      These laws would affect ANY alternative as much as RUclips. Its in the hands of these corporations who are getting LAWS made to favor their interests. RUclips is pulling videos because if they dont THEY can get sued by BIG MUSIC! It would take a class action lawsuit against one of these BIG MUSIC company about FAIR USE and CENSORSHIP.

    I had a copyright flag on one of my videos of Dogwood Canyon. They said I used some music from Jimmy Hendricks. The only problem is there was no music in the video. I challenged them, and You Tube dropped the flag. That one still has me scratching my head trying to figure how they got that from the video.
    Oh well, I won that one, but you're right. The internet was supposed to be the free sharing of ideas and information, but since it became big money, it's being destroyed one user at a time.

    For anyone who doesn't get how serious/stupid this is, if all of this CR BS comes to pass, companies (i.e. Gibson) could file claims simply for their products/logos appearing in a video.
    This is crazy, and it almost makes me glad that I went through all of this a few years ago, when all of this crap first started. I had nearly my entire channel deleted (over 100 guitar/music-related vids, except for 3), and lost thousands of subscribers. But, decided to just let it go, because unless you are a part of the top (1%) channels, it's not even worth the fight.
    Much love from the US, Mike! Give'em hell! And, I can wait for more of your vids! :)

    Copy-write law allows "fair use" which includes educating, reviewing and criticising. Does Google not know that? Too much corporate greed. Is anyone up for starting a crowd funding campaign to launch a community owned video repository?

    • @ipsurvivor
      @ipsurvivor 5 лет назад

      undercrackers56 - You don’t understand that Fair Use disputes have to be decided by a judge in a courtroom. You can claim fair use but you cannot by truly sure about it since every instance must be evaluated by itself. Although Diminis (brevity of portion of work) is generally helpful it has to be graded with the overall context. Many people use the entire work and try to pass that off as educational. Keeping it down to a few seconds can help but is no guarantee. It generally needs to be transformative. That’s vague and again a judge can only ultimately decide that.

    • @78tag
      @78tag 5 лет назад

    • @ipsurvivor
      @ipsurvivor 5 лет назад

      78tag - If someone sued them they would probably be countersued just like someone being sued by them might have to counter sue them.
      If I am not mistaken they recently expanded the amount of time for songs to be in the Public Domain, in both the UK and the US. I think when “Love Me Do” by The Beatles entered the Public Domain in the UK around 1963 the powers that be changed it to 70 years from release date as opposed to the 50 years previously stipulated. It’s not retroactive so it would seem the Beatle’s stuff would mostly be in the PD but I’m not sure about that.
      In my opinion this is only going to make the situation worse.
      People live longer now and so do their immediate heirs but mostly corporations and their big wigs who are quite removed will benefit the most.
      In the US all recordings from 1957 to February 15, 1972 will fall into the public domain on February 15, 2067. To me that leaves a huge chunk of time for the music to be exploited by those who are born long after its creation.

    This is all so much bullshit from RUclips and legal vampires. Playing someone's song only advertises it for the artist. It's like wearing a Pepsi t-shirt to advertise Pepsi and then being sued by Pepsi for copyright infringement!!!!! Down this road, companies will start to look at the backgrounds of videos and say 'Oh, there's our washing machine in the background of this video' we will sue this person..... even if the content is NOTHING to do with the machine or indeed anything in the background! Points well made Mike. I have respect for your views and many of the people you mentioned now the internet is a corrupted fishing net. How uncomplicated our world was when loving and learning songs was a respectful admiration and means of improving our craft, especially if the song had no available sheet music. Guitarists would share this knowledge before the internet- whether sitting with another guitarist or learning by ear with repetition of a section of a record, cassette, CD etc. I understand the copyright concern where an artist loses their entitlement but copyright of a chord shows how sad, crazy and greedy things have become. Don't be thwarted and I hope you continue with others to keep up your great work as it is very appreciated. Simon in Melbourne.

    Google/RUclips isn’t the government. I am not lawyer, but I believe that Copyright law lets you use brief excerpts, use copyrighted materials for education, or to criticize copyrighted works. If big music publishers are impacting your income by making false legal claims, then that seems like an actual damage that civil suits are designed to remedy. I’d seriously consider consulting a real lawyer and filing a real lawsuit to collect actual and punitive damages. Juries rarely tolerate big companies bullying ordinary people, so you may actually win such a case in a real courtroom. I’m sure there are lawyers who would love to file a class-action suit on your behalf if there is a demonstrable pattern of abuse.

    This is the best summary of the far reaching aspects of the RUclips copyright claims situation that has recently come to be. RUclips is not responsible for this. I believe strongly that the great changes the Internet have brought now require the definition of use of copyrighted material to be reviewed and revised. This is about legal decisions from generations before the Internet existed and music companies earning more from artists that create great music than is ethically justifiable. This legal situation is out of control and must be corrected through politics affecting changes to make this rational.

OF COURSE, I'm inspired by 50 years of listening good music - BUT it is always me, I'm not a copy of anybody and also my songs are not copies! ... BRINGING IT TO THE POINT: When I put my video to youtube - it is my personal descision to do it or not. AND when I give my video to the hole community for free - it is also my personal descision. IF I WOULD NOT LIKE, that anybody could use my video/my ideas/my songs - I should not bring it to youtube for free usage - I should keep it like a secret in my rooms! ... WE SHARE SAME THING / SAME LOVE / SAME ART / MUSIC as a free gift from heaven! ... SO SHIT on all that copyright-ideas and strong reglementations - the power behind is only: GETTING MONEY !! GETTING RICH !! ... enough is not enough ... and this is DEATH to every kind of beautiful soulful art !! ... STOP !!

  • @RandyFricke
    @RandyFricke 5 лет назад

    I saw this coming right from the beginning. This is why I didn't bother producing content and becoming dependent on RUclips to keep bread on my table.
    Here's a true story from personal experience. I was the
    guitar player in the up and coming L.A. band Lip Service from the fall of1979
    to summer of 1982. We played all of the traditional L.A. clubs, the high
    schools, skate rinks etc.
    We were finally starting to get booked prime-time at Starwood, Gazzarri's, Troubadour, and the Whiskey. We were "on our way" as it were. Name producers we're courting us. Robin Williams used to come and hang out when we played Madam Wong's Chinatown and Bob Dylan introduced himself to me in front of Gazzarri's after we played there one night. Bob Dylan!
    We were offered a massive record deal (another story for
    another time) when the rug was pulled out from under the whole shebang when the
    guys who started the Lip Service novelty clothing store registered the name Lip
    Service even though we had been working under that original name for the past 3
    years.
    But, because our inept manager (who's dead now) didn't
    register the Lip Service trademark we were served with an injunction
    prohibiting the use of the Lip Service name. By the way… One of the items the
    Lip Service store offered was hot pink Converse Chuck Taylor high tops which I
    originated. (I got fucked on that too!)
    Although I can empathize with copyright holders on this
    topic to a huge degree, and fair use does allow for commercially posted
    content, the copyright is still the creation of the copyright holder and they
    should be compensated accordingly.

    Real censorship for political reasons aside (which can hold this madness for much longer and is an important reason to unleash these policies), just let them do that. After the wasteland where the copyright holders, RUclips and their advertisers will see that they have all been forgotten, nobody cares for their stuff and none of them is making money because content is gone and the one they produce is not talked about, shown, listened to and cared for, i.e. when their bottom line is going down and they hear crickets around them, they'll quickly pedal back and beg for someone to post 3 seconds of their precious intellectual properties.
    Use your own content and drive down their revenue and their exposure. Creators will still be able to make some profit, even if it's going to be hard but once the huge "word of mouth" disappears from the web money goes down for the big guns too. YT is not profitable already, once they will have to spend even more money for all the Art. 13 shenanigans measures and see important creators dropping down in their metrics, maybe leaving, viewership getting sluggins, people moving to alternative platforms, advertisers leaving with them they'll just raise their voice with their buddies (don't think for a second big tech, media corportations and governments are not part of the same big family) and we'll see what we've seen with newspapers fighting Google News and then coming back crying and whining for their new to be embeded again...
    They need our data, they know very well very few will subscribe to premium services, especially if the content offering is not that good and the price point is high, and - be it for business or for social control - they need our eyeballs ON the screen, not OFF it so... don't sweat it too much ;)

Governments should mandate that You tube should introduce a fee on a sliding scale to levy against every claimant which will only be returned if after investigation the claim is upheld and also a suspension against the claimant if the claim is deemed nefarious.
    (The same model as landlords that now have to lodge their tenant's deposits and if a claim arises it is arbitrated by an independent ombudsman who's decision is binding.)
    At the moment It's blunt instrument and a huge swordfish dragnet to catch a few single minnows. It has to start by stopping politicians being lobbied by big corporations wanting to steer legislation in their favour. Here's the mechanism.

    There's a punch up going on as we speak on both sides of the argument on this website with the copyright "owners" v the copyright "infringers".

    You guys find an alternative to RUclips and we will move with you in a heartbeat. F@@k RUclips. Who bloody owns Dsus anyway. This is too much.

    • @MikeBurn

      Like I said in the video, RUclips is not the main culprit. The music label corporations, their lobbyists and the lawmakers in the parliaments are the problem. I am from Germany and EU-Article 13 will take effect soon. Here is what RUclips CEO Susan Wojcicki has to say about Article 13 and I can understand why she is giving this answer: "EU tech regulation - RUclips chief says EU copyright plan could lead to blocked access" www.ft.com/content/266e6c2a-e42e-11e8-a8a0-99b2e340ffeb

    While is certainly does suck, that whole movie school analogy is a bad one. I learned guitar before RUclips existed. No copyright claim can stop me from going to a guitar teacher.

  • @nickbouvy8851
    @nickbouvy8851 5 лет назад +5

    Surely most of these claims would fail in court but who has the money to test it? Maybe the answer is a new video platform. Not RUclips. Dark web? Underground guitar lessons?

  • @FFVison
    @FFVison 5 лет назад +1

    You had mentioned people streaming video games. If video game publishers could make a copyright claim, that would be like Fender guitars trying to claim copyright on a video of you playing in your band with a Fender guitar. You are the entertainer and the guitar is part of your medium of entertainment. That being said, how can you copyright a single chord? This reminds me of a popular cruise line trying to copyright the word "fun". In the US, we have patent trolls and it seems like they are also branching out into other areas of IP.
    Also, I know many people that use RUclips to listen to music. If there were no more copyrighted materials allowed on RUclips, that might be another nail in the coffin of the record industry.
    We live in sad times, friend.

  • @stephenpertesis6738
    @stephenpertesis6738 5 лет назад +3

    Well, someone could, in theory, start a NEW video platform. 🤷🏽‍♂️🤝🍻 bye bye youtube? After all, if the content creators leave, youtube has NOTHING. We are everything. RUclips, as a company, produces nothing that they then use to generate money for themselves.

    Hey!! My band is called 'Band X', you wanna deal with my lawyers? ;-) j/k
    Thanks for bringing this up. Trying to hold people in violation of copyright for using a single chord is absurd. Not much doubt the chord was already used by someone else in a recording.

    John Lennon once said all chord combinations and beats have already been used there is no new music so where does it leave musicians with robots checking your chord progretions and strumming technichs. And as for lobbying the MPs in the UK they are a laughing stock just look at Brexit and how long they have had to sort it. Keep up the good work.

    1. UMG is going to be sold to a degree, and that more claims are issued seems like a way to keep the price of sale in boundaries of expectations of projected sale amount.
    2. Article 13 - long term implications
    3. Any newer content filters implemented.

    We should find out these bands and corporations and boycott them into the poorhouse. Its why I stopped making videos 12 years ago. I mean they were just covers and a few started blacking the content in other countries where it could not be seen. This will never stop until we all ban together and hurt them in their pockets. Including You Tube.
