- A California father's outrage is on full view as he's told his entire family is to be booted from an overbooked Delta flight. A flight attendant actually told the Orange County couple that their kids could be taken away if they didn't surrender their seats. "You'll be committing a federal offense," the attendant said in cell phone video of the incident. "You and your wife will be in jail and your kids will be put in foster care." It happened aboard a flight from Hawaii to Los Angeles last month. #InsideEdition
The “Kids in foster care” comment was totally unnecessary and inappropriate. Why would she say something like that?

No amount of apologizing or free 1st class seats to any destination would rectify the gross injustice that was handed down to this family by that single flight attendant. I do hope however they did seek Justice by suing her for the the threat of taking their children away and putting them in and Foster care and the airline themselves for harassment and abandoning them in an empty Airport with nothing open at 12am.

I remember this story. Back then, we were planning a trip to Hawaii. Our kids weren't infants, but THIS story convinced us not to fly Delta. We never flew Delta for any of our family vacations. The gall of that flight attendant to threaten the family like that. Unbelievable.

This is the RUDEST FLIGHT ATTENDANT I've ever seen! She literally makes a whole family with infants go off the plane because of FOUR OTHER PASSGENGERS?! They took a seat they didn't have a ticket for to put their baby, they weren't asked to leave until they refused to surrender a seat they didn't have a right to...overbooking was not the reason, stolen seat was, the family is 100% at fault

@@75ur15no sir, the family bought the seat but the son bought another one on earlier flight. They dont consider them owner of that ticket since the buyer (son) is not on that plane, which is ridiculous and unlawful.

They didn't pick up a boarding pass for their son, who left on an earlier flight, which allows the airline to believe the seat is available and makes their ticket forfeit. The family could have resolved this by bringing it up when getting their tickets and having the ticket given to them for the infant.
@@GuyAngon no, they have the boarding ticket. You check in with ticket otherwise the security wont let you in. The difference is that the name on the ticket doesnt match the baby name. And this give the airline excuse.

But the airline was not at fault. he did not pay for the seats for the toddlers and is only pretending to be concerned about safety to get a free seat. Did not care about their safety when had to fork over money to pay for their seats. Just being cheap. He does not get father of the year because he cares more about money than his kids safety.

The flight attendant? She’s just doing her job. Her boss told her to get the family to leave to make room for the extra passengers they overbooked. A single flight attendant doesn’t have the authority to kick 5 people off and arrange for replacement passengers to take their place on short notice, that is the airline.

We covered this case in my Law and Theory class. Technically, the seat was not in the infant's name and as such, the airline used a loophole to reclaim the seat. Had the parents changed the ticket to the infant's name, the airline would have had no leg to stand on. Either way, the flight attendent and airline were 100 morally wrong, and legally on very shady ground.
It’s not technicality or loophole. Their teenager who had the seat took an earlier flight. The only way to put the seat in the infant’s name would have been to buy an additional seat because the teen’s fare was already settled. Right?
I get the technicality that the seat is not in the infant’s name but is it right to kick off family with infant kids at midnight?! At the end of the day the parent paid for the seat. It’s not like the plane lost money. This is still

I mean yes technically she's right, flight attendants have fairly broad leeway in what they can lawfully demand and failing to heed lawful demands from flight crew can be a federal crime. And yes, they have every right to take that seat, read the fine print the ticket only applies to the name on the ticket. Hence Joe Smith, Sally smith, Jerry smith individually rather then a single ticket for x seats under the familial name. Just don't fly unless you have to honestly, it's horrible for the environment and has been a crooked industry since it's inception.

I imagine as the names didn't align, and common sense was chucked out the window...that was the reasoning behind the airlines decision to remove them all unfairly. It doesn't defeat the point in anyway that the family had been horrifically treated and threatened.

Techhniquelly you did not pay for the seat unless you reserved it which cost extra. The normal flight ticket is you pay to board the plane but that's it rather it's the same flight or next. Also, the reservation of the seat is reserved under the person's name that the seat was purchased for.
They didn’t pay for the seat. They paid for a ticket for their kid who then moved to a different flight, which means that the “seat” that was paid for also was moved to that other flight. They had not paid for this seat. It was an infant in arms, which is free because they don’t take a seat. So if they wanted the seat, they would pay another fair for the seat.

Airlines shouldn’t be allowed to overbook flights
They have to to operate successfully. Only booking to 100% capacity then no shows could result in the plane being too empty to make it worth travelling. Large Hotels tend to do the same thing around Xmas and big local graduations, they can't risk running at anything less than virtually full capacity. It doesn't make business sense as you leave yourself open to being unprofitable. If they oversell to 120% capacity and 20% miss the flight or cancel for whatever reason, they can still fly full. Sounds odd but most big venues/travel companies all oversell. It's a very common business model.

Even if you paid for the seat, it can only be used by the passenger in the booking. You can’t just replace anyone else on the seat willy nilly. Anyone who has flown any airline before should know this. If the passenger don’t show up, the airline has the right to assign it to another passenger. This time, it’s the couple’s fault.

Airlines will always overbook seats, but usually when this happens, they usually offer things for someone on the flight to give up their seats. Usually they offer cash, higher and higher until someone gives up their seat.

THE TICKET FOR THE OLDER KID WAS REDEEMED ON AN EARLIER FLIGHT. THE SEAT WAS THEN AVAILABLE FOR A STANDBY CUSTOMER. THE GUY WOULD HAVE HAD TO HAVE ONE OF THE INFANTS IN HIS LAP FOR THE DURATION OF THE FLIGHT IF HIS OLDER SON WAS THERE ANYWAYS. THE AIRLINE SHOULD NOT HAVE BROUGHT IN PEOPLE TO FILL ALL OF THE FAMILIES SEATS, BUT THE GUY HAD NO BUSINESS EXPECTING TO HAVE A FREE SEAT FOR HIS KID
There tickets should be refunded and given free tickets as an apology. Its shocking how poorly they treated that family.
The following should have happened
- tickets refunded
- hotel and meals paid for (preferable a higher end hotel)
- free first class tickets for the return trip home.

Isn’t it funny how they always seem to apologise after the fact instead of get it right in the moment. I’m a dad with too young kids and this made me livid. They wanted to kick the family off the plane even though they had paid for all 4 tickets, sue for millions they need to understand this is not ok

I think that's the thing they did. Payed for 4 tickets only. The teenager swapped to another plane with one ticket. So that seat is still vacant and was sold to somebody else, but the family put their kid on a seat which wasn't theirs.
My uncle works at delta and he said that the worker was sued and fired. The worker is banned from that airport. And everything she said was false information

They should get a refund, another free flight home, and compensation for any inconveniences of pulling them off such as that nights hotel costs, any trouble with work that they had because of the delay, a FULL ON APALOGY from both the fight attendant and the company for the rude and hellish experience of being told that they had to hold a child on a flight, then told that they would be in jail that night along with their kids in foster care, then being told that they were on their own and that it was their fault that the plane was overbooked. I agree with some of the comments in that if the airlines were really sorry for their actions, that they should have stopped any further incidents such as these from happening.

As rude as the stewardess was she was technically right and the family had said that they had purchased the seat for their son their son took an earlier flight to therefore he used the seat that was paid for and was no longer available to them so the stewardess had every right to give that seat to another person the family was basically trying to get a two-for-one deal and was angry when things didn't go their way
Adam Hanscom when they say their son took an earlier flight I think they mean they purchased another flight in order to use the seat their son was supposed to use for their other infant son. I don't think you can just transfer your flight like that.

The flight attendant absolutely shouldn't have threatened jail, putting herself and the airline in the wrong. Instead she should have explained that a seat allocation can't be transferred by the person paying for it, to another passenger - this is well established law. The man had plainly booked two seats between his three children; the youngest child must have been booked as a lap passenger. When the teenage son managed to get a separate booking on another flight, the father mistakenly thought that this seat could be transferred, by himself, to his youngest child. I think the man backed down in the end because he knew he'd tried to pull a bit of a fast one. He'd certainly have lost in court if he'd sued over the seat allocation. But he'd probably have won compensation because of the flight attendant making threats about jail and foster care.
Man : “I paid for these seats, I’m with my wife and my 2 kids and you want to kick us off this aircraft with nowhere to stay for the night ?”
Flight Attendant : “If you refuse to leave this aircraft this will be considered a federal offense, you and your wife will go to jail and your kids will be placed in foster care”

yeah. im usually a really positive dude who enjoys bringing out happiness in people, but folks like that flight attendant just have this contagious misery to them that makes me want to commit highly regrettable acts against them out of spite and frustration. and i hate being capable of such emotions. it sucks how much negativity can exist in this world, and it sucks even more how it infects and takes over anyone who interacts with it. major, major props to the dad there for not losing his cool
Happens more often than you think with the threat of jail. I stayed at a Hilton hotel for 7 nights which was not cheap, I was driving home and got a call that I didn’t recognize so I let it go to voicemail, it was the receptionist threatening to call the police ln me because my card only let then pay for all of it except 23$ because it was a credit card and it got locked once so much was spent in another state. Keep in mind Over 700$ did go through and was payed, yet they had the audacity before even trying twice to contact me to threaten to call the police. Best part is when I went to complain the complaint went to that same person as they were the manager so I never heard back from them. How does such a nice hotel chain higher such a shity manger that threatens to call the police on someone who has just spent over 700$ at their establishment

Also when the teenager who's name was on the ticket didn't show for that flight that ticket on that flight was no longer a valid ticket as it MUST be used by the person who is on it in this case the teenager.
I hope there is a follow up with the family and they get the compensation they deserve

When the teenager didn’t check in for the flight it told the airline that the seat was open so they sold the seat again. This is commonplace among most airlines in the US. Overbooking flights will not go away.

@Cyrsclin Agreed, however attendants have been on a real power-trip since Congress changed the law to make not obeying any order from cabin crew a Federal offense. I have little doubt the attendant would be only too happy to see this family in custody if they didn't obey her.
Every airline should pay for all expenses incurred by any passenger on their overbooked flights. Hotel and food expenses, taxi, and re-booking charges as well as a fee for inconvenience.
