The US Census Bureau gets it's authority under Article I, Section 2 of the U.S. Constitution. Their authority consists of... "The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct."
The "American Community Survey" and all other Census Bureau Survey questionnaires are unconstitutional, and fall under U.S.C. Title 13, Census, not the constitution. Therefore, voluntary. If the "American Community Survey" was law, under Article I, Section 2 of the U.S. Constitution? The questionnaires would not be sent out to random homes in America every 5 years, it would be sent to everyone, as is the decennary census.
The decennary census only requires an enumeration, (population count) under Article I, Section 2 of the U.S. Constitution. All other questions are intrusive, and unconstitutional. Therefore, voluntary. Nowhere in "Title 13, Chapter 7 - OFFENSES AND PENALTIES" does it say it is unlawful to not answer questions not related to enumeration of population. It is however unlawful to give false information with intent to cause inaccurate enumeration of population.
Title 13, Chapter 7 - OFFENSES AND PENALTIES:
Subchapter I - OFFICERS AND EMPLOYEES (§§ 211 - 214) applies to the government workers.
Subchapter II - OTHER PERSONS (§§ 221 - 225) applies to "We the People"
Subchapter III - PROCEDURE (§ 241) - Evidence: Is a threat of "prima facie evidence".
Even though the right to privacy is not specifically mentioned in the U.S. Constitution, for cases such as the controversial case Roe V. Wade, the U.S. Supreme Court has found that several Amendments imply these rights:
First Amendment: Provides the freedom to choose any kind of religious belief and to keep that choice private.
Third Amendment: Protects the zone of privacy of the home.
Fourth Amendment: Protects the right of privacy against unreasonable searches and seizures by the government.
Fifth Amendment: Provides for the right against self-incrimination, which justifies the protection of private information.
Ninth Amendment: This amendment is interpreted to justify a broad reading the Bill of Rights to protect your fundamental right to privacy in ways not provided for in the first eight amendments.
Fourteenth Amendment: Prohibits states from making laws that infringe upon the personal autonomy protections provided for in the first thirteen amendments. Prior to the Fourteenth Amendment, a state could make laws that violated freedom of speech, religion, etc.
Remember... The fourth section of the Fifth Amendment to the Constitution, articulates procedural safeguards designed to protect the rights of the criminally accused AND to secure life, liberty, and property from impairment by the federal government. The due process clause seeks to preserve and protect fundamental rights and ensure that any deprivation of life, liberty, or property occurs in accordance with procedural safeguards.
Liberty, is the condition of being free from oppressive restriction or control by a government. Man, have we fallen far!
