  • The police in the UK seem to think they can do whatever they like, using lies or blatant incompetence, without repercussions. Here's an example of a pair of Loch doon bananas. The police visit me to try to illicit an incriminating statement from me and want me to admit to some suspicion they have about something or other. They actually threaten to arrest me!

Yet again, we see the incompetence of more armchair 'experts'. A police officer is not expected to know every criminal law/statute off by heart. That's the job of lawyers, who spend many years studying law just to qualify, and then they usually charge lots of money for applying that knowledge. But even they can't know every aspect of criminal law. They have libraries full of law books to consult. Of course, I'm sure you know EVERYTHING about the law... don't you?

@@another3997 If an officer intends to arrest or enforce a law of course he needs to be competent in law that's his job , police cannot know everything but the basics are in PACE which they have access to at any time . There's only one problem with your line of reasoning. Police officers are NOT lawyers, they are only trained in the basics of the legal system. That's why the police (and you) have access to qualified lawyers, who ARE trained in law. But even they have to look things up in most cases, because no person can know every law in the UK. But I guess you never make mistakes? If an officer arrests you for a specific offence, but quotes the wrong statute, it does not invalidate the arrest, as long as the offence you're being arrested for is an arrestable one.

    • @another3997
      @another3997 Год назад +4

So you're a qualified lawyer, with expertise in every aspect of criminal law in the UK and Scotland who can reel off every statute without recourse to any legal texts? I don't think you are or that you can. That's the problem with all you armchair 'experts', you think you know what your rights are, but you only small bits, and don't know how it actually applies.

When I went through training in the 70s, we had to sit, (and pass lols) what were known as K and R exams. Knowledge and Reasoning. The question would be, typically, 'you are on or off duty, in or out of uniform, at a location, at a time of day, when something occurs. The answer, in essay format, you had to list any actions required or offences observed, then name the act and section which gave you the power to carry out your intentions pertaining to that scenario. In those days, we considered knowledge was an essential to power.

The drone phenomenon is relatively recent and I do not think coppers particularly enjoy having to knock on someone's door about an alleged drone infraction. I believe, Robert, that you have Lassie and Caledonian which are both under 250g. We, drone pilots, know that the Mini 2 and the Mini 3 are low risk drones that can be flown almost anywhere as long as safety regulations are respected, e.g. do not fly your drone near airports, over crowds or busy roads, or again close to somebody's windows, be in control of your drone, etc. The fact that these 2 coppers did not ask you what type of drone you allegedly flew on that particular occasion is in my view significant. It highlights the suspicion that the police authorities have not bothered training their officers to deal effectively and sensibly with drones related issues and are sending them to investigate complaints without being fully equipped with the knowledge of the existing legislation. So the responsibility for their obvious incompetence in such situations lies directly with the upper echelons of the police authorities, and the idiot(s) who reported you.

In Shetland they are notorious for stopping single drivers at night and accusing them of breaking the speed limit whether or not they are. They become aggressive even racist to try and get a reaction that they can use against the person. Threats of being taken to the station are couched as if the person is going to be arrested and interrogated under caution even although they have done nothing. The worst case I know personally of is a nurse going home from work in the dark having an unmarked car with two people in it driving dangerously up her back. She feared for her life and speeded up to get away from them but to no avail. After a certain distance they pulled her over and booked her for speeding. She was so traumatized by the whole thing she just paid the fine and got penalty points and wanted nothing more to do with it. Sad to say this is not the only case that is known about up here but it always involves lone drivers and usually lone women.

This idea you've got about the police not being entitled to be there without a warrant. You need to google what the term "Implied right of access" refers to. Next time a copper turns up at your front door, inform him you've withdrawn his implied right of access immediately and without notice. From that point on he's not entitled to be there without a warrant. Doesn't mean you'll get rid of him, just means he loses a few powers that he'll try anyway and gives you a mildly better chance in court.

Suddenly I saw two lights on full beam in my mirrors approaching me from behind and getting closer. I couldn't see who was behind because the headlights were on full beem. I thought I was going to be run off the road by some lunatic in a car so I opened the throttle and accelerated to try ro get away. Next thing I knew I saw flashing blue lights. I had no idea the car behind was a police car because of the full headlights. They forced me to go faster so they could justify in stopping me and accuse me of spending. I ended up in court and received a fine and points on my licence. That was in 1986. Because of that I lost all respect for the police. As far as I'm concerned they are useless and a total waste of space. Incapable of dealing with proper crime and only opting for harassing what they think of as easy options.

Hilarious 😆 Me thinks they need to go back to cop school 😂 Beggars belief sometimes. Around 30 years ago when I owned a Sierra Cosworth I was randomly pulled over & searched by the police one night because “a car matching the description of yours sir” had been used in a ram raiding incident in Leeds the night before 😮. I think there may have been some pretty major damage on mine if that was the case (there wasn’t 🙄). One of the officers was really keen and wanted to find and note down the engine serial number (not visible without removing several covers). The other officer was a bit more well informed and already knew this. They clearly had no leads and were clutching at straws to try and solve the previous night’s crime 😂😂

I don't think going back to copschool will help, Nick. They train cops to lie and escalate incidents so that the 'suspect' might either incriminate himself, or raise his voice so that the police can arrest him for Breach.

@@WindsweptRobert Very true. My dad was once asked by a cop if he’d put a recently extinguished propane gas bottle in his car that had been set alight in the builders compound on a job he was managing. You should’ve heard what he said to the copper. Lots of 4 letter words!!! 🤬. It stayed put 😁

Under section 13 of the Criminal Procedure (Scotland) Act 1995, a constable is empowered to require the name, address, date of birth, place of birth (in as much detail as the constable considers necessary) and the nationality of anyone whom they suspect of committing or having committed an offence.

Be honest Robert has Lassie been flying over Scotland with a hip flask full of whisky suspended from a piece of string below, offering sustenance to walkers and anti droners alike in the Scottish countryside ? If so I want to strongly protest as I live in NW England and feel like I'm missing out 😁

    Goodaye Robert,
In all fairness some whinner caused this.
Just as you were not fully aware of your rights and the letter of the law nor were these two.
I would think it rather difficult to know all laws / acts in regard to everything.
As this was not a dangerous encounter or an event requiring immediate police intervention , they should have been properly informed before going.
I believe you said 100K views. Now more people know about your channel and drones in general.
    All good.
Ps. In general I believe the police do a good job of keeping a small number of villians away from the rest of us most of the time.

      Hi Phil.
Aye, it was some whiner, no doubt.
I am not paid a very good salary to be aware of my rights (and the Acts of Law) - these 2 constables ARE.
It is very likely impossible to be aware of all laws/Acts in regard to everything. But if you are a police officer and you have been tasked to question someone re a possible aviation offence, you better get an understanding of those particular laws before you go and question someone about them.
PS I believe the police are interested in only their own benefit, and some kind of perverse pleasure in locking people up. Not a single police officer that I have known in over 25 years of working beside them has given me any reason to respect them.

    Hi Robert.
Welcome to my world, Robert, as a black man living in London. When I was eleven I was stopped by the coppers whilst doing my paper round. They said, "where did you nick that bike from, sambo" I replied that I bought it with money from doing the paper round. They asked to see the receipt, I said I didn't have it on me, and they took my bike and told me to bring the receipt to the police station to get it back. Decades of similar harrasment have followed.
The police hate people who don't acquiesce in their presence. Which is why they lie and expose their incompetence. As they have done to me on numerous occasions, and to you, as they trespassed on your property.

I have almost no understanding of how it must feel to be a black man (or any man who is not white) living in the 'civilised' world. I can see the extra hurdles that non-whites have to jump over every day in UK, and I do not envy you at all.
Here in Scotland, we are generally (I believe) more aware of the problems we have caused since time began that allowed a 2-teir (and more, often) society to become prevalent in the world, but I believe we are working at reversing that insane way of thinking that has existed for millenia.
Until the world corrects itself, RECORD EVERYTHING!
