The difference between Mediation and Litigation:
Mediation: Involves a neutral mediator helping both parties negotiate a settlement.
Litigation: Involves presenting cases to a judge who makes the final ruling.
-Mediation allows both parties to retain some control over the outcome and explore creative solutions tailored to their family’s needs. While Litigation leaves all the decision making up to a judge.
-Mediation also tends to be quicker and less expensive than litigation since it avoids lengthy trials, witness examinations, and exhibit preparations.
-Judges in Litigation aim for fair outcomes for both parties, not clear winners. They have very broad control in terms of decision-making power and tend to make decisions that leave both parties unsatisfied.
-In mediation you are able to bring in Family law specialists who actively work in helping both parties achieve a better agreement during their mediation process.
