that they manage themselves? At first I imagined a scenario of "you can use these loops up to X or Y listens or major/reputable indie label release", but not even that? Entertaining, for sure.
I have seen the TOS on sites if you used Royal Free photos, music, videos and all that? I have seen in the Terms to give credit to the original producer of the photos, music, videos, etc. I think that is where the team of that rapper forgot to do was give credit to who created the loop which puts them in the wrong as well. So, the video that Kyle did is informative, and I think both sides also were in on this on how to correct issues in the music industry without going to court and all that. It was a way to settle things civilly in the music industry. We have been seeing estates of artists suing everybody today for copyright infringement and all that.
By making a loop royalty free (and not clarifying you need credit) the use doesn’t need to give credit What happened here is Mexican ots team seems pretty solid and probably gave him a 1% of pub or just basic credits cuz they wanted to avoid litigation (even though they were in the right) or cuz they want to keep good public relations
To all us producers on ground level lets stay away from these midi packs and these samples . I dont get how they sell a product to other producers and then still want royalty and producer rights and all this other studf … insane
Think it was from a free kit, which realistically justifies wanting payment from a song especially if he includes terms. I get ppl getting annoyed that paid kits still require credit (Looking at KXVI's kits for instance) but if u use a free loopkit and don't expect the producer to get a split or something you're being greedy
as far as Cymatics: and their royalty free claim, are their samples actually free and clear? because i have made a song using one of their loops and was just curious.
If you actually have the license (aka bought it, not torrented it) then yeah, you are free to use it however you want as long as it's not directly reselling
I remember seeing that video and as soon as he said the royalty free part I felt the same way. I gave him the benefit of the doubt and thought maybe he just forgot that was a royalty free license until they had to check.
He didn't go to the Lawyer bcoz he Dropped a Quote Free/Completely Royalty Free Pack, kne damn well what he was doing.. If He did put liscense terms in the folder he never mentions that. Darez The Composer gets credited bcoz Mexican OT team probably didn't want bad PR coz the song is over millions of streams This video is click bait to promote a Product. He never mentions a liscense at no point Kyle Said he released it both Free & Completely Royalty Free
I HAVE MADE thousands of beats you dont always remember every loop you use..i try not to use loops because of this reason but sometimes you need that little bit of inspiration.....and question if you slice up the loop do you still have to pay for every kick hat and one shot to... .shit i am suprised you dont have to pay the daw and plugins you use.i say dont call something free if its not free..
I wasn't familiar with Kyle but that video came up on my homepage, and I went in to it (based on his title and thumbnail) completely looking to support him as a producer, a friend of mine makes music so I was instantly sympathetic to the situation... But after the first few minutes it just left a bad taste in my mouth, his attitude during the video was the completely opposite to the attitude in his title and thumbnail... straight off the bat it goes from his beat to his friends beat (but continuously calls it his own beat through the rest of the video)... from a stolen beat to free beat pack he released... from famous rapper stole to he himself admitting that the famous rapper had next to nothing to do with what happened.. On top of that he's super professional and friendly to the manager he contacted, the whole thing was settled really well in my opinion, but for some reason he completely flipped when it came to releasing the video afterwards, he says things like "i dont wanna throw anyone in the mud" then titles it "famous rapper stole my beat" with the rappers picture in the thumbnail. For a youtuber to move like that it really wouldnt surprise me, people constantly mislead and clickbait for attention - but from a producers perspective all he's done is burn a good connection with a manager who seemed super friendly and complimenting of his work and showed he can't be trusted in one space because he'll happily throw you under the bus for attention in another space instead. I would never recommend my friend trust or work with him, and I seriously can't imagine any major artists wanting to work with him after that either. I myself know very little about how the music industry actually works, but if my friend was ever in a similar situation I can only hope he would be treated with the same respect that OT's manager gave Kyle, you hear horror stories all the time of minor producers getting shafted, and i was super impressed with the way it was resolved - turning it on them for the sake of some clickbait video could have done some serious damage for music based youtubers trying to get into that industry in future. He may have burnt that bridge for everyone not just himself.
Something like this happened me in the past month. I found out a tiktok viral song hit 20+ million streams on Spotify and it's using a piano song I made in 2011 throughout the entire song! Literally a song from my first album. It was "stolen" in 2014 but it didn't go viral until May 2024. I sent a copyright strike through Spotify's support system. They took it down. Nothing seemed to happen, my mails went unanswered. Then 2 weeks later the artist's manager contacted me and offered me a resolution. Now the song is back up and I'm a co-owner. The song in question is: Sickboyrari - Princess Cuts My Wrist My original song from 2011: Krisu - My Beloved
I would never work with them again because they knew they stole an entire song lol can’t trust they everything they put out isn’t stolen from some random kid in the Philippines
I ain’t even that good at making beats I been doing it a year, but I can’t take the guy serious when watching him. One of the biggest/cringiest ass hats in the community
Should have labeled it as *Royalty free and then define it at the bottom of the marketing like every other thing that markets itself as this great thing *under certain conditions.
They really the same thing. If you against loops be against samples they really just loops. And at that point make your drums make your own vst make your own everything
Thats exactly why i create my own melodies. People tht really cant make beats probably good at drums and hats usually need loops. Orchestra/choir loops is what cheaters use😂
If you watch the video till the end, He says that he realized it was royalty free. But producers still should get credit for their work. The music industry ain’t shii without them.
I used to use samples from these sample packs royalty free like cymatics but ive stopped using any royalty free loops and just make my own, write some random base notes, some mids and some highs like arps or something and then consolidate it, stretch it, reverse, chop it, effects and you're ready to hit em drums
I think producers market their kits as "royalty free" to get more sales and make an income but when something becomes a hit they all feel cheated.. I know I will only use loops that are royalty free, and I do think that a "royalty free" loop is just that..royalty free
Great insights as always bro. I have a couple non-royalty-free loop packs and stuff out there that have been used a bunch without credit and none of the songs went platinum or anything, but a couple of them did decent numbers and I just wanna be prepared for if something similar to this happened. You explain here very well what the sample makers want and how easy it could be to handle the business if people just read the fine print and follow basic business ethics. I include a document with my terms for splits and placements with everything and make it really easy and fair for people to contact me and many times I am publishing/ sending them for free under those clearly stated stipulations. I want people to use them, as many as possible, just like every loop maker does. The problem is so many rappers and hip-hop producers feel entitled to stealing things no matter how easy it is to do the right thing. I’m glad things worked out here for Kyle and his boy, and I think he mostly handled it the right way….given that little plot twist 🤦♂️(they rightfully got credit, but as you point out, LUCKY to have even secured the plaque with that caveat) It’s just disappointing how often this stuff pops up and how much harder it is to navigate when you’re a small time guy.
Although my situation is nowhere near this level of magnitude, if it’s helpful to anyone, my biggest solution to this was to build strong relationships with a much smaller circle of producers who I trust will absolutely give me credit if any of our songs get placed (and I am in constant close communication with) and have all my Ascap #s and stuff. It can make a world of difference to lock in with a few real ones. Posting kits is really tough though. It’s tempting to just “spray and pray” when it comes to posting loops and stuff on the internet but you gotta make sure to protect yourself. My personal nightmare is posting a sample on looperman and having a quadruple platinum lmao. That’s why I’d rather just release samples for free that are explicitly NOT royalty free
Also, if you are trying to figure out how to state your terms properly in writing and don’t have a lawyer, you can at least use something like a beat stars contract as a starting template. 💯
I've produced a few songs for OT and I can vouch that his team is great to work with. They always go out of their way to make sure you're paid & credited🤞🏽
I appreciate this take, and it is a legit review of a sh*t video idea. He also sold a sample pack from DAREZ for an OT beat contest and the loops are trash man. He is sending the beats out on August 10th, and I would be dammed if OT's management uses any of them...but for a quick $27 you can get them from Kyle and credit DAREZ. I'm done lmao
Heres what i feel is missing. Kyle MANILY wanted his buddy to get the props and he was navigating the situation carefully because he knew it would be a good business venture. Its also content
a lot of royalty free samples are not "royalty free for commercial use" read the fine print even free kits are free until commercial use is the case. a lot of royalty free includes clauses to clear for commercial use, and proper credits need to be listed depending on fine print in the free sample pack.
Why can´t producers just make everything themselfs? When you have 10 parties making different things, uploading it to different sites etc. You get problems like this. I´m all for collaborating. But with people you know and trust.
Kyle said it was a free kit in first sentence..he wanted the guy to get credit for producing it and he did get credit.. obviously he tried to get some money too if they agreed

Few weeks ago I found out that something similar happened to me.. An artist used my beat n made a video also, it's 7 years old today sitting around 3mil views or more.. Can something be done??
My team is currently working with Mexican OT and they are very thorough. Good people and as soon as u meet them u can tell they are really passionate about their artist. We had a situation where one of our producers had a signed artist by the name of Foushee, who he produced Deep End RnB track with her and she uploaded her vocals to that to Splice without anyone knowing and Sleepy Hollow/Shef G used her Splice vocals and went platinum with their song. My guy got sent a plaque still because when it came out , their team was open to making sure anyone who could get a plaque got one. Once they verified the information, they sent us a plaque. I believe it's discretionary in most cases.
@DJPain1 What was going gold with CD's like 500,000 units?? And 1,000,000 was platinum? Outkast went Diamond at 10,000,000. Seems like streaming just moved the goal post so to speak.
I have the same opinion as DJPain1, i hate the loop packs (specially the "free" ones) that ask you to contact the loopmaker in case of a major placement... that might destroy possible new bridges and allowing you in "the real game"
He wasn’t acting all the way to make a video. .. In one part he said “I dread making this phone call to tell what ever his name was that there was a platinum record”… I was like whut..
Kyle thought he was going to ger some money so karma humbled his ass. I really dislike when people give shit out free but then want credit for something that was given away to the community.
im so happy other people think like this too. I was really upset about his title. For one, Mexican OT didn't steal his beat, 2, it wasn't kyles beat, 3. it was a FREE LOOP made by HIS FRIEND. Kyle's title for the video is completely clickbait and a lie. Especially because OT's team was extremely helpful and was doing whatever they could to make it right, even though they didn't do anything wrong. If i was OT's team, after seeing that title I would've taken back everything I did to help. Idk maybe im trippin and thinkin too deep.
Finally someone sees it for what it is. Kyle's beat was never stolen. It was never even a beat, or even his exact beat. It was a snippet out of his sample portfolio -- a perfect opportunity for a publicity stunt.
I've always been suspicious of "Royalty-Free" loops even back in the day when I was messing with Prime Loops. I remember playing with one loop and went on RUclips and there was a dude rapping on the same loop that I was about to use. I know I could have chopped it and flipped and all types of shit to make it different but it just turned me off from the whole thing.
A person who decides to make something royalty free can add stipulations to that creation, like getting credit. For ex: an artist made an art piece of a Lamborghini that Mr Beast used in a video. However that particular piece had a stipulation that whoever used it had to give the artist credit. Mr. Beast did not initially, and the artist almost had the video taken down which is a huge deal but Mr Beasts team credited him in the description and all was good. So you can relinquish any royalties while stll stipulating being credited, but it should be clear in the description of the creation or in some way in the file or folder or comment - just some clear way.
@6:40 he didnt get a lawyer at first because he knew going down that route at first can cause immediate chaos. He wanted to see how scared the other oarty would be and measure his opportunity from there.

Yo Pain keep dropping gems bro much appreciated and much respect, peace bro
Appreciate that
👏🏽I mentioned the same thing about T&C/TOS in the comments on Kyle's video.
@@THANKYOUTEZ they could. They could buy him a car too.
13:37 - Well said and great advice for any producer. Thanks for this video.
This is exactly why I hate using other peoples loops. I just stay away from it. I dont even bother to manipulate it..just sample stuff with a license.
I subscribed YEARS ago because you were one of the ONLY major producers using Acid Pro and ‘till this DAY this has been one of the best decisions I’ve made!
Thank you!
Thank God for Splice, Loop cloud and Tracklib
Hate to break it to you but most sync agencies explicitly do not accept works with samples from Splice. Too many people plagiarize samples and they don't really vet them. Plus dealing with them is a nightmare.
my biggest issue was how he downplayed the producer so much the whole video saying, he stole he stole he stole, to end up being that he didnt steal....and OT's manager said this was the first time that producer had a placement. its just shitting on someone who did nothing wrong.
I was confused 🫤 watched the entire video but the sample was royalty free 🤨
Why r u so mad damn dude
10:41 I think that's WHY they went through the manager was to ONLY get him CREDITED because LEGALLY they couldn't FORCE anyone to do anything... its royalty free... talk about Kyle TWISTING the narrative for content though cause I was confused the whole time too
How does this come into play if you sell sample packs? What if you sell a sample pack and a producer goes platinum? Do you need your create a read me file that states, you get credit if it goes big or something?
Did you watch the video?
I thought I was the only one who thought Kyle's video was trashy, it's great to see other people noticed how weird it was.
I had a very good feeling that's what this video was about.
if its in a sample pack its not stolen, if u dont want it to be used dont put it in ur sample pack lol. My advice to ppl working to become a producer and wanna stand out is to get into other genres, especially edm subgenres since u learn to use all of the daw and learn how to do ur own sound design which helps u develop ur own unique style, which in turn helps u to stand out from the rest.
insightful as always!
By making a loop royalty free (and not clarifying you need credit) the use doesn’t need to give credit
What happened here is Mexican ots team seems pretty solid and probably gave him a 1% of pub or just basic credits cuz they wanted to avoid litigation (even though they were in the right) or cuz they want to keep good public relations
@@Bigjar420 Royalty refers to money not credit.
Glad I landed on this video, loved the insight, also Kyle did do a lil bit of a troll with that video.
To all us producers on ground level lets stay away from these midi packs and these samples . I dont get how they sell a product to other producers and then still want royalty and producer rights and all this other studf … insane
🙄
Think it was from a free kit, which realistically justifies wanting payment from a song especially if he includes terms. I get ppl getting annoyed that paid kits still require credit (Looking at KXVI's kits for instance) but if u use a free loopkit and don't expect the producer to get a split or something you're being greedy
@@etrur2595 That is absolutely ridiculous, then don't give away your samples for free. It is not free if it requires payment.
That’s why I make most my beats from scratch it’s too many people selling people like you hard work and passing it off as they own it’s crazy
Thought I was the only one still still using the AKG Q701s. Great vid by the way.
as far as Cymatics: and their royalty free claim, are their samples actually free and clear? because i have made a song using one of their loops and was just curious.
Darez The Composer gets credited bcoz Mexican OT team probably didn't want bad PR coz the song is over millions of streams
This video is click bait to promote a Product. He never mentions a liscense at no point
Kyle Said he released it both Free & Completely Royalty Free
I appreciate you doing a video on this especially the royalty free part. That now makes sense. 👍🏾

20% of the composition’s royalties from a goofy drum loop?? No wonder they don’t contact you! I want what you’re smoking
I thought the same thing 😂 20% is excessive for a loop
Not for a drum loop, those are royalty free. Get mad though 😉
The song in question is:
Sickboyrari - Princess Cuts My Wrist
My original song from 2011:
Krisu - My Beloved

If you watch the video till the end, He says that he realized it was royalty free.
But producers still should get credit for their work. The music industry ain’t shii without them.
I used to use samples from these sample packs royalty free like cymatics but ive stopped using any royalty free loops and just make my own, write some random base notes, some mids and some highs like arps or something and then consolidate it, stretch it, reverse, chop it, effects and you're ready to hit em drums
I understand how to make with your comments u have pretty Good explanation 🙏🙌
I think producers market their kits as "royalty free" to get more sales and make an income but when something becomes a hit they all feel cheated.. I know I will only use loops that are royalty free, and I do think that a "royalty free" loop is just that..royalty free
They can ‘feel’ however they want but all they can do is make non-royalty free kits in the future, which I think is what Kyle did
Your videos are always helpful💎💎🐐🐐
Appreciate it
DJ Pain with the cliff notes version and the reality check of the situation thank you
I like Kyle beats for being a RUclipsr and storyteller but thank you for saving me time. Some time the vids are a miss.
I just subbed, I like your take on things man, this is good stuff.
I've produced a few songs for OT and I can vouch that his team is great to work with. They always go out of their way to make sure you're paid & credited🤞🏽
You are right. They should send what they want in the terms ie advance, splits. These guys do not answer emails either
I’m pretty sure the the packs say anything that makes over 500,000 listens has to be cleared for use 😅
🔥🔥🔥🎯
I watched kyle video. I enjoyed your view on this. Made me aware of a few things I missed.
Glad you enjoyed it!
There’s almost never actual ‘fine print,’ people just don’t read or understand the terms.
Why can´t producers just make everything themselfs? When you have 10 parties making different things, uploading it to different sites etc. You get problems like this.
I´m all for collaborating. But with people you know and trust.

That streaming scale for going Gold, Platinum, etc is wild to me. 75 mil for Gold???
Why is that crazy?

@@TheTonyTitan they do have really clear terms
Mann. I remember you back in the ACID Sonic Foundry days. Sound Forge and all that. That used to be my workflow

This is VIABLE INFO !!! , but... isn't it illegal to record a whole phone conversation? and ...why does he 😵💫 blink hard, so much?? 👀🔥
Not illegal and who knows if there was consent, I doubt they weren’t aware
A person who decides to make something royalty free can add stipulations to that creation, like getting credit.
For ex: an artist made an art piece of a Lamborghini that Mr Beast used in a video. However that particular piece had a stipulation that whoever used it had to give the artist credit. Mr. Beast did not initially, and the artist almost had the video taken down which is a huge deal but Mr Beasts team credited him in the description and all was good.
So you can relinquish any royalties while stll stipulating being credited, but it should be clear in the description of the creation or in some way in the file or folder or comment - just some clear way.
You can stipulate anything you want. Evidently thats not what happened here
Just REMAKE their remakes and you don't have to contact the "Free loopkit" loopers for shit.
Please take this moron's advice. I have a lot of lawyer friends who need the billable hours.
@6:40 he didnt get a lawyer at first because he knew going down that route at first can cause immediate chaos. He wanted to see how scared the other oarty would be and measure his opportunity from there.
