      I’m a paraprofessional who absolutely loves working with non verbal kids. Breaks my heart what these kids go through, especially at the hands of “care takers”. I wish you and your little one well 💜

      I drive buses with children with wheelchair I have good experience with driving I don't put no seat belt on kids. And I always want an aide Dat I can get along with. And no phones toooo.

      Exactly!!! It is amazing that someone would act like this was a simple mistake. Sitting in front, then watching on the back and seeing her uncomfortable or eventually worst, would maybe have been mistake but not checking her once and playing the victim? If i did this i would need ppl to put me away because i could never live with myself when a child died because i did not care to even barelly do my job, is completely absurd, her attitude should give her 10 more. I truly hope they lock her away a minimum of 20 years.

      How would she notice the girl is choking? The girl is non verbal, the girl probably looked how she always looked then just looked like she drifted off to sleep. This isn’t the movies where things are all dramatic.

      i'm hearing impaired, nobody realized this till i was 7 so i was basically non-verbal i spoke a made up language out of misunderstood words, anyways the school put me in a speech class so i could catch up, the issue was that the teacher would slap me for not paying attention, like a week after i started the class my parents saw my injuries and i managed to explain to them a teacher did it and i didn't just fall or something, my parents complained, i don't really remember anything but i know due to the school's unchanging plans for me we ended up moving to the other side of the state so i could goto a better school.

      Abuse in aged care homes is also a problem, a while back the australian media was running stories with videos from hidden cameras set up that caught their carers abusing them.

      I got a job one time working for a home because the owner loved when they stop at the store I worked at on the way back from a special Olympics event. I was giving the guys high fives and congratulations on thier medals, she gave me a card and said I should give her a call if I wanted extra work. It was the best job I had until I went into business for myself.

      my special ed teachers just gave us work packets to do all day and sat back probably telling themselves they are a great teacher. They didn't care about us kids they just wanted their job to be easy sit back and collect tax payers money for the job and the status of being a teacher. if it were todays day and age they probably would have been texting and looking stuff up on their phone after handing us assignments instead of up in front of the class actually teaching.

    I was a bus aide and always sat accross the child in wheel chairs. I was paid to watch them and make sure they were safe on the bus. She should go to prison.

      It was the families fault they didn’t strap her into her wheel chair properly, they probably did it on purpose. The family should be the ones charged, it’s the same thing as leaving your kid in the car during the summer.

      1:00 the family didn't come forward on whether they secured the girl. it's confusing on whether for sure the sister/mother incorrectly harnessed the daughter. Is it the claim of the aide? or the family actually did the initial harnessing?

      The family strapped her incorrectly in her wheelchair.
      The bus lady DI NOT DO THAT.
      The bus lady only secured the wheelchair to the ground.
      Her mistake was not sitting next to the child n not checking on her this not catching the incident before it became deadly.

      @@yvonnecortes_ that my friend is the definition of child endangerment which could lead to 10 years of prison. I don’t know the protocol but I am guessing that before the bus is in motion she is required to check all straps including the one’s that’s attached to the wheelchair. Sad case and honestly I don’t feel any pity for this lady and hope she gets the maximum, bc of her negligence a child was sentenced to death.

    What’s the point of hiring a bus aid if they don’t actually watch the child? In that case, they could just have a driver and no aid… she wanted to get paid to play on her phone instead of watching the children. And now she has no remorse and takes no accountability. She’s blaming others, but if she’d done her job, the child would be alive.

      @DarthLesbian she probably was underpaid and undertrained, but I can imagine that any training she did receive as a bus monitor would have advised her to monitor the children. Not to mention, common sense should tell you not to wear both earbuds while turning your back to the special needs child you’re supposed to be monitoring for the entire duration of a 40 minute bus ride. She really just didn’t care and that’s not a training issue.

      I was a bud aide. I have no idea how she even was allowed to make it that far without someone noticing. She's done this before and I hope they shred her for it. That phone doesn't come out unless there is an emergency, let alone double ear bud.

    This is so terrible! My own autistic son was on his bus once when the clip lock to keep him from taking off the belt and running in the bus, was twisted and cutting off circulation. Because the aid was doing her job she was able to take care of it immediately and put my son in a new seat. He didn’t have the capability to ask for help at the time, but because she was paying attention and doing her job, he was fine. I can’t imagine! My heart breaks for the family

      I am a special education teacher and one of my students was in a similar wheelchair when it broke and he slid out the bottom. He almost strangled himself with a strap identicle to the one this little girl was wearing. We were desperately trying to free him. It was terrifying. He is also non verbal. We got him out safely. This situation is absolutely disgusting!

      Not true, watch the video. She takes responsibility but doesn't think she should get 20 years in prison. I agree with her. Some guy was speeding (>100 mph) on a city street around here and T-boned a family of 5, killing all 5, and he got only 6 months in jail. But he was a rich white guy and she is a poor POC, so maybe you think 6 months for him and 20 years for her is fair? Sentences are so inconsistent in this country.

    Update: On Monday, Davila was found not guilty of aggravated manslaughter and not guilty of reckless manslaughter, but was found guilty of endangering the welfare of a child.

      Give you 20 years for your superficial analysis. There is plenty of blame to go around here. Who thought that a child this fragile was safe to go on a bus in the first place? Who trained the bus aide and what SOP was she supposed to follow? Did she violate any SOP? In retrospect it would have been better if the aide had the child under direct observation, but was she ever told that was necessary? Was the seatbelt placed incorrectly? Was the child strapped into her wheelchair incorrectly? Did the child have a medical event that caused her to slump?

Buses are supposed to be safe but for a child to be as fragile as her should not be transported without their parents, mainly if they can’t speak to let you know of something. That woman may have reasons to be in jail but accidents happen, same would go as if she were asleep on the bus and not aware. Straps might have been faulty, honest mistake, and unintentional killing/not planned. IDC I’m tired and at this point who cares what you all reply to me. some of these are just my opinion p.

    It was 100% negligence. For a child to be non-verbal and you’re not watching them, WITH EAR BUDS!! You are at fault….you had the simplest job. And couldn’t even do that??

      I do wonder though, is she properly trained? Or is this just the first person they found for a minimum wage job without proper training. Because I’ve definitely had jobs that just dropped us in without explaining the full scope of dangers.
      So I want to know if they picked some random woman and just dropped her in this position or if she was fully aware of her full responsibilities and duties. Not that it makes it any better for the family either way. But I want to know if she is fully responsible or if there is in fact someone above her who didn’t do their job either.

      She is hardly the only one at fault, but the other parties involved want someone to take the fall. There is plenty of blame to go around here. Who thought that a child this fragile was safe to go on a bus in the first place? Who trained the bus aide and what SOP was she supposed to follow? Did she violate any SOP? In retrospect it would have been better if the aide had the child under direct observation, but was she ever told that was necessary? Was the seatbelt placed incorrectly? Was the child strapped into her wheelchair incorrectly? Did the child have a medical event that caused her to slump?

It's clear this individual cared more about her phone then another human being. Stop making excuses for someone's pathetic behavior. And lack of accountability.     School bus monitors should be prohibited from using cell phone during working hours. In addition, there should be clear instructions as to where monitor should be seated during ride to and from school. I don't think it was intentional. Definitely, Neglectful.

    She is said to have seven years of experience for this job and when you have this job, you receive regular training throughout, which she did. Stop telling people to sue the bus company, aides are not employed via the bus company, they are employed through the school system. Lastly, her responsibility is to watch the child. In most cases they sit next to the child. She was supposed to sit across from her, not 4 feet away from her with her back turned and headphones on. Her mistake was being too complacent in her job and forgetting that she was responsible for a vulnerable child that despite their incapacitation still needed to be watched.

    I’m a teacher, including in summer camps, and when I’m monitoring even non-disabled teenagers I would always at least sit facing them and never have earphones in even if I’m doing something else such as lesson-planning at the same time.

My kids are my number 1 priority, and more than that, they are mine, I may not have birthed them, but they are mine, I love and treat them as such.     The error by the family was CORRECTABLE, she is making is worse by blaming the family. If the aide had been watching, they could have pulled the bus over and fixed it. I knew another student that died on his bus in NJ. His aide is also criminally charged. She has a toddler with a disability who may be riding a bus like this (unknown if her child uses a wheelchair)

    That's one hell of a mistake. We call it dereliction of duty. This little girl is not coming back.Why didn't she take the seat beside her to make sure that she could see her? A side glance would have saved her. That's crazy. She deserves every year! There needs to be a rule that when you are in charge of youths or people who need extra assistance you do not touch your phone until they get to where they need to be. Or in case of an emergency.     The prosecution said there wasn't evidence the family messed up, but the investigation indicated the girl's family was mostly to blame.
    That's why this lady got off with child endangerment, but acquitted of the more serious charges. That mother and her sister should be held accountable for their failures too.

    My special needs brother was placed into a group home, since it was becoming too much for my parents to handle. Within less than 2 weeks, an aide mishandled by brother, causing him to fall and break his hip. He now lives back home with my parents. That aide showed no remorse either. These types of aides are everywhere, unfortunately. Rest in peace, sweet girl

    I'm in special education and I work as a Speech-Language Pathologist. I do trainings for aides in my district to bring the humanity and Empathy, and passion back into their jobs. People with disabilities are human beings. I talk about respecting non verbal students, talking to them even if not expecting a response, and not ever, ever talking about inappropriate topics in front of them. I do this for this exact reason. ...Aides are not paid well so you get the bottom of the barrel sometimes, however, it is no excuse to deny anyone, especially a child with high needs, of their basic human rights and dignity. Rest in peace, beautiful ❤

    I think both the mother and the bus aide are at fault here. The mother did not correctly strapped her daughter in the stroller, and the bus aid dodnr check to see if the child was secured correctly.

    Before the bus moves you check the harness if the child is in a wheelchair, then the tie downs and seat belt are tight enough so the wheelchair does not move. You also sit within reaching distance of the child and check on them every 5 to 10 minutes to make sure they are ok. Your job is to look after the child, to make sure they get to where they are going safely. Not listen to music with headphones in or play on your phone. That would be an immediate termination of job where I work.

    Has a trained aid she should of double check to make sure that baby was properly strapped in.

    She should never be allowed near kids again and/or locked up for a very long time. She clearly doesn't care. "It's not my fault." That's nonsense. When I watch other people's kids, it's always my responsibility to make sure the children are okay no matter how they came to me. If something is wrong, I fix it. I feel bad for the girl's family that this irresponsible careless person did this to them.

    She makes a valid point
    There’s serial killers and murders out here that get less time than what they are trying to give her
    However she failed at her job and she needed to pay full attention to child
    So sad
