Constitution can be amended in 3 ways; Amendment by simple majority of the parliament. Sir but Article 368 said Amendment by simple majority we can't call it amendment
Bill has no future if the houses are on a deadlock. You can say it that the Bill won't proceed further & no amendments will be incorporated into the Constitution. There are 2 cases. a. If introduced in, and passed by LS, & not passed in RS, the Bill lapses automatically when the LS dissolves b. If introduced in, and passed by RS & not passed in LS, the Bill is stalled indefinitely as RS is a permanent Body
Sir I have a question What if in special majority we get more than 50 percent of votes(more than 272 vote) but can't get 2/3rd of total voting members. Will it be passes or not. For ex. 540 members are voting and they got 300 votes but 2/3rd of 540 is 360, so will it be passed or not?
First & prior condition is getting Two-thirds of the members (in your case 360). If getting 360 is not possible, then no point checking for 50% bar ! The Amendment bill stands a failure ! !
SIR PLEASE MENTION WHERE U HAVE TAUGHT THE MNEMONICS, we don't know about any or while teaching atleast say it once again, its a request@@AdityaTiwariUPSC
Sir agr special majority ( ratification of half of state) 👉 isme ek bhi state nahi sath diya toh kya bill pass ho jayega Kyu ki parliament ne state se poochkar formality toh poori kar hi di ! Or strong toh parliament hi h ! 37:42
If the amendment bill intends to change the federal structure, then, under art 368, half of the states have to agree with the centre. If the states do not agree, then that amendment bill stands a failure
Sixth scheduled can be amended by only simple majority, still Sonam Wangchuk sir is facing so many difficulties to give the ladakh 6th schedule. We can surely say that MPs are not deserving of parliament seat, at least after seeing the power of parliament. They are just corrupt leaders, seeking the benifits of Parliament and destroying the country.
Indian Constitutional ammendments require 2/3rd majority . But several ammendments have been done by Indira Gandhi and Rajeev Gandhi without even discussing in the Parliament . Those so called ammendments should not require any majority support to be scratched now , after so many years . Please clarify .
State there means : the 28 states (UP, Bihar, Rajasthan, etc.) do not have any power to amend the Constitution by themselves But when you think of Parliament (LS+RS+President), this 'state' does have the sole power to do so
Suppose, in national interest, there is a need to create a nationwide law on fisheries (which is a state subject, hence different states have different laws in their territories). So, only Centre can make such a Law which has pan-India jurisdiction. Then only Rajya Sabha can initiate such a process by passing a resolution to that effect with 2/3 Majority (Present & Voting)
3rd Special majority - • 2/3of the present member present and voting. •more than 50% of total membership or seats. • at lest 50% of state legislatures voted.
Sir in lakshmikanth it's written fundamental duties are enforceable but on NXT page it's written not directly enforceable...r they enforceable by law or not ???
Sir apne 2/3rd majority nikal ke har baar +1 kara required ke liye.....magar 49:24 president ke time ki 2/3rd majority pe apne +1 required nhi kiya...direct 2/3rd kr dia.....esa kyu??????

Sir in lakshmikanth it's written fundamental duties are enforceable but on NXT page it's written not directly enforceable...r they enforceable by law or not ???
They are not enforceable, but Parliament can make certain provisions related to punishment. Hence the statement not directly enforceable
Meaning state must enforce it through citizens but it's non justifiable meaning you can't go to the court for its enforcement... it's our moral duty!
