    Yay sneak peak! I imagine all the bad press Walmart gets from youtube videos showing the crazy shoppers has created this policy for them? You aren't the first I've heard being told not to film at Walmart; a New Zealand couple I watch visiting America for the first time wanted to record seeing Walmart for the first time and they were approached as well. Such a rebel recording anyway lol, we appreciate the effort!

      @@cruisingdave8929 Walmart isn't public. It's owned by Walmart. If they don't want folks filming they're absolutely within their rights to ask you to stop, or leave the premises. "We reserve the right to refuse service to anyone". Period. End of story!

    Recording in public of public views (what anyone else can see) is entirely legal (with ver few exceptions). But inside a business is not public. They are private property that can restrict you from recording. Even if they have hundreds of cameras like a casino.

    Walmart is not considered public it is private property. They can ask anyone to leave. They make the rules. And Walmart has always had a no recording policy.

    There’s a YT’er in Florida who was filming a Spark pick up and WalMart employees went nuts on them and said they were being banned.
    IMO the general public doesn’t want to see themselves on someone’s channel-

    The base pays were high because they had been boosted. When an order sits on the screen for too long Instacart will boost up the base pay to try & get you to take the orders. You can tell which orders have been boosted up with the orange box that says boost included. Which means that the orders base pay isn’t what it started out as. So example if the base pay for an order starts at 5 dollars but then it sits for a period of time it will go to 6 then to 7 then to 8 & so on until it caps out at a certain amount then if it’s still sitting it will restart the base pay at 5 again & keep boosting it up basically doing this boost circle until it gets taken.

    The recording ended but started again via phone so what I don't understand is why was Lou asked to leave to me people don't like when you question them it's totally nonsense this is why a lot of people don't shop at Walmart.

    That's crazy....the last time I did a Spark video in Walmart they asked me what I was doing, I told them and all they had to say was "cool". I do use a magnet chest mount though and not the headband mount.
    I haven't done IC in a very long time.

    The store does have a right to refuse to allow recording as its private property. I know other stores have policies against it.

    I kinda had a feeling this was going to happen to you guys at some point considering how often you record. Not that you were in the wrong but there are a lot of people out there that are VERY restrictive/sensitive about this sort of thing. 😫💀 Hope this won’t affect you guys too much because I love the content! 👏

    Everyone can record on their phones nowadays. Walmart is in the wrong. Are they going to police everyone with a phone?

    Recording in public is not always free rein, and voice recording here (even in public in most instances) is actually illegal without consent of both parties. It's a very misunderstood law, especially in my state where it's very restrictive. Stores have their own laws, but at least here, if people are being recorded they usually have signs stating such because of the stickiness of things. Typically, stores are not considered public because they are private property.

      New York is a “one-party consent” state, which means that you can record conversations if you are physically in the state and are taking part in the conversation, or if you have permission from one of the parties in the conversation. This applies to both phone calls and in-person conversations.

      ​​@@TheLongIslandDashExperience when it comes to recording in public as you are doing it falls under Freedom Of Press, that is protected by the Constitution 1st amendment. People think that they have to sign something to be recorded in public and that is not true. The 2 party recording that is being mentioned is for recording a voice on a phone call. People need educate themselves on the laws and stop letting their rights being walked on or We will lose all rights we have left. As for Wal-Mart having say of their business they are limited due to being open to the public and selling goods to the public. None of us signed a agreement when we walked through the doors. Now a business like Costco would have the say because they are membership business. That is the difference.

      I know here in California: New policy starting January 1, 2024 they are going bag free. Will be like Costco with empty boxes or force you to bring your reusable bags with you. They already ran out of bags here too, not sure what the delivery people are supposed to do about it. I plan on just keeping some extra Costco boxes in my trunk just for this reason

    Had that last weekend. Mine capped at 60$. Did first 3 boom boom. Then,,just grabbed what I could get. Within reason of course. Took me 5 hrs by myself.

    Costco has a full parking lot during the week in my area; so never mind going to it on the weekend unless the tip is huge. Low mileage and low item count even if it doesn't have a tip is key for promo days. If it is high item count and mileage, it would have to have a high tip for me to do. Once, I had a $115 for 6 promo and got a $118 order for 40 items/ 16 miles at Costco. $25 of that was base pay so it defeated the purpose from doing the promo any more. I have some gripes with Walmart too. The loaders have been getting careless with misplacing items in areas of my car; and grouping items with the wrong customer. Ended up getting some free items in my order the other day; but now I am keeping a good eye for when I have missing items.

    And they couldn't have been like, "Hey, we've got a policy of no recording in the store. Please put the camera away or we'll force you to leave," then kick you out only if you don't comply. Seems a bit of an extreme measure to force and escort you out immediately.

    When a business is doing sale of goods and open to the public it is not the same as private property. The first amendment of the Constitution gives everyone the right to record. It is called Freedom of Press. These people are recording to disseminate the information on a media platform. They are not trying to record people in public. They are doing so for their business (it is their way of making a living) Therefore Wal-Mart is depriving these two of making an income. People have no expectation of privacy in public, that was handed down by the Supreme Court. So if anyone is uncomfortable with someone else recording then turn away from them and walk away. As for government buildings, the video camera recordings can be obtained by what is called FOIA. (Freedom Of Information Act)

    Walmart is private property, not public, and, therefore, it's 2 party consent in NY. The sidewalk is public. Walmart is not.

    Why record after they asked you not to? Walmart is private property and youre lucky they let mary finish. Ive seen plenty of sparkers deactivated because of this. Makes gig workers look bad. Respect the rules.

    All of the orders you were taking were orders with Boost and Promo pay (usually meaning nobody else takes them so they've added to them) so that made them higher base pay orders. I think that shouldn't count toward a promo like you were doing but it does.

      It does mean 2 packages. When they want 2lbs It will say 2lbs when you scan it “customer requested 2lbs total”.

      @@hayleytheesweird. In my experience anytime there’s a 2 it’s 2 units. When it’s a meat and they want 2 lbs it won’t have a number and when you scan it’ll have you enter the lbs. I didn’t see what her said because she scanned the meat off camera.

      People need to be educated on business, commerce and selling of goods to the public. Yes they are a private business but they fall under LAWS of doing business. No policy can over ride a law. They are opening their selves up for a lawsuit. Now if it was Costco on the other hand that is an exclusive membership business anyone who signs up for a membership agrees to anything they have in their policies. I wish people would wake up to what is going on before we lose all our rights.

    I would seriously consider a small claims lawsuit for lost wages, harassment and discrimination… you did not sign a contract with Walmart and they have no signs stating that you cannot record inside of Walmart… unless if you are in Cali where you you cannot record w/o their permission you are allowed to record.. it only takes $30 to file the document (which is online) find out what’s the max amount you can sue in ny (usually 10k) and before you even get to court they will settle with you… you have all the proof you need to file the suit
