    The issue of jury trials with high profile cases like this. The old/current system of a jury of your peers who have not been polluted with opinions on your accusation is not really possible with the current situation. Its not really.viable to sequester them completely away from media coverage.

    Quick Recap on the Photo:
    It was not one, but TWO frames squashed together to make a single - changed frame. i.e. Not a frame of video from the night of the incident. Anyone with editing experience knows any 2 frames can have subtle differences in a video. Combining these frames brings in Data that does not belong there.
    *Anyway, none of that is relevant. The Claimed Support hand in that still is a light reflection on the Vehicle. It remains there 4-5 frames back when Kyle is several feet out of position and still has the extinguisher.
    The real rip in all of this is that the Drone footage is in fact key to answering what caused the vents of that night to unfold, but everyone is so stuck on Rosenbaum and Kyle they completely miss it.
    * Ziminski planned an Execution. He walked around most of the night with Gun in Hand, just waiting for the opportunity to execute his plan. (Much like Reinoehl in Portland)
    The Plot:
    Ziminski - the Hero Savior
    Rosenbaum - the victim of a crazed militia attacker
    Kyle - The Target of the plot
    *Ziminski is to step forward and Back Kyle to the front of the Vehicle - where
    Rosenbaum is to Tackle Kyle - then
    Ziminski would Step in and Shoot Kyle - Claiming he was threatening them with his rifle.

    Ziminski and Wife also set off the Chase after Kyle, yelling to Get him, Ge him, cranium that boy, etc. - then disappear into the crowd and leave.

    1) Kyle has no idea how lucky he was.
    2) Binger is an Egotistical Moron that completely missed a Murder Plot and Prosecuted the wrong man.

      @@saf2197 All True and now that Binger was made a fool of in Court he is going after Dominick Black on the Same firearm/Minor law the Judge dismissed against Kyle.
      This DA is an absolute POS, as is Lying Kraus. Kraus had the software on his court laptop to manipulate, crop and compress video, yet he claimed to not know anything about how any video editing worked. He even attempted to blame Binger for the different File Name......... as Binger sat there shaking his head no.
      *I know the judge will not do anything since Kyle was acquitted but he has all the evidence he needs to press for Both prosecutors to be investigated and brought before the Bar.
      As for Kyle raising the Rifle - No, it never happened and the last call for Mistrial was due to the defense receiving he evidence Binger had presented the misleading Photo and the Detective lied when claiming to Verify it.
      The supposed support hand on the magic Rifle was nothing but a light reflection n the Duramax that stayed even when Kyle was not there.
      overlaying a Rifle model, even using the reflected light as a support hand would place the rifle i a 45 degree angle skyward - not at any person

      Thank God someone else sees how it all played out. I’ve been screaming that Zimenski is the damned key to this since first seeing the drone footage. I had my suspicions from something Richie McGuinness had said describing the events before that but the drone footage made it obvious. The fact that the DA got away with letting that ass avoid testifying by charging him with arson and delaying his trial is sick. And if any prior act/character evidence should have been allowed it’s Rosenbaum’s suicide attempt and battery charge. It completely explains the kind of mind a person has to have to attack a kid with a gun IMO. The dude had zero regard for his own life or anyone else’s.

    Actually on the same day of the Rittenhouse verdict a black man in Florida was acquitted on self defense when he fired at police because he didn’t know they were police. I wish I had the name of the man atm, but a google search should give you the answer.

    If I were the defense, I would’ve asked for a mistrial with prejudice after the “enhanced” video was introduced. And after finding out that the copy of the video delivered to the defense was a lower resolution copy and not the same as the one the prosecution submitted as evidence, I would’ve been even more insistent on mistrial with prejudice. The prosecution’s incompetence (and I’m being charitable) has tainted the whole case with prejudice against the defendant. Their malfeasance is so egregious that it constitutes a violation of the defendant’s right to a fair trial by an unbiased jury.

      Disagree- the Prosecution provided the "raw data" & Richards could/should'eve done his own enhancement, with an expert he trusted.
      (In a murder case, where "cause of death" is in question the Defense can order a 2nd autopsy, but that 2nd coroner doesn't rely on the 1st coroner's report they only get the "raw data" aka the corpse)
      Had Prosecution supplied the enhanced version the Defense would have argued for a mistrial for being supplied "altered" & not "raw" data.
      The veracity of "photo enhancement" argument was settled in the '90- the 4mb vid vs 11mb version would have ZERO bearing on the fact that it shows Kyle turning on a dime while Rosenbaum is in full run, Kyle shooting him too soon to claim Rosenbaum lunged at or grabbed at his gun.
      HOWEVER, IF THE DEFENSE COULD PROVE THAT THE PROSECUTOR HAD SPED UP THE VIDEO TO "ENHANCE IT" WOULD THEY HAVE HAS GROUNDS FOR A MISTRIAL. & that's not what the D is arguing.

      1. It’s prosecutorial malfeasance to show evidence to the jury before first providing it to the defense.
      2. The prosecution’s case rests on provocation; wether Kyle pointed his weapon at the crowd just before Pedobaum started chasing him. No witnesses have been brought to testified that Kyle did. So the prosecution’s case rests solely on the “enhanced” video.
      3. As for shooting too soon, Pedobaum had plenty of warning. Once under chase, Kyle aims at Pedobaum but doesn’t fire, choosing to further retreat instead. Second time Kyle turns around, Pedobaum launches at Kyle and reaches for the rifle (as per witness testimony and video evidence). Kyle was justified in shooting. Pedobaum got what he asked for.

      As for the judge’s take, he has a wait and see attitude (he seem to do that a lot). He said so himself regarding his ruling on a mistrial. He even talked about a day of reckoning for the prosecution.
      I have been watching the trial live every day. Without commentary. Just the live feed from the court. And Kyle Rittenhouse should be found not guilty of all charges. That’s based on the facts of the case.
      As for my opinion, Rittenhouse should get a medal and a movie deal.
      Now dilate and seethe.

    On a previous video on the topic someone commented how video taken with a mobile phone or a tablet can even mix frames together to improve the perceived image quality. I checked about that a bit and it is actually a thing. So when there is little light the software can try to guess the color values of pixels by comparing changes over several frames and these changes are then written in the file. This can cause all kinds of insane changes on the smallest image scales, but looks decent when viewed normally. I don't know which brands/models do what, but it seems like there needs to be a national level study done into it which could be used as a basis for future trials.

      @@xaby996 The point is that there is no "original" in the same sense as an analog or "untouched" digital recording could be thought to be. If you record video, but the saved file has already a bunch of filters etc applied to it then clearly it does not represent reality in the same way one might expect. On a pixel peeping level what one sees can in fact be more digital artifact and software creation then reality. There is no difference when viewing something very clear to each viewer, but that could be tested as well for example the jury having to recognize a defendant or object by the image alone without any help. If they're unable to do so then clearly it is not obvious and an expert witness is required.

      @@tcritt Something like Nearest Neighbor Scaling, bilinear or bicubic or similar traditional methods have nothing to do with more modern methods that mix frames and create expectation profiles based on the overall characteristics of an image. Surely there are much fancier "AI" solutions as well. To an extent there are similar issues with any digital transformations made, but these newer kinds are notably more questionable. Imagine with even those older ones if someone would just down- or upscale an image step by step until it looks closest to what the claim is. Some Scene Optimizer bullshit my phone makes huge changes to the photo that can then be called "the original" photo.

    It's a white blurb, that loosely looks like the arm gesture of someone raising a gun.
    However, if it is to be perceived as that, then it would mean Kyle was aiming with his off-side..... instead of right- hand on grip as with how he's done in all of the footage.
    The image is just a mesh of like- colors, that when combined from a certain angle while blurred... looks like the sleeve of a raised arm.

    If you watch the reading of charges and court instruction before jury deliberation, if he is found to have perfect self defence he beats certain charges straight out, no need to look at lower degrees for that specific charge. However just self defence is not adequate to clear certain lower degrees of the charges. This doesn't necessarily track to the reckless endangerment charges I don't think.

    The rifle law was not at all ambiguously phrased. In fact it was one of the clearest laws I've ever seen. Nobody under 18 can use a rifle with the following three exemptions: They are hunting, they are a service member, the barrel of their gun is longer than 16 inches (and they are over 16 years old).
    They literally have the law stated, a set of conditions to convict, and then a section specifically for exemptions. It's the most layman law I've seen.

    The problem is that some of the functions in the software the prosecution used produce imagery that is not supposed to be used as evidence in a court of law, but only for investigative purposes. If an algorithm is generating new images using multiple frames, as is the case with various upsampling algorithms or AI algorithms such as DLSS for example, then that function is producing CGI images, how tf anyone thinks it's legit to use computer-generated imagery as evidence is mind boggling. That's not even accounting for the anatomy of how one is supposed to believe that Kyle magically teleported his sling and rifle into a left handed position and then back again between frames, that would be one hell of a trick.

    The video @41:00 *IS* the most important piece of evidence but to me, it doesn't make sense. If he was pointing the rifle up he would have had to turn 180° which he doesn't do in this video and since he didn't turn 180° he's pointing the rifle down which is how it normally sits when attached to the sling. Am I wrong on this? If I am, why? Genuinly curious.

The defense had a better closing overall but suffered from similar problems of becoming meandering after a while. But what really sticks out as the highlight of that day was the rebuttal. I don't see how anyone can contest their arguments anymore, the ones that really convinced me were "he brought a gun to a fist fight and was too cowardly to use his fists to fight his way out" and my favorite "Everyone takes a beating sometimes", I've never heard such good arguments before.

    I feel like the prosecution tried to have a Perry Mason moment with this video and cropped in photo.. to me they just solidified his self defense claim more. He’s not in any kind of way brandishing the gun. The drone video shows more clearly how Rosenbaum charges after him and reaches for the gun BEFORE kyle shoots. I don’t see at all what prosecutors are trying to show here. I’m guessing neither did the jurors? Obviously?

    I’m guessing a mistrial. Either way, Kyle benefits. A mistrial with prejudice, he walks. A normal mistrial, the state MAY press charges again, and the defense (hopefully a new one) will be more prepared. It’s obvious that the prosecutor and defense are begging the judge for a mistrial right now, and the judge is just not granting it. The prosecution has blatantly overstepped the line multiple times.

In that video, Kyle didn’t have his gun, isn’t being chased, isn’t attacked, and doesn’t have to run away from a violent mob. If your best evidence of him being a bad guy was meeting some people in a bar, then you’re going to have to prove that
      A: He knew about the proud boys before the shooting
      B: He knew that the people at that bar were proud boys either during the meet-up or before.
      C: That he knew that idiots like you think the Ok hand gesture is a white supremacist symbol because you all turned a 4chan prank into what you genuinely believe.
      D: Any of that prior stuff waves his right to self-defence while someone grabs his gun, and then a mob attacks him.
      So far, you’ve not met any of those basic requirements, so all you can do is cast baseless conjecture in the hopes to smear someone you don’t like.
      Kyle wasn’t the only shooter that night. Before he even fired, Joshua Ziminski fired his pistol in the air moments before Rosenbaum lunged to steal Kyle’s weapon. Being charitable to you, I’ll assume you mean that he was the only person that killed anyone that night, which is true. Only Kyle killed anyone that night, but only Kyle was attacked by a man who reached for his gun and had threatened to kill Kyle if he found him alone, only Kyle was chased by a mob yelling “cranium that motherfucker” and “beat his ass” while that mob chased him for multiple blocks, only Kyle was hit multiple times by with a skateboard and kicked in the head, and only Kyle had someone fake surrendering and pointed a gun at his head.
      There’s no evidence that Kyle’s gun jammed at all. If it did, then there would have to be alive round at the scene. Since the detectives happened to find every single round that Kyle has been alleged to have fired at the place they were alleged to be fired, what happened to that bullet that would actually confirm your bullshit lie to be true. At that close a range, even using one hand, Grosskreutz was absolutely capable of hitting Rittenhouse and might not have been able to unless he actually got as close as he did. Grosskreutz even admitted on the stand that Kyle didn’t shoot at him until Grosskreutz pointed the gun at his head. Kyle was willing to let him back off while Grosskreutz decided to attempt to murder Kyle. Grosskreutz also knew that Kyle would turn himself into the police because of a brief conversation they had before Grosskreutz decided to join that violent mob. He must have been able to see the police lights that Kyle was running towards before Kyle was forced to the floor due to a person hitting him. When watching the video of Grosskreutz being shot, you’ll notice that Kyle’s gun wasn’t even pointed at him. It was pointed at the ground until Grosskreutz started to aim at his head (Grosskreutz, funny enough, was the person not legally allowed to carry a gun out of the two of them). Also, Grosskreutz didn’t have plenty of time, it was a fraction of a second between Grosskreutz pointing the gun at Kyle and Kyle shooting, it’s not like he was just staring at Kyle for 15 seconds and then Kyle shot him, it was literally a split second action and Grosskreutz roommate posted to social media that he had spoken to Grosskreutz and that his only regret was to “not emptying the entire mag into him [Kyle Rittenhouse]”.
      Stop being a delusional partisan, and if a protestor were in the same position, I’d absolutely be arguing it was self-defence.

    Just to speak on what the prosecutor was trying with the judge, he was hoping (stupidly) that it would be better to ask for forgiveness rather than permission. Judges have A LOT of leeway to fuck up your case based on a whim. He should have known better and definitely deserved a chewing out. Another thing I wanted to touch on is that it was a VERY good play by the defense to have Kyle take the stand. Juries and judges are looking at the defendants emotional state all the time, and him showing genuine emotions (and yes, I do think he's experiencing genuine trauma) shows both parties that this is not the outcome he wanted

    40:50 apart from the artifact(WHITE BLOB) which Binger has been priming everyone to believe is the barrel supporting arm of Rittenhouse, do notice that the distinct bend in the arm one gets when holding the rifle grip is usually on the right side of people who are right handed(on the blurry video however it is on the left side of Kyle) AND KYLE IS RIGHT HANDED (as seen in umpteen clearer videos of the day).
    So the prosecution is either reading it wrong and have succumbed to confirmation bias or are straight up lying.
    They did hide the HD video from the defence so I'm guessing they are upto no good.

    About Ziminsky: he cannot be brought to testify by the defense because the prosecution (same individual) has him on arson charges so he would self incriminate. 5th amendment.
    However, if the prosecution wanted him to testify they could have expedited his trial (they actually intentionally adjourned it until the end of KR's), given him immunity or dropped the charges.
    So the bottom line is Ziminsky couldn't testify because the prosecution didn't want him to.

    I'm from Europe, from Italy to be exact and I am about to finish law school. I think that if destiny is right about saying that "anything can happen in jury trial" is a little bit fucked up. A verdict should be based on the evidences and not about the feelings of the jury. Idk, I'm not knowledgeable about US court system though

      I'm not a law expert by any means, but I think its just theoretically possible. The lawyers are also involved in jury selection, which has its own problems. And I believe jury decisions have to be unanimous. And if with all that and hearing the evidence, the jury comes to an unjust decision, then the defendant can file for an appeal. I would think the prosecution could call a mistrial as well

      It’s not true, a judge can overturn a blatantly unreasonable jury guilty verdict (see judgement as a matter of law). On the other hand, you can never be sure of a conviction since the jury is within its rights to say not guilty, even if guilt is clear.

    Applauding vets is common. Especially in airports. It became popular during the iraq war and is one of the most uncomfortable andawkward situations i have ever been in. For anyone who cares, please dont thank us for our service its is extremely awkward for many of us. Instead phrase it like " i appreciate your service" instead of thank you. it gives us the opportunity to say thank you instead of " your welcome" which is an extremely uncomfortable position to be in considering the size of the military.

    That "most important piece of evidence", i wouldn't be able to trust after catching a bit of the trial yesterday. The prosecution provided a different version to the defense and didn't verify who delivered it.

      The jury doesn’t know about that whole situation though. The bad part about it is that Kyle’s rights were violated. The state has the responsibility to ensure that the defense has all evidence that is going to be presented in the trial, and they did not. It’s not the defenses responsibility to ask for something that they couldn’t possibly know exists.
      Just another point towards appeal.

      As I understand, the video was revealed to the prosecution after the trial started. I believe they originally got a lower quality video as well, and eventually obtained a higher quality file from the drone operator.
      Apparently it was the mail App or Airdrop on iPhone which compressed the video.
      Comedy of errors, and some willful perversion of the situation all around.

      @@Raigan_Avalon idk about metadata. I didn't state that. Apparently some counties and states have a Dropbox like system for this sort of stuff, but wasn't available here. So individual means were taken. I can easily see this as accidental. Considering tech ignorance, and the fact prosecution even had to go back and get a higher quality video.
      No doubt the defense has exploited the situation whether unintentional or not.

    I love supporting your work and being a subscriber of yours but what really irritates me is when you feel like you have the nerve and the ability to speak on something when you didn't even give it the full time of day. You refuse to watch all 10 or 12 days of the trial. If you did then you wouldn't be making such outlandish comments saying oh well maybe Kyle started the problem or maybe this maybe that, if you read and watched the trial every day it was on from the beginning to the end, then you would know everything you need to know. Kyle was running from Rosenbaum because in the clip that you showed you can see something shiny right near Kyle as soon as he starts to run away from Rosenbaum. Later in the trial it comes out that he was whipping a chain like a circle in his hand. He had a doubled up huge stainless steel chain walking around threatening Kyle with it and that's why he started running from him. And the autopsy photos in the trial show that Rosenbaum is missing his fingers and has gunpowder on his hand because he tried to grab Kyle's gun out of his grip and Kyle fired his gun because Rosenbaum went for it. and there was a solid wall behind kyle, he had nowhere else to run so he was cornered. You would know all this if you watched the trial. It could be tedious work but you can just watch and listen to it in the background while doing something else and in the long run it'll help you and benefit you because you'll be able to tell your subscribers the information they want rather than guessing all the damn time. Not that hard

    Almost anyone experienced with the criminal justice system where i am in Miami, meaning anyone who has been arrested or been in jail or on probation, has told me between 5 years probation and a year or 2 in prison they will almost always choose the time inside because probation is SOOOO easy to fail for the smallest bullshit reasons. Certain traffic things CAN violate your probation, they have to call your job, your landlord, everything sucks on probation.

    - play the video
    -now pause
    -now close one eye and squint really hard, can you see the unicorn?
    Defence: objection your honer, this is not valid evidence
    Prosecutor: your honer, I think we are all familiar with how when you squint, you can see things that aren't really there, this is not something new I am introducing.

    A video clip would have to be extremely detailed and salacious, a far cry from what actually has been presented, for me to change my opinion that kyle was the victim of a violent incident that night. No video exist of him acting provocatively, with malice, with prejudice. Richie McGinnis was essentially vlogging the movements of kyle acting as a 3rd party subjective witness, not once in all the hours of testimony, video recording, written articles and interviews given by McGinnis even lightly touches on kyle being an aggressor in any way. McGinnis interviewed kyle less then 14 minutes before the first shooting, there isn't even a throw away line such as "kyle was ignorant to how his actions could be seen as threatening" or "I don't think he meant it but his tone was very aggressive" instead we are painted the scene of a naive 17 year old who wrongly assumes that his exposed rifle and non threatening demeanor give him immunity from the violent ill intent that was growing around him. Wat McGinnis does point out however is something far far more insidious and dark, he has found himself in more than 1 dangerous situation being a reporter on the ground covering many large gatherings and upheaval, he was able to.immediatly identify the warning signs popping up all around him. I can imagine it now, the body language, the posturing, the tone of the crowd, the Erie silence that happens when men are taking position and preparing for battle. He saw faces start to go from uncovered to covered, he saw hands disappearing from view, veins start to bulge with increasing bloodpressure and the abjecation of responsibility that plagues mob mentality building. He knew before anything had happend that kyle was likely already gleefully participating in his own death. What ever happend after this is irrelevant to me the.ziminskis and Joe Rosenbaum have already begun thier offensive attack. People have this stupid idea that aggression can only be acted out physically or verbally. Ask a female who is cornered I a dark alley, her route to escape blocked and the men tightening in on her position if it matters what they said or weather they hit her or weather it was scary enough on its own. I kno men who are scary enough to make you shake without saying a word. If I enact a plot to harm someone but we don't raise our voice and we don't strike anyone physically does that mean my actions were not malicious and with ill intent? Had Rosenbaum and ziminksi not hatched thier plot kyle would have gone home that night and noone would even know his name. We only know him and are able to judge his actions because he was attacked. Its victim blaming and its disgusting

    I’ve just wanted to ask a question, legally no you can’t use deadly force to protect property, only in situation where there is risk of bodily harm/death to yourself. And I agree we shouldn’t just jump to shooting someone because someone stole a candy bar.
    However this feels like it creates a weird situation, where we argue that just having a firearm can deter crime from taking place, and for the most part that’s true..but if someone who wants to rob/steal/destroy stuff knows you Can’t legally use force, it stops being a deterrent
    Can we really argue that’s it fair, if the police wouldn’t stop that behavior that a person is just suppose to allow it to happen to their property?

      Nah, you should legally be able to use whatever force is required to stop a crime if you have good reason to believe that they are committing a crime. If it’s something like a candy bar, you probably shouldn’t do that morally, but you should be able to legally. I just can’t have that much sympathy for a thief when they are shot for thieving.

Look at soldiers, not just in more messy modern wars but literally any of them. You guys really think Rittenhouse wouldn't change a single one of his actions that night, that if he is acquitted any nightmares he's having are just going to stop when the trial does?

    Is Kyle's defense team local or did he bring in people? It's very likely that the judge and prosecutor socialize outside the courtroom. Often times well known defense attorneys in courts are also in those social groups

    The zaminkys threw a bag at him to get his attention. As soon as Kyle Rittenhouse turned around to see, he noticed them chasing after him. He drops his fire extinguisher and tries to deter then from chasing him. He realizes Rosenbaum doesn't stop and that's when he shoots him. We've seen footage of all of this and the prosecutors want to twist it around and say that Kyle was chasing rosembaum. This is ridiculous.

      It really is though. This is cut and dry of self defense. Let's say for whatever reason it wasn't, he killed a child rapist, wounded another known criminal and killed another criminal who likes strangling his victims. Their criminal sheet is public. To anyone who doesn't believe me, just look up their names and their crimes. Kyle is a fucking hero in my book. Also, the timing of the dude getting out of the mental ward a month before isn't just a coincidence.

    As soon as I got out of basic and ait I was on a plane during christmas and was actually moved to tears as the pilots had the whole plane clap and recongnize me and another buddy as the plane landed...so it does happen and its very overwhelming....we werent even veterans at the time

    The one thing i find biased here is that the judge ruled against that last piece of evidence of Kyle saying to his friend he wished he had his AR so he could shot them.
    It's a very weird train of thought that because Kyle did in fact not act there and called 911 instead it somehow means he's not prone to vigilantism.
    I mean he's literally saying he would shot them if he could and the fact he didn't shot them might well be because he didn't have his gun. This could of course just be young men acting tough and doesn't prove anything but i don't see why the jury wouldn't be the ones to decide that?

      I saw the hearing. Basically the CVS thing was different place n time, and likely just teen talk. Pretty much video n witness evidence show us Kyle was defending himself.
      Note judge did not allow attackers criminal record. This is huge esp for Rbaum the child rapist.

He comes back and objects to something that is really small and claims judge isn't following his own rules when it was real unclear and funny wording over the objection. What people don't mention is THAT THE JUDGE GRANTS HIS OBJECTION.

    There is evidence (an unfired round from Grosskreutz's pistol found at the scene) to suggest that Grosskreutz tried to shoot Rittenhouse but the pistol misfired and he lowered it to cycle it before he could shoot him.

    Did he say prior act evidence? All of the guys that attack Rittenhouse have large criminal background. Rittenhouse on the other hand has a clean and admirable background. Bicept guy got his 2nd DUI right before the Kenosha incident.
