I don’t really think Portnoy understood what the lawyer was asking. He knows he had the guy make the T-shirt after he fired Rappaport. What he is insinuating is that Portnoy had the T-shirt designed already. Dave Portnoy doesn’t say anything about whether he had the design made yet or not. He just says it was instant how could it be instant unless the T-shirt guy already had the design. How is that the exact opposite of what the lawyer is insinuating?

Try spending a day in the shoes of a trial lawyer. They get tons of discovery thrown at them all at once. Believe it or not, no matter how good the lawyer: Things like this happen every day in depositions.

BREAKDOWN:
- the lawyer is trying to get Dave to say that he already had the shirt made and was just looking for a reason to fire Rapaport, which is wrongful termination and illegal. And why Rapaport is suing Dave.
- Dave’s recording proved the opposite showing the shirt came after the termination and he had reason for firing Rapaport.
- the lawyer tried to twist Dave’s words in the recording to mean that Dave was just waiting for a reason to Rapaport when in reality that statement was referring to releasing the shirt for sale, because Dave’s explicitly states he was waiting for Rapaport to say something after being fired to sell the shirt bc he knows Rapaport is a drama queen. Lawyers will always try to twist people’s words to mean or intend something they do not. That’s lawyering 101.

Curious how a T-shirt "justifies" the termination. If anything, it's used to articulate cause after the fact. DP knew MR, who has a notorious mouth, would do exactly what he did. In effect, there can't be defamation in predicting exactly what someone does, then they do it.

My former job had me testify a lot in jury trials, and I learned that a defense attorney is actually the biggest threat to their client. They try so hard to create a "gotcha" moment with witnesses that it often ends up strengthening and proving the prosecutions case when they end up destroying the doubt they are trying to create.

Context is key. “I was waiting for him so say something so I could release it.” Lawyer thought portnoy was waiting for an opportunity to fire him. In reality, the firing had already happened and portnoy was waiting for him to retaliate so he’d be justified with the tshirt.
How to make PICKLED CARROTS🥕! These quick pickles come together in a few minutes and you can use any carrots you have on hand.
