  • CINCINNATI (Rich Jaffe) -- "There's obviously a big difference in power between the landlord and a low income person renting an apartment but their actions of trying to get a landlord to comply with building and health code violations, that's protected by law," said the managing attorney for Legal Aid Society of southwest Ohio.
    A local landlord tried to evict the tenants who've been blowing the whistle on deplorable conditions in his building. But Local 12 is getting in his way.
    A landlord is trying to silence his tenants and keep them from talking with Local 12 News and city officials about the mess inside one of his apartment buildings. The residents told Local 12 Wednesday, Jan. 28, about their concerns that power may be cut off because the owner, Terrance Sebastian, hadn't been paying his bills.
    Even as the story aired, Sebastian was apparently trying to intimidate the tenants with eviction orders. But when tenants officially complain about sub-standard conditions in buildings it is illegal by both state and local law for landlords to retaliate against them. That was clearly something Terrence Sebastian of TBC Enterprises did not understand.
    After showing Local 12 the leaks in his apartment on two different occasions Jesse Duke got a surprise from his landlord

    I went through this with my landlord, she wouldn't fix the hazard conditions in the apartment such as mold, lead and a huge pest infestations due to all the cracks that turned into holes so now pest just come in the apartment from outside or other apartments, no heat in the winter, no hot water and now we found out the gas lines was never instilled right. We're in the process of moving out and suing the landlord.

      The problem is most of the landlords doesn't want to take responsibility for their buildings. They just want money and leave everyone else in the dark.😠

    I am so blessed to have a wonderful landlord. He took 100 dollars off of the rent for Christmas. My granddaughter passed away, he gave me 250 dollars toward a headstone. He put a new air conditioning unit in and he took almost 200 off of my rent for the inconvenience to me. He and his wife are good people.

      You must have one of those landlords who doesn't need the money and is maybe just doing it for the enjoyment of housing people and being a bill collector. And maintains a friendship with their tenants by letting rent go now and then, pulling out sharpies on the lease and buying extra gifts. I've heard of these legends before.... but never been able to fiscally afford it nor could handle the politics.
      I've learned the happy tenant today when you let things go and do a favor, is twice as angry tomorrow when you don't.
      In fact after doing this for 6 years and surviving the Moratoriums/rental housing extermination I can honestly say there is no way I would ever, ever be a landlord if I didn't have to. If I won the lottery I'd hand in my tin crown tomorrow lol.

    This happens all the time. You disagree with your landlord who refuses to take care of the property, & you wind up evicted over total lies. They can make up ANYTHING, slap it on the eviction notice, & your gone.

      Mary Jane , as a landlord in pa, you are correct too a point. But here is the stickler of it . I still have to have just cause while their is a lease agreement. Has to violate the lease first. After on a month too month yes you are correct!

      @@mikebiro3148 I am a tenant in PA. My real estate company (infamous Kelly) mostly rents out to students. So they freely bully them and threaten if repairs are requested and also steal security deposit. The law is also messed up so the tenants cannot even request repairs or they will be evicted

You have to know what to say to the judge and how to say it, because once you bring up the right points of laws (and resist saying anything that gives the landlord an out) the judge has to address infringements or violations, but you have to be clear and direct with how you present your case, and it helps to get a lawyer (legal aid is AWESOME!!!)

    After the collapse in 2007 & 2008 millions lost their homes to the corrupt banksters and all kinds of criminals became landlords. Just look at how rents have skyrocketed. Rents used to average 25% of your income. Today rents average 56%. Tell you anything?

      t4705mb6 The recession caused prices & inflation to rise. Therefore, rents, like everything else in this country, rose. Hell a bag of chips used to be 25 cents. Now it's 35 cents I think. A bag of chips...
      Tickets at the theater even went up.

No one should have to live with rodents, roaches, mold and a broken oven and black gunky water clogging up the sewer line making it impossible to use the water, including flushing the toilet. I live in a house for 10 years and there were no problems until the landlord sold the place to a millionaire slumlord a year and a 1/2 ago who never fixed anything. I am severally disabled and he failed to accommodate me which was just asking to gut a travel trailer on our rented property in which he said no.The rental neighbors have one for recreational purposes.This is discrimination!

    I'm actually going through this shit rt now . My landlord gave me a eviction notice after living in home for 8 yrs because I called the code inforcer to inspect my place because he refused to fixed anything . After writing my landlord a letter saying the the issues needing to be fixed he sent me a eviction notice the next day . These issues were prior to is moving in and he had promised to get the issues fixed by the following spring. After eight yrs of waiting and sick of him telling me if u don't like it u can leave or move I called code inforcement. I am now moved and going after my landlord for for half my rent back pain and suffering for me and my kids and the cost of me having to move out into another place

    mt girlfriend went to legal aid and they did nothing when she went through the same thing, even though her landlord evicted her in retaliation, the judge still reported it. If you have no lawyer to stand with you in court you are screwed

      chrismc410 as a person who ran properties for a landlord , trailer parks are the biggest scam .
      You fall into debt owning rent , in most states they can start your eviction the day of rent due .
      Some states allow eviction less than 30 days
      If you own the trailer , they can put a lean on it .
      Because you are at this point likely paying two rents , current and land trailer is on , you fall behind and suddenly the park owns your trailer .
      I never understand why people want to live in trailer parks

    I am glad I live in NY because in NY it is illegal for a landlord to do this. There is a organization that specifically deals with slum lords

      As an ex-landlord in the Midwest I can say it was tough enough; I can't imagine trying to do it in NYC. I recall tenants who became very delinquent in their rent; I didn't evict them, and suddenly they were complaining about maintenance. Then they held back their rent to, supposedly, pay for the repairs themselves. (That is allowed under the law here, though I might have been able to evict them since they were _already_ delinquent and that made paying for the repairs difficult. I was on a tight budget.) After they held back enough to pay for the repairs I noticed that the repairs weren't done. I asked about it, and they admitted to spending the rent money on something else, but it was STILL "my" fault in their eyes though they owed me thousands of dollars and misspent the withheld rent which they claimed would be spent on repairs. Like I said...I'm an EX-landlord.

      Polydynamix there are legal aid groups plus tenat advacasy groups who can help with lawsuits against landlords or even college law schools offer help

      Polydynamix legal aid is helping represent the tenants file lawsuits against the landlord under the federal justice code where all people have the right to legal council whether it be criminal or civil matters

    I’m am going pro se against my landlord and using all of the various different municipalities that are also involved testifying against the landlord before the court. We’ll see how he responds in court. Lol 😂.

    My landlord called 911 on me when I tried to pay my rent and told them that I was acting irate with him. I was a wonderful tenant and also had plenty of witnesses of him harrassing me, not repairing anything on purpose.

    Parachute Colorado has the same issue. Landlord Todd Barton at cottonwood view apartments tells tenants that they must get his permission to call police on meth labs and meth dealers or they will be evicted.

    If i owned an apartment block and tenants had complaints about damages from outside their control i'd personally go down there and inspect said damages and then work out a plan to fix the damages and if it hurt my bottom line for a bit while the repairs are happening? i wouldn't care, the tenants come first in my eye...hell if they had to move out while the repairs were happening i'd set them up in a motel or hotel so they at least have a place to stay if they can't stay with relatives.

      I am like you if I am a landlord I will treat my tenants like gold and fix everything. If they tell me they had an emergency come up and they don't have the rent I will allow them to pay a little at a time. I been there so I understand what tenants go through. Empathy is a big must for landlords.

    I'm going through a similar situation with my landlord.iv been hesitant to ask her to fix the air-conditioning .she has told me before she ain't fixing nothing until I give her the rest of her deposit .I owe her .

    Tenants rights vary. In Connecticut the laws are almost entirely in favor of the tenants. Landlords have little power here.

      Cowie Pipenger. Good for tenants I suppose, but we landlords are constantly being screwed by them as a result. There needs to be a better balance between the two parties.

      I'm sorry but the main reason the law favors tenants is because of the vast majority of landlords are absolute slumlords who do not maintain their properties to an acceptable safe livable condition. I move cities a lot in my line of work and so I have rented approximately 45 properties. I've had to break about 12 leases due to being unlivable and for others simply had to endure. They hide things. The common 3 always seem to come up. (1) severe mold problems, being the most common and LIFE THREATENING issue (I learned after the first few occasions that if I smell bleach when I inspect, to run in the other direction as fast as possible), (2) homes with plumbing in absolute disrepair (I always flush the toilet, check under the sinks and check the water pressure now as it's usually an indication of plumbing problems which lead to problem 1) or (3) roof problems - leaking roofs in disrepair which then also lead to problem (1). I'm not renting cheap places either. SLUMLORDS don't want to spend a damn penny on maintenance. What you need to realise is that WE are paying YOU for a safe and livable home. It's not OUR problem that you can't afford to pay your mortgage if you make repairs. Also, good tenants being punished by landlords because the person before us wrecked the place. NO I am not paying for the repairs for damages which your previous tenant caused. They try it EVERY SINGLE TIME until I show them a copy of the extremely detailed photographic and video evidence of the condition at entry, plus my favorite of the audio recordings of our phone conversations they always say never happened. HAHA the look on their faces always brings a smile to my face :)

      Shambolic Rhetoric. Among the circle of landlords I used to run with, the universal complaint was unsavory, untrustworthy tenants who took every advantage they thought feasible. BTW, we considered ourselves to be conscientious and responsible property owners and got screwed too many times to call the law fair.
      The knife cuts in both directions.

    Thi sis what you do. Health inspector goes in, condemn the place. Get the people out and find them places, Next day at 5 am. BULLDOZE IT! Send the slumlords a clear message. Oh, and put him in jail while this all going on. A city has every right to condem and destroy any building deemed against public safety.

    In my housing recertification I included a letter from my doctor requesting an apt switch and citing hippa laws. At the end of the week my fob would not let me in any of the building doors.

    that is weird , my last has was condemned after months of paying into escrow in the Xenia Municipal Court, and they claimed that there was nothing they could do about the retaliation and frivolous counter suit. I ended up getting only 7 days to move and at least got the escrow back . But because of the 7 days to find a place , I moved into a place that already had code violations and a week after moving in the basement staircase collapsed and when I called the landlord about my broken arm, a long list of retaliation including returning my rent checks for 3 months and then filing an eviction for non-payment of rent . There's a slumlord epidemic inDayton and no one is doing anything about it . Here I am , a disabled veteran , about to be homeless because I can't afford an attorney .

    Makes me wonder why people even become apartment managers in the first place. They’re obviously not in it for the money they don’t make that much. If you’re not a people person then why do you get a job where you have to deal with people and complaint on a daily basis. My apartment manager is so hated that she got disowned by her own family. If you were to go into that leasing office she is always in a bad mood.

      Because they get those jobs and secretly pocket money from the landlord behind his or her backs... thats how they make their money off of those jobs and landlords are so gullible for keeping them around.. does it not dawn on the LL to check his accounts and with his tenants every once in a while to make sure his PM is doing their job and not messing with numbers at the office..

    Very similar to what I'm going through. Though I have no place else to go that's within my budget. My landlord makes no repairs and often doesn't pay the utilities so I take the rent and pay it outta that. And warned him I'll sue next time I get a shut off notice posted one more time. He also owns a apartment building right up the street that collapsed pinning a tenant under rubble for 9 1/2 hours. Washington PA. Slumlords are everywhere and these landlord tenant laws are a lmao joke. There rarely if ever enforced.

      The collapse happened in July of 2017. Thankfully the tenant is okay. He's facing multiple lawsuits as I speak.

      He will have to prove gross negligence. Then the insurance will pay. But he is up against the insurance company. Not the landlord in this case.

    Having similar issues here in Washington (Lakewood), Management is trying to evict us here. We have a Right to an Attorney Law here, our Attorney has found a few unlawful actions against us so we may win. The main issue is the fact I got sick and wound up losing my job over it, was not able to pay the rent. Finally was able to file for Retirement through Social Security, signed an agreement to pay the back rent and keep our rent current, next day got a 60 Day Notice to Vacate. The reason they are using is that we had a roach infestation, which was caused by Tenants next door, we got the infestation after they moved out. Finally was able to get it under control through Pest Control, they made them come out. BUT we lived her 20+ years so we have boxes of stuff that we have no room or storage to put in, the Current Manager did not like that, the other Managers who came in our apartment had no problem with it but this one did so she is using that as a pretext to evict us, the main reason is we have no Refrigerator (only works half ass, it freezes but it don't keep the perishable foods refrigerated), we complained about that, two we had a water leak from a busted pipe over the hot water heater, it was repaired but Maintenance, in order to repair it had to cut the counter top over the hot water heater, we complained about it multiple times, even to the representative from the main office who was doing the Pest Control for the roaches the 3 or 4 times he was here, it was never repaired even to this day. Even when our Attorney gave them our side of the story to see if they'll settle out of Court, they're still refusing to settle or do the repairs or replace the refrigerator. They're still going to try and evict us, mostly for non-payment of Rent the main issue and retaliation for our complaining about needing repairs done and they're refusing to do the repairs. We may win the Eviction but we know that they're going to keep trying to evict us even if we do win.

      Juanita Sullivan No they can ask you to leave without a cause for eviction. Obviously it will be for retaliation but will be very hard to prove in court if they wait for a long period of time to report any changes.

    What happens to our family if we call the Housing Authority and they Red Tag our rental and we have to leave immediately? Where will we go? How will we get our belongings?
    That's what has protected our Slumlord for the last 11 years we paid rent as my husband battled Stage IV Cancer and we couldn't move.

    He wasn't charging me rent the whole time I worked at the carwash I paid him to be nice when I wasn't asked to I didn't even have a lease till January of 2023 I had already lived there for over 2 years without being retired to pay rent I met him on a gay dating app and after I got the lease to get into a housing program through the foodbank was how he manipulated me because I wouldn't let them sexually abuse me on the upstairs living room I barricaded my door to avoid being raped and then he retaliated and tried to evict me and the judge ignored the prior police reports i filed showing that Aubrey was sexually abusing me filmed it without my consent and threatened to murder me and our dog he took complete advantage of me and i was raped by 150 people at his house

    In Rochester, NY, there was a big case about this, Hungerford was the owner of a 3story 1930's bldg, anyways, it caught fire, arson, what a surprise! Tenants lost everything, scum Lord probably gets away with it!

    Just why would you want to live in deplorable conditions. I am a landlord and hell, I would suggest that they withhold rent until conditions are fixed. A few months plus and a tenant will have a small amount of cash saved to move somewhere else.

    What happens if the landlord just waits 6 month and then decides they no longer want you to live there what if they make something up like you're complaining too much when all you're complaining about is what you were told you would have when you moved in. I have neighbors that are drunks and drug addicts and they make noise every night after 11:00 and my landlord told me to stop complaining that it sounded like I didn't want to live there that I always had the option to move and I know if I keep saying something she will kick me out so how do you keep this from happening and I have several audio clips of the noise from my neighbors over the past 4 years not to count they never fixed one thing here like they said they were when I moved in. Would I be protected?

    Most landlords are like that in my experience. Tenants are just a way for people to make money, apparently. Before a landlord judges tenants maybe they should have a good look at themselves first. My advice is say hi and bye, pay the rent and sign leases on time, and that's it. Just don't try to de"elop any type of relationship with the landlord, other than to be friendly and prove yourself as a good tenant. The closer you are to your landlord, the worse your situation will be when you and the landlord have a fall-out.

No. If he spends money on fixing things for his tenants, how will he be able to keep himself in all the luxury items he can buy with their rent money? Come on, tenants.     that makes no sense in Oregon the landlord can issue a no cause for what ever they want. That is the law. So how can you prove retaliation if they can evict you for what ever they want? Sounds stupid to me

    Landlords don't evict in "retaliation", it costs money to file, it takes months in most cases, its horrible, most hate going to court. Filing for eviction is a desperate act when they see no other way to get the lease to work, and only a judge can order one after fairly hearing both sides of a case. So no, think again, a judge is not going to agree and rule to evict someone if they see a landlord is just putting themselves through all that extra work out of spite. They do it because the landlord proved their case.
    THINK how much easier it is just to collect rent, if the tenant is doing nothing wrong as they claim. Its got to be a big, big problem. Its a huge ordeal to renovate apartments after tenants leave, usually with tenant damages out of vengeance which they're stuck having to clean up and repair and they practically always end up losing money. This sort of stuff is just blithering nonsense.

      People do pay and they get evicted away for retaliation or they want to you to move out after 10 years because they want to remodel the place for more or they say the place is uninhabitable when they have never even been in it. Than they say they sold the place. These are all the reasons we have been told to leave and no we couldn't get out in time so he evicted us with failure to accommodate a disabled person by y preventing us from gutting a travel trailer on our rented property because it was his property. Being a landlord is more than just collecting people's money and not doing a damn thing because they are to cheap and lazy to do anything else. This guy is a millionaire. Failure to accommodate was just plain evil and I am now living in my car because I go into pain convulsions when exposed to fragrances. We aren't done with him yet.
