It's not just an opinion. The court has jurisprudence on their side. The jurisdiction of the court was expanded when they issued the arrest warrant for Putin. At that time, Russia was no longer a member of the court. However, the crimes were committed in Ukraine, against Ukraine, and, since Ukraine is a member of the court, therefore the court had jurisdiction to rule on the issue. Palestine being a part of the ICC gives the court jurisdiction to investigate crimes that are committed there.
Same with Russia and Ukraine. The court has no jurisdiction over Russian territories but the alleged crimes are committed in Ukrainian territory and Ukraine is a member state of the court giving the court the legal right to investigate those alleged crimes.
