To whom does the MP owe allegiance? Party? Electorate? Mike Ocquaye seems to aver that the MP’s (primary) allegiance is to the party and so it is (ONLY) the party that can ask the defecting member to vacate her seat in Parliament. Do you agree with him?
Following from this, he says that members of other parties have no locus asking that a defecting MP of another party should vacate her seat.
Again, he goes on and on to talk about the mischief the law seeks to cure and thus prescribes certain cautions to apply, citing how parties can frivolously cause the removal of MPs. But in this case, isn’t the law CLEAR on what shall constitute grounds for removal of an MP ?
Listening to him, I thought some members of the relevant constituencies should either petition the Speaker or go to court to get their MPs removed from Parliament for changing their stances on what got them voted into Parliament.
Where does the law say a party should evoke a provision? If a sitting MP contests with his or her party's official candidate, what does the Constitution say. Karma has no expiring date.
The spirit and letter of the law is what Prof has talked about. It is not about emotions.
How can a man who turn his back to his own ruling be talking about the spirit of the law idiots
Am I the only one who seem to see the two face of Prof. Oquaye?? Why do these old boys think Ghanaians are all senseless?? The constitution of Ghana is bigger than any political party and not a husbandand wifeaffairlike you are insinuating. Stop misleading the public.

There is not any role to be played by any political party in this case to be heard. The law or constitution makes it clear that when a person lives or joins another institution or go independent he has chosen not to be a part of that party. So where does the so called Party issue come in. MIKE OCQUAYE is just saying this to protect the NPP

As at now, would the majority insist their seats are not vacant if they had more than enough members to still form the majority?
