- Prime Time today debates the controversies surrounding Uniform Civil Code and the setbacks of implementing the same across the country. Dr Faizan Mustafa, VC of NALSAR University in Hyderabad explains that Personal Laws are always based upon prevailing customs and are not based on religious codes. He adds that cultural practices within a religion can vary from place to place and hence it is wrong to associate Personal Laws with religion. (Audio in Hindi)

both Hindu and Muslim laws should be scrapped out, religion causes too much political instability. Laws should be based on critical thinking, freedom, reason and logic. Religion is internal and personal. Politics and Law are social and Geographical. Religion deals with internal power, Politics and law with External powers, hence should be equal for everyone. For Social Welfare sometimes some things like religious beliefs should be kept personal. Privatization of law is the stupidest idea i have ever heard someone trying to do. The whole point of law is social.

Yes, because if UCC comes, then Sapinda marriage or marriage between blood relatives will become legal which is illegal now under Hindu Marriage Act.
Also, the authority of dowager after husband's death would not be legal, as whole property will go directly to children without going through the widow mother.
Rights of Malayali hindus who follow Marimukkalthyam laws will also be violated. Also, tribal laws of Adivasis who till today practice polyandry and polygyny will retaliate it.

This is a perfect example of ravish kumar's most famed politics ahead of actual logic debate. nowhere the finance minister said he is explicitly talking about only Muslim personal law, he went ahead and said that whatever measures and parameters are now on defined to reform the Muslim personal law should be the test also for other personal laws. but still ravish tried to present it as an attack on Muslims.
He tried to suggest that the law commission tried to target the Muslim community by its questionnaire. A journalist of all people should be the last one to say asking mere opinion on social issues, mostly pertaining to a community which is trying to reform itself and is having a debate is an attack on that community.
He suggested that people are smart enough to identify the politics behind it. sir, people are even smarter to identify your politics on this topic. and you people call yourself liberals.

No , there are Hindu Civil laws with two major law schools÷ Mitakshara Law School & Dayabhaga Law School. These laws deal with marriage, divorce, adoption and inheritance.

Prof. Mustafa is saying that marriage is cultural matter and hence it should get a protection of 25 and 29.
But the similar argument were advanced in lata Singh case were family claimed there cultural and religious right to restrict the women from marrying person of different caste.
But supreme court has rejected the view citing protection of article 21.
And thus the Arun Jaitley's view seems more convening

For eg..If a person is not satisfied with the property rights given by his religion , what should he/she do? Change the religion ? Is it allowed for a muslim woman to get her father's property as per Hindu law if she wants ?
