First Amendment Test: Sonoma County Courthouse Security Guards Threaten to Confiscate My Camera

- While recording at the Sonoma County Civil and Family Law Courthouse, Guards from First Security Services tell me that I cannot take pictures of the Courthouse from the parking lot or the public sidewalk. One Guard threatens to confiscate my camera if I take photographs the Courthouse. After informing them that I will proceed to record & take pictures from the sidewalk irrespective of their threats, a Sherriff’s Deputy comes out to discuss the issue. Watch the video to see what happens next…
Peaceful, non-violent protest, with a camera. Love it! Thank you for your time and effort in helping protect citizens' rights, whether or not it makes nervous those whom believe they have policing authority under the guise of their corporate employment. Private security guards should have to pass a test on civil rights and get certified to qualify for security work.
A county court house is public property even if the land is leased. We, the people, pay that lease, that means it is public property
now that cop is what America needs..
I greatly admire your calm, respectful methods and willingness to educate. You are a credit to the auditing community and set a fine example for others to follow. Well done sir!
WOW!! Can we just have that Deputy give a nationwide refresher course to LEOs on laws and rights??? He didn't even attempt to ID.
if the property is leased and PAID by/with PUBLIC money you should be able to do anything that you are allowed to do in any other public property. my opinion.
+Cristian Ozar You are absolutely correct, no matter what a "Policy" might say. A "Policy" isn't a "Law" which can *ONLY* be passed by the U.S. Congress or a State's Legislature...not from a Judge or a Police Department/Sheriff's Office!!
I usually treat anyone I m interacting with the same way they treat me-be nice,I ll be nice...be stupid,I ll be stupid.
If you ve never done this before-you have no idea how nerve wracking it is-you never know if your gonna get a Good Officer or,an Idiot that beats your a$$.
Give that man a medal, he actually knows the LAW.I am IMPRESSED!
Deputy (Vivian?) is a sterling example of what a cop is supposed to be like in America! Kudos to you, Sir!
If a government agency leases a property for it’s use, it is government property.
If private property is rented from the county, state or city that means is no longer private property.
The property is still OWNED by a private entity so therefore it is still private property.
@@Nicklee425206 No, it isn't owned, it's rented. Know the difference
That courthouse isn't privately owned; you should have stood your ground. Notice how the security guards couldn't cite an actual owner of the courthouse nor provide proof that the building was being rented out by the county.
Empire College owns the land. However, the order that the guard referred to did not exist. I did my research, then made a return visit. You can see what happened in the follow-up video.
If it is leased by the county, it would be public.
I would even go as far as to report to the Sheriff that his deputy went above and beyond in handling the situation. Gotta give credit where credit is due....
Damn fine officer!
Policy is not law, they need to learn that.
Great job. Love your videos. I been watching several auditors for the past couple of weeks and you're the best so far. You're professional, come straight to the point, educate people, and you know when to put up a fight.
I've been a videographer for over 20 years and have had to deal with these kinds of issues a lot. People need to know about privacy laws (especially security and law enforcement) before they come up to someone in "public" and start to assert their demands on them.
For all those of you who don't understand what these audit videos are about. Let me put it this way . . . let's say you're out with you're in a public park and taking some pictures and video of trees and flowers, some total stranger walks up to you, asks you to stop recording because they're in the background and you might have recorded them, demands that you stop, asks you for your ID, threatens you, then starts recording you in retaliation. What would you do? Let them harass you? Of course not, you would tell them to get the F away from you or you will call the cops on them.
These audit videos are playing a small part in educating the general public, federal employees, security guards, law enforcement, etc. about our rights to have freedom in public. Don't want freedom? Move to a different country then.
It is a "public area" or "public space" meaning it can be entered without invitation or fee, ownership is moot. And as far as a county courthouse being "private" property, because it is owned privately but leased/rented by the county makes it public property because of the entity controlling it, the public courts.
"We're gonna confiscate your camera if you take a picture". LMAO
+sonny freeman if the police officer is a cunt ,let him know you don't appreciate that type of policing They did in dallas and baton rouge!
Clearly Tennessee is wrong...
en.wikipedia.org/wiki/Glik_v._Cunniffe
+sonny freeman are you serious? I hope not. The 1st amendment says you can. Thats crazy if they somehow made a law saying you cant. Id have to take my chances and go as high as necessary to fight that.
Private property my ass! Taxes pay for that place its mine and yours, what a joke. Thanks for this video.
libra8a For sure and we pay for it so it is public land.
I like that sheriff.....he is trying to accommodate the auditor....and he did not escalate.
I respect what this man is doing. Good job, sir. Keep up the good work!
I love how he's like " you can't film in the courthouse"and your like "ok" so you didn't do anything wrong , then he says you can't be on the property ? Dumb ass security guards can't make up there minds lol the deputy was an ok guy . KEEP UP THE GOOD WORK BROTHA !!!!! Love the vids
+J Law Was thinking the same thing they said "you can't take pictures inside the courthouse" yet he clearly was not inside.
Love the Sheriff how he handed the situation....its not prohibited in public what the eyes can see!!
+adonay ortiz The eyes cannot trespass, best thing
If the property is leased by the county then it is paid for by the citizens and that makes it public property.
deputy was a class act! bravo
"There['re] no photographs in the courthouse"? LOL, then you should've said, "Oh, okay, good, because for some reason I thought this was Walmart Photo, the place where I was supposed to pick my prints up," or "Oh, okay, shoot, then I guess you should add a few to brighten the place up a little!"
Excellent Officer! I've never seen one officer like him before! He should be Deputy Commissioner or commissioner :D
If the county leases the property there is an obligation to allow the public to treat the property as public.
+AndyShep Stop guessing and actually learn the Founding Documents. "Drops mic and walks off"...
Get the copy of the order....don't tell the security guards that it's all right...don't believe anything they say....hold their feet to the fire on everything they claim. They lie a lot. Sometimes from being incompentent and not knowing the law or Judges order, or sometimes being willfull and knowingly lying to the public. That makes them corrupt.
See follow-up video
John Tingle = gay boy 5000
Great Police Officer, did everything right.
First, no judge can rule against the constitution........period
They do all the time. That's why the Supreme Court makes me laugh. They rule one way one time and one with the next. It's all about their interpretation of the Constitution. Sad.
"Love you, take care" lol
Need more like that deputy. Good job officer.
I love what you're doing, man. Keep it up.
Good guy Sheriff's deputy!
The courthouse is not private property.
I find it unlikely that you can be trespassed from in front of the courthouse.
if the county is leasing the property you have the same rights as if it owned the land. Your taxes are paying the rent.
Not private property if any land is being leased or rented by the government and open to the public then that makes it public property and your first admenment right to film stands. Good job
How in the hell is a country court house private property?????
That was my first thought.
It is a good thing that you retreated to the sidewalk because the county or the government often leases private buildings to run their business that way they can claim it both ways-that it is a private and govt. property at the same time.
The reason they don't have a sign up out front stating no filming is because it's legal to film outside.
if the county leases the property from the college. then it is public property. paid for by tax payers.
Empire College owns the courthouse? LOL Clueless security guards.
Thank you for doing this!
When the deputy got sarcastic right off the bat I would have called him on it and shut down until he apologized.
Private property used for a public purpose, such as a court house is public for all intents and purposes.
Yeah I agree. If a private entity leases property to a public entity then the leased and common areas become public for the duration of the lease. If the owner of the property doesn't want his property to be public then he needs not lease to a public entity. It's exactly like if you leased an apartment. Can the owner of the complex trespass your guest from your apartment? No, he gives up some of his ownership rights for the term of the lease. Similarly, the police couldn't go to the complex owner to get permission to search your apartment. Why? It belongs to the owner right? Wrong that space belongs to the renter for the duration of the lease.
The security left a lot to be desired, however great props to the deputy. It's not often you get to see the good law enforcement officers who know what they are talking about. Great A+ for this gentleman. Keep doing what you do, I believe you help a ton. I do have a question for you though.
During your First Amendment tests, have you ever encountered a situation where photography is not permitted at all within a city? I know a few cities, "Rochester, NY" being one that I can name from my head, have city laws that say you are not allowed to take photographs anywhere in the city limits without a "Press Pass," basically a license they can give you for photography in their city. Unless you research the city laws deeply, or get confronted by city security, you wouldn't know the law existed. If you know anything about this, please enlighten us.
Heyyy, this is the other sample from the intro, 'we're gonna confiscate your camera'. Cool.
The cop is wrong. It's public.
It is indeed private property, but it is leased by the county. Anyhow, courts don't look at property ownership. The do forum analysis.
They’re not cops, they’re security.
the judge has authority inside the courtroom not outside... what asses... did they graduate from kindergarten? People in positions of authority with no knowledge...
I certainly hope you contacted the Sheriff's Office to let them know how courteous and professional Deputy Vivian acted. He was very calm and non confrontational regardless of your insinuation.
Ask if you're being detained, when they say "stick around".
"No photographs in the courthouse." Well i'm not IN the courthouse, have fun.
Besides i have written permission *pulls out constitution* Here you go.
The threat to sieze property is actually considered armed robbery and can be resisted with lethal force if so desired.
Taxes pay for rent, utilities , security, workers inside and the corrupt judge. So guess what? It's public.
If you do not exercise your rights, you can make certain these goons will take them from you...
if property is leased by the county then it is leased with taxpayer $ and the rules of public property apply...
+Kirk Anderson SOUNDS KIND OF RIGHT BUT IF YOU LOOK UOP THE DEFINITION FOR LEASE a contract by which one party conveys land, property, services, etc., to another for a specified time, usually in return for a periodic payment meaning temporarily you have no power over that item property an so on>>>>>.
+Sergio Valenzuela
The fact that the property is leased is a non-issue. Since the Courthouse is a public place, the public has the right to be present on the property and engage in photography/videography, provided that it does not violate court rules or applicable laws.
This is why I returned to the property to conduct a follow-up test, after researching the local court rules and being advised by the court Facilities Manager that no order prohibiting photography outside of the courthouse exists (contrary to what the security guard told me). In doing so, I remained on the property while filming, and the Deputy affirmed my right to do so.
+Sergio Valenzuela When you lease a property you can tell the owner to leave.
I know you're just starting out, but so far you're doing a great job. Keep up the good work and the subs will come. You carry yourself professionally, calmly and intelligently. If you've decided to not show ID I strongly recommend looking up the ID laws in your area and not relying on RUclips rumor. In florida for example you NEVER have to show ID even if being arrested. All you have to do is give your real name on arrest, it's up to them to decide if youre telling the truth of not. And then kick your ass if they can prove you lied. A lot of you tubers seem to have no idea what the Id laws in their state actually are are and say stupid things like "unless you suspect me of a crime I'm not showing id". To which the cop replies, I suspect you of doing X. Then they have to argue whether that's a good enough reason. Instead I think you want to tell them that they've not meet the conditions that would legally compel you to identify yourself. Let them wonder what those conditions are. Make you You know the rules in your state first though before trying something like that.
+jgallantyt
Thank you for the positive feedback and suggestions. I never have my ID with me when conducting a First Amendment audit. I would provide my name and DOB to an officer of the law if I were being detained, and they threatened me with arrest if I did not provide said information.
California is not a stop and ID state. I've looked into Terry v. Ohio regarding detentions and the need to show ID and will research the state laws as well.
+Live Life I liked your point about recording them not having a RAS. But I think you missed the point. If you predicate your identification on them not having reasonable suspicion, then if they give any reason at all then you're in the tough spot of having to argue wether it is reasonable enough. When in fact many states don't require you to ID yourself even when being legally Detained. So yes, establish that the detention isn't legal, for sure, but don't make that a requirement for ID if the law doesn't require it. And my original point was that many youtubers have no idea whether or not their state requires it.
+Live Life I think we are in agreement.
The guard said "no pictures in the court house"... Thus you were not in the building.
If someone opens up their land to the public , it's a public domain requiring the owner trespasses you in order to leave or then be arrested for failing to leave after a "Public trespass" . YOU CAN NOT TRESPASS YOURSELF ! ! !
Your videos are great bro....
So a PRIVATE property leased to the government, a PUBLIC service, is still a PRIVATE property - there should be a law stating that if an "official" (cop, fbi, kgb or even security) state something so belatedly BS should be fined...
If it is leased by the county it is de facto public property, there is no trespassing issue.
Thank you for your service
security wankers who do not know the law, should all be fired. At least the cop knew the law and applied it properly
my trouble is that you have a county courthouse on private land ,so there fore there is a conflict of interest as it needs to find people quilty in order to pay the lease!!!
He's not confrontational , as he approaches you with his hand on his gun .
Well I can say "Water exists" but does that mean I can magically produce a bucket of water on the snap of a finger?
+TheZombaslaya
A poor analogy, especially since the purported order does NOT exist.
Stop loitering on that sidewalk! Don't you know you could get arrested!?
Well....things are getting better...1st amendment testing is slowly educating the cops.
It's public property, get yourself a constitutional law book.
you should do more research .if that bldg. is rented or leased by the county , it must have public access.
Good Work.....Thank You!
Lol I like how this guy likes to piss people off. He reminds me of myself. Subscribed
Public Offices (Federal, State or local) who lease space from them public cease to be private property.
rsmith89b correct for the most part. It still remains under the control of the private owner; however, the private owner (in California) cannot trespass one from exercising the rights under Article 2 of our Constitution. CA rights enhance or provide an affirmative right versus a negative command to Congress outline in the US Constitution. Pruneyard Shopping Center v Robins.

"You can't film something that any member of the public can walk up to and look at."
Oh, the irony!
deputy was a class act
Great cop. Love police that know the law. Cant ask for more
Very professional good cop.
I always thought that if it is rented by the government, that makes it public. Is this not the case?
Privately owned, but open to public access.
so doesn't that mean that he can photograph in the public access area?
Love the attention to detail great job bud!
U should've called the sheriff office and complimented the officer
Is that officer Jon Baker/Larry Wilcox from C.H.I.P.S overweight 😂🤔🤔🤔?
Great Police Officer!
I was kind of wondering where people with low IQs actually work thank you for pointing it out
By e-mail to the Sonoma County Courthouse:
You are going to need to immediately cease and desist from any further
attempts to restrict the use electronic equipment including cameras and
cell phones on sidewalks and other open public spaces outside the
courthouse in Sonoma County. Nothing about this correspondence is
optional. Thank you in advance for your absolute and full cooperation.
Why don't you check property boundaries and rights before you go..
The only reason i like theese videos is because he is not hating on cops 24/7. He tests other people such as guards :)
+ApocalypseYT™
A lot of people give me shit for filming guards rather than cops. Glad you like it :)
First Amendment Tests The problem is, there is a terrible image on cops recently. Im not doubting there is not corruption. But everyone has their limits, even a cop. So they expect you to post negative things about them.
Notice that even though Deputy Vivian radioed in "Code 4" (no assistance needed) at 4:25, backup in plainclothes still came and stood by behind him in the last part of the video.
On and for the record your corporate policy only applies to corporate employees not to the People. We the People do not consent and wave the benefit to your corporate policy. We the People do not accept your offer of your corporate policy. We the People do not wave and invoke our First Amendment Right.
+Richard Layton Ordinances only apply to government officials and employees. Ordinances do not apply to the People.
So sick of these geriatric guards who clearly don’t get the difference between law & policy. That maybe how they dealt with things on their day, but times have change & if they can’t change, they shouldn’t be working
ive been wacthing all sorts or videos like this. the baliff at the end seemed like genuine dude. just tryna keeps things cool. as white adult male I see a lot of bad police officers in the United States and the bailiff at the end kind of gave a light at the end of the tunnel for me
this is gold
He said in the court house. Last time I checked he's outside.
+phoenixmage0 The morons can't tell the difference between outside and inside
+phoenixmage0 Yes! IMO that meant the Presiding Judge could permit or not permit photography and videotaping in their Courtroom during a hearing or trial. The restriction of "in the Courthouse" PERHAPS does not apply to the lobby and corridors. (?)
PERHAPS the immediate outside, even if leased from a private company, is "public land" because it is rented by the County, a public entity. (?)
+T Phord
Or perhaps he was just completely full of shit, making of stuff as he went along.
As a RUclips trial watcher, and real life Court attender what the unknowledgeable Security Guard was misspeaking, misunderstanding and misapplying about the Presiding Judge seemed normal existing Court House policy to me.
IS that security guard wearing Depends???
Good interaction with the sheriff officer but that thing about private property is nonsense. If you have business at a government run facility, they must allow you access even if it is on property leased by a private entity. If your business is conducting a first amendment audit, which is protected, then you have the right to be there. You are not filming the private parts of the property, just the government officials in the course of their duties. Who are those Security guards, Paragon?
cant these grandpa security people go play some golf or bingo. maybe they blew their retirement savings on gambling or drink. or their wives dont want them at home all day
Why wouldn't the security just say the land is leased from the get go? It seems logical that a county courthouse would be public property...
I am curious to know why a taxpayer paid for lease wouldn't also allow for citizens to exercise their rights...? Seems like someone should mandate in writing on the lease that all property leased by the public must allow for the citizens to exercise their rights OR the lease agreement can not be accepted...just a thought
This seems more like a loophole to strip people of their rights...
