Is my workplace discrimination case worth more than $40k or $50k? Should I settle?

    I wish, I found a good lawyer when all this happened to me. Too many years of abuse, but because you have a family you put up with it. I have been destroyed mentally and physically.

      I am sorry for what you have faced! It’s not easy but it’s important to take care of yourself! Friends and family will not support you but they will support you when you fight on your own and win. Study the title VII, ADA, and other federal misconduct rules and regulations! Most people who respect pro se do not know enough to get started. The magic word is “framing” your case line by line and back it up with facts, logic, and evidence! Most people do not document things but the email communication and video footages can be obtained by your investigators. Please try to leave it behind and move forward if they have dismissed you case. Either way, you have learned something and the next time it happens to you, you know what to do!

    I work for USPS, won a sexual harassment lawsuit. I have the pictures, texts that were sent to me. Since then I have been harassed every time I take my intermittent FMLA (long standing chronic that will never get better) My manager is telling my supervisor that I can't take part of a day to go to the Dr or use it when I'm sick and come in late or leave early for the same condition. My Dr wrote 1 to 3 days per incident, up to 4 times per month. We are allowed to take increments in hundredths of an hour and my FMLA notes time for intermittent leave Dr appointment/ illness from disease. They will not ask for it in writing, but verbally harass me every time I use it. Saying that the manager said she is going to report me for abusing it. This is incredibly stressful and I'm seriously ill with a condition that will never get better

      Sorry to hear that you’re going through this. Document what is occurring in emails to your manager and/or whomever is harassing you. File an FMLA leave interference complaint with the federal government.

      Are you allowed to record the conversation without them knowing? You can take notes with date and time. You should let them harass you so you can gather more evidence! Bullies get too comfortable getting away with things for too long that they think they will never be held accountable! Catch them in their lies and action. Stay patient and your time will come! Start wringing the complaints and back it up with facts! Studying ADA, civil rights title VII, and other state or federal laws. Make sure you email to HR or email your other co-workers or senior leaders. This is also evidence that you reached out to their HR. Also write to your manager that it is not acceptable what he is doing. You can use this as evidence to your EEOC complaints. Enjoy while you take notes because you will have your day & they wished they could unfollow you all these they did to you. Be empowered and stay strong! Do not quit because if they terminate your employment, it gets easier for you to win as you can prove retaliation!

    My question is if you can settle for $50k can you request that the previous employer pay your legal fees ? In addition that they write a letter of recommendation based off your actual performance rather than what they discriminated against you?

    I had a severance package they was trying to give me in a promised me not to sue. It’s been going on 2 years now and we’re waiting on the judge to rule.

      Shit...2 years....I just had a mediation where the amount offered was a tad less than half the BARE MINIMUM I was willing to accept. Can't state the details legally for obvious reasons but I have only 3 days to either take the "final offer" by my employer who wrongfully terminated me cuz of my autism and not cuz of anything I did....and I've been unemployed for 5 months now with my current career likely destroyed as I CANT use them as a reference now....
      So I'm wondering whether to try and fight...and likely be where u are now, or just take the sum I have which was $3K less than the actual half of what would've been 1 year income.

      @@croc560 my case is still pending because I refuse to take what they feel like I deserve. I’m the victim. So much had went wrong working for a company who didn’t care about what was right as so as I took my complaints I’ve their head. They started retaliating against me but the employer lawyer trying to get my case dismissed is why it’s taking so long because it’s in the judge hand they gave me a severance package in exchange for me not to sue them. Which was only 3k then they went up to 12,500 I refuse that I was out of work for a year on top of all that my son died I’m still waiting.

    Yesss I feel like my lawyer is low balling the hell out of me he stated my depression and anxiety is worth 20,000 I see a psychiatrist or still affects me 1 year later sucks

      @@ramonahudson984 I would do your Oren research. And look into getting a new lawyer. Some lawyers. Just wanna settle easy peezy just bc there busy you know like one. On Vincent’s videos Some lawyers don’t wanna put the time and rush a settlement so they can say they made xyz in an hour or two

    I was out off work under FMLA and my company changed in the middle of my time off. I came back and they literally said they are not hiring anyone because they are full. What should I do in this situation?

    An employee has a discrimination case at work (I’m her friend) and their lawyer calls me at work- do I have to talk to them. I do not want to get involved, I’ve only worked there 6 months and she’s had issues with employer for over 12 years.

      You are involved if you witness the Discrimination. You are involved if you witnessed the damages that affected your "friend". Employers cannot retailiate against you for being a witness, it's called Potected activity. But if you choose not to speak up when you are aware of the Discrimination you are just as guilty as them. Shows the type of character you have.

      ​@BuckQweet I testified against my employees and was openly discriminated against. I left, and no lawyer would take my case against this major cooperation. I would definitely do it all over again!! (No regrets)

    Things that never happened. Client saying he has ppl vouching for him being a good guy as evidence. This is the equivalent to doctors complaining about webmd and cops complaining about csi, complaining > than ppl actually think that ish by a lot

    How to you search to find a EEOC complaint. Haven’t had update from My Attorney and is EEOC different from USSERA do I need to file on both Attorney mentioned no need for it

      Your attorney should be happy to provide you a copy of the complaint as-filed along with proof of filing from the EEOC

      @@JobAttorney Thanks! Finding out Attorney didn’t file with EEOC as I had on mind when it was agreed . Just now my instinct was telling me to check with EEOC and was told no file. Didn’t know what a bad Attorney after being well recommended loss my case

Getting scam by such a sketchy attorney taking advantage of my situation not going by initial purpose of hiring representation of reaching maximum results never file thru EEOC never provided any documentation copies filed o introducing court correspondence response not communicating details facts update status on schedule court hearing no participation on any negotiation progress . Force to take the settlement without option threatening to withdraw from representation have a lien on case and filing lawsuit against me for malicious … disappointed

      Attorney percentages range, I've seen as low as 25% and as high as 50%
