If you're a foreigner and have a child born in Thailand, your child won't automatically get Thai citizenship unless one of the parents is Thai. Thai nationality laws are based on bloodline (Jus Sanguinis), not just being born in the country. Your child can stay in Thailand under your visa or status, and later, they might apply for Thai citizenship if they meet the legal requirements.

Not that easy, They need residence permit, basically they need to stay in Thailand on non-immigrant visa for at least 3 years to able to obtain that status.
This child does not qualify for Thai citizenship. One of the parents need to be a Thai national for that. The parents can't get citizens until they have had Permanent Residency for a few years. And there are many other requirements for them to fill before they can apply.
You need to contact Australian Embassy and Canada Embassy to report birth aboard of your child. Thai birth certificate is only document for you to show to the embassy to get her passport. Thai birth certificate does not give a Thai citizenship of your child because both parents are foreigners. She will have dual citizenship Australian and Canada and to be able to stay with you in Thailand as a dependent visa.
In my experience applying for Citizenship by Descent, it took us 2 weeks to receive the citizenship paper. For the Aussie passport, it was the same, we waited 2 weeks as well. I think everything’ll be alright, mate.

While we need new generations to sustain the nation, an uncontrolled increase in population would be overwhelming. Therefore, these strict rules are necessary.
Please contact the Australian and Canadian embassies in Bangkok to report an overseas birth. I am an American born in Thailand and have both a Thai birth certificate as well as a U.S. birth certificate issued by the U.S. embassy in Bangkok. You need to do this for your child. I am a dual national, and the Thai passport process is extremely efficient. I was able to get my Thai passport same day. But you need all the documents in hand.
I think, as long as you have your children birth certificate, and you children still in Thailand, I think you can obtain parenting visa, as long as your children still need to be taken care off. One good thing is if either of you able to obtain Thailand permanent residence in near future, the child may also automatically got Thai Citizen Status.
Getting registered as Australian citizen and getting an Australian passport in Thailand is a simple process just need the appropriate paperwork. Private hospitals usually can help. Let's me be honest! It is almost impossible. Any foreigner without Thai blood must pass a lot of qualifications. Even though you have all qualifications still you can not be sure. I have a lot of foreigner friends in Thailand. They have tried and gave up.
4 months is plenty of time. Thai immigration wouldn't give you any grace, but if push comes to shove one of you can pop to Malaysia and back again to get an additional 60 day stamp (visa exempt) and then the other of you does the same, then you can leave as a family and apply for your DTV visas, or one plus trailing spouse and child
Thai citizenship is very hard to get it. Unless one side of the parent is a Thai citizen. However, Regarding of you said that you may have to leave the country. In Bangkok has Australian embassy. That is where is you should get the Australian citizenship and a passport for your kid.

My daughter born in udonthani, I applied for her Aust citizenship back in 2013 at Aust consulant in BBK it took 6 month to get her document approved,and then 6 weeks to do her passport, it's not a quick process.
Something was wrong then as I did it around the same time and we had citizenship in like two weeks and a passport a week later. Was there an issue with translated documents?

Because you both are from different countries the baby can have dual citizenship: Australia and Canada. You are giving her Australian citizenship first (now) and she can get Canadian citizenship later in life. Not sure how Thailand fits in other than origin of birth.
Please be encouraged to get Thai citizenship there will be checks and the process may be complicated, but when your child is born in Thailand and if you intend to, you can apply for Thai citizenship for your child if you want to wish you good luck.

Of course the baby is a Dual Canadian and Australian I’m smelling a rat. This is just click bate. I am a dual Canadian and Brit My children have 2-3 citizenships each. And my Brother three. She can get a Passport and with the passport comes acknowledgment of citizenship!
First thing you should do, call the immigration office explaining that your wife just gave birth and your visa will expire soon and the baby does not yet have any documents to be able to travel.. Listen to what they will tell you, maybe they can extend your stay.
It's not that hard. I did the same and it only took a few weeks. Pretty certain from memory you need to wait for the citizenship to be granted and then you submit the paperwork for passport. I had an Australian friend there which made it easy.
My Elder Daughter was born in the UK First thing we did was register her birth at the Canadian High Commission We had a Passport one week later. I’m not saying it’s very easy, but it’s disingenuous to claim your daughter is Stateless. She has dual Australian and Canadian Citizenship and can hold the two passports.

According to Article 7 of the Nationality Act of 21 July 1965, the jus soli does not apply in Thailand, and dual citizenship is not legally recognised.
Advice you guys. You both couple different countries. You a father since you born your child in Asia or Thailand 🇹🇭. You mush go straight away to Australian embassy to register your child. She can’t citizen in Thailand because both parents different countries. Good luck

If in Indonesia a child is new get a citizenship when this child is minimum 17 years old from theire parents and get a card named Kartu Tanda Penduduk. Recently they have caught 2 Indians in Thailand. 1 had a business and had stayed for 8 years, after his holiday visa expired. The other had his visa expired for 6 years. Her Dad's citizenship and the country she was born.
@mangoking - it depends if a country gives citizenship via "jus sanguinis" (by blood) or "jus soli" (by soil/ birthplace). Thailand is a jus sanguinis country - one of the parents must be a Thai citizen. There are more countries which are jus sanguinis than jus soli (like USA, Canada, Argentina). Countries in SE Asia are mostly jus sanguinis (by blood). USA will be revising its citizenship laws in the new Trump admin. A child born in the USA will only be given US citizenship if at least one of the parents is a citizen or permanent resident = no more anchor babies by illegal immigrants.
Thailand has migration problem from neighbouring countries especially Myanmar (5 million people) and we signed an international agreement that the children born in Thailand should have Thailand citizenship (Which is harder to get than the EU or US otherwise). And just like in EU and US many complain about the tax money spending to educate and brought up these children. But that's a near sight opinion from hypocrite people 😂 cuz Thailand has long been a place of multi cultural and nationality and you can hardly found a pure blood Thai person anymore. The case is either their grandparents came from china or their ancestors move here from neighbouring countries or maybe their ancestors are the merchant that come to trad and live here since Ayutthaya and nowadays half Thai-westerner dominated as an actor in Thai film. It's funny that some Thai people hated Myanmar children but love Japanese and Westerner children 😂.
When your child is born, you must register. If you don't then it is your fault not Thailand or your original country. Therefore, you make a false story. I was born in Thailand and my Chinese immigrant grandfather registered all his children and grand children. So we have Thai citizenship and your child would be the same. You give money under the table in a RED envelop. The government employee will give you a birth cerificate, id passport. Money walks in Thailand. There are White Lawyers who can help you. Today is not a primitive society.

Applying for Thai nationality not easy but, however, it can be done and I think, you both are very qualify for your kid to have Thai nationality.

Because you both are from different countries the baby can have dual citizenship: Australia and Canada. You are giving her Australian citizenship first (now) and she can get Canadian citizenship later in life. Not sure how Thailand fits in other than origin of birth.

First thing you should do, call the immigration office explaining that your wife just gave birth and your visa will expire soon and the baby does not yet have any documents to be able to travel.. Listen to what they will tell you, maybe they can extend your stay.
Same as Japan. You won’t get Japanese citizenship. You need to go to your country embassy and apply for it.

It's not that hard. I did the same and it only took a few weeks. Pretty certain from memory you need to wait for the citizenship to be granted and then you submit the paperwork for passport. I had an Australian friend there which made it easy.
My Elder Daughter was born in the UK
First thing we did was register her birth at the Canadian High Commission
We had a Passport one week later.
I’m not saying it’s very easy, but it’s disingenuous to claim your daughter is Stateless.

I had the same situation but mate it takes like 8 months to get it done bro you're not gonna get it done in 4 months
I suggest one of you leave NOW then the other leaves in 4 months cause there is now way you can get it done in 4 months the Australian government are slow af, if you need an aussie to sign I can help you out

@ I don’t just think out of the blue……years ago foreign kids born in Thailand automatically get Thai nationality….fact! However due to homophobic mentality, especially on people from neighboring countries, this policy was revoked…..however, politicians of today are having a change of heart and are now proposing that children born on Thai soil be given Thai citizenship….. for whatever reasons that be. So if this law or regulation passes in parliament it would cover all foreign parents with kids born in Thailand!

Lloyd, what ever you have to do, do it quickly. All over the world especially in Europe. They are deporting immigrants. Recently they have caught 2 Indians in Thailand. 1 had a business and had stayed for 8 years, after his holiday visa expired. The other had his visa expired for 6 years. Both of them have been deported back to India. Lila, she is gorgeous. Surely if a child is born in a foreign country. Automatically she should get dual citizenship. Her Dad's citizenship and the country she was born.

@mangoking - it depends if a country gives citizenship via "jus sanguinis" (by blood) or "jus soli" (by soil/ birthplace). Thailand is a jus sanguinis country - one of the parents must be a Thai citizen.
There are more countries which are jus sanguinis than jus soli (like USA, Canada, Argentina). Countries in SE Asia are mostly jus sanguinis (by blood).
USA will be revising its citizenship laws in the new Trump admin. A child born in the USA will only be given US citizenship if at least one of the parents is a citizen or permanent resident = no more anchor babies by illegal immigrants.

Thailand has migration problem from neighbouring countries especially Myanmar (5 million people) and we signed an international agreement that the children born in Thailand should have Thailand citizenship (Which is harder to get than the EU or US otherwise). And just like in EU and US many complain about the tax money spending to educate and brought up these children. But that's a near sight opinion from hypocrite people 😂 cuz Thailand has long been a place of multi cultural and nationality and you can hardly found a pure blood Thai person anymore. The case is either their grandparents came from china or their ancestors move here from neighbouring countries or maybe their ancestors are the merchant that come to trad and live here since Ayutthaya and nowadays half Thai-westerner dominated as an actor in Thai film. It's funny that some Thai people hated Myanmar children but love Japanese and Westerner children 😂.

Hypocrite? เบื่อจริงๆวาทกรรมไทยไม่แท้ ทุกประเทศมันก็ประกอบด้วยคนหลายเชื้อชาติ/ชาติพันธุ์(ethnicity) อยู่แล้ว (จีนมี 54 ชาติพันธุ์ แถมชาวฮั่นที่เป็นชาติพันธุ์หลักยังแยกย่อยไปอีก เวียดนามมี 56 พม่ามีเป็นร้อย) แต่ทีนี้สมัยโบราณคนที่โดนกวาดต้อนมาจากดินแดนอื่นๆเค้าก็ไม่ได้มาอยู่ทำกินเฉยๆนะ ต้องเข้าระบบไพร่ คือทำงานเป็นแรงงานให้นาย ทำไร่ทำนาให้นาย นายส่งส่วนแบ่งให้หลวง มันก็คือระบบภาษีอย่างหนึ่ง เวลารบก็โดนเกณฑ์ไปรบ เข้า 6 เดือนต่อปี ครึ่งนึงของเวลาชีวิต ถ้าเทียบระบบภาษีก็เหมือนจ่ายภาษีไป 50% คือเสียเวลาทำงานครึ่งนึงของชีวิตให้หลวง/รัฐ มีส่วนช่วยในการร่วมสร้างบ้านเมือง คนจีนไม่ได้เข้าระบบไพร่ก็จ่ายตังค์แทน ลูกหลานก็กลายเป็นพลเมือง ก็เหมือนอเมริกาที่ทำงานเสียภาษีรายได้ถูกต้อง ถ้าเข้าเกณฑ์ก็มีสิทธิ์ได้สอบเป็นพลเมืองซึ่งต้องเสียค่าใช้จ่ายมากมาย ซึ่งทั้งหมดนี้มันคนละเรื่องกับการให้ใครก็ได้มาเป็นพลเมืองเพียงเพราะอพยพมา 20-50 ปี เอกสารใดๆไม่มี ภาษีรายได้ไม่เคยจ่าย (ปล.พูดถึง income tax นะ ไม่ใช่ VAT) มาร่วมแบ่งสวัสดิการ เด็กเรียนฟรี อาหารกลางวันฟรี รักษาฟรีแล้วยิ่งมายึดที่ดินตามภูเขา เผาทำลายป่า เป็นต้นเหตุน้ำท่วม ฝุ่น PM2.5 โดยที่บรรพบุรุษปู่ย่าเค้าไม่ได้ร่วมช่วยสร้างบ้านเมืองใดๆ ไทยรวยแค่ไหนเหรอถึงมีปัญญาไปส่งเสียเงินให้ลูกหลานประเทศอื่น สิงคโปร์รวยกว่าไทยมาก ไม่เห็นให้ต่างชาติเรียนฟรีเลย สิงคโปร์ก็คนจีนนะ ทำไมสิงคโปร์ไม่ให้คนจีนเรียนฟรี หรือแจกสัญชาติให้คนจีนล่ะ แถมแก้ปัญหาคนจีนมากว้านซื้ออสังหาจนราคาแพงขึ้นมากโดยการขึ้นภาษีสำหรับต่างชาติ 60% เค้าก็ไม่เห็นมองเรื่องเป็นเชื้อชาติเดียวกันนะ มีแต่พวกหัวซ้าย woke โลกสวยเท่านั่นล่ะคิดว่าให้คนอพยพแล้วเดี๋ยวก็เข้ากันไปเอง ไปดูประเทศฝรั่งตอนนี้สิ พังเละเพราะเสียเงินไปกับผู้อพยพ อาชญากรรมเพิ่มขึ้น จนคนทนไม่ไหวกลับมาเลือกพรรคฝั่งขวา ล่าสุดทรัมพ์ก็ชนะ ส่วนไทยยังเดินตามก้นแนวคิดหัวซ้ายโลกสวยอยู่เลย นายทุนก็ชอบ นะได้มีแรงงานราคาถูกเยอะ มาช่วยจับจ่ายใช้สอย

When your child is born, you must register. If you don't then it is your fault not Thailand or your original country. Therefore, you make a false story. I was born in Thailand and my Chinese immigrant grandfather registered all his children and grand children. So we have Thai citizenship and your child would be the same. You give money under the table in a RED envelop. The government employee will give you a birth cerificate, id passport. Money walks in Thailand. There are White Lawyers who can help you. Today is not a primitive society.
If both parents are not Thai, You can’t get Thai citizenship anymore.
