  • Houses are protected in Arizona bankruptcy proceedings. So are mobile homes. But you're out of luck if your sole residence is an RV.

      No, what is disgusting is people who make poor choices and live above their means. I can say that being frugal and sacrificing isn’t much fun but at least I will never be in their position. Maybe, more people should suffer when they are younger so that we don’t have to listen to the bleeding hearts of liberals. As far as my money before you go saying I’m a problem, when I pass on all of my money is going to a charity like Tunnel of Towers who helps families of severely injured police and military veterans who are struggling at no fault of their own!

      That's me. I live in a semi truck, though. I can afford a mailbox. Only way to afford to go back to the doctor and to ever hope to pay back the bills Im acrueing.

      @@zeroshepard9513 I don't know your state or situation but you can contact the places you owe medical bills to and ask them to lower them. Many times they actually will. Maybe you could declare medical bankruptcy. I would contact your state rep and senator and ask for help. Neglecting your health will get you in worse trouble. Are you eligible for any sort of assistance? The state I live in has a health care program for low income people. Please try something. I wish you well.

      Under the current law an RV is a Vehicle, not a home. The judges are somewhat correct in that he can’t rewrite the law. But they could’ve said that is their home and made some accommodation for them.

      The couple caused all of this not the courts. They thought they would be slick and file bankruptcy to get out of paying a relatively small hospital bill. I guarantee they spent far more than $10k a year traveling the country. They could have gotten on a long term payment plan for the bill and scaled back their traveling a bit. I know plenty of rv parks that are nice and only charge $250 a month plus electric.

      An older woman that works at a grocery store lives in one and it’s an old one. She is literally one missed paycheck away from being homeless. And because it’s an older one it has problems that come up. Elderly people who have worked their entire lives and end up in a situation like this couple should be allowed to keep their home!

    There are over a million that live in RV 's in America. I had to, I could not afford buying a home. I purchased a half acre. And cannot afford to have water, electricity, and an aerobics septic system installed. I started documents to get social security retirement. Found out they will not give me a check, until I pay off veterans medicine bills! Never did I ever thought this would turn out. And now a dialysis patient. I inherited from my grandfather! But I am a firm believer in prayer!

      No matter what you say or how many people live in them it is classified as a motor vehicle.
      A motor vehicle has a motor a transmission headlights tail lights and turn signals and requires a driver's license to operate. A mobile home is not a motor vehicle because it does not have a motor.
      A mobile home is a home on wheels It does not require a driver's license to operate nor does it have an engine nor does it require annual inspection and it is insured differently because it is not a motor vehicle.

    I am lucky I live in Oregon ( never thought I’d say that), when I had to file bankruptcy last August I was able to “claim” my RV as my home so it was protected. The bank was more than happy to let me keep paying each month, allowing me to re-affirm the loan. I’m a disabled senior that also spent weeks in the hospital with Covid in 2020, I’m still recovering, but thankfully my dog and I are not living my car.

      @@trentbrownstone1481 Unfortunately, I think you're probably correct. My guess is that they knew it was a risk, but there was no other way for them to come up with any other scenario that would allow them to keep it, so they rolled the dice.

If they had family that could have loaned them the $8K to save their RV would have been a better option. I'm assuming they have MA plans which leave you on the hook for thousands when you need care! Sad that we are the only country that doesn't have true national health care and leaves its people bankrupt over medical bills!

    Not right. It's called a " MOTOR ( HOME ) ". Which means you have a HOME with a motor or because it is mobile, meaning it can be moved it could also be considered a MOBILE HOME. The government doesn't give a flip about us. !!!! I'm sick and tired of the rules and regulations on how you're supposed to have this law and that law on what a home is. They want us on the streets.

      @@dps6198if you didn’t know, mobile homes don’t have deeds, they have titles. Just like your car or RV. So they’re not that much different under the law. The problem with the laws is they are not kept current with the times we’re dealing with. Twenty years ago someone living full time in an RV would be rare. But now it’s becoming more common. I know you most likely have seen a few RUclipsrs that choose to live in a van and drive cross country. That’s their home, despite what the law actually acknowledges currently.

      A mobile home cannot be driven around. It does not have a "motor" and remains stationary on a plot of land and that land has an ADDRESS.
      A motor home (an RV is in this category) has a motor and is a mode of transportation ... even if someone lives in it.
      They should have just made payment arrangements on the $8,000 medical bill. I feel bad for them but the law can be very tricky!!!
      I had a unexpected illness/surgery and incurred $12,000 in medical bills just 1 month before going on Medicare. I thought about filing for bankruptcy but said Hell No because my house is almost paid off and a judge would possibly make me sell the house to pay the medical bill. So I had to deal with the bill ... and I surely didn't want to ... still dealing with it!!!

    If it's squatters in that RV, it's considered a "home" for the squatters n "landlord" pay the bills. If the owner owned the RV fighting for it, then it's not a "mobile home"..remember u need to do something illegal to be protected at this age n time.

      That’s a load of crap. Squatters don’t have any comparison to this issue. Laws don’t get changed until there is a demand for them to be replaced. An RV under the current law is a vehicle and nothing more. Because more and more people are being forced out of the housing market, living in an RV is becoming more common. The bad thing is if they do allow an RV to be classified as a home. Will that also mean even if you declare bankruptcy, are you still required to pay for it? Because some states allow you to declare cars under bankruptcy protection, which means you can keep the car and not pay for it.

      Legal education here/ several hundred court cases/ house and home can be defined entirely different/ one falls under law of attachment/ if a house is permanently affixed to ground/ a home maybe movable/ a house is not/ according to individual state law.       I am very interested in your comment. Where did you find the information? After viewing this clip, I was shocked to learn their RV could not be considered a home by Arizona state law. I have spent time reaching van conversions and travel trailer remodels. Many people live in their vehicles because of limited, or no income, to support what Arizona considers a home. A post from Oregon said their state allowed him to claim his RV as his home. Thank you in advance for any statics and source information.

      If they owned a nice home, they would have been allowed to keep it. A mobile home is usually worth less than a house! If it’s their primary residence, they should be allowed to keep it! It costs far less to travel in a motor home than it costs to pay a mortgage. Maybe you shouldn’t be so judgmental until you’ve been in that position.

      Yeah but these people aren't doing a bankruptcy and trying to keep the RV that they don't even pay for. Yes they were able to travel around the country and have a good old time. Since they sold their home they should have paid cash and nobody would of taken the RV.

They were going to keep paying it, but when you have rv worth $50k or what ever you try to use the bankruptcy exemption to keep and pay the rv, but because they couldn’t use the exemption that means every penny of equity becomes the property of the bankruptcy trustee. Using the exemption doesn’t mean they’re getting the rv for free

    I’m a member of many RV forums and it scares the hell out of me how many people are selling their homes (an appreciating asset) to buy a depreciating asset. If you have to sell your home to buy an RV, then you are doing it wrong. I feel very bad for these people and I hope their story serves as a warning to others.

      I have a home and I live on Social Security,, that is not enough to pay for the taxes, the insurance, utility bills, water, and sewer, that along the maintenance upkeep that comes along with owning a home. Homes are expensive not just to purchase but to live in them. Not sure you know this, but many homes are depreciating now.

      If they have loan for the rv where the bank’s lien is on it the rv isn’t theirs and will lead to more replevin, repossession, and collection fees when the bank goes after it to get it back. Their mistake was living in a state where they could not claim the rv as a home like other states do.
      Also in addition exemptions and stays only work if people are making the loan payments. Default gives financial institutions the right to ask the courts to have stays removed and have foreclosure/repossession activities continue

    In Seattle when homeless people living in cars were towed from the streets they would be crushed but the court came out and said something to the effect, homeless people living in rv could get them back because they are their home.

    They sold a house 2yrs ago and bought an RV (How much RV did they buy?!). Did they stop working too? Racked up lots of debt and got sick as well. Filed for Bankruptcy and didn't expect their primay asset wouldn't be seized? Something is missing here. They should've had savings or something BEFORE taking that leap. How were they going to pay off those debts? A lot of poor planning and decisions were made.

The US is the only first world country I'm aware of in which a person can lose almost everything due to medical issues EVEN when they have insurance.

      @@kristinab1078 you’re right about people not having much, if any, savings but I think given the particular circumstances of this case this couple could have paid off this debt albeit at a very slow pace. As I have said in other comments on this post they could have negotiated the monthly payments with the hospital and agreed on a number that they could manage. I think people often misuse the bankruptcy system. We are talking about $10k not some 6 figure amount. They could have probably paid $100/month and they would still be in their rv today.

    So they sold their real house during the height of the pandemic, likely for big bucks. Bought an RV and travelled all over the country. Lived high on the hog im sure because gas for an RV aint cheap. Instead of buying land to put the RV on, these two acted like college kids on a summer vacation.

    My husband and I lived full-time in our motorhome for five years (2018-2023) while traveling the United States, visiting the lower 48 states (we flew to Hawaii and Alaska). I say this to put my two cents in that one can definitely call a motorhome a home and live in it just as you would a house. I'm living proof!!!

    So, don't declare bankruptcy. They would rather get 10 mpg in their RV and travel. Perhaps they were making payments on the RV. Either way, they would have known this before signing the bankruptcy paperwork. So tired of the medical bill excuse. Hospitals let you pay $100 a month or lower for outstanding bills. "It's not fair." Too bad.

      A rv is not a home period. I have an rv I have to get it inspected every 2 years and my insurance covers it as a trailer, definelty not a home. 😆 you can't even get a mortgage loan on a rv it's a personal loan 😆 17 percent apr.

    It sucks, but thats the law, and it's not a home, it's a vehicle, not a residence, it's never going to be covered by the homestead act.
    So the message here is, if you are planning to do this, make sure the motor home is paid off in full, if you can't afford to do that, you can't afford to live that lifestyle.

Without that roof over their heads many would be homeless. Which would you prefer? This is a growing situation in the US, and especially impacts older individuals who are trying to make it on social security and/or a small savings. Rent is too high for many. Times are a changing and not for the better.

    So a "mobile home" -- a manufactured home that is placed semi-permanently on a lot and which after a few years basically is no longer "mobile" -- is okay, but a "motor home" -- which can be virtually indistinguishable from a "mobile home" but actually is truly "mobile" -- is not okay. The trustee should be ashamed for pursuing this, and the court should be ashamed of its wacky ruling.

      A mobile home is not a motor home and a motor home is not a recreational vehicle. Is the Icon of the Seas which is a 248,336 ton, 1,198 foot long, 20 deck cruise ship with 2,805 staterooms that can accommodate 7,600 passengers a mobile home as long as the owner chooses to live in it so they can claim it as a homestead exemption after deciding to declare bankruptcy while keeping their most valuable property?
      Unless you can say with a straight face that "if Bill Gates gets so far in over his head he can buy the Icon of the Seas and move into it and say "this is my homestead" or "mobile home" you are ignorant. The Rule of Law requires uniformity and specificity and a vehicle must a vehicle and a home a home unless the law specifies when they may be re-classified as something else. This is why the law SPECIFICALLY says a condominium and a mobile home are a homestead. This is why the law says:
      1. Interest in Real Property in one compact body, or
      2. The person's interest in one condominium, or
      3. A mobile home in which the person resides, or
      4. A mobile home in which the person resides plus the land on which that mobile home is located
      The Court is correct in saying that if the Legislature wants a car, yacht, cruise ship, jet, recreational vehicle (RV) or any other vehicle to be included then they need to be added as #5, 6, 7, 8...1,000,....2,000....
      If they are not then they are not real property in one compact body, on which exists a dwelling house, a condominium in which the person resides, a mobile home or the land on which that mobile home is located. They are vehicles!

Legally they are deemed to be "chattel," not "real property." Mobile homes remain "mobile" in the sense they can be moved (at substantial expense) somewhere else. A Class A "motor home," which is usually categorized as a recreational vehicle, quite obviously -- but not necessarily -- is more mobile than a so-called mobile home. Neither are attached to the land, are not "real property in one compact body" (to use your phrase), and people can and do reside in both of them. There is no practical reason that a yacht, houseboat, etc., cannot be claimed under the homestead exemption; these exemptions vary from state to state. The problem is that our legislators are quite poor at drafting laws: often they fail to think things through. Case in point: recently I saw a local law that holds residences cannot have locks on interior doors, nor may they have interior walls!

      I agree with you, it is awful enough we had to deal with a bankrupting world leader, I find it cringeworthy each time I hear of someone taking on debt, to foist it off later. But, in this case, this is medical debt. Very unusual for us in a modern society to accept that some are just too poor to live, some not worthy to live due to quirks of intelligence, luck, grace, opportunity, socialization, etc. (Anyone who isn't at least a secret ego-maniac, knows that even if provided the graces of intelligence, social aptitude and endurance, through luck of birth, can end in naught, without luck of chance meetings, support, schools, experiences, work opportunities... some get very lucky, some not so much.) Letting people just die because they were born in the wrong place, or didn't have luck, is pretty normal in the history of the world, and still very common in many areas, such as the slums of India. I know my kids would be dismayed, astonished and deeply saddened if I forewent treatment to prevent pain, further illness, or death, simply because the unknown medical cost might exceed my insurance and ability to cover with savings.
      Luckily, you appear to have excellent insurance, based on your total focus on the bankruptcy, but not the reason for it. Good your medical needs will never exceed your insurance pay out, to the point that you can't cover the cost of medical care, without wiping out needed savings/retirement. It's good you have savings, and can use any savings you have, to cover medical care, that you made so much, and saved so much, that you won't need to keep those savings to help you if you have an disabling injury, or as you age.
      $8k is a drop in the bucket of medical care, and medical care easily overwhelms many people's insurance coverage, if they have it. So many can't cover insurance, on top of all the other expenses. $8k indicates they didn't even have a battle with cancer, which usually would exceed $100k out of pocket, usually closer to a quarter million. Many people have had a single significant car accident, and even with insurance, have found their bills to be nearly $1M. $1M. To the lucky, that wouldn't be hard, but to most, it's overwhelming, toxic stress. If this couple was hoodwinked into getting an Medicare Advantage Plan, then their insurance coverage would run out very quickly..... you have to be a lucky person to not end up with medical debt with Advantage Plans, but many aren't able to slice and dice through the slick brochures, extras, and the up-front lower cost. Some simply can't afford anything but the lower cost of an Advantage Plan, instead of spending the extra for the safety of a bundle of Medicare options.
      I'm not sure how I feel about a person just dying, because a person wasn't as lucky as another. Or maybe, just not being able to walk. Feels weird. And, would I want someone I love to simply die because we who love them couldn't pool the money? Or to be in great pain? Seems wrong. Its why insurance came about...we are sharing risks and costs. And, I've known a couple individuals who survived, but with great debt, and kept it, and they questioned that impact that choice had on their family every day, wondered if they shouldn't have just died. Probably will die prematurely due to the stress effects. Painful to lose lovely engaging people.
      Perhaps you think people should die rather than take on medical debt they can't afford, and that is fine... most people simply won't admit that. And, in a nihilistic framework, it isn't a wrong philosophy/approach, it's just one choice of many of how to organize your approach, and then broader, how we want to live as humans massed together. So comes the question, is that the society we want to foster? Is that a distant dystopia we want to pluck from history to project into the future? Or was it dystopia.... dead in the refuse cluttered streets, collected in carts,. Certainly not attractive, positive, hygienic, fine smelling. Course, what I label dystopia might be ideal for you. ...Or maybe the ill should gather at stations, so the sick, dying and dead are orderly. Choices.
      Me? I personally will simply stop eating if I find I have a difficult or costly cancer as I start to age, rather than use my funds for medical interventions, instead of giving my kids a bit of seed money. A balance. Hopefully by the time I have to make a choice, my kids will be in a good place, and be ready to be without me as a journeyman. I assume you too will not allow your medical costs to exceed your ability to pay. Tough choice, when your brain is clear, you feel engaged, and you are engaging in life.... but that is when we must let go, to not incur medical cost that might exceed our ability to pay, otherwise, we may suffer brain changes that make it so we can no longer make that choice.

    Federal tax laws does not implied to state laws. An rv, camper is not a home. In most states you can not buy land and park a rv on it and live.

    It’s an RV, it’s not a home. I have TWO RV’s and a Home. Just because somebody sets up a tent on the city street or in a city park and lives in it for months doesn’t make it a home. It’s really that simple.

      Likely. They bought an RV, enjoyed traveling all around the country, ran up credit card debt and had a fairly small hospital bill. Then the chickens came home to roost. Hope their vacation was worth it!

    she says it's a home. But it has wheels, steering wheel, engine, etc. So it is drivable, which they did alot of.

      I applied for Medicaid for myself only. I am a legal resident and my spouse is a permanent alien (i.e., green card holder). We were both unemployed for a short time, so our income was $0. I applied for myself only, not my spouse.
      I received a letter from the state. It said because my spouse was a permanent alien, my entire household was disqualified from any assistance. However, if my spouse were an undocumented immigrant, then here are a variety of programs to help you - health insurance, food stamps, housing assistance, energy subsidies, etc. It listed these, gave me phone numbers and offices to call, etc.
      So yes, it is very, very true illegal immigrants can get government hand-outs. Legal immigrants, by contrast, cannot under any circumstances receive any government assistance. You are immediately setting yourself up for deportation if someone at the state-level approves funds. USCIS checks this. It’s a big deal.
      American policy here is stupid, wrong, and quite frankly racist. If you are a foreigner but live in geographic proximity to the USA and can walk there, you get stuff. If you are a foreigner from across the sea and need to properly enter the country, be prepared to pay thousands and thousands of dollars, receive zero assistance, and immediately pay high taxes if you are get a good job. Basically, if you’re a Latino welcome to the family; if you’re Asian shut the hell up and produce tax revenue for us.

    They shouldn’t have filed for bankruptcy over $10k. They probably spent way more than that just to travel for 1 year. It wasn’t like they were stationery in an rv park year round. They were spending tons of $ on fuel and campgrounds.
    They could have easily gotten a payment plan for that $10k that would have been manageable and could have found an rv park for $250 a month.
    Sounds like they just wanted to get out of paying the hospital bill.

      @@markbajek2541 it was near eufaula, Alabama. However, even if the lot rent was $450 somewhere they could still afford to pay $100 a month towards the debt. Hospitals are often willing to negotiate terms that are manageable for the debtor. You just have to be honest and show them how much you make, what types of other fixed costs you have and how much you can truly afford to pay.
      This couple abused the bankruptcy system to shirk their responsibility.

    If they didn't have enough money for medical emergencies, then why sell your house, move into an RV and then travel. They should have stayed home and found a cheaper hobby. Bankruptcy impacts all of us. They made bad decisions.
