First Amendment Test: Sonoma County Courthouse Security Guards Threaten to Confiscate My Camera

  • While recording at the Sonoma County Civil and Family Law Courthouse, Guards from First Security Services tell me that I cannot take pictures of the Courthouse from the parking lot or the public sidewalk. One Guard threatens to confiscate my camera if I take photographs the Courthouse. After informing them that I will proceed to record & take pictures from the sidewalk irrespective of their threats, a Sherriff’s Deputy comes out to discuss the issue.     Peaceful, non-violent protest, with a camera. Love it! Thank you for your time and effort in helping protect citizens' rights, whether or not it makes nervous those whom believe they have policing authority under the guise of their corporate employment. Private security guards should have to pass a test on civil rights and get certified to qualify for security work.

    if the property is leased and PAID by/with PUBLIC money you should be able to do anything that you are allowed to do in any other public property. my opinion.

      +Cristian Ozar You are absolutely correct, no matter what a "Policy" might say. A "Policy" isn't a "Law" which can *ONLY* be passed by the U.S. Congress or a State's Legislature...not from a Judge or a Police Department/Sheriff's Office!!

    If private property is rented from the county, state or city that means is no longer private property.

    That courthouse isn't privately owned; you should have stood your ground. Notice how the security guards couldn't cite an actual owner of the courthouse nor provide proof that the building was being rented out by the county.

      Empire College owns the land. However, the order that the guard referred to did not exist. I did my research, then made a return visit. You can see what happened in the follow-up video.

    Great job. Love your videos. I been watching several auditors for the past couple of weeks and you're the best so far. You're professional, come straight to the point, educate people, and you know when to put up a fight.
    I've been a videographer for over 20 years and have had to deal with these kinds of issues a lot. People need to know about privacy laws (especially security and law enforcement) before they come up to someone in "public" and start to assert their demands on them.
    For all those of you who don't understand what these audit videos are about. Let me put it this way . . . let's say you're out with you're in a public park and taking some pictures and video of trees and flowers, some total stranger walks up to you, asks you to stop recording because they're in the background and you might have recorded them, demands that you stop, asks you for your ID, threatens you, then starts recording you in retaliation. What would you do? Let them harass you? Of course not, you would tell them to get the F away from you or you will call the cops on them.
    These audit videos are playing a small part in educating the general public, federal employees, security guards, law enforcement, etc. about our rights to have freedom in public. Don't want freedom? Move to a different country then.

    It is a "public area" or "public space" meaning it can be entered without invitation or fee, ownership is moot. And as far as a county courthouse being "private" property, because it is owned privately but leased/rented by the county makes it public property because of the entity controlling it, the public courts.

LOL, then you should've said, "Oh, okay, good, because for some reason I thought this was Walmart Photo, the place where I was supposed to pick my prints up," or "Oh, okay, shoot, then I guess you should add a few to brighten the place up a little!"

    Get the copy of the order....don't tell the security guards that it's all right...don't believe anything they say....hold their feet to the fire on everything they claim. They lie a lot. Sometimes from being incompentent and not knowing the law or Judges order, or sometimes being willfull and knowingly lying to the public. That makes them corrupt.

    It is a good thing that you retreated to the sidewalk because the county or the government often leases private buildings to run their business that way they can claim it both ways-that it is a private and govt. property at the same time.

    Private property used for a public purpose, such as a court house is public for all intents and purposes.

    Yeah I agree. If a private entity leases property to a public entity then the leased and common areas become public for the duration of the lease. If the owner of the property doesn't want his property to be public then he needs not lease to a public entity. It's exactly like if you leased an apartment. Can the owner of the complex trespass your guest from your apartment? No, he gives up some of his ownership rights for the term of the lease. Similarly, the police couldn't go to the complex owner to get permission to search your apartment. Why? It belongs to the owner right? Wrong that space belongs to the renter for the duration of the lease.

    The security left a lot to be desired, however great props to the deputy. It's not often you get to see the good law enforcement officers who know what they are talking about. Great A+ for this gentleman. Keep doing what you do, I believe you help a ton. I do have a question for you though.
    During your First Amendment tests, have you ever encountered a situation where photography is not permitted at all within a city? I know a few cities, "Rochester, NY" being one that I can name from my head, have city laws that say you are not allowed to take photographs anywhere in the city limits without a "Press Pass," basically a license they can give you for photography in their city. Unless you research the city laws deeply, or get confronted by city security, you wouldn't know the law existed. If you know anything about this, please enlighten us.

      The fact that the property is leased is a non-issue. Since the Courthouse is a public place, the public has the right to be present on the property and engage in photography/videography, provided that it does not violate court rules or applicable laws.
      This is why I returned to the property to conduct a follow-up test, after researching the local court rules and being advised by the court Facilities Manager that no order prohibiting photography outside of the courthouse exists (contrary to what the security guard told me). In doing so, I remained on the property while filming, and the Deputy affirmed my right to do so.

    I know you're just starting out, but so far you're doing a great job. Keep up the good work and the subs will come. You carry yourself professionally, calmly and intelligently. If you've decided to not show ID I strongly recommend looking up the ID laws in your area and not relying on RUclips rumor. In florida for example you NEVER have to show ID even if being arrested. All you have to do is give your real name on arrest, it's up to them to decide if youre telling the truth of not. And then kick your ass if they can prove you lied. A lot of you tubers seem to have no idea what the Id laws in their state actually are are and say stupid things like "unless you suspect me of a crime I'm not showing id". To which the cop replies, I suspect you of doing X. Then they have to argue whether that's a good enough reason. Instead I think you want to tell them that they've not meet the conditions that would legally compel you to identify yourself. Let them wonder what those conditions are. Make you You know the rules in your state first though before trying something like that.

      Thank you for the positive feedback and suggestions. I never have my ID with me when conducting a First Amendment audit. I would provide my name and DOB to an officer of the law if I were being detained, and they threatened me with arrest if I did not provide said information.
      California is not a stop and ID state. I've looked into Terry v. Ohio regarding detentions and the need to show ID and will research the state laws as well.

      +Live Life I liked your point about recording them not having a RAS. But I think you missed the point. If you predicate your identification on them not having reasonable suspicion, then if they give any reason at all then you're in the tough spot of having to argue wether it is reasonable enough. When in fact many states don't require you to ID yourself even when being legally Detained. So yes, establish that the detention isn't legal, for sure, but don't make that a requirement for ID if the law doesn't require it. And my original point was that many youtubers have no idea whether or not their state requires it.

    If someone opens up their land to the public , it's a public domain requiring the owner trespasses you in order to leave or then be arrested for failing to leave after a "Public trespass" . YOU CAN NOT TRESPASS YOURSELF ! ! !

    Public Offices (Federal, State or local) who lease space from them public cease to be private property.

It still remains under the control of the private owner; however, the private owner (in California) cannot trespass one from exercising the rights under Article 2 of our Constitution. CA rights enhance or provide an affirmative right versus a negative command to Congress outline in the US Constitution. Pruneyard Shopping Center v Robins.

    Notice that even though Deputy Vivian radioed in "Code 4" (no assistance needed) at 4:25, backup in plainclothes still came and stood by behind him in the last part of the video.

      +phoenixmage0 Yes! IMO that meant the Presiding Judge could permit or not permit photography and videotaping in their Courtroom during a hearing or trial. The restriction of "in the Courthouse" PERHAPS does not apply to the lobby and corridors. (?)
      PERHAPS the immediate outside, even if leased from a private company, is "public land" because it is rented by the County, a public entity. (?)

      As a RUclips trial watcher, and real life Court attender what the unknowledgeable Security Guard was misspeaking, misunderstanding and misapplying about the Presiding Judge seemed normal existing Court House policy to me.

    Good interaction with the sheriff officer but that thing about private property is nonsense. If you have business at a government run facility, they must allow you access even if it is on property leased by a private entity. If your business is conducting a first amendment audit, which is protected, then you have the right to be there. You are not filming the private parts of the property, just the government officials in the course of their duties. Who are those Security guards, Paragon?

    cant these grandpa security people go play some golf or bingo. maybe they blew their retirement savings on gambling or drink. or their wives dont want them at home all day

    Why wouldn't the security just say the land is leased from the get go? It seems logical that a county courthouse would be public property...
    I am curious to know why a taxpayer paid for lease wouldn't also allow for citizens to exercise their rights...? Seems like someone should mandate in writing on the lease that all property leased by the public must allow for the citizens to exercise their rights OR the lease agreement can not be accepted...just a thought
    This seems more like a loophole to strip people of their rights...
