मै यह जानना चाहता हूं, कि एक ही केस कितनी बार कैविएट प्रार्थना पत्र दिया जाना चाहिए।जैसे विपक्षी केस को हारने के बावजूद न जल्दी Higher court मे अपील करे और न ही कोर्ट के जजमेंट के अनुरूप कोई कार्यवाही करे ।जैसा कि एक कैविएट की टाइम लिमिट 90 days ही होती है और और केस हारने वाला पक्ष कैविएट के टाइम लिमिट समाप्त होने के बाद कभी भी अपील कर सकता है।कम से कम कितनी बार कैविएट लगाना सुरक्षित है ताकि केस का फैसला बिना अन्य पक्ष को सुने कर दिये जाने की संभावना हो ।

मेरे ख्याल से आप जितनी बार चाहे उतनी बार कैवेट को रिन्यू कर सकते हैं, हर 90 दिन के बाद। और इतना ही नहीं, आपके विरोधी ने केस दायर करने के बाद भी कैवेट दायर किया जा सकता है।

To caveator uss Herering date mey agar court mey present na huye to opponent party ki kiye huye case ki court koyi sunyayi ha hi degi ya sunyayi degi. Na caveator ki aney thak wait karegi

सर मैं एक जीडी बिनानी पीजी कॉलेज मिर्जापुर यूपी में कंप्यूटर ऑपरेटर के पोस्ट पर पर मैं पिछले 15 वर्षों तक लगातार कार्यरत रहा मुझे मौखिक आदेश के द्वारा सेवा समाप्त कर दी गई मैं उस सेवा समाप्ति को माननीय उच्च न्यायालय में चैलेंज किया माननीय उच्च न्यायालय ने कहा कि सर्वप्रथम आप लेबर कोर्ट जाए उसके बाद आपकी बात ना सुनी जाए तब फिर आप यहां आएंगे उच्च न्यायालय इलाहाबाद से मैंने अपने फाइल को ले जाकर के लेबर कोर्ट में सीपी वाद दाखिल किया गया डीएलसी डिप्टी लेबर कमिश्नर के द्वारा मेरा मुकदमा चला वहां एक रिफरेंस बनकर आया लेबर कोर्ट में मुकदमा चला 5 साल मुकदमा चलने के बाद पीठासीन अधिकारी ने श्रम न्यायालय ने मेरे पक्ष में फैसला दिया कि सेवा की समाप्ति अनुचित अवैधानिक थी इनको पुनः उसी सेवा की तारतम्यता के साथ सेवा में बहाल किया जाता है और पिछले वेतन का 50 परसेंट एवं आदेश पारित करने की तिथि से श्रमिक पूर्ण वेतन पाने का अधिकारी होगा महाविद्यालय के मैनेजमेंट कमेटी पीजी कॉलेज के प्राचार्य एवं सचिव ने इलाहाबाद हाई कोर्ट में चैलेंज किया लेबर कोर्ट के आदेश को स्टे कराने के लिए रिट दाखिल किया उनका स्टे एप्लीकेशन स्वीकार नहीं किया गया और वहां हाई कोर्ट से आदेश मिला कि जो लेबर कोर्ट ने आदेश पारित किया है उसको तत्काल उसी रूप में लागू किया जाए जैसा आदेश कह रहा है उसके बाद अभी तक मुझे ज्वाइन नहीं कराया गया लगभग 25 दिन हो गया आदेश आए हुए हाईकोर्ट का मैं आपसे यह पूछना चाह रहा हूं क्या सुप्रीम कोर्ट मैनेजमेंट जा सकती है मेरे लिए क्या ऑप्शन होगा एवं साथ ही साथ मुझे यह बता दिया पूर्ण वेतन का मतलब क्या है जो मैं अस्थाई कर्मचारी पर था वह वेतन या स्थाई वेतन या पूर्ण वेतन में हमें वेतन क्रम में वेतनमान तृतीय श्रेणी के पोस्ट पर रखा जाएगा

Aor misguided the court&tagged it with each other.we hire alawyer ,but it's a little bit late,because of we know it late,that slp will be filed against us.&then we filed caveat .so sir pls suggest how to come our case early *&it will be dismiss soon

Simple sa issue agar hai to ek din mein bhi final hearing nipat jata hai. Aur agar issues complicated hai to ho sakta hai use 2 din bhi Lage, 5 din bhi Lage, ya ek hafta bhi lag sakta hai ya कभी-कभी usse jyada bhi!
