    I used to manage the RUclips channel for a friend of mine, a recording artist who had a couple of hits (including MTV airplay of the video) in the 90s. She had been on Atlantic Records at the time, so Atlantic owned all her videos from that period, even though she hadn't been on the label for years. Somewhere around 2010 or so, we found some old 3/4 Inch U-matic videotapes of her videos, which we had digitized and posted to her RUclips channel. We thought the fans would enjoy the blast from the (relatively recent) past.
    The videos lasted, if I remember correctly, something like 4 or 5 days, at which point they were taken down due to a copyright claim by Atlantic Records, and we were warned not to try it again lest we lose the channel. We tried to argue, but there was basically nobody to argue with. I think YT has a challenge process now, but it didn't back then. So basically, my friend couldn't put her own videos on her own channel. We even had her lawyer (who happens to be a pretty high powered entertainment lawyer who represents some pretty big name people, way bigger than my singer-songwriter friend) try to reach out to Google, or to Atlantic, or to anybody, and basically he said it wasn't worth fighting. So we gave up. But you want to talk about a broken system? How about a system where a musician can't post their own videos? It's insane. And it serves no one.

    • @denaeads9745
      @denaeads9745 2 года назад +4

      They aren't her videos. Atlantic Records paid for them and hired her as an employee. She sold her songs to them and possibly her name and her likeness.

    • @tonycamas9747
      @tonycamas9747 2 года назад +3

      @@denaeads9745 Sure. And that points to another problem of the music industry. For every one artist that "makes it" there are dozens, or hundreds that just scrape by, or, worse, end up in hock to their labels because they never are able to make back the money the label spent on them, resulting in them losing all, or most, rights to their work product. I don't know what the answer to that is, but it's a shame, especially when you consider how many incredibly talented people toil in obscurity and never work their way out of indentured servitude. The labels aren't necessarily the villains in this story -- they're just businesses, trying to feed their families like everyone else. But the system is flawed; I don't think anyone would dispute that.
      But, as I said, that's a different topic. My point here is that the videos that the labels spend all that money on, they are created for one purpose and one purpose only, and that is to promote the songs they cover, along with the albums and the artists in general. The album that contains the songs whose videos were blocked is still sold (albeit in very small numbers) by Atlantic, because yes, they own it. So what purpose does it serve for them to block the videos from being shown by the artist who wrote the songs in the first place? They can only stand to benefit from the videos airing. Why try to stop it?

    • @BobKerns4111
      @BobKerns4111 2 года назад +7

      @@denaeads9745 That's NOT how it works. Musicians are not employees. What Atlantic Records owned would have been specifically *recording* rights, that is a specific recording.
      Note what Taylor Swift is doing, re-recording her own songs.
      Of course, she might have signed away the rights to the compositions themselves, which would be a poor business decision. But it definitely is not automatic, and definitely is not part of buying (not hiring) buying rights to a recording.

    Music is blocked out of FOMO. Fear of missing out on royalties. Fear of losing a revenue stream that dried up years ago. When the Eagles and the Beatles were current on the charts, record deals were THE thing. Gold, platinum, and double platinum meant money. The aged musicians don't know how to deal with gravy tap being turned off. Your point of introducing new, younger listeners is extremely valid. Someone needs to explain the situation to guys like D.Henley.

      @vibratingstring Except it isn't. As Rick pointed out, YT can monetize the video and pay the copyright holders that money. It's actually more democratic than a bar owner getting a license, because that license fee is split up among artists who might never actually have a song played there. Radio stations submit audits of what was played in a fiscal year, but bar owners? Nope. YT only blocks stuff if the copyright holders jam a bunch of lawyers up their ass to make them do so. It's an interesting point Billy raised and it may well be something of a factor, but the fact that there are (for instance) lyric videos all over YT which are obviously monetized by the actual copyright holder proves that YT does in fact have a way to get the correct people paid.

    In 2017, Haley Reinhart's 3rd album was a cover album of songs her parents raised her on from the '60's. She flew her parents to LA to have them record on it, on analog tape, using engineers who worked on the original songs. After the album came out, Jefferson Airplane, The Zombies (pre their Hall of Fame induction) and the Turtles all reached out to Haley to thank her for bringing their music to a NEW generation. REAL musicians want their music, their legacy to go on, to be enjoyed by their fans, to be discovered by new fans too young to have known the songs when they came out. This is why the music business sucks. They only think about now and what 'belongs' to THEM, they don't give a fnck about 'legacy' and 'artists'

      Could it be the artist were appreciative and there were no problems because they would be getting paid if they had publishing? I wonder how the artists would have felt if the music was covered on RUclips with no income for them? It could be artists from yesteryear have made their money and hopefully are doing OK now and just enjoy hearing the music go on and inspire but there are many who still need or want that money. It’s a tricky decision. Do you clamp down on any infraction, protecting your creation or hope that it’s presence in a popular medium actually generates an increase in DL’s or purchases that would eclipse people finding it because it is blocked on free outlets? So glad I’m no longer trying to make a living as a musician. It was an impossible dream when there was a traditional industry…now…no way.

      @@daviswall3319 1.) Bad music is derivative of something else. Good music is born out of/expands something else. Beato isn't doing either-- he's discussing OTHER people's music and he is repeatedly complaining because those people want to be paid for their work, but he's not making enough (off of THEIR work) to share with them. There's an easy solution here-- he can make his own music, break it down to explain those same concepts to us, and keep all the money to himself without anyone else having a LEGITIMATE claim to it. If he can't create his own compelling music (no shame there), then it simply proves that he needs other people's music to do what he does-- and they absolutely have the right to not permit it.

      I went through a long phase in my early 20s of listening to Jimi almost exclusively, and also learning to play his songs on guitar, drums, and bass guitar. My friends were all thoroughly annoyed and didn’t care for most of it, and this was late 90s early 2000s
      Long guitar solos and rough recordings are better in my mind than modern pop with all of its production and sterility, but I’m not sure how many young people agree

      Jimi's half sister is in charge because their father is gone. And neither of them is exactly record business savvy. Hell Jimi wasn't! She has lawyers and advisors telling her what is right and all she wants to do is to protect his legacy, because the record industry chewed him up and spit him out. You know he was mostly broke when he died right? Well his record company sure as hell wasn't. She is a sister of a dead guy who got taken for a ride and used and abused by the record business. All you have to do is just go to any of the thousands of currented playlists for every genre including classic rock and get exposed to stuff you have not heard. The music of the 60s and 70s came out 50-60 years ago, its like being sad that the young people of the 70s were not appreciating the music that was made in the 1920s. He even tells me sometimes that his friends will play a new remake or a song that was clearly ripped off from an original, and he always likes the original better, then tries to introduce his friends to it... so in a very small way, I am trying to do my part... keep the faith Rick! Yet, the entire album is unblocked on other channels with no "value added content". I agree channels like yours and Doug's are another avenue for the publishers, record conglomerates and, hopefully, the artists and writers to receive an additional revenue stream by exposure to your loyal viewer base. I think you hit the nail on the head with the difference between older and contemporary artists, and those who control the rights to the music of each. It's all to do with intellectual property. Those who control the catalogues of the older artists are still in the mindset of the pre-internet age, when tight control of IP rights was how they made their money. They still haven't updated their approach to the realities of the internet age, when control of IP rights, while still important, is actually a bottleneck in gaining exposure to new (i.e. younger) audiences when exercised so tightly. When will this change? Probably when the companies that control the catalogues are finally run by executives who grew up in the internet age, as the current generation of auld bastards dies out! So, ten or so years from now, when you retire from RUclips, you just might see the change beginning to come into effect. There are those that have recognised what the exposure brings. Vika and Linda Bull used RUclips during Covid lockdown in Australia to promote themselves with their Sunday singalong show, did a Covid version of Nutbush that got them 5 million views, rereleased their entire back catalog which you can listen to on Spotify and RUclips and put out an Anthology album. That album became their first number one seller in a 35 year career. They’ve now released an album of all new material, the first in 19 years and that’s on there too. There’s a whole new generation who would not know and love their music if not for the exposure that RUclips brought them.

    Rick you and I have the almost exact starting point..perhaps I’m a year older or two. Clapton was my man, he was the one who got me fired up. I ruined so many Cream albums try to learn his parts. So by the time 1978 rolls around, I’m getting a pretty good grip of their catalog. Then my brother in law ask me if I’ve heard the new Van Halen record yet. I proceed to hear Running with the Devil and loved it. But then Eruption kicked in and my life was forever changed. I went through several emotions, some disbelief. “Ehhh that’s not an actual guitar, and then quickly I figured out it was indeed a guitar, that was the 5 minutes that I considered changing instruments . Lol I then became very inspired to learn this magic that I just heard. I went to the Crossroads so to learn (or try to)with these VH albums. In the process really messing up my collection. After many years of struggling through the pre-internet RUclips years, I had somewhat developed a fairly decent handle on Ed’s style.Ed would always introduce the pieces of musical instrumentals that just blew all of us players minds and then it’d be back to the laboratory, in hope another video would come out, or Guitar World magazine would give us some music with some “tablature” in it. Me and my playing buddies would go over this stuff like we were searching for a cure for some rare disease. Today on RUclips I dare say there’s a video that will show you anything that you could ever imagine to want to play. It’s nuts...I love your channel Rick and watch it faithfully, such a diverse display of great music and talent. You did another great piece on Peter Frampton whose guitar playing was as big an influence, so that episode caught my attention. I was a touch jealous, but did get my personal audience with Peter back in 1992 just for a bit. I briefly played his replacement Les Paul while we both were trying to remember a particular lick that he does. We finally figured it out and I was floating. Ok I’ve written a novel here, so my apologies. Keep on doing you my brother, I’ll be watching! Peace and God Bless.🙏🎸

    Remember when labels wanted to ban the sale of blank tapes to consumers because of industry piracy hysteria? But, how many of us bought an artist’s entire catalog after being turned on to them by someone who gave us a cassette copy?
    This has always been a part of the industry, but around the time Napster happened, the reasoning shifted away from protecting intellectual property rights to normalizing the idea that you do not own what you buy. There’s a lot more money for the corporations in selling subscriptions than there ever was in selling albums.

    This copyright policy gone overboard may slowly be killing music. Part (not all) of the reason why so much (not all) contemporary music is _'dead.'_ Mindless, often automated and indiscriminate copyright implementation and music blocking may slowly bury both music history and ageless musical genius, hiding much from those it was written for, the audience. It may impoverish our musical soundscape, and risks relegating more and more of it to buried treasure status, until too much of it may become gradually lost and forgotten, like so many other things that are lost to us already, unrecoverable.
    There may come a time when only a rare few individuals will still remember some genius, innovative, unique parts of it, and when those individuals are gone, so much of it could be lost and forgotten, future generations will not even know what it is that was lost - what they, and in the sense of human existence, what _we_ collectively, as humanity, will have lost if that happens: part of our _'soul.'_

    It makes zero financial sense to block free advertising. For every song that I discovered on RUclips, I could listen to it hundreds of times in Spotify while practicing my guitar. My guess is that marketing and finance people on these companies probably understand this, but unfortunately the lawyers seem to be making the calls.

    I always look at the videogame industry as a comparison to the music industry and how it should be. Could you imagine if game companies copyright claimed all the youtubers and streamers playing their games? It would still be a niche thing "just for nerds". The gaming industry exploded because the developers embraced streaming and content creation. They realized it was a beneficial symbiotic relationship to growing a community, and games from the 80's and 90's are to this day still played as a result.

      I think you are onto something when you talk about “growing a community”, as it pertains to the video game industry. Clearly, that industry gets it and the music industry and also the movie industry clearly don’t. They choose to mothball all this material where guess what, it will all eventually die on the vine.
      I had a vintage King Super 20 alto saxophone and always figured I’d be able to sell it cause that’s the same brand of horn played by Cannonball. By the time I wanted to sell it, younger players barely knew who he was. By the same token, there are people in their 30’s who never heard of Elizabeth Taylor or Paul Newman. Greed, closed-mindedness and a lot of thinking that is stuck and stunted. It’s tragic.

      Other ads blast in later and I have to reach for the "skip ads" button to stop the racket. If I don't, a second ad starts in. If I turn it down, I can't hear Rick's voice when he finally returns.

      It may be RUclips itself inserting the ads. They changed their policy a year or so ago so that they now can insert ads on videos the creators have chosen not to monetize. The creator still gets no ad revenue (because they didn't monetize it themselves), but RUclips does.

      Determining what is transformative-and the degree of transformation-is often challenging, in order for court to accept fair use as a defense you need to have strong transformative quality. And what Rick is doing is not enough to justify a fair use defense.
      The less you take, the more likely that your copying will be excused as a fair use. However, even if you take a small portion of a work, your copying will not be a fair use if the portion taken is the “heart” of the work. In other words, you are more likely to run into problems if you take the most memorable aspect of a work. For example, court would never accept fair use defense if you copy the opening guitar riff and the words “I can’t get no satisfaction” from the song “Satisfaction.”
      Another important fair use factor is whether your use deprives the copyright owner of income or undermines a new or potential market for the copyrighted work. Depriving a copyright owner of income is very likely to trigger a lawsuit. This is true even if you are not competing directly with the original work.
      Claiming fair use doesn’t mean that the work qualifies as a fair use. Only a court can determine that, not you or Beato, only court!
      For example, in a case involving a Seinfeld trivia book, the publisher included a disclaimer that the book “has not been approved or licensed by any entity involved in creating or producing Seinfeld.” Despite the disclaimer, the court held that the use of the Seinfeld materials was an infringement, not a fair use.
      You see, I know about music business more than you. At the end I have so much connections in the music industry it's ridiculous to even try to attack me like you do. So please stop with that nonsense.

As a 60 year old man I don't have skin in the game, but I feel sorry for young people never to be exposed to great music. 30 or 40 years from now so many fantastic musicians will be lost to time and their music will be as popular as barbershop quartets are now. Much of the music that I enjoy came from being introduced to from older members of my family. Without them I would never have explored much of jazz or the Great American songbook. Such a shame.
