Something VERY important to note about Sherlock Holmes: *he* is in the public domain, but a few of his final stories are not. Which normally shouldn't matter, but...here's the thing. The Doyle estate LOVES to file lawsuits. LOVES IT. And because Holmes behaves in a somewhat different manner in those copyrighted stories, they seem to believe that they effectively have a monopoly on any depiction of Holmes that is altered in any way from his original depiction. Basically, any and every media you can imagine that has used Holmes in a novel way has absolutely been sued by Doyle's estate. And they don't really care if they lose either, they'll just do it. So keep that headache in mind.
Additionally: characters in the popular zeitgeist thanks to previous adaptations - be they fairy tales like Rapunzel (or the rest of the Disney stock), or pulp stories like Zorro or Cthulhu - be VERY CAREFUL that you're ONLY using what's actually in the public domain! Flynn Rider and the Kingdom of Corona do not exist in the original Rapunzel story, and are therefore owned by Disney. Disney may not own the little mermaid, but it sure as hell owns the name "Ariel" which they invented for their film. Dorothy and all the Oz books are in the public domain, but if you dare put her in *ruby* slippers instead of silver ones, expect a call from WB lawyers because they were colored that way specifically for the film, which will not fall into the public domain until 2035. And so on. The point is, just because something is in the public domain doesn't mean you're free to use *everything* connected to it.

    • @marksemple297
      @marksemple297 4 года назад +129

yeah was thinking that Doyles estate had sued people before, for example the french author of the Lupin stories. the character was pitched as a master thief that had run ins with holmes. then later there is the anime Lupin III because the character was meant to be a descendant of the original Lupin and Holmes was mentioned in passing, though i may be off and that last one and it was the estate of the french author that went after them, been decades since i read about it originally.

Essentially what you need to do is the same thing that Phoenix Technologies or American Megatrends did with their IBM PC compatible BIOSes... a clean room design. You need to find someone that has never seen any of Sherlock Holmes/Zorro/Grimm popular media and only have them read the public domain versions and derive their character from that.

It’s best to google your idea to make sure it’s not copyrighted, if you can too, maybe mix and match different ideas, for example, Sherlock Holmes investigates a string of murders with the same style of neck wound, he meets Van Helsing who tells him the killer is Dracula, showing that the wounds were destroyed after death to hide those bite marks, and then cue a murder mystery horror

Zorro saves Rapunzel and teams up with Long John Silver not knowing about his bad intentions.
After they arrive at Dracula's Castle, the three team up but fail as Dracula escapes. Dracula flees the land and creates a portal to Cthulhu, he tells the creature about what's happening above.
The three mortals arrive at the treasure but Long John betrays them and throws them overboard.
Zorro and Rapunzel gets rescued by the Loch Ness Monster and brings them to the shore where Huckleberry Finn brings them to safety for a few days.
After a few days, Sherlock Holmes knocks on the door asking about Long John's location, Zorro and Rapunzel decide to help Sherlock to take down Long John. They also get help from Huckleberry Finn and Loch Ness.
They travel and come across Samson who lost all his family and without hair. They also come across Paul Bunyan making a new house. Both of them agreed to help.
Meanwhile, Long John Silver hires an army of pirates as his guards.
In the underworld, Dracula and Cthulhu prepare to takeover the overworld.
Paul Bunyan spots Long John and his army stopping on the shore and they prepare to fight but all of a sudden, a vortex in the ocean appears and Cthulhu and Dracula rose along with multiple demons from the underworld.
Long John spots Zorro and his team and they prepare for battle.
They fought in the shore, it became an all out battle as each side was throwing blows.
Huckleberry is running around unintentionally damages Long John's troops, Dracula is biting every foe he sees. Loch Ness tries to attack the foes in the ocean, Rapunzel hitting pirates with her hair dealing huge blows. Paul is swinging his axe like a madman. Zorro is striking everyone with his sword. Sherlock is fighting with MMA. Cthulhu is throwing huge waves at the shore. Long John Silver is shooting cannons.
Samson can't do anything without his powers, so Rapunzel magically gives Samsom hair and he goes full on powerful, wrecking everything. He leaps and punches Cthulhu sending it back in the underworld.
Dracula all of a sudden, gets staked by Sherlock Holmes, and all of Long John Silver's guards are defeated and he is captured.
    The day is saved.

The problem with all the versions of Cthulu is that they actually have Cthulu as a character.
For all the times he's mentioned in the Mythos, I think he only shows up in person once, and he doesn't get a chance to fully materialise.
Most of the time he's mentioned as a thing worse that the thing you're currently dealing with.
Yes, there are powerful creatures that want to murder you, but have you heard about the thing that those creatures are afraid of?
Cthulu is the thing that even monsters have nightmares about, and his greatest asset is his inevitability. Maybe you didn't have to deal with him, but your grand children might not be so lucky. One day Cthulu will wake up, and when he does it will be the end of humanity, not because he hates us, but because we're so insignificant that he won't even notice he destroys us.
Cthulu shouldn't show up in your story, he should be in the background as a reminder that your victories can only be temporary.

For example, while you can still use Thor, Loki, Odin, etc. in your own works, you cannot do them the same way Marvel does them.

Technically it no longer qualifies after the author has "filed off the serial numbers" in the parlance of the fanfiction community by removing everything that is directly connected to the copyrighted characters and setting of the original Twilight series. But it is true that many authors who got their start in fanfiction have gone on to become successful authors of original stories, albeit sometimes only after modifying what started out as fanfiction so that it can stand on its own. I think it can serve as useful training wheels for an aspiring new writer by giving them a ready made setting and cast of characters. As their writing abilities improve, a writer should ultimately aim to write their own original stories.

You need to be careful with SCPs though, because while the concepts become technically public domain the version of the SCP itself does not. If you just put SCP 173 in your movie it's actually a copyright infringement because the creator still holds the rights to that specific version.
That's actually why there isn't any big movie or show about the SCP foundation even tho it's so great of a concept, the original creators of particular SCPs still technically hold copyright over that SCP and if you especially want to do something that involves many SCPs at the same time you'll have to track a lot of people down and hope all of them will say yes.
I think there was actually a big problem once a SCP that was put in a game without the creator's knowledge and they had to then take it down because of that, so be careful when it comes to SCPs

Luckily, the artist let people use 173 for non monetary purposes. That's why most SCP games are free and the ones that aren't have a different model for 173. Also, a main reason why there are no SCP movies is because no studio would want to make them since they wouldn't get any royalties from it. And here's when its revealed that the whole thing has been one universe.
Sherlock devises a plan to bring down Cthulu, but the plan requires the strength of all the characters.
Paul Bunyan and Samson ended their competition in a draw, but the timber left over is used to make a gigantic ship, which Long John Silver commands. The ship is so gigantic that it has to be manned by all the other characters (including Bunyan).
Zorro (willingly bitten by Dracula) and Dracula (taught swordsmanship to nearly Zorro's level) have developed a friendship over generations and command an army of vampires, adding to the ranks of our gang.
They are all led by Nessie, as she, being a monster herself, knows where Cthulu is (and is leading out of gratitude for Sherlock's keeping her secret safe).
Huck tags along, still trying to avoid his home. A driving internal conflict is presented through Sherlock's knowledge of the fact that the one who summoned Cthulu will have to be sacrificed in order for Cthulu to be defeated.
The group goes off to face Cthulu, but gets absolutely wrecked the first time. Their ship is nearly destroyed.
They return, with Rapunzel's hair holding the ship together, making it even stronger. Nessie reveals why she was so grateful to Sherlock when she calls the entirety of her kind, (whom would have faced extinction had Holmes revealed her) whom join the group.
    Round 2.
The group leads Cthulu away from civilization, into the ocean.
The hair allows the ship to be more malleable, so it transforms into a giant mech, but still, it gets wrecked. Nessie's group takes on Cthulu's legs, but it flies. The sun just about sets and the entire vampire army is released from the ship-mech.
Ok, I need to stop, I've gone WAY too far.
Thanks for coming to my TEDTalk.
Edit: Feels uncomfortable leaving anyone who read this far on a cliffhanger.
The vampire army slows down Cthulu in the air.
Inside the ship-mech, the group convenes. Sherlock takes Huck into a separate room. He tells him what has to happen. Huck agrees, writing a note to his parents. He asks Sherlock to deliver it to them personally once Cthulu is gone. Sherlock and the group set up the whole thing.
The vampire army outside is dwindling in strength. Huck is strapped down and Cthulu starts feeling off. It directs its attention towards the mech and knows that its summoner is being sacrificed. It makes a mad dash for the ship-mech. The vampire army, including Zorro and Drac, is out.
Bunyan and Samson slow it down momentarily. As it gets closer to the ship-mech (and closer to the water) Nessie's group goes for the jugular, but Cthulu fights them off. Silver sets off every cannon and weapon on the ship. Cthulu gets angrier. Rapunzel manipulates the hair on the ship-mech, striking Cthulu. Cthulu rips off the arm that struck it. Cthulu peels of the chest of the mech, where Huck is strapped down.
Cthulu reaches for Huck, just as he says, "I forgive you" (referring to his abusers, the bystanders, the strangers that never stood in.) Huck is killed, Cthulu is gone.
Here's where two certain endings after that could pick up on the aftermath. Either Huck stays dead and his arc is complete. Or Drac revives him, and he lives with Zorro and Drac and goes on wacky zany adventures featuring other free to use characters.

Cthulhu (and any Lovecraft really) is so hard to translate to film because a lot of Lovecraft’s horror comes from the incomprehensible quality of the horrors being witnessed. The reader’s own mind can come up with something far scarier than anything special effects can produce. Translating that to film is nearly impossible because it’s a visual medium.

thanks for the cool video, i'd have loved to see some more unknown characters on the list, with maybe the more known ones just as quickshots or honorable mentions. Most of these already have strong backstories or are very prominent and might not go well as side characters or even main characters at that. There are so many good stories and characters out there that are a bit less known but still have interesting origins and developments which are less likely to step into others bounds and run the risk of seeming like a poor rip-off or bad parody.

Any myths or legends are fair game. Just pick a country and look up a legend. That's where we got bigfoot from.

    You can combine them, even.
Like Chtulhunzel, stuck in her cosmical tower with no stairs
Or Draculholmes, who solves murders of monsters done by peasants

As a Scotsman I can honestly say that the water horse was probably the best and least offensive version of a lochness monsteresque creature in recent film and writing history. Very very few people can write Scottish set stories/characters properly without comong across as racist and stereotypical arseholes.

It's a very old disney animated characters, i don't care much about them playing with fictional characters, unless they're involved with something in reality.
They didn't "tried it's best" they're already achieved it many years ago.

I genuinely think it's amusing that George R.R. Martin claims to "hate" fan fiction but when given the opportunity he wrote a story about Jaime Lannister discussing with his brother Tyrion how you would go about killing Cthulhu.

This reminds me of how Nintendo actually made a game filled entirely with Public Domain American Folklore characters. You have Tom Sawyer, The Cowardly Lion, and Randolph Carter fighting against a bunch of Cthulu elder beings in a steampunk tactical shooter.
